AUSTIN POLICE DEPARTMENT OFFICER ANDREW BROTHERMAN ON MAY 11, 2016, RESPONDS TO TENTATIVE CRIME REPORT FROM JOHN KEVIN McMILLAN ABOUT ALLEGED POSSIBLE JIMMYING OF THE DOOR LEADING FROM THE LIVING ROOM DIRECTLY INTO THE LOCKED PRIVATE BEDROOM OF Mr. McMILLAN INSIDE HIS AND HIS ROOMMATE'S TWO-BEDROOM, TWO-BATHROOM, RENTAL APARTMENT UNIT IN NORTHWEST AUSTIN


(The following initial report from the Austin Police Department Officer Andrew Brotherman, Badge Number 6856, was publicly released by APD on September 20, 2016, among 136 total pages of legal documents that APD mailed that day to public-information requestor and private citizen John Kevin McMillan of Austin, Texas. The documents were publicly released in response to APD public-information request 9-17932. In that September 15, 2016-dated e-mail request, Mr. McMillan had specified in writing to APD that he exclusively sought documents from APD in the period ever since 12:01 a.m. April 17, 2011, that referred to Mr. McMillan being a victim of either a possible or actual continuous crime or an alleged possible or actual federal crime.

(THE TERM 'EDP', BELOW, IS AN APD ABBREVIATION FOR 'EMOTIONALLY DISTURBED PERSON'. OFFICER BROTHERMAN IN THIS APD REPORT CHOSE NOT TO MENTION THAT COMPLAINANT JOHN KEVIN McMILLAN IS DEPENDABLY CIVIL AND LAW-ABIDING AND GAINFULLY EMPLOYED AND NOT UNDER PSYCHIATRIC CARE; HAS NOT CONSUMED ANY--OR BEEN REQUIRED TO CONSUME ANY---PSYCHIATRIC MEDICATIONS ON ANY OCCASION IN THE MOST RECENT 25-YEAR PERIOD; AND DOES NOT HIMSELF HAVE ANY CRIMINAL-CONVICTION RECORD. --- jkm)

"On 5/11/16 at approximately 8:58 pm I, Ofc Brotherman #6856, responded to a Burglary Service call at 10926 Jollyville Rd #902. The call text stated a 'BOR' has been going on since September of 2015...it appears a bedroom door was 'jimmied' and unauthorized entry was made...complainant states his roommate's door is 'fine'. Upon arrival, I made contact with the complainant:

"John McMillan W/M 4/27/57

"John, who has been documented EDP/Mentally Unstable and has quite an extensive involvement with APD, pointed out that there is a slight gap between the door and door frame of his bedroom. He believed someone broke into his room, although he did not advise of anything missing.

"The door actually appeared to be warped at the top, which would be the reason why there is a slight gap. I observed no evidence of the door being forced open by any means.

"John also stated he sometimes hears 'giggling and music' from a neighboring apartment late at night, which he thinks is 'odd'.

"John was provided with this case number.
