Subject: re: one reported mass shooting in Utah from 1982 to present

• Mass shootings in the U.S. by state 1982-2022 | Statista

May 20, 2022

Dear Utah Department of Public Safety Public Information Officer and Sergeant Cameron Roden,

Best Wishes again to yourself and your crime-deterrence-minded state law-enforcement agency colleagues.

Sgt. Roden, I'm sure it's very likely that you have already reviewed the above copyrighted online chart at Statista.com. But if for any reason you haven't seen this chart yet, I am hopeful that you and your DPS colleagues and public-policymakers here in Utah might be interested in evaluating this factual information.

My hope is that the State Government of Utah currently has a mass-shooting-prevention strategy and a mass-homicide-prevention strategy that are adequately financed and fully successful at deterring any and all potential mass-shooting scenarios and any and all other forms of mass-homicide scenarios of the present or future.

Incidentally, please let me know if for any reason the statistic for Utah cited in this online chart --- one total mass shooting from 1982 to present --- is not fully up-to-date and fully accurate. Statista.com is defining a "mass shooting" as a shooting in which four or more persons are killed.

I hope this follow-up letter proves to be helpful to you and your law-enforcement colleagues; municipal-government, county-government, and state-government officials here in Utah; federal elected officials from Utah; and members of the general public here in the Beehive State.

Sincerely and Best Wishes,
John Kevin McMillan, a Lincoln, Nebraska native (D.O.B. 4-27-1957) and former full-time employee of the Texas Department of Public Safety in Austin (TX).
I am also a permanently-drinking-alcohol-free, permanently-illicit-drug-free, lifelong-tobacco-free, lifelong-tattoo-less, clean-talking (no profanity verbalized by me in my everyday conversations with others), law-abiding and vigilant, single adult Anglo-Saxon male current resident of Utah who has been gainfully employed in Salt Lake County ever since January 3, 2022, after I arrived in Salt Lake City by airplane to become a new resident of Utah on December 31, 2021.

Subject: Fw: 4-15-21 re: the attorney I hired to directly call you re: home-invasion crimes

May 19, 2022

Dear Salt Lake County District Attorney Sim Gill in Salt Lake City, Utah,

I need to make one correction to the following sentence in the courtesy letter I wrote and e-mailed to you on May 18, 2022:

"I might add that the ONLY persons other than me whom I ever permitted to enter my bolt-locked hotel room were each on-duty employees for the Sugarhouse Extended Stay America hotel in Salt Lake City---including one employee who kindly replaced with a new bolt-lock what he apparently agreed had been a surprisingly loose bolt-lock to my front door."

District Attorney Gill, upon further reflection I need to retract the latter portion (now italicized and bold-faced by me, to clarify the text I am now retracting) of the above statement about my living conditions as the sole approved paying occupant living alone and always sleeping alone in Room 210 at Extended Stay America Sugarhouse, 1220 East 2100 South, in Salt Lake City.  I resided alone there in Room 210 from December 31, 2021, until January 19, 2022.

It was actually during my subsequent stay from January 19, 2022, until February 24, 2022, as a rent-paying sole approved occupant always sleeping alone on my bed in Room 227 at the Extended Stay America location at 7555 South Union Park Avenue in Sandy, Utah, when I am completely sure that a male Extended Stay America staff member entered my hotel room at my request in order to himself install a new and tighter-fit bolt-lock to my front door after I complained to the staff at that Sandy location that the bolt-lock to the front door was not tightly secured.

I can add, however, that during my prior period of residence in 2022 as a rent-paying occupant living alone at the Sugarhouse Extended Stay America Sugarhouse location in Salt Lake City, one articulate male staff member at that hotel, Bud, did visit my unit in January 2022 at my request and did agree with me that the outdoor screen to the window of my hotel room at that location was not as firmly placed as it should have been. I had cited that exterior screen to Bud as a possible home-security issue for myself.

I need to also mention with emphasis that during my period of residence this year as a rent-paying occupant at the Extended Stay America location along South Union Park Avenue in Sandy, Utah, I filed a criminal-law complaint on February 14, 2022, with the local police department,  the Sandy Police Department, about my having been victimized by alleged home-invasion-crimes, alleged anal-rape crimes, and alleged personal-injury-crimes during my sleeping hours as I lay alone on my bed, asleep and unconscious, inside my bolt-locked Extended Stay America hotel room in Sandy.

The criminal-law case number on my crime report I submitted to Sandy Police on February 14, 2022, is: SY22-7423. The resulting rape-evidence kit that was obtained from me at my request on February 14 by a female forensic nurse in the Emergency Room of the University of Utah Hospital in Salt Lake City, Utah, has been assigned the official ID number of 21-0238, according to a Victim Advocate for the Wasatch Forensic Nurses nonprofit group, Genevieve Smith, who provided me with that factual information on my cell phone on April 5, 2022.

Even though I emphasized to Sandy Police this year that I have been victimized by alleged continuous daily and year-round home-invasion-crimes and alleged continuous and continuing daily and year-round anal-rape-crimes and personal-injury-crimes and sleep-harassment crimes during my sleeping hours----including when I had previously resided in northeast Austin (TX), I also mentioned to Sandy Police---no full multi-month retroactive DNA-traces processing by the Utah DPS of each of the DNA-traceable items in that 2022 rape-evidence kit obtained from me here in Utah has been authorized by the Sandy Police Department so far.

District Attorney Gill, I would like to thank you for your very kind patience in accepting and reviewing the above factual correction and additional factual information that I am sharing with you at this time. Best Wishes to you and your first-rate criminal-prosecutions team at the Salt Lake County District Attorney's Office.

Sincerely and Best Wishes,
longstanding criminal-law complainant and Salt Lake County resident John Kevin McMillan.

Subject: Fw: 4-15-21 re: the attorney I hired to directly call you re: home-invasion crimes

May 18, 2022

Dear Highly-Esteemed Salt Lake County District Attorney Sim Gill in Salt Lake City, Utah,

Best Wishes to you and your staff from a single adult Anglo-Saxon male resident of Salt Lake County ever since December 31, 2021.

As a courtesy to your very influential Salt Lake County District Attorney's Office, I have decided today to share with your public law office in Salt Lake City, Utah, this e-mail letter of mine (below) to a high-ranking official of the Travis County (Austin, TX-based) District Attorney's Office in regard to to "home-invasion crimes" that were allegedly victimizing me on a daily and year-round basis when I resided alone in an always-fully-locked efficiency apartment unit in northeast Austin (TX).

Two state-certified peace officers of the Austin (TX) Police Department, Detective William Costello and Officer Lelan Larroque, in separate conversations with me on the telephone each politely and helpfully advised me in 2021 to move from Austin, Texas, to Salt Lake City, Utah, in order to myself live in a U.S. city with a significantly lower crime rate than Austin, Texas, has.

Best Wishes,
longstanding criminal-law complainant John Kevin McMillan.
I might add with polite emphasis that during a multi-week period from December 31, 2021, until January 19, 2022, I rented and stayed alone in a solo-occupancy hotel room I kept fully locked at all times at an "Extended Stay America" hotel facility in the Sugarhouse section of Salt Lake City, Utah. During that multi-week period, I did diligently and using a utensil of some type collect numerous samples of suspicious items I had found on my fitted bedsheet of my hotel bed and other bedsheets on that bed that definitely DID NOT come from me. I also put those items in an envelope that I later sealed as crime evidence for police investigators in Utah.  I had been repeatedly awakened with pain in my anus in the middle of the night on a nightly basis while I was living alone the entire time in that fully-locked hotel room in Salt Lake City.

During that time period in January 2022, I apparently did not contact the Salt Lake City Police about the sealed crime evidence I had obtained from my hotel bed in Salt Lake City. I was very aware that I as a hotel guest did not have a signed official written contract with Extended Stay America that would have provided me with full legal protection against any risk of my being evicted from my hotel room (such as in a possible context that might have possibly been in response to my having filed a home-invasion-crimes and anal-rape-crimes criminal-complaint with the Salt Lake City Police Department that might have triggered possible anger toward me by some of the other rent-paying tenants or occupants or possibly even one or more employees at that Extended Stay America location).

I will be happy to turn over that sealed envelope containing crime evidence on my behalf to the Salt Lake County District Attorney's Office or the Salt Lake City Police Department or any other police department in Utah---or any other police department in the USA that has jurisdiction--- for DNA processing that might identify the identity of alleged home-invasion-crimes perpetrators and alleged rapists and alleged personal-injury-crimes perpetrators in my fully locked hotel room during my sleeping hours.

I always slept alone in that hotel room, and I have been completely celibate ever since and including the day I moved to Utah on December 31, 2021. I might add that the ONLY persons other than me whom I ever permitted to enter my bolt-locked hotel room were each on-duty employees for the Sugarhouse Extended Stay America hotel in Salt Lake City---including one employee who kindly replaced with a new bolt-lock what he apparently agreed had been a surprisingly loose bolt-lock to my front door.

My date of birth is 4-27-1957. My place of birth: Lincoln, Nebraska. I am a gainfully-employed, permanently-drinking-alcohol-free (ever since 1990) and never-previously-addicted, permanently-marijuana-free (ever since 1984) and never-previously-addicted, lifelong-illicit-drug-free in regard to any and all illicit drugs other than marijuana, lifelong-tobacco-free, lifelong-non-vaping, lifelong-tattoo-less, permanently-jewelry-less, platonicly polite, longtime-celibate (including on a continuous and uninterrupted basis anywhere and everywhere I have resided or visited or been situated ever since the day I moved to north Austin (TX) in August 2001), consistently clean-talking (no profanity by me in my everyday conversations with others), non-sadomasochistic and anti-S&M, facially-cleanshaven (no beard, no mustache, no goatee), honest, friendly, conscientious, public-safety-minded, vigilant, non-stalking, and diligently law-abiding, lifelong single adult white Anglo-Saxon gentleman of English, Scottish, and German ancestry. I myself DO NOT have any criminal-conviction record, and I am a former full-time employee in Austin of the Texas Department of Public Safety state law-enforcement agency.
I have repeatedly and politely informed officers of the Austin Police Department and law-enforcement agencies here in Utah, including one or more polite peace officers for the Sandy Police Department, that I myself DO NOT agree to participate in or be subjected to any inter-racial sexual contact with myself, and I myself do NOT agree to ever participate in any "inter-racial dating".

To: Mr. Henry Kellison, Executive Assistant to Travis County District Attorney Jose Garza in the Office of the District Attorney himself.
April 15, 2021
Dear Mr. Kellison,
This is a courtesy follow-up note to you in response to the polite request you made of me on April 6, 2021, during a phone call I made to your office inside the Travis County District Attorney's Office.

I have hired an attorney (see related message I sent to him, below) for the purpose of making one phone call to you about alleged home-invasion-crimes victimizing me during my sleeping hours as I lie alone on my own bed inside my bolt-locked current rental-apartment unit in northeast Austin. That first-rate criminal-law attorney is Mr. Jon Evans of Evans and Lusk Law Firm.

"Mr. Evans,
Thank you for kindly agreeing to represent me in a phone call about alleged 'home invasion crimes' victimizing me inside my current bolt-locked apartment unit during my sleeping hours. I appreciate your willingness to make that phone call on my behalf directly to Executive Assistant Henry Kellison, who is situated in the office of Travis County District Attorney Jose Garza in the Travis County DA's Office in Austin. Mr. Kellison on his own initiative on April 6, 2021, specifically asked me on the phone to myself find a criminal-law attorney who would then represent me in that one total phone call to Mr. Kellison in regard to the subject of 'home invasion crimes' allegedly victimizing me on a continuous daily and year-round basis inside my current apartment unit at Pebble Creek Apartments, 8805 North Plaza Drive. I reside alone as the only tenant in Apt. 2418 of Building 17 at Pebble Creek Apartments.
I have been assured on the phone by Texas Legal, my first-rate legal-aid service in which I am a dues-paying current member, that my hiring you for this one total phone call to Mr. Kellison can be covered under my Texas Legal insurance plan, since it would comprise actual representation of me on the telephone in that context. I have not used any hours for an attorney actually representing me during the current coverage year, according to the female Texas Legal staff member who spoke with me on the phone."

The above online message was sent by me to Mr. Evans at 9:17 p.m. April 14, 2021, through the only online method I could find for contacting Mr. Evans last night---the State Bar of Texas website. I tried to find a way of contacting Mr. Evans online at his official law firm website, but could not find any e-mail address for himself specifically that was available to me last night. I found one e-mail address for Mr. Lusk, but not Mr. Evans. However, I wanted to send my message directly to Mr. Evans, since he will be the one total State Bar of Texas attorney directly representing me in that phone call to you.

Mr. Kellison, thank you again for your kind willingness to talk with me on the telephone. I contacted numerous other attorneys, nearly all of whom either declined to represent me in a phone call to you (a few of them even referred to the request from yourself as "weird"), or did not reply to my phone message to them, and one of whom (based in Houston) indicated through his male assistant that there could be major additional financial expenses I could incur from the hiring of a former FBI agent on that attorney's staff to assist with factual investigative research on my behalf.

Mr. Evans was the first attorney I've contacted who definitely stated to me on the telephone that he will be willing to contact you on my behalf if I make an initial payment to him he has requested for that phone call. I have assured his secretary, Katherine, that I will make that financial payment to Mr. Evans he requested if need be, but that Texas Legal, my legal-aid insurance plan I joined in 1997 upon direct invitation from a State of Texas agency full-time employer of mine, has told me that my hiring Mr. Evans for that one phone call to you can be covered by that legal-insurance plan through a category I have not used yet in the most recent coverage year, since I have not previously hired any attorney in this coverage year, that Texas Legal staff member helpfully informed me.

I am very grateful to Mr. Evans for having been the only attorney I can recall whom I have consulted in recent months who specifically told me on the telephone that he supports my legal right to keep anyone and everyone but me away from any portion of my current apartment unit during my sleeping hours.

I am a longtime celibate-by-choice, single-by-choice, permanently-drinking-alcohol-free (ever since 1990) and never-previously-addicted, permanently-marijuana-free (ever since 1984) and never-previously-addicted, lifelong-illicit-drug-free in regard to any and all illicit drugs other than marijuana, lifelong non-Christian, dependably civil and law-abiding and platonicly polite, clean-talking (no profanity by me in my everyday conversations with others), lifelong-tattoo-less and anti-tattoo-minded, white Anglo-Saxon non-Hispanic gentleman, age 63.

I hope this is helpful to you, Mr. Kellison, in honoring the polite request you made of me on the phone. Please give my best regards to your hard-working supervisor, Travis County District Attorney Jose Garza.

Sincerely and Best Wishes,
John Kevin McMillan, longtime criminal-law complainant with the Austin Police Department in numerous alleged home-invasion-crimes cases for which no suspect or suspects were ever identified by APD in any context I was myself ever informed about.
My solo-occupancy efficiency-apartment-unit rental-home address ever since June 21, 2019:
Pebble Creek Apartments (a Belco Equities-affiliated, large gated-community complex), 8805 North Plaza Drive, Building 17 (northeastern corner of complex), Apt. 2418 (a second-floor, eastward-facing unit), Austin, TX 78753.

Dear Mr. Kellison,
This is a courtesy follow-up note to you in response to the polite request you made of me on April 6, 2021, during a phone call I made to your office inside the Travis County District Attorney's Office.

MY COURTESY FOLLOW-UP LETTER TO TRAVIS COUNTY DISTRICT ATTORNEY'S OFFICE EXECUTIVE ASSISTANT HENRY KELLISON IN REGARD TO THE 'HOME-INVASION-CRIMES' CASE HE HAD DIRECTLY CITED TO ME ON THE TELEPHONE ON APRIL 6, 2021

Today I was able to confirm the date in 2021 --- it was April 6 --- when Henry Kellison, Executive Assistant to Austin, Texas-based Travis County District Attorney Jose Garza, on his own initiative asked me on the telephone to myself hire a criminal-law attorney who would then be expected to directly contact Mr. Kellison on my behalf.

That first-rate attorney, as I confirmed for Mr. Kellison in this courtesy April 15, 2021, follow-up letter, is the highly-regarded "Super Lawyer"-status criminal-law defense attorney Jon Evans of Austin. Mr. Evans is a very distinguished alumnus of the Texas Tech University Law School in Lubbock, Texas.

Dear Mr. Kellison,
This is a courtesy follow-up note to you in response to the polite request you made of me on April 6, 2021, during a phone call I made to your office inside the Travis County District Attorney's Office.
