Dear Utah State House Majority Leader Mike Schultz,
I would like to thank you again for having sent me a December 6, 2023, reply letter inviting me to share with you concerns of mine about Utah.
I am concerned about the likelihood that the apparent current absence of any regulation of tattoo parlors in Utah by the State Government of Utah may be harmful to the medical and emotional health of many Utahns and visitors to our state.
Above is an online link to a copyrighted May 17, 2023, report by the American Red Cross. That report is entitled "Can I Donate Blood If I Have a Tattoo or Body Piercings?"
Some key statements from that report:
"Tattoos and Blood Donation
"In most states, a tattoo is acceptable if the tattoo was applied by a state-regulated entity using sterile needles and ink that is not reused. The same goes for cosmetic tattoos (including microblading of eyebrows only): if they were applied in a licensed establishment in a regulated state using sterile needles and ink that is not reused, then they are acceptable.
"If you received a tattoo in a state that does not regulate tattoo facilities, then you must wait three months after it was applied. Currently, the only states that DO NOT regulate tattoo facilities are District of Columbia, Georgia, Idaho, Maryland, Massachusetts, New Hampshire, New York, Pennsylvania, Utah and Wyoming."
That report apparently indicates that anyone in Utah who recently obtained a tattoo in the "Beehive State" must wait three months after the date of that tattoo before he or she might possibly be permitted by the American Red Cross to donate blood to that non-profit organization.
There may be a legal liability incurred by the State Government of Utah from the current absence of a State of Utah-certified assurance that only sterile needles are being used by respective tattoo parlors in Utah for customers requesting to be tattooed on their own body inside a tattoo parlor in our state.
There may also be a legal liability to the State of Utah from the current absence of an official State Government of Utah certification that the ink being used by each tattoo parlor in Utah is "not reused" ink.
Lengthy delays on the ability of Utahns who have a new tattoo on their body to donate blood to the American Red Cross during a major medical crisis in our state, such as might occur from a major storm or earthquake, could be potentially disastrous for Utah and Utahns.
House Majority Leader Schultz, I would like to also point out that the apparent decision by the Utah Legislature not to impose prohibitions on emblazoning of tattoos on any particular specified organs or specified body parts of Utahns or visitors to Utah may also be endangering the medical health of Utahns and visitors to the our state.
