Dear Office of General Counsel Officials for the Texas Department of Criminal Justice (TDCJ) state agency in Huntsville,

Thank you again for your September 27, 2021, reply letter (below) to me in which you explained why you are asking me to pay your state agency the estimated financial amount of "$498.60" in exchange for your processing in full my most recent public-information request to your state agency.

This is one additional hopefully-polite follow-up letter that is aimed at helping to reduce the total amount of time you will need in order to respond in full to my August 28-dated public-information request---a request focused exclusively on your TDCJ Office of General Counsel in Huntsville and me.

I feel hopeful that if I provide you with the factual information for my request that my own official SID number with the TDCJ is 04530055, this might significantly reduce the total financial expense I incur from obtaining a full and complete written response from your state agency at your earliest convenience.

I also feel hopeful that your Office of General Counsel's determination in March of 2015 that your state agency had no responsive documents in response to a similarly-worded public-information request of mine, might enable you to save some time in your fully up-to-date response to my current 2021 public-information request. Farther below, for your convenience, is a copy of your state agency's reply letter to me on March 11, 2015.

For the record, my August 28, 2021-dated public-information request to your state agency that you officially received on August 30, 2021, had sought "a copy of any and all e-mail communications, reports, memoranda, or other written communications that
were written or received or forwarded or FAXed or mailed at any time since April 1, 2011, by any staff member or attorney or administrator in your state-agency's Office of
General Counsel in Huntsville, and that, in each and every such case, referred at least once in any manner to myself, John Kevin McMillan of Austin, Texas.
Excluded from the scope of this public-information requests are any and all e-mails that were directly sent by myself to your Office of General Counsel in Huntsville."

In view of this additional factual information from me, I hope to hear from you soon in regard to whether you are now planning to reduce the total financial amount you ask me to pay you in exchange for a full and complete response from your state agency on my most recent information request of this year.

---Is the TDCJ or the Texas Board of Pardons and Paroles or any other cited government agency or government-owned institution operating in Texas at present, currently providing me with any possible or actual or alleged "client services" or "legal services" or
"educational services" or "administrative services" or "punitive services" or "victim-assistance services" or "rehabilitation services" or "religious-conversion services" or or "religious services" or "medical services" or "negative reinforcement services" or  "counseling services" or "communications services" or "mental health services" or  "psychiatric services" or "correctional services" or "thought-control" services or "censorship services" or "defacto incarceration services" of any type?

--Has any official of the TDCJ state agency expressed major concern over the possibility that some business entity or group of individuals or private-sector entity or non-profit group or religious group or media company not officially representing either state or local government in Texas, has somehow possibly abrogated any type of legal authority normally held by the TDCJ or the Texas Board of Pardons and Paroles in a context that somehow relates to or refers to myself or impinges on or violates my own privacy rights?

---Has the TDCJ noted any possible alleged violation or violations of my own privacy rights in Austin, Texas, that poses a concern to any TDCJ official?

---Has any TDCJ official ever stated that he or she is dismayed to note that one or more allegedly law-breaking vigilante groups or groups claiming to "take the law into their own hands" who are allegedly operating in Texas at present, have allegedly been significantly medically injurious and financially injurious to myself, former TDCJ state agency full-time employee John Kevin McMillan, and that the Austin Police Department, the Travis County District Attorney's Office, the Travis County Sheriff's Office, the Travis County Attorney's Office, and the Texas DPS, for instance, have thus far apparently not pursued any actions to lawfully and in a civil manner terminate outside interference in my own life by any such allegedly law-breaking vigilante group or groups.

---Does any TDCJ official know what prompted David Ferris, then Civil Probate Division Director of the Travis County Government in Austin, Texas, to on his own volition state to myself on the telephone in 2001, during a local phone call I made to his office in the Travis County Courthouse from my rental apartment unit at that time,  Apartment 1638 at Wind River Crossing Apartments in Austin: "There appears to be an attempt by many people in the Austin area to drive (sic) you (John Kevin McMillan) out of the Austin area" (approximate quote).

---What prompted a kindly male TDCJ staff attorney to state to myself on the telephone this 21st Century several years ago, during a long-distance phone call I made from my current rental apartment unit to his public law office in Huntsville, Texas, that "It seems to me that the people of Austin are NOT friendly toward you, John! I recommend that you move to Huntsville, Texas, and purchase a home for yourself here in Huntsville!" (approximate quote).

---Does the TDCJ know what prompted my oldest brother, Kent Neal McMillan of the Austin area of Texas, to volunteer to myself on the telephone in a long-distance phone call I made to his and his wife's home in Austin, Texas, in the summer of 1991, this during a multi-month period when I myself resided in Cuero, Texas, in my capacity as a full-time newspaper reporter for the "Victoria (TX) Advocate" general-circulation daily newspaper, that "Your (John Kevin McMillan's) living conditions in Texas call to mind the prohibition on cruel and unusual punishment in the United States Constitution (Bill of Rights)," brother Kent observed in that 1991 phone conversation. Kent then immediately added in that very same long-distance 1991 phone conversation, this with no directly-cited context to his elaboration, that "Sweden has a better record than the United States has on human-rights issues."

---Does any TDCJ official know what prompted my oldest brother, Kent Neal McMillan of Austin, Texas, to emphatically state to me on his own initiative in 1991, this during a long-distance phone call I had made to his and his wife's home in Austin, Texas, from my rental apartment unit in Sweetwater, Texas, where I was employed full-time as a reporter for the "Sweetwater Reporter" general-circulation newspaper: "You (John Kevin McMillan) are being PERSECUTED in Texas!"

---Has the TDCJ ever at any time ever on any occasion ever once officially designated me as a single adult white male victim of ANY felony crime of any type that was reportedly inflicted on me in Texas against my wishes by one or more law-breaking or criminal persons?

---Does any TDCJ official currently exhibit any possible failure to fully acknowledge that I myself am dependably civil and law-abiding and honest, that I myself am psychologically healthy and very honorable and conscientious, that I am a lifelong non-Christian gentleman, that I am a longtime celibate-by-choice single adult gentleman, that I am platonically polite and have a strong aptitude for platonically-polite mutually-agreed-upon personal or professional relationships or acquaintanceships with others, and that I myself have no criminal-conviction record?

 

---Is there any record indicating that the TDCJ or the Texas Board of Pardons and Paroles or any other government agency operating in Texas currently has, or currently reports having, any cited possible "employment" relationship or any cited possible "employer" relationship with myself of any possible type?

Thank you for your September 27, 2021, reply letter (below) to me, explaining why you have determined that I will need to pay "$498.60" to the TDCJ in order to myself receive a written response from you that provides me with any and all documents that are responsive to my late August of 2021 e-mail public-information request to your state agency.

My request had sought applicable legal documents on file with your Office of the General Counsel in Huntsville, Texas, that directly refer to me in any manner. I myself do not have any criminal-conviction record, as I'm sure your state agency in Huntsville is very aware.

Thank you again for your reply letter. I will need to give some thought to whether I plan to submit a polite appeal to the Attorney General of Texas, the Honorable Ken Paxton, in regard to the $498.60 financial charge to me by your state agency on this.

For the record, my applicable information request to  the TDCJ had sought a copy of  "any and all e-mail communications, reports, memoranda, or other written communications that were written or received or forwarded or FAXed or mailed at any time since April 1, 2011, by any staff member or attorney or administrator in your state-agency's Office of General Counsel in Huntsville, and that, in each and every such case, referred at least once in any manner to myself, John Kevin McMillan of Austin, Texas. Excluded from the scope of this public-information requests are any and all e-mails that were directly sent by myself to your Office of General Counsel in Huntsville."

I had sought those legal documents from your TDCJ Office of General Counsel in Huntsville in an August 28, 2021, public-information request I emailed to your state agency---a request that your state agency officially received on August 30, 2021.

The cost estimate provided to you is based on the cost of performing the search and review of records.  We do not anticipate the discovery of a large amount of responsive records based on a similar search for a request you submitted recently.  The cost of searching TDCJ records is based on the computer programming and processing time, and is not necessarily dependent on the search terms.  We cannot estimate the number of pages of responsive information which may be available to you following the search.

 

It is also noteworthy that any responsive information fall under an exception to a release under the PIA and/or be protected by a privilege.  

 

The PIA does not require the TDCJ to respond to questions.  If you are requesting additional information, you must submit a new request using one of the methods listed at the following link:
