Subject: TX Sec of State cites 'atty-client privilege' in seeking OAG OK on withholding docs from me that refer to me

(The following is the verbatim text of the 3-page signed legal letter from the General Counsel of the Texas Secretary of State to the Office of the Attorney General of Texas in response to my September 27, 2021, e-mail public-information request to that state agency in Austin. As the requestor, I obtained a  courtesy-copy of this lengthy legal letter through one of the attachments accompanying an e-mail letter (below) that was sent to me on October 18, 2021, by Jennifer Williams, Legal Assistant to the very honorable General Counsel for the Texas Secretary of State, Mr. Adam Bitter. Please note that I have taken the liberty of bold-facing and increasing the type size for a key paragraph in Mr. Bitter's signed legal letter to Texas Attorney General Ken Paxton that directly refers to me by my first and last name. 

My public-information request to the Texas Secretary of State state agency was: "This is a Texas Open Records request in which I seek to obtain from you a copy of any and all e-mail communications or other written communications referring at least once in any manner to myself or to my 'Progressive Prohibitionist Religion', that at any time since January 1, 2011, were authored, typed, handwritten, sent, received, mailed, forwarded, e-mailed, or FAXed by the General Counsel for your state agency or by any other attorney or staff member or administrator in your state agency's Office of the General Counsel."

Dear General Paxton:

On Saturday, September 25, 2021, the Office of the Texas Secretary of State (“Office”) received
a written request for information (“Request”) from John McMillan (the “Requestor”) under the
Public Information Act, Chapter 552 of the Texas Government Code (the “PIA”). A copy of the
Request is attached as Exhibit A. A statement regarding the date of receipt is attached as Exhibit
B.

The Requestor seeks certain communications involving Secretary of State employees over a
specified date range. See Exhibit A. On October 11, 2021, we produced some responsive
information to the Requestor. We intend to provide additional responsive documents to the
Requestor today. The Office asserts that other information responsive to the Request is excepted
from public disclosure under Section 552.107 of the Texas Government Code. Thus, we are
requesting a ruling regarding the release of these records.(footnote 1) (Footnote 1:)  
To the extent that we can segregate responsive information for which we are not asserting any confidentiality
exception, we will produce such information to the Requestor.


SECTION 552.107 OF THE TEXAS GOVERNMENT CODE

The Office contends that certain information responsive to the Request should be excepted from
public disclosure pursuant to Section 552.107 of the Texas Government Code. Section 552.107
provides that “[i]nformation is excepted from the requirements of Section 552.021 if: (1) it is
information that the attorney general or an attorney of a political subdivision is prohibited from
disclosing because of a duty to the client under the Texas Rules of Evidence or the Texas
Disciplinary Rules of Professional Conduct; or (2) a court by order has prohibited disclosure of
the information.” Tex. Gov’t Code § 552.107(1).

Relevant here, Texas Rule of Evidence 503 encompasses the attorney-client privilege. The
Attorney General has determined that “information that is protected under Texas Rule of
Evidence 503 is excepted from disclosure under section 552.107(1).” Open Records Decision
No. 676 at 4 (2002). Rule 503(b)(1) provides:

  
A client has a privilege to refuse to disclose and to prevent any other person from
disclosing confidential communications made to facilitate the rendition of
professional legal services to the client:
(A) between the client or the client’s representative and the client’s lawyer or
the lawyer’s representative;
(B) between the client’s lawyer and the lawyer’s representative;
(C) by the client, the client’s representative, the client’s lawyer, or the
lawyer’s representative to a lawyer representing another party in a pending
action or that lawyer’s representative, if the communications concern a matter
of common interest in the pending action;
(D) between the client’s representatives or between the client and the client’s
representative; or
(E) among lawyers and their representatives representing the same client.

Tex. R. Evid. 503(b)(1). Rule 503 further provides that “[a] communication is ‘confidential’ if
not intended to be disclosed to third persons other than those: (A) to whom disclosure is made to
further the rendition of professional legal services to the client; or (B) reasonably necessary to
transmit the communication.” Id. R. 503(a)(5). So, to withhold information under Section
552.107 as subject to attorney-client privilege, the governmental body must: (1) show that the
document is a communication transmitted between privileged parties or reveals a confidential
communication; (2) identify the parties involved in the communication; and (3) show that the
communication is confidential by explaining that it was not intended to be disclosed to third
persons and that it was made in furtherance of the rendition of professional legal services to the
governmental body. See Open Records Decision No. 676 at 6-8; accord OR2021-12471 at 2-3.

The Request encompasses certain internal communications between the Secretary of State’s
General Counsel (the undersigned, Lindsey Wolf, and Carmen Flores) and non-attorney
employees of the Office, as well as an internal memorandum prepared by the General Counsel.
Specifically, the responsive information includes documents reflecting the provision—or a
request for the provision—of legal advice by the Secretary of State’s General Counsel regarding
the agency’s review and processing of correspondence sent by the Requestor to the Office.

These communications were made in furtherance of the rendition of professional legal services
to the Office. The communications were not intended to be disclosed to third persons; nor have
such communications been disclosed publicly. Each of these communications satisfies the
requirements of Texas Rule of Evidence 503 and is thus entitled to protection under Section
552.107(1). See, e.g., OR2021-12471 at 2-3; OR2021-03191 at 3-4; OR2020-24447 at 3-4.

Exhibit C contains the responsive information that the Office asserts is excepted from public
disclosure pursuant to Section 552.107, as reflected by the Office’s notations on the documents.

For the reasons stated above, the Office asserts that certain information responsive to the Request
is excepted from disclosure under the Public Information Act. Accordingly, we are requesting a
ruling from the Attorney General regarding the release of these records. The responsive
information that the Office seeks to withhold is attached as Exhibit C.

This is a Texas Open Records request in which I seek to obtain from you a copy of any and all e-mail communications or other written communications referring at least once in any manner to myself or to my "Progressive Prohibitionist Religion", that at any time since January 1, 2011, were authored, typed, handwritten, sent, received, mailed, forwarded, e-mailed, or FAXed by the General Counsel for your state agency or by any other attorney or staff member or administrator in your state agency's Office of the General Counsel.

My legal name is John Kevin McMillan. My date of birth is April 27,1957. I was born in Lincoln, Nebraska. I am a single adult gainfully-employed white Anglo-Saxon non-Hispanic gentleman of English, Scottish, and German ancestry.

I currently reside at a large gated-community apartment complex, Pebble Creek Apartments, 8805 North Plaza Drive in northeast Austin.

I have been and continue to be gainfully employed as a non-managerial staff member at one or more  restaurant workplaces in the Austin area of Texas on a continuous and uninterrupted basis ever since April 27, 2002.

 I lead a permanently drinking-alcohol-free (ever since 1990), permanently marijuana-free (ever since 1984), lifelong-illicit-drug-free in regard to any and all illicit drugs other than marijuana,  lifelong-tobacco-free, lifelong-non-vaping, dependably civil and law-abiding and honest and vigilant, non-sadomasochistic and anti-S&M, non-gambling, non-pranking (I am VERY opposed to pranksterism and fraudulent communications and criminal mischief), lifelong-tattoo-less and anti-tattoos-minded, permanently jewelry-less, clean-talking (no profanity by me in my everyday conversations with others), platonicly polite lifestyle. I strongly oppose "thought-control projects" and I take pride in being privacy-respectful. I myself DO NOT generate any anonymous communications that are inflicted on anyone else in a context that violates or impinges on their own privacy rights. I oppose verbal harassment of or by anyone.

I am the founder and only approved current member of the non-Christian, factually-focused and public-safety-minded, non-proselytizing Progressive Prohibitionist Religion---a new "Honor Society" religion with very stringent membership-eligibility requirements. That only religion of mine was registered with your state agency in 1996, when I resided in Denver City, Texas. However, I later chose not to renew my registration with your state agency. I have made that decision because I am the only approved member, and because I want to wait until I enjoy fuller privacy rights in my own life for a reasonable duration of time before I am willing to even consider permitting any other person to apply for possible membership in my new religion.

I am a recent criminal-law complainant in APD Alleged  Sex Crimes and Alleged Home Invasion Crimes Case 2021-0830533----an APD crime case that was activated by APD on March 24, 2021. 

I am also a current criminal-law complainant in APD Sex Crimes Case 2021-2440624, a new and currently active APD Sex Crimes and alleged Home Invasion Crimes case that was opened by APD on September 1, 2021.  An APD-authorized DNA-swabs forensic sexual-assault-evidence medical exam was performed on me by a female forensic nurse for Austin SAFE Alliance in the early morning hours of September 2, 2021, inside the ER of Dell Seton Medical Center at The University of Texas, in central Austin.
