Open Office of Injured Employee Counsel state agency Open Records Coordinator,
This is a Texas Open Records request in which I seek to obtain from your very influential state agency in Austin a copy of any and all e-mails or other written communications referring at least once in any manner to myself, John Kevin McMillan of Austin, that were authored, typed, produced, sent, forwarded, mailed, e-mailed, FAXed, or received at any time since April 1, 2011, by your state agency's Public Counsel, Deputy Public Counsel, General Counsel, Assistant General Counsel, or Legal and Staff Services Manager, or by any staff member under the direct supervision of any of those high-ranking officials for your state-government agency.
Your state agency's current highly-esteemed Legal and Staff Services manager is reportedly Kathleen Contreras. Her office phone number is: (512) 804-4194. Her official e-mail address at your state agency is "kathleen.contreras@oiec.texas.gov".
My legal name is John Kevin McMillan. I was born on April 27, 1957, in Lincoln, Nebraska.
I am a former salutatorian of Stephen F. Austin High School of Austin ISD here in this state-capital city for Texas. I am the founder and only current approved member of a new and non-Christian, factually-minded and implicitly-deistic, permanently drinking-alcohol-free religion, the Progressive Prohibitionist Religion---a religion with very stringent membership-eligibility requirements. I am a lifelong single gentleman, and I am Anglo-Saxon in ancestry. I have been and continue to be a resident of Austin on a continuous and uninterrupted basis ever since mid-March 1997.
I lead a permanently drinking-alcohol-free (ever since the late summer of 1990), lifelong-tobacco-free and anti-tobacco-minded, lifelong-non-vaping, permanently marijuana-free (ever since the late fall of 1984), lifelong-illicit-drug-free in regard to any and all illicit drugs other than marijuana, lifelong-tattoo-less and anti-tattoos-minded, facially-cleanshaven (no beard, no mustache, no goatee) and anti-facial-hair-minded, permanently-jewelry-less, consistently clean-talking (no profanity verbalized by me in my everyday conversations with others), non-gambling, dependably civil and law-abiding and very honest and conscientious and vigilant, pro-law-enforcement, public-safety-minded, healthful-living-minded, gainfully-employed lifestyle.
Ever since June 21, 2019, I have resided alone as the rent-paying only official tenant and the only apartment-management-team-approved occupant in an always-bolt-locked efficiency apartment unit at a very large gated-community apartment complex in northeast Austin, Pebble Creek Apartments, 8805 North Plaza Drive. I am a longtime celibate (including on a continuous and uninterrupted basis ever since the day I moved to north Austin in August 2001), single adult Anglo non-Hispanic gentleman. I always sleep alone on my bed. I might add with polite emphasis that I have never once permitted anyone but on-duty Austin Police Department officers or, on one total occasion, on-duty EMS staff members (shortly after I called 911 to complain about having vomited repeatedly inside my current unit), to enter or be physically present anywhere inside my current apartment unit anytime between the hours of 8 p.m. in the evening and 8 a.m. in the morning.
The apartment complex where I currently reside is located 5.1 miles in driving distance from the Texas Department of Public Safety state law-enforcement agency headquarters compound along North Lamar Boulevard. Even though I am a former full-time Texas DPS employee here in Austin, only one total DPS employee whom I can recall, Lt. Jesse Valdez of the Texas Rangers Division of the DPS, has ever directly contacted me anytime since April 1, 2011, in regard to my repeated crime reports to APD about my being victimized by alleged continuous daily and year-round home-invasion crimes and alleged continuous daily and year-round anal-rape-crimes and other personal-injury-crimes during my sleeping hours as I lay alone on my own bed inside my bolt-locked apartment unit.
My primary personal e-mail address, "mcmillanj@att.net", has remained the same throughout the entire 10-and-one-half-year period applicable to this public-information request. My landline phone number, (512) 342-2295, has remained the same throughout the entire 10-and-one-half-year period applicable to this public-information request. My cell phone number of (512) 993-7305 has been the same ever since the summer of 2019, when I became a cell phone owner and cell phone user for the first time ever.
I have resided at the following respective home addresses during the 10-and-one-half-year period applicable to this public-information request:
---Wind River Crossing Apartments, 11411 Research Boulevard, Apt. 325, Austin, TX 78759.
---Crossland Economy Studios, Extended Stay America, 12621 Hymeadow Road, Apt. 133, Austin, TX 78729.
---Village Oaks Apartments, 10926 Jollyville Road, Bldg. 9, Apt. 902, Austin, TX 78759.
---Village Oaks Apartments, 10926 Jollyville Road, Bldg. 16, Apt. 1609, Austin, TX 78759.
---Austin Motor Inn, 11400 North IH 35 (a hotel room I rented for one week in June 2019 until I had official prior permission from the Pebble Creek Apartments management team to move into my new rental-apartment unit at the cited date and time of noon on June 21, 2019), Austin, TX 78753;
and, ever since June 21, 2019, Pebble Creek Apartments, 8805 North Plaza Drive, Building 17, Apt. 2418, Austin, TX 78753.
One highly-regarded Ear, Nose, and Throat medical specialist whom I have consulted in Austin, Dr. David Tobey, stated to me in a recent prior year during a medical appointment I had with him that he believes that alleged home-invasion-crimes perpetrators inside my locked apartment unit at that time in northwest Austin had illegally subjected me to chloroform in my nostrils that held me unconscious during my sleeping hours as I lay alone on my own bed inside my locked apartment unit, Dr. Tobey helpfully volunteered.
The same Dr. Tobey earlier this century stated to me inside his medical clinic, then situated along Angus road in northwest Austin, that he believed that permanent damage to my own hearing capacity from continuous noise pollution in Austin that I myself had not generated and I myself was not blameworthy for, was comparable in magnitude to what an Austin Police Department officer sustains over the entire course of that APD officer's career, Dr. Tobey stated.
Dr. Tobey earlier this century signed a formal statement for me on his own initiative in which he stated that I had acquired a hearing-loss-related disability, in his stated opinion at that time.
I have been employed exclusively in the restaurant industry in Austin and nearby cities that included Round Rock and Cedar Park and possibly Pflugerville, on a continuous and uninterrupted basis throughout the entire 10-and-one-half-year period applicable to this public-information request.
One work supervisor of mine at Luby's Lakeline Cafeteria in far northwest Austin, Assistant Manager Israel Rios, a resident of the Cedar Park or Round Rock area of Williamson County, stated to me in 2011 or 2012 on a workday for me at that corporate-owned cafeteria at a time when Mr. Rios was on the on-duty-employee side of the serving line and I was either going through the line as a paying guest or walking through that area just before I began my evening-shift workshift that day: "It's obviously organized crime that is victimizing you (Luby's waitstaff employee John Kevin McMillan of Austin) inside your apartment unit during your sleeping hours" (approximate quote, with "it's obviously organized crime" being an exact quote of Mr. Rios's very helpful and courageous statement he volunteered to me at a time when he was officially on duty for Luby's Lakeline corporate-owned cafeteria. The Luby's Cafeterias restaurant chain during that time period was headquartered in Houston, Texas.
In a recent prior year, I filed a workers' compensation claim through an employer of mine relating to an incident in which I sustained a medical injury at a workplace on December 29, 2019.
In the 10-and-one-half-year period of this public-information request, I myself have undergone at least seven separate doctor-ordered medical surgeries on myself in several respective hospitals of Austin (including St. David's North Austin Medical Center, Seton Central Medical Center in central Austin, and Heart Hospital of Austin) for potentially life-threatening medical problems I had sustained.
One medical physician whom I consulted, Dr. Carson Higgs, a first-rate family-practice physician at Austin Regional Clinic Quarry Lake location, stated to me during a medical exam I had with him that sleep deprivation could have played a role in my having sustained damage to my circulatory system for which medical surgery was ordered by doctors. Ever since mid-April 2011, I have been awakened several times per night, in the middle of my nocturnal dreams, with anal pain or an unpleasant sensation in my anus, an unpleasant nasal-inhalant sensation in my nostrils even though I do not own or use nasal inhalants, often with a ringing sensation in my eardrums, an urgent need to urinate in my apartment's bathroom, pain in my legs or hips, and wobbliness in my legs as I walked to the bathroom. Because of mysterious pain in my body I had sustained during my sleeping hours, I often had difficulty falling back asleep after I walked back to my bed from the bathroom.
The most recent forensic DNA-swabs anal-rape-evidence medical exam on myself that was pre-authorized by the Austin Police Department Sex Crimes Unit occurred in the early morning hours of September 2, 2021, in the ER of Dell Seton Medical Center at The University of Texas, in central Austin. That rape-evidence kit was obtained from me at my request for APD Sex Crimes Case 2021-2440624. The first-rate APD Sex Crimes Unit Detective William Costello is the investigator for that personal-injury-crimes case. The APD direct-access phone number for Detective Costello is: (512) 974-4247.
My Wind River Crossing Apartments management-team-approved roommate from mid-April 2011 through the end of May 2011, Sandjaja Utama, a self-identified citizen of Indonesia and self-identified "member of the Catholic Church" and self-identified restaurant-industry busser, stated to me several times inside our apartment unit that his "auntie" was a medical physician named "Dr. Sheila Shung" who resides with her husband in Round Rock, Texas, Mr. Utama said.
Mr. Utama stated to me in May of 2011 that he himself was briefly interviewed by Austin Police Department Sex Crimes Unit Detective David Silva on the telephone during Mr. Utama's period of residence with me. That telephone interview took place after I filed a crime report with APD on April 28, 2011, for which APD's Sex Crimes Unit officially authorized a forensic DNA-swabs forensic sexual-assault-evidence medical exam on me for APD Case 11-1180447. That rape-evidence exam on me occurred on April 28, 2011, inside the St. David's Medical Center ER in central Austin. No criminal charges were filed by APD against anyone in that particular APD case. Detective Silva specifically stated to me that all of the results from DNA-traces processing of my rape-evidence kit for APD Case 11-1180447 were negative, Detective Silva said.
Thank you in advance for your prompt and helpful reply letter in response to this public-information request to your state agency.
Sincerely and Best Wishes,
My solo-occupancy efficiency rental-apartment-unit home address ever since June 21, 2019:
Pebble Creek Apartments (a large gated-community apartment complex that is reportedly managed by the Austin-based Belco Equities, Inc., a highly-regarded for-profit corporation with its headquarters at 505 East Huntland Drive in Austin, and for whom the first-rate President is Joslyn Domel and the highly-esteemed area supervisor is Cecil Domel. The owner of my current apartment complex is cited on my current six-month-period management-team-approved lease agreement --- an agreement that officially began on July 1, 2021 --- as "Pebble Creek Babay, Ltd., dba Pebble Creek Apartments" , reportedly an apparent "Limited California Partnership" with a primary agent for the owner maintaining a mailing address in Beverly Hills, California), 8805 North Plaza Drive, Building 17 (northeastern corner of complex), Apt. 2418 (a second-floor building on the eastern side of Building 17), Austin, TX 78753.
