This is a public-information request I am identifying as a November 1, 2021, request for the above-cited reason.
I am seeking to obtain from you a copy of any and all e-mail communications and other written communications, and any and all phone messages, that were or are generated, received, written, sent, forwarded, mailed, or FAXed at any time from 8 a.m. July 15, 2021, through 8 a.m. Monday, November 1, 2021, by Travis County Attorney Delia Garza or any other attorney or administrator or other staff member in the Travis County Attorney's Office here in Austin, and that, in each such case, referred at least once in any manner to myself, John Kevin McMillan of Austin.
EXCLUDED from the scope of this public-information request are any and all written communications that were specifically e-mailed to the Travis County Attorney's Office directly by myself, and in regard to which, IN EACH AND EVERY SUCH CASE, your public law office neither generated any written communication or legal note or phone-call-related message nor forwarded or FAXed or mailed to anyone that particular e-mail communication from myself.
My legal name is John Kevin McMillan. I was born on April 27, 1957, in Lincoln, Nebraska. Ever since January of 1988, I have resided in Texas on a continuous and uninterrupted basis.
I have resided in Austin proper (this state capital city for Texas) on a continuous and uninterrupted basis ever since mid-March of 1997. I have been and continue to be gainfully employed on a continuous basis in the restaurant industry in the Austin area ever since April 27, 2002.
I have resided alone on a continuous and uninterrupted basis ever since June 21, 2019, as the only management-team-approved official tenant and the only management-team-approved occupant in Apt. 2418 of Building 17 at Pebble Creek Apartments, 8805 North Plaza Drive, in northeast Austin. My current official six-month lease agreement for Apartment 2418 ends at 11:59 p.m. December 31, 2021. I have never on any occasion had any invited overnight visitor inside my current apartment unit. I do everything I can to lawfully and in a civil manner keep anyone and everyone away from any portion of the interior of my current double-bolt-locked efficiency apartment unit anytime between the hours of 8 p.m. at nighttime and 8 a.m. in the morning.
The ONLY exceptions I have ever made on that very firm policy of mine have been for on-duty Austin Police Department officers occasionally obtaining crime evidence from me inside my efficiency unit or obtaining a lost-and-found item from me that I had reported to APD on the phone; or on-duty Austin-Travis County Emergency Medical Services staff members directly responding to a 911 phone call from me in which I had requested to be taken by ambulance to a hospital for an unexpected medical crisis, such as repeated vomiting, that I had personally experienced.
The ONLY exceptions I have ever made on that very firm policy of mine have been for on-duty Austin Police Department officers occasionally obtaining crime evidence from me inside my efficiency unit or obtaining a lost-and-found item from me that I had reported to APD on the phone; or on-duty Austin-Travis County Emergency Medical Services staff members directly responding to a 911 phone call from me in which I had requested to be taken by ambulance to a hospital for an unexpected medical crisis, such as repeated vomiting, that I had personally experienced.
I am the current criminal-law complainant and permanently-drinking-alcohol-free (ever since 1990) and never previously addicted, permanently marijuana-free (ever since 1984) and never-previously-addicted, very anti-marijuana-minded, lifelong-illicit-drug-free in regard to any and all illicit drugs other than marijuana, psychologically healthy, permanently non-gambling, lifelong-tattoo-less, non-sadomasochistic and anti-S&M, permanently jewelry-less, dependably civil and law-abiding----I myself do not have any criminal-conviction record----and very honest and conscientious, platonicly polite, anti-prostitution-minded, lifelong-non-smoking, lifelong-non-vaping, facially-cleanshaven (no beard, no mustache, no goatee), consistently clean-talking (no profanity verbalized by me in my everyday conversations with others), very-recently-certified HIV-negative, white Anglo-Saxon English-Scottish-German-ancestry American citizen and non-Hispanic single adult longtime-celibate-by-choice, 64-year-old male adult victim in a currently active Austin Police Department (APD) Sex Crimes case. That new APD case is the APD Alleged Home-Invasion-Crimes and Alleged-Sex-Crimes Case 2021-2440624.
The first-rate crime investigator in that new APD Case that was activated on September 1, 2021, is APD Sex Crimes Detective William Costello. Detective Costello reportedly has a very fine reputation for great success at solving sexual-assault-crimes cases, according to what a female APD officer colleague of his stated to me during an on-duty visit she made to me this year in which she entered my apartment unit with my permission. Detective Costello on September 1, 2021, signed an official authorization form for a DNA-swabs forensic sexual-assault-evidence medical exam on me. A very diligent forensic medical exam of that type was then conducted on me at my request in the early morning hours of September 2, 2021, inside the ER of the Dell Seton Medical Center at The University of Texas, in central Austin, by a female forensic nurse for the Austin SAFE Alliance . The resulting rape-evidence kit from that forensic exam on me was sent by APD Sex Crimes Detective Costello on September 7, 2021, for processing, Detective Costello informed me at about 10:25 a.m. on September 15, 2021, during a phone conversation I had with him.
Detective Costello later stated to me on the telephone in October of this year that he expects to receive results from forensic-lab DNA-traces processing of that rape-evidence kit by early December of 2021, that highly-regarded APD crime investigator said.
I myself have repeatedly and politely stated to APD Detective William Costello on the telephone that I allege that I am being victimized by alleged continuous-and-continuing daily-and-year-round home-invasion-crimes, alleged continuous-and-continuing daily-and-year-round anal-rape-crimes, alleged-continuous-and-continuing-daily-and-year-round verbal-harassment-crimes, alleged continuous-and-continuing daily and year-round noise-pollution-infliction-harassment crimes victimizing me, including during my sleeping hours hours inside my current solo-occupancy locked apartment unit, alleged continuous and continuing daily and year-round infliction of noise pollution on my eardrums during my sleeping hours that often allegedly causes a ringing sensation in my eardrums that I experience when I am abruptly awakened in the middle of my sleep as I lie alone on my own bed, alleged continuous and frequent nasal-inhalant-infliction crimes (I myself DO NOT own or use any nasal inhalant!) that inflict an unpleasant nasal-inhalant sensation in my nostrils that I experience immediately after being awakened abruptly in the middle of my sleep during the early-morning hours or nighttime hours, and allegedly illegal hydration of my own body that has allegedly or possibly played a role in my being awakened several times per night with an urgent need to urinate in my bathroom and an unpleasant vibrating sensation or pain in my anus.
One first-rate medical physician whom I have recently consulted, Dr. Amy R. Mason, a certified "Super Doctor" dermatologist, very helpfully stated to me during an August 31, 2021, medical appointment I had with her, that Dr. Mason believes I myself will benefit from significantly safer housing conditions in my own life if I move to Salt Lake City, Utah, from Austin, Texas. Two respective polite members of the Austin Police Department have also stated to me in recent weeks in separate phone conversations I had with each of them this year that they each believe that it makes very good sense for me to move from Austin, Texas, to Salt Lake City, Utah, in the near future.
One very courageous medical-services provider of mine at another medical clinic in Austin stated to me in person during a medical appointment I had with her on September 29, 2021, that she has directly contacted Austin Police Department Sex Crimes Detective William Costello in regard to my currently active APD Sex Crimes case. She also stated to me during my medical appointment with her that she supports full freedom from home-invasion crimes and safe housing conditions for anyone and everyone, including myself.
