'Texas Commission on the Arts' Deputy Director Jim Bob McMillan to Me on May 5, 2009: Our State Government Agency in Austin Has No Records That Refer To You

It seems like only yesterday when I exchanged e-mails in April and May of 2009 with "Texas Commission on the Arts" state agency Deputy Director Jim Bob McMillan.

Jim Bob McMillan, who is apparently not related to me in any way, indicated to me in writing on May 5, 2009, that with the exception of the text of  my April 25, 2009, Open Records Request (last item, below) to his state agency in Austin, his State of Texas agency had no documents on file that  referred to me in any context.

Dear Mr. McMillan,

I apologize to you for sending you this belated follow-up letter in response to the actual text of your reply  E-mail letter (see below) to me that was dated May 5, 2009.

My follow-up question to you today is simply this:

Mr. McMillan, would you be willing to please clarify a portion of your May 5 reply letter to me by stating your reply to me in the correct style in accordance with the Texas Open Records Act.

I would appreciate your stating to me whether you do (or do not) have any documents or any other items that are responsive to any or either portion of my April 25-dated Open Records request to your state agency in Austin.

Thank you in advance for your very helpful reply note about this one additional point that I would like to respectfully raise at this time.

Sincerely and Best Wishes,

John Kevin McMillan,

Dear Mr. McMillan,

This is a Texas Open Records request in which I seek to obtain from your State of Texas agency in Austin a photocopy of any and all letters, reports, memoranda, computer records, E-mail correspondence, handwritten notes, printed documents, legal actions, available transcripts of audiotapes or videotapes, telephone records, or any other items, that refer to myself, John Kevin McMillan, in any context or any way, and that, in each such case:

(1) at any time since January 1, 1997, were received or produced or generated or compiled or stored or sent or authored or written by any employee or official employed in the office of the Executive Director of the Texas Commission on the Arts state agency, including the Executive Director himself;

(2) contained or referred to actions taken or to items for planned discussion or to proposed action that had been placed on the agenda of any of the Texas Commission on the Arts meetings----including any items discussed or acted upon during any executive sessions of that commission-----that were held at any time since January 1, 1997.

My legal name is John Kevin McMillan.  I was born at Lincoln, Nebraska, on April 27, 1957. My social security number is....

I have resided in Austin proper ever since mid-March of 1997, most recently.

I am submitting this Open Records request to your state agency partly because I have heard numerous  rumors in Austin that some State of Texas agency has reportedly had some alleged involvement in alleged impingements upon my own privacy rights, such as through alleged electronic surveillance or alleged audiotaping or alleged videotaping of myself, or through alleged verbalized communications to myself or alleged "educational services" inflicted on myself or alleged noise pollution and verbal harassment and verbal abuse inflicted on myself against my wishes that I definitely do not want or need.

I myself am not employed by or affiliated with any arts and entertainment institution or organization or any arts-and-entertainment business entity, as I'm sure your state agency is already very aware.

Thank you in advance for your prompt and very diligent response to this Open Records request from myself.

Sincerely and Best Wishes,

John Kevin McMillan,
