Howard, This is a Texas Open Records request in which I seek to obtain from yourself a photocopy of any and all handwritten notes, typed notes or other notes, printed documents, letters, memoranda, reports, E-mail correspondence, computer records, transcripts of court records, official government documents, legislative proposals or resolutions or bills before the Legislature on file with your office, or any other items of any type received or generated or written or noted or authored or stored or mailed or sent or E-mailed by yourself, Rep. Howard, or by any member of your own Legislative staff, at any time since February 1, 2006, and that, in each such case, refers at least once to either myself, John Kevin McMillan of Austin, in any manner or any context, or to my one-member (myself only, at present) and fully independent, non-Christian, and alcohol-free Progressive Prohibitionist Religion, in any manner or any context. Specifically EXCLUDED from the scope of this public-information request are any and all items that were authored or written solely by myself, John Kevin McMillan. NOTES OF YOURS RELATING TO MYSELF MIGHT INCLUDE NOTES TAKEN BY ANY STAFF MEMBER OF YOURS IN RESPONSE TO ANY OF THE NUMEROUS POLITE PHONE CALLS I HAVE MADE TO YOUR LEGISLATIVE OFFICE IN AUSTIN IN RECENT YEARS, OR, FOR THAT MATTER, NOTES SENT TO YOUR LEGISLATIVE OFFICE BY PERSONS OR OFFICIALS OTHER THAN MYSELF, AND THAT REFER TO MYSELF OR MY RELIGION IN ANY WAY. My legal name is John Kevin McMillan. I was born in Lincoln, Nebraska, on April 27, 1957. My social security number is: .... I was raised in Westlake Hills, Texas, for all but approximately three years of my youth. I am an alumnus of Eanes Elementary School of Eanes Independent School District and of Stephen F. Austin High School of Austin Independent School District, respectively. I am also an alumnus of The University of Texas at Austin. I have resided alone in the same private residence in northwest Austin during the entire multi-year time period in which you have served thus far in the Texas Legislature. In fact, I have resided in Austin proper on a continuous basis ever since mid-March of 1997, most recently. I am a consistently civil and honest and law-abiding, non-stalking, vigilant and law-enforcement-minded, permanently illicit-drug-free, never-previously-addicted, and anti-drug; lifelong tobacco-free and anti-tobacco; alcohol-free, never-previously-addicted, and anti-alcohol; non-sadomasochistic and anti-S&M; non-pranking and anti-prank-minded; non-gambling and anti-gambling; tattoo-less and anti-tattoo; HIV-negative; fully ambulatory, medically healthy, disease-free, psychologically healthy, clean-talking and anti-profane-speech and platonically polite, people-friendly, idealistic; facially cleanshaven, single adult male constituent of yours. I am a staunch opponent of intergenerational exploitation of younger persons, including adult younger persons; and I also strongly oppose the sex crimes of pederasty and of sexual prostitution. In addition, I strongly support proposed legislative revision of our state's penal code in Texas to include attempted homicide among the very sinister and violent felony crimes for which a proposed court-ordered capital punishment of an individual convicted of that heinous and unconscionable crime could also, in fact, be legally and in a civil manner authorized by state law in Texas. Rep. Howard, I wish to politely emphasize to you that I myself have no criminal-conviction record, and, as you may already also be very aware, I am among the most civil and conscientious and honest and vigilant of all of your own single adult male constituents in all of Central Texas. I would also like to again remind you today that although I have a Master's Degree in Journalism, I myself have never earned as much as $20,000 in total overall gross annual employment-derived income for any calendar year of my entire life thus far. Among the insights I hope to glean from your response to this Open Records request are: ---State Rep. Howard, what might explain why you have chosen thus far to not volunteer to me any factual information or hunches of yours in regard to who or what might be blameworthy for circumstances in my own life in Austin, Texas, that you yourself may regard as being unjustifiably cruel or injurious or sadistic toward myself. --Is there any evidence of possible alleged employment discrimination or any other form of discrimination against myself or alleged persecution of myself in Austin, Texas, at any time since you first assumed office as a member of the Texas Legislature in 2006. --As the primary state legislator representing me in the Texas House, are you aware of any restrictions upon my own privacy rights in any context that were ever at any time authorized by the Texas Legislature or any State of Texas official or any State of Texas-owned institution. ---Rep. Howard, were you aware that the General Counsel of the Texas A&M University System, Mr. Delmar Cain, did several years ago write an entire memorandum, a photocopy of which I was later provided by his university, in which that Texas A&M official explored the question of whether Texas A&M University System could provide me with legal assistance of any type in response to politely verbalized complaints of mine I'd politely shared with that State of Texas-owned university system in College Station about alleged unwanted obscene communications allegedly victimizing myself, John Kevin McMillan, in Austin, Texas, during that time period. --As a state lawmaker, do you seek to help protect the privacy rights and other legal rights of all of your law-abiding adult constituents, even if their own political and religious beliefs and personal beliefs happen to be very different from your own? ---Are you as my duly elected state lawmaker aware of any possible outside interference or medddling in my own life or life circumstances by any government-owned or government-sponsored or government-affiliated institution of any type, or by any individual, who or that is situated in or operating in or evidenced in the Austin area of Texas. --Do you concur with the decision made by Travis County District Attorney Ronald Earle in January of 2006 to formally establish an official pre-prosecution criminal-law file on my own behalf, a file strictly for my own benefit, in the Strategic Prosecution Division of the DA's Office, with DA Earle's stated intention being to himself at some future time consult that criminal-law file and make use of it in filing formal criminal-law charges in a court of law in Austin, Texas, shortly after himself learning that I myself, John Kevin McMillan, was or am ever myself reportedly victimized by a felony crime. ---Have you yourself ever expressed any concern about alleged year-round or frequent noise pollution injurious to myself and my own auditory medical health in Austin, Texas, that an ear, nose and throat specialist, Dr. David Tobey, has officially determined to have occurred based on in-person medical examinations of myself over a multi-year period inside his medical clinic in northwest Austin. ---Do you agree with the statement made to me in a recent prior year (2000 or 2001) by a magazine journalist in Austin, in which that very influential gentleman journalist stated to me over the telephone during a local phone call I made to his downtown-Austin magazine office from my state agency workplace in northwest Austin, that "an unethical (sic) media (sic) company (sic) may be harassing (exact quote) you (John Kevin McMillan) in Austin these days." ----What has been your own response to the information I've shared with you via the E-mail about myself having formally filed respective civil-law and criminal-law legal complaints on my own behalf against "The Austin American-Statesman" and its parent company in Atlanta, Georgia, through the Office of the Attorney General state agency's Consumer Protection Division in Austin and, more recently, through the Austin Police Department law-enforcement agency. ---As a very influential state legislator, do you know what prompted my biological sister, Mrs. Julie McMillan Lechtenberger of the Houston area, to state to me over the telephone in 1999, this in possibly our last-ever telephone conversation (a long-distance phone call I made to her and her attorney husband's residence from my apartment unit at that time a few blocks from UT-Austin), that "I've (Julie McMillan Lechtenberger) never denied that you (John Kevin McMillan) are hearing actual, verifiable, anonymous voices (exact quote) in Austin. However, that should not affect your financial earnings capacity. If you lose a job, you can find another job." ----Do you as a very influential state legislator suspect that any person or persons about whom you are yourself aware have allegedly violated my own legal rights through verbal harassment of myself; alleged stalking of myself; allegedly illegal communications to myself in any context; alleged anonymous communications to myself that I did not authorize; alleged character assassination of myself; alleged libeling of myself; alleged verbalization of harmful-intent threats or verbalized death threats to myself in any context; alleged fraudulent or deliberately dishonest verbalized communications to myself; or alleged fraudulent medical care services to myself, for instance. ---Does it surprise you, State Rep. Howard, to learn from myself today that some very influential Texas Republican Party officials, including widely-respected State Republican Executive Committee Members Ms. Jan Galbraith and Mr. Brian Russell of the Austin area, each wrote and sent me polite E-mail letters in a recent prior year that urged me to be persistent about myself asking Texas Governor Rick Perry in writing to please send me a formal reply letter in response to my gubernatorial campaign question in which I had merely asked Governor Perry if he believes state law in Texas currently adequately protects a resident of Texas (myself, for instance) against any scenario of that individual (myself, for instance) being subjected against his wishes to a deplorably sinister and violent and flagrantly illegal would-be
"snuff movie" production or actual "snuff movie" production in Austin, Texas, or elsewhere in Texas. ----State Rep. Howard, do you have any reason to suspect that any political party or religious group or civic group or business entity at any time since February 1, 2006, has allegedly violated my own privacy rights or allegedly stolen intellectual property of mine or otherwise wronged me in any way? ---As a state legislator, have you observed any evidence indicating that any resident or residents or group of residents of your Central Texas district, or any institution or media company situated in the Austin area, has ever publicly criticized myself, John Kevin McMillan, in any context, or has reportedly somehow exhibited a failure to fully acknowledge that I myself am consistently civil and law-abiding and non-pederastic, morally and aesthetically straight and gentlemanly, single and adult, gainfully employed, masculine, conscientious, honest, psychologically and medically healthy, disease-free, HIV-negative, hygienic, good-looking, creatively talented, intelligent, and industrious. ---As a state legislator, have you observed any evidence in support of the grim oral statement made to me over the telephone in latter 2001 by Travis County Civil Probate Division Director David Ferris, this in a local phone call I made to his Travis County Government office in downtown Austin from my private apartment residence in northwest Austin, that "there appears to be an effort by a lot of people to drive you (John Kevin McMillan) out of the Austin area." ---Have you opposed any attempt of which you may be aware to censor myself and my own political and religious beliefs in any way, or to subject me to any form of "brainwashing" or "hostage-taking" or "entrapment" in Austin, Texas, that I definitely have never requested at any time, and that might have possibly been orchestrated by gay militants, lesbian militants, a militant gay professor, transsexual militants, Metropolitan Community Church activists, a gay media company, effeminate male adult militants, bisexual adult male militants, Quaker activists, opponents of court-ordered capital punishment, vigilante groups, anarchist groups, atheist groups, communist groups, socialist groups, Unitarian activists, Christian activists, a possible Judaistic or Jewish or Hispanic or African-American group, or some other group of persons that has been described by one or more persons as being allegedly censorious toward myself in a cited context. ---As a state legislator, are you aware that one or more of the persons whom I have myself already rejected from my own life in a law-abiding and civil manner, may have possibly exhibited a defiance of my own legal right to enjoy a current and future life that lawfully and permanently excludes that cited person from my life and life circumstances. --As a state legislator, are you aware that the law-abiding form of heterophilia and accompanying pro-masculine-and-cleanshaven male adult affinity that I myself exhibit in all aspects of my own platonic life is, in fact, Constitutionally and legally protected by the U.S. Constitution and American legal system. ---As a state legislator, are you aware that the new religion I have myself established, the Progressive Prohibitionist Religion, assigns top priority to helping to comprehensively befriend any and all Americans under age 30 who, during that period of their lives, are residing in the same private residence with their parent or parents. ---As a state legislator, are you aware that my legal right to myself lawfully and in a civil manner exclude from my own life any and all homosexual adult male, gay adult male, effeminate adult male, facially hairy adult male, bisexual adult male, lesbian adult female, transsexual adult persons, and bisexual adult persons, and all adult illicit-drug-addicts of the present, if I so decide, is fully protected by the American legal system and U.S. Constitution. ----As a state legislator, do you have any reason to suspect that the "anti-straight" community in Austin, and I am of course including in that group the community of Austinites who seek to have consumption of illicit drugs legalized, or the organized-crime underworld of Austin, including the prostitution-ring underworld, for instance, has possibly targeted me for any form of harassment or stalking or abuse or conduct injurious toward myself in any context.
