Dear Texas Assistant Attorney General Graham,


Thank you for your very helpful and encouraging  April 18, 2024-dated e-mail  reply legal letter to me that contained a legal ruling from your state agency  you sent to me, with a carbon-copy of that letter having been addressed to an official of the Travis County DA's Office in Austin.


I especially appreciated this April 18 written statement of yours to me:

"If you feel the district attorney’s office has not complied with the ruling, you may send additional written comments to this office."


Your April 18 legal letter to me was in regard to my December 2023 Open Records Complaint to the Attorney General of Texas. 


My legal complaint alleged that the Open Records Coordinator for the Travis County District Attorney's Office in Austin allegedly failed to provide me with any written document  responsive to my  narrowly focused November 30, 2023, Open Records Request to that DA's Office.

(On December 28, 2023, your Attorney General of Texas Open Records Division assigned to that Open Records complaint from me the official identification number of  OR-23-103287-IC.)


My November 30, 2023,  public information request to the DA's Office in Austin had sought "'a copy of any and all documents on file with each applicable division or unit of your DA's Office that were each authored by someone other than me at any time since 9 a.m. January 1, 2021, and  which each  stated that I myself was or am victimized by  a felony crime."


As of  9:55 p.m. Mountain Time tonight, Tuesday, April 23, 2024,  I myself still have not received any legal document  from the Travis County DA's Office Open Records Coordinator -----or from  the Travis County Attorney's Office acting on behalf of Travis County DA Jose Garza's Open Records Coordinator ---that was directly and specifically responsive to my November 30, 2023, Open Records Request  to their county government agency in Austin.


Texas Assistant Attorney General Graham, I would appreciate receiving a follow-up letter from you in regard to whether your Open Records Division in Austin is able to obtain for me and directly send to me---- or have sent to me by the DA's Office or County Attorney's Office in Austin--- a copy of each of the specific  legal documents responsive to my November 30, 2023, request that you have specifically ordered the Travis County DA's Office to release to me.

 You requested assistance from the Office of the Attorney General (the “OAG”) in obtaining information from the Travis County District Attorney’s Office (the “district attorney’s office”) under the Public Information Act (the “Act”), chapter 552 of the Government Code. 


 Your correspondence was assigned ID# OR-23-103287-IC. 


The district attorney’s office requested a ruling from this office regarding the requested information and our office issued Open Records Letter No. 2023-043598 (2023) on December 21, 2023.  


Open Records Letter No. 2023-043598 concluded (1) with the exception of the information we marked for release, the district attorney’s office may withhold the information it marked under section 552.107(1) of the Government Code; (2) to the extent the e-mail addresses within the remaining information belong to members of the public and are not excluded by subsection 552.137(c) of the Government Code, the district attorney’s office must withhold such e-mail addresses under section 552.137 of the Government Code, unless the individuals to whom the e-mail addresses belong affirmatively consent to their release; and (3) the remaining information must be released.

I apologize for having forgotten to send you a copy of this  peace-officer-safety-related public-policy letter (below) about a very crucial theme for Utah that I wrote and sent out yesterday.

The greater the number of  certified peace officers in Utah whose bulletproof vests are fully effective and meet all State of Utah  standards, the lower the injury rate and fatal-injury rate to  on-duty government law- enforcement officers throughout our state.

Below is an online link to a related 2014-dated news story from KSL.com.

 I have not been able to find an online update news report in regard to the current percentage of all bulletproof vests being  worn in 2024 by  on-duty peace  officers that are damaged or substandard or being used by on-duty officers  beyond those vests' expiration date.

I hope this will prove to be of interest to you, Rep. Judkins.

Do you know which State of Utah agency maintains records on applications for federal funding that have been  submitted on behalf of  respective  police departments, sheriff's offices, or state agencies  in Utah when they seek to purchase new bulletproof vests for their  respective local or state law-enforcement officers?

Is that state agency your Utah Department of Public Safety, the Attorney General of Utah, the Governor of Utah, the Utah Labor Commission, the Utah Legislature, the  State Comptroller of Utah, or some other state agency of Utah?

Also, has the applicable State of Utah coordinating agency this year contacted each of the applicable local and state-government agencies of Utah and informed them in writing  that the U.S. Government in April 2024 began accepting applications (see further below for more details) for new grants toward purchase of new bulletproof vests for peace officers here in Utah?

Sgt. Roden, I am also attempting to verify that each of the local or state law-enforcement agencies of Utah that in 2024 or 2023 identified a need for one or more new bulletproof vests for their own law-enforcement agency's officers did apply to the U.S. Justice Department  for defrayment of up to one-half of the vest-purchase expense incurred by  the applicable city or county or state agency.

I am concerned about the possibility that some city governments or county governments or state agencies of Utah in calendar year 2023 or 2024 may have  failed to get official approval from the U.S. Justice Department for federal funding to defray up to one-half of the financial  expenses incurred by that local or state government agency  on purchase of new bulletproof vests for their certified peace officers.

A Legal Letter Addressed to Me That I Received Via E-mail Today from Texas Assistant Attorney General James Graham in Austin


Farther below is an attached legal letter to me I received today from Texas Assistant Attorney General James Graham in Austin. The legal letter was in regard to my recent Open Records Complaint to the Attorney General of Texas that the Open Records Coordinator for the Travis County District Attorney's Office, Susie Duttinger, has allegedly failed to provide me with any written document directly responsive to my November 30, 2023,  Open Records Request to the DA's Office in Austin. 

Jose Garza has been the Travis County District Attorney ever since January 1, 2021.

My November 30, 2023,  request to the DA's Office  had sought "'a copy of any and all documents on file with each applicable division or unit of your DA's Office that were each authored by someone other than me at any time since 9 a.m. January 1, 2021, and  which each  stated that I myself was or am victimized by  a felony crime."

As of this afternoon, Thursday, April 18, 2024, I myself have still not received any document  from the Travis County DA's Office Open Records Coordinator, Susie Duttinger, that was directly responsive to that  November 30, 2023, Open Records Request of mine to her office.

Mr. John Kevin McMillan  (a former Austin (TX) resident now residing in Salt Lake City, Utah, as a permanent resident of Utah ever since January 1, 2023).

Dear Mr. McMillan:

 You requested assistance from the Office of the Attorney General (the “OAG”) in obtaining information from the Travis County District Attorney’s Office (the “district attorney’s office”) under the Public Information Act (the “Act”), chapter 552 of the Government Code. 

 Your correspondence was assigned ID# OR-23-103287-IC. 

The district attorney’s office requested a ruling from this office regarding the requested information and our office issued Open Records Letter No. 2023-043598 (2023) on December 21, 2023.  

Open Records Letter No. 2023-043598 concluded (1) with the exception of the information we marked for release, the district attorney’s office may withhold the information it marked under section 552.107(1) of the Government Code; (2) to the extent the e-mail addresses within the remaining information belong to members of the public and are not excluded by subsection 552.137(c) of the Government Code, the district attorney’s office must withhold such e-mail addresses under section 552.137 of the Government Code, unless the individuals to whom the e-mail addresses belong affirmatively consent to their release; and (3) the remaining information must be released. 

 Accordingly, as this office addressed the requested information in a letter ruling, we are closing our file on your complaint.

Dear Utah Department of Child Protective Services state agency Officials, Utah State Board of Education Substance Use Prevention Officials, University of Utah Health Medical Services Provider Adult  Alcohol- Addiction Treatment Specialists, Utah Adult Protective Services state agency Officials, Utah Consumer Protection Division state agency officials,  and Utah Attorney General Sean Reyes,


The wide variety of new  "non-alcoholic"  and "low in alcohol content" beverages (see online link above) apparently being marketed in retail stores in Utah these days are causing  lots of anxiety and  confusion for children and other minors under age 21, Mormons and other non-drinking religious groups,  pregnant women, and current or former or  recovering alcoholics here in the Beehive State, respectively.


At present, Utah State Law specifically permits supermarkets and convenience stores in our state to sell bottled or canned  beer that is  5 percent alcohol by volume (ABV) or less.


I am writing to each of you Very Honorable Government Officials today to ask whether any of you believe it would be much simpler and safer for the above-cited Utahns if any and all supermarkets and convenience stores here in Utah were legally prohibited by the Utah Legislature from selling inside their store ANY canned beverage or ANY bottled beverage---regardless of whether the canned or bottled beverage is labeled as a "seltzer"----that contains any quantity of alcohol.


Under this proposed revision of state law, the only retail or wholesale stores in Utah  that could sell bottled or canned beverages containing any quantity of alcohol would be the  State of  Utah-owned State Liquor stores.


I would also like to raise the question of whether the current sale of "non-alcoholic beer" inside retail or wholesale stores in Utah could possibly increase the risk of minors and adult recovering alcoholics in our state  developing an intense curiosity to try drinking or a  craving for, respectively ---- or an incipient or relapse  psychological addiction to  ----  "real beer" that contains actual alcohol.


I hope this brainstorming letter is helpful to each of you State Government of Utah officials.

The annual Red Bull Rampage Mountain Biking Event in Virgin, Utah, is a source of considerable infamy for our entire state. 

That ultra-competitive event features a repeatedly  suicidal  flirtation with death by each of the competing bikers from around the world  and promulgates the message to the entire world that  Utah is Very Proud to  be the Official Host  State for Numerous  Near-Death or Possibly Fatal  Experiences for Bikers.

"Men's Health" magazine in January 2022 featured  a copyrighted story by Scarlett Wrench that bore  the title: "Welcome to the World's Most Dangerous Mountain Biking Competition".

Some key statements in that report:

----"Riders are judged on a number of criteria, including airtime and tricks, as well as more virtuoso factors such as fluidity and style. To put it bluntly, they are rewarded for taking risks: riders score points for their willingness to tread the narrow line between victory and injury."

----"...Californian rider Cam McCaul explains a 'blind take-off': ....(T)he first time the rider catches sight of the landing, it's too late to adjust speed or trajectory.

'Two miles per hour too fast and the rider will land halfway down and explode upon impact,' says  McCaul, matter of factly. '[Going] two miles per hour too slow will put the rider before the landing – and cause them to get catapulted off the bike.'”

----"In 2015, a rider named Paul Basagoitia from Nevada crashed on a step-down and shattered his vertebrae. He was evacuated by helicopter and required nine hours of surgery. The same year, Boston slopestyler Nicholi Rogatkin tumbled off a cliff in his qualifying run, enduring a 12m beating on the way down."

One copyrighted online "Outside Magazine" report about the same annual biking competition was most recently  updated on May 12,  2022, and was entitled "Inside the Most Dangerous Bike Comp on Earth". That report,  written by Peter Vigneron, began with the following statement:

"Of the dozens of crashes at last fall’s Red Bull Rampage, the one that rattled me most was Kelly McGarry’s. During practice a few days before the competition, McGarry, a 32-year-old from New Zealand, misjudged a 70-foot gap jump over a canyon and overshot his landing. At six feet four inches, McGarry is the largest guy on the Freeride Mountain Bike World Tour, and both of his wheels imploded on impact. (In the vernacular, he 'tacoed' them.) McGarry went over the handlebars and landed face first in the sandstone, eventually ragdolling to rest in a sitting position while his bike bounced down a ten-foot cliff."

State House Majority Leader Schultz, you have the legal authority to help save the lives of thousands of young men of the present and future. You can go that by asking your colleagues in the Utah House to refuse to let Utah turn into a Death Trap for young men.

Possibly the State of Utah under your kind leadership could require that each competitor at the Red Bull Rampage Mountain Biking Competition in Virgin, Utah, must be at least 21 years old, must pass a drug and alcohol test, must be certified by their physician as being  mentally and physically healthy,  and must wear specified State of Utah-required full safety gear while competing in   that event.

One biker wrote a recent safety-minded copyrighted online report (see online link below) that was most recently updated on December 7, 2023, and offered the following advice for safety gear:

"Wearing a mountain bike helmet is a no brainer (ha!), and it may even be required by law. Protective gear won’t prevent all injuries, but in most cases it can significantly reduce the severity.

"Beyond helmets, consider knee and elbow pads, chest and back protection, and even a neck brace. Manufacturers are starting to build protective features into everyday wear items like hydration packs and even jerseys. Consider adding one or more of these pieces and you just might be surprised how little they interfere with your riding comfort."

Dear Utah State Legislature  House Majority Leader Mike Schultz,

Thank you again for your friendly  November 27, 2023, reply e-mail letter to me  in which you invited me to write and send you additional public policy-related concerns of mine about Utah.

I am writing you today to respectfully ask if you believe the Utah House  should authorize funding for a follow-up Utah "High Occupancy Vehicle Lanes" on highways  study  to the one about eight years ago for which the lead author was  Brigham Young University (BYU) Professor of Civil Engineering Grant Schultz.

Above is an online link to a copyrighted 2016-dated  BYU report summarizing  results from that study. The report was written by Todd Hollingshead.

One possible goal of the proposed new  follow-up study might be to identify whether there has been an increase, decrease, or no change since eight years ago  in the  percentage of drivers in Utah's High Occupancy Vehicle (HOV) lanes during rush-hour traffic  who each violate carpool requirements applicable for that highway.

The State of Utah apparently defines a carpool as a moving motor vehicle in which there is a driver and at least one  passenger inside that vehicle.

Another possible goal of the follow-up study could be to determine whether carpool- lane speeds in Utah during rush-hour traffic periods  are currently  averaging more than  55 miles per hour.

The Utah Department of Transportation reportedly supports the goal of maintaining average carpool- lane speeds on highways in Utah  at more than  55 miles per hour during rush- hour traffic.

House Majority Leader Schultz, I also am very  hopeful that your sagacious Utah House under your enlightened  leadership will please approve a Resolution praising BYU Professor of Civil Engineering Grant Schultz for his outstanding contributions toward promoting safer, more law-abiding,  and more energy-efficient use of High Occupancy Vehicle lanes in Utah during periods of rush-hour traffic on highways.
