AUSTIN POLICE DEPARTMENT (APD) ON MARCH 7, 2016, DENIES IN WRITING THAT APD's NUISANCE ABATEMENT UNIT HAS EVER INVESTIGATED ANY CASE AT WIND RIVER CROSSING APARTMENTS IN NORTHWEST AUSTIN, WITH APD ADDING THAT ITS NUISANCE ABATEMENT UNIT HAS NEVER AT ANY TIME INVESTIGATED AUSTIN RESIDENT JOHN KEVIN McMILLAN, EITHER




(Editor's Note: Among the categories of illegal activity at an apartment complex or private residence or business of any kind or motel or any other property in Austin, Texas, for which APD's Nuisance Abatement Unit has legal authority to investigate, are: sexual assault; prostitution; organized crime activity; trafficking of persons; illicit-drug activities; aggravated assault; robbery; gambling; the unlawful carrying of a weapon; and the discharge of a firearm. The APD Nuisance Abatement Unit can pursue legal action that results in the closing of a property for 12 consecutive months that was determined to not be in compliance with the law in one or more of those cited categories. --- jkm)

The Nuisance Abatement Unit advises: “There has never been a nuisance abatement case for the address of 11411 Research Blvd, the Wind River Crossing Apartments. In regards to Mr. McMillan himself, the nuisance abatement unit has never investigated him.”

Dear Public Information Coordinator for the Austin Police Department in Austin, Texas,

This is a Texas Open Records request in which I seek to obtain from the Austin Police Department any and all letters, reports, memoranda, findings, E-mail communications, phone messages, and other legal documents that any employee or officer or official of the APD Nuisance Abatement Unit wrote or issued or received or generated or forwarded or sent or mailed at any time since 12:01 a.m. April 17, 2011, and that in each such case, refers in any way to myself, John Kevin McMillan of Austin, or to any building or unit at Wind River Crossing Apartments, or to that apartment complex, or to any property owner of Wind River Crossing or any member of the management team or maintenance team or a security guard for Wind River Crossing Apartments or anyone else employed at Wind River Crossing Apartments, or to any cited tenant or visitor or intruder or trespasser at Wind River Crossing Apartments.

That apartment complex is located at 11411 Research Boulevard, Austin, Texas, 78759. That apartment complex either has been or currently is reportedly owned by a Dallas-based nationwide for-profit realty corporation, Westdale.

I myself resided at Wind River Crossing as an official apartment-management-team-approved tenant there from August 2001 through July 29, 2015.

I resided in Apartment 325 of Building 3 at Wind River Crossing from January 2002 through July 29, 2015. I moved out of Apartment 325 at Wind River Crossing on July 29, 2015, after I received a prior official written notice from that apartment complex's general manager, Ann Coker, which stated that my and my one total official roommate's lease agreement with Wind River Crossing had not been renewed. Ms. Coker also informed me in person inside her manager's office that there had not been any violations of the lease agreement by myself, or by my apartment-management-team-approved one total official roommate, Mr. "John Douglas Martin" his cited legal name.

This public-information request was prompted by a December 2011 intra-office memo by Norma Hilbig of the Travis County District Attorney's Office Strategic Prosecution Division in which she stated in writing to her colleague Dayna Blazey that Ms. Hilbig had spoken with Rick Shirley in regard to crime reports that I myself as a tenant had sent to the District Attorney's Office and the Austin Police Department. Ms. Hilbig also stated in writing that she had sent to Rick Shirley some copies of my letters of complaint as a tenant at Wind River Crossing from that approximate time period.

I obtained a copy of that memo from Norma Hilbig to Dayna Blazey through a public-information request I submitted in a recent prior year to the Travis County District Attorney's Office in Austin.

I have since learned that Rick Shirley is currently employed as a sergeant for the Austin Police Department Nuisance Abatement Unit.

Thank you in advance for your prompt reply letter providing me with any and all responsive documents.

Please let me know as soon as possible if you anticipate that you plan to charge me more than $20 for the administrative costs you incur from responding to this public-information request from myself. That information will then enable me to consider narrowing the scope of this public information request, in order to minimize the processing fee I incur from submitting this request to your municipal law-enforcement agency in Austin.
