This is a Texas Open Records request in which I seek to obtain from your very influential county government a photocopy of any and all letters, computer records, reports, memoranda, E-mail transmissions, printed reports, phone messages, or any other items on file with Williamson County Government at any time since October 1, 2007, and that, in each such case, either refers to myself, John Kevin McMillan, in any manner or any way, and/or refers in any context to the Village Inn 620 restaurant at 11630 FM 620 North in Williamson County, Texas, or to the Souper Salad restaurant along Pecan Park Boulevard that's situated near Lakeline Mall in Williamson County, Texas.

The photocopies I seek are of documents and other items that at any time since October 1, 2007, have been received or compiled or produced or generated or noted or stored by any employee or official at any of the following offices of Williamson County Government:

---the Williamson County Health Department Retail Food Division, or any other office of the Williamson County Health Department, including the office of the Director of the Williamson County Health Department and the head official for the Williamson County Health Department Retail Food Division.

Included in the scope of this Open Records request are E-mail letters I wrote and E-mailed to Ms. Kay Kelley or Ms. Yvonne Garcia of your Williamson County Health Department Retail Food Division on February 4, 2008; February 26, 2008; February 27, 2008; and March 24, 2008; and any phone messages relating to my numerous phone calls to that office in the entire period since early February of 2008, including today, when I spoke with Ms. Yvonne Garcia of that office, and I asked her whether Ms. Kelley has in fact received the most recent E-mail letter from myself.

Ms. Yvonnne Garcia of your county government stated to me on the telephone on March 20, 2008, that there have been "several" inspections by the Williamson County Health Department of Village Inn 620, situated at 11630 FM 620 in Cedar Park, Texas, thus far in calendar year 2008. Despite this, a day or two ago when I consulted your county government website, I was not able to find any cited result from any such reported inspection of Village Inn 620, in particular.

My legal name is John Kevin McMillan. My social security number is .... I was born on April 27, 1957, at Lincoln , Nebraska . I have resided in Texas ever since January of 1988, most recently. I have resided in Austin , Texas , on a continuous basis ever since mid-March of 1997, most recently. I am a single, unencumbered, gainfully employed, law-abiding, adult gentleman. I lead a completely alcohol-free (and never-previously addicted) and anti-alcohol, lifelong tobacco-free and anti-tobacco, completely illicit-drug-free (and never previously addicted) and anti-illicit-drugs, tattoo-less, clean-talking (virtually no profanity ever being verbalized by myself), facially cleanshaven, platonically polite, masculine and politely aggressive, consistently civil and honest and consistently law-abiding and non-stalking, longtime celibate, HIV-negative, disease-free, healthful lifestyle.

I am the founder of a new and non-proselytizing, lawfully non-Christian religion of my own --- a religion with only one total member at present, myself --- that emphatically opposes anonymous communications, stalking, verbal harassment, profane speech in communications with others, sadomasochism, torture, pranksterism, and fraudulent communications. In that regard, I myself definitely do not participate in any anonomyous communications, stalking, verbal harassment of others, sadomasochism, torture, pranksterism (pranks), or fraudulent communications.

I previously resided in Williamson County , in the city of Taylor , Texas , for a brief multi-week period of 1990, when I worked as a reporter and photographer for the general-circulation newspaper in Taylor . I currently work in two different chain restaurants that from what I understand are each situated inside Williamson County , Texas .

Early this year, I received yet another medical finding inside his medical clinic from a first-rate ear, nose, and throat specialist, Dr. David Tobey of the Austin area, that noise pollution in recent months at one or more of my workplaces and away from my workplaces as well that I myself did not cause has allegedly caused significant damage to my own hearing capacity and auditory medical health, Dr. Tobey helpfully informed me.

I previously was employed as a server for the IHOP Duval chain restaurant in Austin , Texas , from November of 2002 until October of 2007. I have worked for a variety of Souper Salad restaurants in the Austin area ever since May of 2002; I have worked at Souper Salad Lakeline restaurant in Williamson County ever since early 2003, to the best of my recollection.

One assistant manager of mine at the time at Souper Salad Lakeline, Ms. Patty Hummel, helpfully stated to me several years ago during working horus for me inside Souper Salad Lakeline restaurant that noise pollution at that time was a major problem inside that restaurant. The general manager at that time was Rudy Woolf (Woolfe? sp?), who no longer works for Souper Salad Inc., from what I have been told.

Dr. Tobey has examined myself and my hearing or auditory health several times inside his medical clinic in northwest Austin ever since about three years ago, and he has obtained reliable statistical medical reports confirming damage to my own medical health in that regard.

I myself do not play any loud music, and I almost never raise my voice or shout, and I maintain a quiet lifestyle inside my residence in northwest Austin .

Attached, please find legal correspondence of mine relating to noise pollution damage to my own medical health that I have sustained in Williamson County , Texas , and in Travis County, Texas, in recent months and recent years:

County Attorney Duty, I am also submitting this Open Records request because I was informed in January of 2006 by Ms. Norma Hilbig, a paralegal based in the Strategic Proseuction Division of the Travis County District Attorney's Office in Austin, that a voluminous criminal-law file has been established in that division on my own behalf and for my benefit.

Ms. Hilbig informed an Austin-based criminal-law attorney on my behalf in April of 2006 that if any person ever at any time commits a felony crime victimizing myself, John Kevin McMillan, Travis County District Attorney Ronald Earle will consult that "John McMillan file" in pressing criminal-law charges against any such cited defendant accused of having wronged myself and of having allegedly committed a felony crime in the process.

Among the individuals and entities currently or previously residing in or situated in Central Texas whom or that I have lawfully rejected from my own life are: a Jon Miller-Carrasco; a Professor Guy Howard Miller affiliated with The University of Texas at Austin; an Arthur Rauch; .....

Dear Dr. Tobey,

I would like to thank you again for very kindly agreeing with me earlier today during my scheduled 10:40 a.m. medical appointment with yourself inside your medical clinic in northwest Austin that injurious noise pollution in Austin----and, you helpfully added, possible air contaminants at one or more of my workplaces in recent years ----appears to have caused the massive quantity of "beeswax" that you removed from each of my ears today during your medical examination of myself.

Today during your medical exam of myself inside your clinic, you helpfully pointed out that that beeswax buildup inside my ears today was much greater than expected, partly since you had last removed beeswax from both of my ears a few years ago inside that same medical clinic, you helpfully noted.

I would also like to thank you, Dr. Tobey, for your very kind stated willingness today to accept a photocopy of recent Open Records-related legal correspondence of mine with the City Government of Austin. That 30-page legal document, a copy of which your diligent staff member Shay has kindly added to my medical file with yourself, indicates that the Austin Police Department (APD) for reasons unclear to myself has thus far chosen to dismiss as irrelevant verbalized complaints of mine to APD officers about noise pollution in Austin, Texas.

"He (John K. McMillan) asked about filing charges," APD Officer John Nelson notes in a June 11, 2004, E-mail report he sent that day to APD Officer Gena Curtis in regard to my civilly-stated and lawful complaints of noise pollution victimizing myself that I'd verbalized to APD. "I explained that a citation similar to a traffic ticket could be written under certain circumstances. Also advised him that a citizen could file a complaint w/ municipal court."

In a follow-up June 11, 2004-dated E-mail letter in response to my own politely stated noise pollution complaints to APD, APD officer Van Cearley emphasizes to APD Officer Rudy Landeros that "we ran a history on Mr. McMillan and he has been handled as an emotionally disturbed person in the past." That same follow-up report also notes that "he (John McMillan) does not have a specific complaint at this time" about noise pollution, Officer Cearley stated in writing, this in a legal document that was included in the legal documents I added to my medical file inside your medical clinic today.

Even as of today, APD thus far has apparently chosen to ignore numerous complaints of mine about noise pollution in Austin, this despite the fact that that municipal law-enforcement agency in our capital city of Texas is legally responsible for investigating and filing legal charges in a court of law against any and all sources of noise pollution evidenced in Austin, Texas, that violate municipal law---or that violate any other law, I would assume.

Dr. Tobey, please note that I did complete and sign and provide to Shay inside your medical clinic a legal authorization form that gives you my express permission to share with the Austin Police Department or any other government entity, or any attorney, or, I added seconds later in an oral comment to Shay, any media company anywhere in the world, --- or, I might add at this time, any individual who contacts your medical clinic about it --- any and all information or findings or opinions you yourself wish to share with that entity or individual or company that relate to noise pollution (and, you've indicated, air pollution as well) that's been, and continues to be, appallingly injurious to my own medical health in Austin, Texas.

In that regard, I have chosen to carbon-copy this follow-up letter to Austin Police Chief Art Acevedo, partly because I sensed from chatting in person today with APD Officer Will Monte at about 2:15 p.m. this Tuesday inside your medical clinic (a conversation I had with Officer Monte in a context relating to a lost-and-found report from myself to APD today that I informed your polite staff members about before I made that polite 311 phone call from your office to APD), that Officer Monte appeared to also be concerned about the alleged role of noise pollution apparently violative of the law that allegedly has been and continues to be harmful to myself in Austin, Texas.

Incidentally, the APD number assigned to the lost-and-found report I filed over the telephone today from your medical clinic is: 085003893. I filed that report at 1:24 p.m. today, according to Angela, the APD telephone operator who accepted that report from myself relating to a rain-drenched $20 bill I had discovered lying on the ground in front of my parked car near your medical clinic building at about 1 p.m. today. I had made that surprising discovery today seconds after I had driven back to your clinic's parking lot in front of your building in order to provide yourself with a photocopy of the recent noise-pollution-related legal correspondence of mine with the Austin Police Department --- correspondence that contains APD records about their decision to not investigate those stated complaints of mine---and to return a "Southern Living" magazine I had borrowed from your office earlier today with your staff's permission.

Mr. Chris Barbee, a former work supervisor of mine at and current Editor and Publisher at "The El Campo Leader-News" general-circulation newspaper in El Campo , Texas , who has himself kindly stated to me in writing that he fervently opposes anonymous communications of the type that I have complained about to himself.
Travis County District Attorney Ronald Earle, DA's Office, DA Earle having presided over the establishment in January of 2006 of a massive criminal-intent or harmful-intent legal evidence that exclusively contains tentative legal evidence that one or more persons allegedly seek to commit a crime victimizing myself, John Kevin McMillan, with anonymous communications and noise pollution and verbal harassment victimizing myself being frequently cited in that criminal-law prosecution file on my own behalf in Austin, Texas.
