Dear APD Commander Eveleth,

I was informed on the telephone at about 8:30 p.m. today by a first-rate 311 telephone information service staff member "Ambassador" for the City, Ms. Ashlie Campbell, that you are a supervisor of APD Lt. Justin Newsom.

I am writing to you today, Commander Eveleth, because when I recently wrote (below) to Lt. Newsom, who is the immediate supervisor of Sergeant Michael King of APD's "Crisis Intervention Team", Lt. Newsom apparently chose not to reply in any way to my politely-worded E-mail letter.

APD Commander Eveleth, I would be very grateful to you if you would please review the following civilly-worded multi-part letter of complaint that I wrote and sent on June 24, 2016, to Lt. Newsom.

I hope to hear from you soon about this very alarming alleged-continuous-felony-crimes case in which I myself am still, to this very day, the self-identified single adult white male victim of alleged daily and year-round personal injury-crimes and anal-rape crimes in Austin.

As always, I welcome any additional forensic DNA-swab medical exams on myself or any interviews of myself, or any lie-detector tests on myself, that APD is willing to authorize for me at any time.

I wish to politely emphasize, Commander Eveleth, that I am a very strong criminal-law complainant in this personal-injury-crimes and anal-rape-crimes case. I myself do not have any criminal-conviction record, and I lead a permanently alcohol-free, lifelong-tobacco-free, and permanently-illicit-drug-free lifestyle. Also, I myself have not participated in any act of anal intercourse anywhere in the entire world on any occasion since the late 1980s.

ANY AND ALL DNA-SWAB TRACES THAT ARE OBTAINED FROM MY OWN ANUS OR BUTTOCKS THROUGH FORENSIC MEDICAL LAB TESTING, ARE PROOF IN A COURT OF LAW THAT I WAS, IN FACT, RAPED OR SEXUALLY ASSAULTED DURING MY SLEEP IN A CONTEXT WHEN I WAS UNCONSCIOUS WHILE LYING ALONE ON MY OWN BED INSIDE MY LOCKED PRIVATE BEDROOM OF MY BOLT-LOCKED OR LOCKED APARTMENT UNIT.

Thank you for kindly accepting an urgent request from me on the telephone today that you please review the conduct toward me ever since early 2012 by APD Sergeant Michael King and by an immediate subordinate of his, APD Senior Police Officer James Turner, both of whom are reportedly members of the APD Crisis Intervention Team.

Lt. Newsom, I also need to take this opportunity to correct a factual error I made in the phone message I left for you earlier today. After reviewing my legal notes, I am reminded that it was, in fact, a female attorney for the Austin-based "Texas Advocacy Project" non-profit group assisting rape victims who helpfully advised me on the telephone late Wednesday afternoon, June 15, 2016, to myself directly contact the immediate supervisor of APD Sergeant Michael King.

I am very grateful to that attorney, Christian---who emphasized that she cannot herself represent me herself on this---for her invaluable legal advice.

Lt. Newsom, I would like to ask you to please review some May 20, 2016-announced "APD policies" toward myself, John Kevin McMillan of Austin, that were each very emphatically "announced" to me in person by APD Officer James Turner during a "surprise" visit he made to my apartment unit in which I let him into my unit in the hope he and his colleague accompanying him, APD Officer Stanley Vick, would actually obtain some crime evidence on my own behalf.

As you may be aware, numerous City of Austin officials, including City Council Members, and APD officials have informed me ever since early 2012 that APD Senior Police Officer James Turner of APD's "CIT Unit" is my own designated "Liaison" to myself for any and all "crime reports" or "criminal-law complaints" from myself, those City of Austin and APD officials indicated.

The most recently announced APD "policies" delineated by Officer Turner, as stated to me during a May 20, 2016, unannounced visit into my apartment unit by Officer Turner and his APD male colleague Officer Stanley Vick (see supporting document on that, below), are as follows:

---that under no circumstances of the present or future of my own life will APD ever at any time authorize any additional DNA-swabs forensic medical-evidence exam on myself, John Kevin McMillan, Officer Turner emphatically stated to me inside my apartment unit.

---that Austin Mayor Steve Adler and all current Austin City Council members and all employees or officials of the City Manager's Office here in Austin are NOT willing to accept any additional E-mail correspondence or letters from me that refer to my being a victim of alleged crime in Austin.

---that if I continue to complain to Austin Mayor Adler or one or more Austin City Council members or anyone employed in the City Manager's Office here that I am a victim of alleged crime here in Austin, APD might arrest me and formally charge me with having "harassed" the cited City Government of Austin official, APD Officer Turner emphatically warned me in person inside my apartment unit on May 20, 2016.

---that neither APD Officer Turner nor APD Sergeant Michael King nor anyone else employed in the APD Crisis Intervention Team sees ANY need to contact any actual CRIME INVESTIGATOR for APD in a context referring to myself, John Kevin McMillan, as a possible or confirmed victim of crime in Austin, APD Officer Turner stated with emphasis on May 20, 2016. inside my apartment unit.

---that APD sees no need to obtain any DNA-lab processing on the the doctor-ordered and City Manager of Austin Marc Ott-approved (he wrote a check to St. David's for that particular forensic exam on me) DNA-swabs rape-evidence kit obtained from my own body at my request inside St. David's Central ER in the early morning hours of Dec. 22, 2011. That rape-evidence kit was obtained for APD Sex Crimes Case 11-3550615---a crime case for which APD has still, to this day, not arrested any suspect, according to what I have been told. The cited rape-evidence kit from late December 2011 is reportedly being stored at an APD substation without any DNA lab processing of that kit having ever occurred.

---that APD contends that I am NOT a victim of crime, and that all of the allegations and crime evidence I have provided to APD were either "delusional" or of dubious value in any courtroom proceeding in which I myself might ever be cited as the "victim."

---that according to Officer Turner and Sergeant King, APD emphatically denies that I myself have been victimized by alleged continuous-and-continuing, daily-and-year-round, personal-injury-crimes and alleged anal-rape-crimes allegedly being inflicted on me by alleged intruders during my own sleep inside my locked or bolt-locked apartment unit.

----that each of the infrared-photo images and video-clips of cited possible illegal intruders that I myself have obtained in the period since February 2012 (the month and year when I purchased my first-ever infrared camera, a hunter's camera, inside a nearby Academy store in Austin) were, in fact, of myself, John Kevin McMillan, and no one else, according to Officer Turner and his immediate supervisor, Sergeant Michael King.

Lt. Newsom, I would welcome any opportunity to be interviewed by you---or to provide you with several examples of infrared photos of alleged illegal intruders inside my bedroom that I've sent to the two cited APD officers whom you supervise----as you review whether Officer Turner and Sergeant King were, in fact, honest and professional and diligent and accurate in their job performance on behalf of APD.

Texas Rangers does not allow a third party, such as yourself or SafePlace Austin, to file a criminal-law complaint with that division of the Texas Department of Public Safety in Austin, you pointed out in our telephone conversation this afternoon.

Also in our phone conversation today, you stated to me that unless SafePlace Austin receives prior authorization from the Austin Police Department for a forensic medical exam on a self-identified rape victim, SafePlace Austin cannot provide any forensic medical exam on a self-identified rape victim under any circumstances, you indicated.

Without prior APD approval on a cited sexual assault forensic exam, SafePlace Austin would have no place in which to store that rape-evidence kit, you stated.

You were referring to the fact that APD routinely picks up forensic rape-evidence kits from your SafePlace facility in order to then store those kits at an APD facility in Austin.

You also mentioned in our phone conversation today that a hospital in Austin can provide a sexual assault forensic exam on a patient inside that hospital. You added, however, that the medical professional providing that forensic exam inside a hospital in Austin would not be a certified forensic nurse, you pointed out.

Certified forensic nurses currently are not allowed to administer sexual-assault medical exams on self-identified rape victims inside any of the hospitals or hospital emergency rooms in Austin, you said.

You also pointed out that results from rape-evidence forensic exams performed by a certified forensic nurse, such as at SafePlace Austin, will have more credibility in a court of law in Austin than would results from rape-evidence exams provided by a medical professional who is not a certified forensic nurse.

Also in our phone conversation this afternoon, you mentioned that you do not know of any private investigator who might be willing to help me document factual evidence of my being a victim of alleged personal-injury-crimes and alleged anal-rape-crimes during periods when I am lying alone (and I ALWAYS lie alone and sleep alone on my own bed), unconscious and probably also snoring, on my own bed inside my locked private bedroom of my bolt-locked apartment unit at Village Oaks.

Also in our phone conversation today, you mentioned that you not know of any personal-injury attorney who might be willing to represent me as a self-identified rape victim seeking to press successful criminal-law charges through the Austin Police Department and the Travis County District Attorney's Office.

Also in our phone conversation today, I authorized you to share with the Austin Police Department ---or any other law-enforcement agency, I might add at this time---any rumors you ever hear at any time, or any factual evidence you ever obtain at any time, including through your conversations with me, that refer to my being a victim of crime in Austin.

Ms. Black, please let me know if I did not accurately paraphrase any of your cited comments to me on the telephone today.

As a former full-time newspaper reporter, I value having very fine credibility in factual reports I write, including as a crime victim and criminal-law complainant during my off-duty hours in Austin.

That phone call to me from you occurred five days after Austin Police Department Sex Crimes Unit Detective Jeff Dwyer (APD Badge Number 3435) on the afternoon of Friday, May 13, reportedly stated on the telephone to an APD officer present inside your Safe Place facility thatthe APD Sex Crimes Unit would NOT approve the forensic medical exam on myself that I had requested that day as crime evidence for APD Case 16-1340923.

The initial crime report for that Sex Crimes Case was officially filed by APD at 1:37 p.m. on May 13, based on factual information that I myself provided in person to two APD officers who interviewed me that day inside your SafePlace facility. Those two APD officers are female APD Officer Leticia Acosta, Badge Number 5805 (who on an individual basis interviewed me a second time that same day inside your SafePlace facility on May 13), and male APD Officer Craig Ritchie, Badge Number 5364.

In the much-appreciated May 18 phone call you made to me, you helpfully volunteered to me that I have the option of directly contacting the Texas Rangers Division of the Texas Department of Public Safety state law-enforcement agency and myself filing a legal complaint against the Austin Police Department through that state agency, you said.

If I personally file a legal complaint against the Austin Police Department through the Texas Rangers, you helpfully indicated to me on the telephone on May 18, that could trigger a Texas Rangers crime investigation into APD's alleged possible obstruction of justice in a context allegedly victimizing myself.

You offered me that option in the context of yourself noting with kind concern in your May 18 phone call to me that in your multi-year tenure as Director of Forensic Nursing at SafePlace, you can only recall "one or two" prior occasions when APD's Sex Crimes Unit in Austin, Texas, has declined to authorize a forensic medical exam on a self-identified rape victim at your SafePlace facility, you stated.

Ms. Black, I am writing this urgent follow-up note to you in order to ask if you yourself might be willing to please contact Texas Rangers on my behalf, with the clear prior understanding that you are fully authorized by me to share any information or impressions you have about me, including any and all medical information about me, with the Texas Rangers.

APD's repeated refusal over a multi-year period and on 10 or more total occasions to authorize any forensic DNA-swabs medical exam on myself that I myself had requested at that time,comprises what I myself regard as flagrant evidence of alleged possible violations of the law by APD and several APD officers.

One alarming legal document I recently obtained from APD through a public-information request I submitted was an official June 3, 2015-dated APD "Supplements" report by Detective Rae Ann Egan of APD's Sex Crimes Unit in regard to APD Case 15-1540423. I as the self-identified sexual-assault victim had submitted a crime report to APD on June 3, 2015, that prompted the initial filing of that crime case by APD.

In her June 3, 2015, official APD "Supplements" report about myself, APD Detective Egan wrote: "I told the officer (APD Officer Larroque, Badge Number 7429) that the SAFE would be approved. The officer called me back a short while later and informed me that he had the Crisis Intervention Team (CIT) do a follow up and that they informed him that this is a normal thing for this victim and that SAFE's are no longer approved for this particular person. I did some research and I did find out that this particular person is on the Do Not Approve List for SAFEs.

"The officer told me that the victim had been transported to the hospital (North Austin) by EMS. He stated that the victim told them that he wanted to be transported. I had informed the officer that SAFEs are no longer being done at the hospitals that they are currently being done at SafePlace. I told him that the hospital will need to notify SafePlace when he is discharged.

"I had initially contacted SafePlace and advised them of the situation and was not sure when he would be coming for the SAFE. After I learned that the victim is on the Do Not Approve List for SAFEs, I called them back and let them know that he would not be coming for a SAFE.

"***SAFE NOT APPROVED***"

More recently, in May of 2016, Austin Police Department Senior Police Officer James Turner and another male APD officer named Stanley Vick, both of them from APD's "Crisis Intervention Team", made an unannounced visit to my Village Oaks apartment unit in NW Austin from about 11 a.m. to about 11:30 a.m. on Friday, May 20, 2016.

During that visit, in which I let the two APD officers into my unit in the hope they might collect crime evidence on my behalf, Officer James Turner----the APD-designated and City of Austin-designated "Liaison Officer" to myself on a continuous basis ever since 2012---emphatically stated to me that APD will never authorize ANY sexual-assault forensic medical exam on me under any circumstances at any time in the present or future of my own life, Officer Turner stated.

APD Officer Vick, who appeared hostile toward me during their May 20, 2016, visit into my unit, volunteered to me inside my apartment's living room that morning that the ONLY way I myself could ever get a forensic medical exam on myself is if I myself find some private-sector medical provider to offer that medical exam to me, APD Officer Vick said.

Also during those two APD officers' May 20, 2016, visit inside my apartment unit, APD Senior Police Officer James Turner emphatically stated to me on his own initiative that I myself should not write to Austin Mayor Steve Adler or any current Austin City Council member or anyone currently employed in the City Manager's Office about my being a self-identified victim of alleged felony crimes in Austin, Officer Turner stated.

Officer Turner added with emphasis on May 20 in the living room of my apartment that Austin Mayor Steve Adler and numerous Austin City Council members and employees of the City Manager's Office in Austin have recently complained to APD Officer Turner about their feeling "harassed" by crime reports of mine and criminal-law complaints of mine that I have written and E-mailed to those City of Austin officials, Officer Turner said.

If I send any additional E-mail letter to the Mayor of Austin, Austin City Council members, or anyone employed in the City Manager's Office about my being a victim of alleged felony crimes in Austin, Texas, APD might arrest me (John Kevin McMillan) and charge me with the crime of "harassment" of one or more of those cited City of Austin officials, Officer Turner emphatically warned me in person inside my apartment's living room on May 20, 2016.

Ms. Black, I hope that this follow-up letter will help to persuade you to please consider contacting the Texas Rangers in Austin on my behalf at your earliest convenience.
