Dear TDHCA Deputy General Counsel Pender in Austin,
Thank you for your e-mail reply letter to me today in response to my January 3, 2019, e-mail public-information request (last item, below) to your State Government of Texas agency.
In answer to your written request of me today, I as the requestor am not willing to give you permission to withhold from me recent legal documents involving "attorney-client communications" about me that may be on file with your TDHCA General Counsel's Office.
I will look forward to receiving a courtesy carbon-copy of your official written request for an Open Records ruling from the Attorney General of Texas on the legal documents you seek to withhold from me.
Thank you again for your reply letter. I hope to hear from you soon.
Sincerely and Best Wishes,
John Kevin McMillan, current public-information requestor.

Dear Mr. McMillan:
Thank you for your public information request. Some of the information you are requesting may be protected by the attorney-client privilege. The Public Information Act permits the Department to initially withhold such privileged information, but only with your prior written permission. Accordingly, I am requesting that you allow me to redact or withhold any attorney-client communications we may come across while searching for information responsive to your request. If not, it is the agency’s practice to send the information to the Attorney General for a decision on whether we may withhold it. That process takes about 70 calendar days. We will of course produce to you promptly any other responsive documents that don’t contain attorney-client privileged information.
If you have any questions feel free to call. Please let me know what you want to do at your earliest convenience.
Thanks,
Jeffrey T. Pender
