To: Ms. June B. Harden, Assistant Attorney General of Texas, Assistant Public Information Coordinator, Office of the Attorney General of Texas, Austin.
Thank you for your prompt reply letter to me today (directly below) that was in response to the following (last item, below) August 26, 2021-dated and later re-sent-on-August 27 public-information request from me to your correct official e-mail address for receiving Open Records requests.
"Excluded from the scope of this public-information request are any and all e-mails that were written by myself or e-mailed by myself to your state-government agency in Austin...."
Assistant Attorney General Harden, I was very surprised and disappointed by your statement to me today that your law-enforcement-minded state agency in Austin does not have any legal documents generated by any applicable staff member, investigator, or official of your agency that are responsive to the above-cited request for information.
I would like to respectfully remind you that on September 23, 2020, you wrote and sent me a reply letter (below) stating that at that time you had several or more documents not authored by me that were responsive to my information request you had received on September 11, 2020, that sought a copy of "any and all written communications referring to me at least once in any manner, including any and all e-mail communications or reports fitting that description, that certified peace officer Captain Gregory Lucas of your state agency's Criminal Investigation Division or David Maxwell, Director of Law Enforcement for your state agency, wrote or received or sent or mailed or e-mailed at any time since 12:01 a.m. April 28, 2011. Excluded from the scope of this request are any e-mails that I myself exclusively wrote...."
Your September 23, 2020, reply letter to me (directly below, for opening text) requested in writing that I pay you in advance an estimated financial amount of "$144.00" in exchange for your providing me with responsive legal documents.
Your September 23, 2020, official reply letter to me---which specifically at the end of that letter cited yourself as the author of that legal letter----had begun with the following initial paragraphs:
"Ken Paxton
"Attorney General of Texas
"Post Office Box 12548,
"Austin, Texas 78711-2548
"September 23, 2020
"John McMillan

"VIA E-MAIL ONLY RE: Public Information Request No. R005497
"Dear Mr. McMillan:
"This letter is in response to your public information request to the Office of the Attorney General (“OAG”), received by the OAG on September 11, 2020.
"The OAG maintains information responsive to your request. Much of the responsive information has been archived offsite. Other records contain confidential employee user IDs that must be redacted before the records can be released to you. 1 (footnote):
"1 (footnote) Please note, upon payment, the OAG will seek a ruling to withhold additional information from disclosure.")
Under the current OAG Cost Rules, the estimated personnel time to locate, compile, redact, and reproduce this information is $15 per hour for 8 hours ($120.00). The overhead charges are 20% of the personnel charges ($24.00). Because this information will be produced electronically, there are no postage or materials charges. The total estimated cost due for this information is $144.00. Thus, your request triggers section 552.2615 of the Government Code, as well as section 552.263 of the Government Code...."
Assistant Attorney General Harden, today I would like to point out that the scope of my current public-information request might possibly include some or several of the documents that were responsive to the request of mine you received from me on September 11, 2020. I may have enough money in my personal checking account today to pay your state agency in Austin for any and all documents you might ever identify that you determine to be responsive to my most recent PIR that you received on August 27, 2021.
Best Wishes,
John Kevin McMillan, current criminal-law complainant in APD Case 2021-2440624, a new APD Sex Crimes case that was activated by APD on September 1, 2021, and was accompanied by a forensic DNA-swabs sexual-assault-evidence medical exam on me by a female forensic nurse that concluded at 1:56 a.m. today (September 2, 2021) inside the Emergency Room of the Dell Seton Medical Center at The University of Texas, located at the intersection of Red River Street and West 15th Street in downtown Austin.
