Dear Sergeant Investigator Carter and Assistant District Attorney Drummond,

Thank you again for your very kind interest in the alleged-crime case relating to alleged possible violations of the law by one or more Austin Police Department officers----a crime case in which I am the complainant and victim.

As I am sure you will both recall, Assistant District Attorney Drummond two years ago wrote and mailed to me a September 23, 2014-dated, signed certified-delivery official legal letter from your government agency office in regard to the doctor-ordered Sexual Assault Forensic Medical Exam that was obtained from my own body on Dec. 22, 2011, inside the emergency room of the St. David's ER near UT-Austin. That rape-evidence kit was obtained for APD Sex Crimes Case 11-3550615.

Sergeant Carter and Assistant District Attorney Drummond, I need to inform you both that my first-rate primary care physician, Dr. Carson Higgs, a family-practice physician, did state to me (in person) during a medical appointment I had with him on Friday afternoon, July 1, 2016, inside his Austin Regional Clinic (ARC) location at Quarry Lake in northwest Austin, that APD's Sex Crimes Unit (several weeks ago) apparently sent the cited rape-evidence kit obtained from my own body to a "private" medical laboratory for processing, Dr. Higgs stated to me...(on July 1).

Dr. Higgs volunteered that information to me after I commented to him during that July 1 medical appointment I had with him that APD must have sent that (Dec. 22, 2011) rape evidence kit to the Texas DPS headquarters in Austin for lab processing, I stated.

Dr. Higgs replied that no, the "female detective" for APD's "Sex Crimes Unit" with whom he recently spoke on the telephone about my alleged-sex-crimes case indicated to Dr. Higgs that APD instead sent that Dec. 22, 2011, rape kit to a "private" medical lab for testing, Dr. Higgs stated to me during my medical appointment with him on July 1, 2016.

That disclosure to me from Dr. Higgs poses a major concern to me as a longtime and continuing criminal-law complainant with APD over a multi-year period ever since 2011 in which APD (in that entire five-year period) has arrested a total of ZERO crime suspects who might have then been charged with having violated the law in conduct they pursued toward me.

I have heard or read that rape-evidence lab results obtained from a "private" medical lab are NOT as helpful to a prosecuting attorney in a court of law as are lab results obtained from a law-enforcement agency such as the Texas DPS, which has the resources to obtain the names of actual crime suspects through DNA traces from a rape-evidence kit.

I have also heard or read that after a private lab conducts testing on a rape-evidence kit, this severely undermines or completely negates the ability of a government agency to then "further process" results or "obtain reliable results" from that rape-evidence kit in a manner that could somehow be upheld as "valid and authoritative" in a rape-trial case in a court of law in this state.

Dr. Higgs also stated to me during my medical appointment with him on Friday, July 1, 2016, that the cited (Dec. 22, 2011) rape-evidence kit was "sent out by APD on June 2, 2016" (near-exact quote, the date "June 2" of this year being an exact quote) for lab processing, he said.

"No time frame" (exact quote) was cited by the female APD Sex Crimes officer on when the lab processing of the cited rape-evidence kit from Dec. 22, 2011, will be completed, Dr. Higgs stated to me during my July 1, 2016, medical appointment with him inside his ARC medical clinic in NW Austin.

Also during my July 1 meeting with Dr. Higgs, my primary-care physician stated that he does not recall the name of the "female detective for APD's Sex Crimes Unit" who had spoken with him on the telephone in the last several days, Dr. Higgs said.

When I made a phone call later on July 1, 2016, from inside my private bedroom of my apartment unit to the APD Sex Crimes Unit at about 5:30 p.m. Friday, July 1, 2016, to find out if that unit would be willing to simply provide me with the name of the "female detective" who had recently provided the above-cited information to Dr. Higgs, APD Sex Crimes Unit Detective Jeff Dwyer (APD Badge Number 3435), who answered the phone at that APD unit, politely stated to me after he checked his APD computer system while I waited from my end of the phone line, that he could not find any record in their APD system at that time which confirmed that a female Sex Crimes detective for APD had, in fact, spoken with Dr. Higgs about the cited sex-crimes case in which I was the cited rape victim.

Detective Dwyer added, however, that there may have been a delay on when the cited female Sex Crimes Unit detective will actually file an official update report with APD about her having spoken with Dr. Higgs in regard to the cited rape-evidence kit for APD Case 11-3550615.

Detective Dwyer also stated to me in my July 1 phone conversation with him that in about "one week," he said, one or more hospitals in Austin proper will be offering rape-evidence exams inside their emergency room, he said. Detective Dwyer also stated to me that at the time of my phone call to him (July 1), Safe Place in south Austin was the ONLY facility in Austin where a rape-evidence exam could be performed on a self-identified rape victim, he said.

Detective Dwyer himself was the APD Sex Crimes Detective who from his Sex Crimes Unit on Friday, May 13, 2016, reportedly stated on the telephone to a female APD officer, Officer Acosta (Badge number 5805), in my presence at Safe Place in south Austin, that APD's Sex Crimes Unit would NOT be willing to authorize any Sexual Assault Forensic Exam for me that day for APD Case 16-1340923, which I filed that day from Safe Place in South Austin as a crime report for APD.

Sergeant Carter and Assistant District Attorney Drummond, please do not hesitate to call me or write to me if you ever have any questions that either of you would like to pose to me at any time relating to my seeking to file a legal complaint against the Austin Police Department.

I might add that if your DA's Office Public Integrity Unit ever obtains the legal authority to authorize an anal-rape and oral-rape exam on me in which lab results from DNA traces bbtained would extend back as far as 190 days into the past (the farthest back that DNA traces can retroactively obtain crime evidence, according to what APD Sex Crimes Detective David Silva stated to me on the phone in the spring of 2011), this might also be invaluable evidence of alleged possible obstruction of justice by one or more APD officers in their official conduct toward myself.

APD has repeatedly and consistently over a multi-year period ever since early 2012 refused to authorize ANY Sexual Assault Forensic Exam on me at any time, even though I have requested those forensic exams on me on dozens of occasions in that most recent four and one-half-year period.

That repeated refusal policy by APD has repeatedly played a major or decisive role in a medical services provider minutes later declining to provide me with that type of medical exam, whether inside a hospital emergency room or inside the Safe Place (a "Safe Alliance" facility) in south Austin.

I would welcome any and all rape-evidence exams on myself at any time, with ANY DNA trace to someone other than myself being virtual "proof" in a court of law that I was raped during my sleep by that human being. I have not participated in any anal intercourse or any oral sodomy at any time since or including the date when I moved to northwest Austin in August 2001, for instance. I might add that I myself have not participated in any anal intercourse anywhere in the entire world on any occasion since the late 1980s.

I would also welcome any and all lie-detector tests that your PIU unit is ever willing to administer to me at any time, with the clear understanding that APD officers or other government agency employees or officials whom I suspect of alleged possible violations of the law in their conduct toward me would also be willing to submit to lie detector tests about their own conduct relating to this continuous-and-continuing-daily-and-year-round-anal-rape-crimes-and-personal-injury crimes case in which I am the permanently-alcohol-free and gainfully employed and law-abiding single adult white male victim.

Sergeant Carter and Assistant District Attorney Drummond, I hope that this follow-up report is helpful to both of you and to your criminal-prosecution-minded government agency in Austin.
