JULY 13, 2008, FOLLOW-UP E-MAIL LETTER OF MINE TO STATE LEGISLATORS WITH JURISDICTION RELATING TO THE PRE-PROSECUTION 'JOHN McMILLAN' FILE OF THE TRAVIS COUNTY DA's OFFICE THAT IN 2006 CONTAINED AN ABUNDANCE OF TENTATIVE FACTUAL EVIDENCE OF ALLEGED POSSIBLE HARMFUL INTENT TOWARD ME BY OTHERS

Dear Texas House Committee on Criminal Jurisprudence members and Texas House Committee on Law Enforcement members, respectively,

I am very hopeful that each of you very influential state lawmakers will be very concerned about the apparent decision by the Travis County District Attorney's Office in Austin, Texas, to establish a voluminous criminal-law prosecution file relating to legal evidence of others' cited possible harmful or criminal intent victimizing myself, John K. McMillan of Austin, and to then choose not to formally pursue any criminal-law prosecutions in a court of law in Austin, Texas, against any cited defendant that referred to myself as a cited victim in any context.

Attached, please note legal correspondence of mine relating to civilly and lawfully worded concerns of mine about possible negligence in this matter by the Travis County District Attorney's Office over a multi-year period.

Sincerely and Best Wishes,
former Texas Department of Public Safety full-time employee John Kevin McMillan of Austin, Texas.

cc: Professor Karl Galinsky, a renowned Classics Department scholar and former very distinguished Classics Department Chairman at The University of Texas at Austin, who has kindly written to me and expressed his very kind interest in my own quality of life in Austin, Texas, in a recent year. I would like to take this opportunity to express my appreciation to the Classics Department at UT-Austin, for its kind empathy toward myself. Another male instructor in that academic department did kindly state to me on April 27, 2005 (a birthday for me) over the telephone that he hoped that the noise pollution in Austin, Texas, that I had politely complained to himself about that day would be terminated as soon as possible, according to my standard diary entry for that day. So far, that one total Classics Department instructor, who has subsequently asked that I not cite his name per se to any other person, is the only part-time or full-time employee of UT-Austin who has ever on any occasion in the entire period since 1987, for instance, ever once expressed any concern to me about noise pollution in Austin being allegedly injurious to myself----- noise pollution, I might add, that an ear, nose, and throat specialist I've consulted in northwest Austin, Dr. David Tobey, over a multi-year period has determined inside his medical clinic to have significantly damaged my own hearing capacity.

Dear Emmis Communications General Counsel Arnold in Indianapolis, Indiana,
As a courtesy to yourself, since the following attached legal correspondence refers by name to a very influential senior staff member of an Emmis Communications-owned media company in Austin, Texas, and his volunteered helpful observation to myself that an "unethical media company" (his exact wording) operating in Austin, Texas, allegedly may be harassing myself, I would like to share all of this with yourself.
Thank you again, Mr. Arnold, for your helpful reply letter to me of several months ago, assuring me in writing that no Emmis-owned media company has violated my own privacy rights.
Best Wishes,
John Kevin McMillan of Austin, Texas.

July 12, 2008

Dear Ms. Hilbig,

Thank you for your certified-delivery July 10, 2008-dated official signed reply letter to myself on Travis County DA's Office stationery in response to my July 9, 2008-dated Open Records request I had written and E-mailed to yourself at your Travis County District Attorney's Office in Austin.

This morning, I signed for that reply letter I received from yourself today at the U.S. Postal Service post office along Jollyville Road in northwest Austin.

It is noteworthy that all of the 23 total pages of documents, along with the additional accompanying one-page signed cover letter from yourself, that you have provided me in response to my most recent public-information request were, in fact, written by yourself.

None of the documents you have provided me refers to any actual criminal-law prosecution on my own behalf having been pursued thus far in a court of law by any prosecuting attorney of the Travis County District Attorney's Office in Austin, Texas.

Ms. Hilbig, I would like to respectfully remind you that my Open Records request also specifically included in the scope of that public-information request any and all cited documents or other items referring at least once to myself, John Kevin McMillan, or to my cited one-member and non-Christian religion, in any manner or any context---- without any of those items having been authored or sent by myself, I might add---that were each generated or received or written or authored or sent or mailed or E-mailed or noted at any time since January 1, 2006, by Travis County District Attorney Ronald Earle, Travis County Assistant District Attorney Rosemary Lehmberg, Travis County Assistant District Attorney Mindy Montford, Travis County Grand Jury Director Claire Dawson-Brown; or by a "Norma Almaraz," should there be any documents or other items relating to myself or my cited religion that were authored by or received in a context using that particular name---a name you yourself indicated to me in 2006 as also referring to yourself, Ms. Norma Hilbig, I might add.

I would appreciate a follow-up letter or E-mail letter from yourself, stating to me whether the July 10, 2008-dated reply letter you have written and mailed to myself was in fact a complete and thorough and fully diligent response providing me with any and all photocopies or printouts of any and all documents or other items that are in fact responsive to my July 9-dated Open Records request addressed to yourself.

Thank you in advance, Ms. Hilbig, for your invaluable follow-up reply letter to myself about this very important legal matter.

Sincerely,

John Kevin McMillan,

July 10, 2008

Dear Ms. Hilbig,

I would appreciate receiving from you a reply E-mail letter, simply confirming that you have received the following (attached) July 9, 2008-dated Open Records request from myself, and that it is in proper form to elicit a reply letter from yourself within 10 working days that provides me with a photocopy of any and all documents or other items responsive to that public information request from myself.

Among the additional insights I hope to glean from this most recent Open Records request are answers to the following questions:

----Is the Travis County District Attorney's Office aware that attempts by one or more persons in a variety of ways to accelerate the aging process, and trigger premature agedness, in a cited victim (myself, for instance, in a hypothetical scenario), comprises a very alarming violation of the state penal code that is, in fact, a deplorable and outrageous crime.

----Is the Travis County DA's Office aware that the lawfully heterophiliacal religion I have in fact established, the Progressive Prohibitionist Religion (a tobacco-free, alcohol-free, illiicit-drug-free, never-previously-addicted, clean-talking, facially cleanshaven, consistently civil and law-abiding non-Christian religion assigning highest possible priority to generously and conscientiously befriending children and adult persons raising those same young persons under age 30 inside those adults' homes, as well as as to befriending as many other young persons under age 30 as is humanly possible) has very stringent membership-eligibility requirements that do, in fact, lawfully and in a civil manner exclude 99.5 percent to 99.99 percent of all of the adult homosexual, adult lesbian, adult bisexual, adult transsexual, adult transvestite, and effeminate male adult persons from ever at any time being granted official membership status per se in my own religion.

----Is the Travis County DA's Office aware that many Central Texans are in fact violating the state penal code of Texas in a context in which those same Central Texans are expressing contempt for or defiance of my own very emphatic legal position and philosophical and religious position and personal position as well, this in my capacity as a morally and aesthetically straight adult gentleman, that 99 to 100 percent of all of the morally and aesthetically straight adult male persons who are the most similar to myself overall as human beings and who are each the adult male persons in Travis County who are the most compatible with myself as prospective or current or future friends or friendly acquaintances or coworkers or professional associates or coreligionists or roommates or housemates of mine are, in fact, heterosexual or primarily heterosexual in sexual identity per se.

----Does the Travis County District Attorney's Office in Austin, Texas, have any record indicating that there is any current legal restriction or any current legal prohibition in any way restricting me or preventing me in any way from myself asserting my legal and human right at present and in the future as well, to myself file criminal-law charges through the Austin Police Department or through the Travis County Sheriff's Office in Austin, Texas, against any and all cited homosexual, bisexual, lesbian, transvestite, or transsexual adult persons who each allegedly wronged me and violated the state penal code in the process.

----Does the Travis County District Attorney's Office have any record that any cited gay terrorist group, any lesbian terrorist group, any effeminate male adult terrorist group, or any trannssexual terrorist group, has allegedly violated my own legal rights in any context that comprised a violation of the state penal code on the part of any such militant group.

----Does the Travis County District Attorney's Office have any evidence indicating that illicit drug addicts or alcoholic persons or atheists operating in Travis County, Texas, have allegedly victimized myself in any context involving a violation of the law on their part.

---Has the Travis County DA's Office had any communications with the Federal Communications Commission of the U.S. Government in regard to a cited electronic media company that allegedly has stalked me and otherwise violated my own privacy rights and allegedly victimized me in violation of federal law.

Thank you in advance, Ms. Hilbig, for your invaluable reply E-mail letter, assuring me that you have in fact received my July 9, 2008-dated Open Records request. I look forward to receiving photocopies of documents and other items that you provide me in response to that public information request from myself.

July 9, 2008

Dear Travis County District Attorney's Office Open Records Coordinator Hilbig,

This is a Texas Open Records request in which I seek to obtain from you a photocopy of any and all letters, reports, E-mail communications, handwritten notes, memoranda, telephone records, phone messages, computer records, printed documents, transcripts, verbalized records about audio or visual or audiovisual recordings, and any other items referring at least once in each such item to myself, John Kevin McMillan, in any manner or any context, or to a cited religious or political affiliation of mine (my own fully independent and non-proselytizing and still-one-member (myself) Progressive Prohibitionist Religion, for instance), in any manner or any context, and that, in each such case, was generated or received or written or authored or sent or mailed or E-mailed or noted at any time since January 1, 2006, by Travis County District Attorney's Office officials or employees Ms. Norma Hilbig (yourself), or, alternatively, Ms. Norma Almaraz; Ms. Claire Dawson-Brown, Chief of Grand Jury; Assistant District Attorney Rosemary Lehmberg; Assistant District Attorney Mindy Montford; or District Attorney Ronald Earle.

Specifically EXCLUDED from the scope of this Open Records request are any and all documents or supporting materials that solely and exclusively contain a communication written by or authored by or sent by or mailed by myself, John Kevin McMillan.

INCLUDED in the scope of this Open Records requests are each and every one of the several E-mail reply letters or letters that yourself, Ms. Norma Hibig, have diligently written and mailed to myself, John K. McMillan of Austin, in the period since January 1, 2006.

My social security number is .... I was born on April 27, 1957, at Lincoln, Nebraska. My legal name is John Kevin McMillan. I am a 1975 alumnus of Stephen F. Austin High School of Austin Independent School District, and I am a 1979 alumnus of The University of Texas at Austin.

I have resided in Austin, Texas, on a continuous basis ever since mid-March of 1997, most recently.

I have resided at the Wind River Crossing apartment complex in northwest Austin ever since August of 2001. I have resided alone in Apartment 325 in Building 3 of that apartment complex ever since early 2002.

I resided with a roommate in Apartment 1638 at Wind River Crossing Apartments from August 2001 until early 2002. Before that, I resided at 2518 Leon Street, Apartment 101, near UT-Austin from December of 1997 until August of 2001, with myself having resided in that apartment unit during separate multi-month periods with two different respective roommates, each of them self-identified graduate students at UT-Austin.

My E-mail address is mcmillanj@att.net. An E-mail address for myself that I have used in prior years was: jkmcmil@texas.net.

Among the insights I hope to glean from this Open Records request are:

---Is the harmful-intent or criminal-intent criminal-law legal file relating to myself, John Kevin McMillan, and my own living conditions in Austin, Texas, that Ms. Norma Hilbig or Ms. Norma Almaraz of the Travis County DA's Office officially confirmed to me as having been established in January of 2006, still on file with the Strategic Prosecution Division of the DA's Office in Austin.

---What might help explain why you yourself, Ms. Hilbig, have chosen in 2008 to not return any of the phone messages I have left with yourself at your public law office in the DA's Office in Austin, and why you yourself have never once agreed to speak with me on the telephone on any of the occasions when I have made polite follow-up calls to your public law office relating to the criminal-law file you've yourself established on my behalf.

---What might help explain why you yourself, Ms. Hilbig, have chosen not to send me any reply E-mail note or reply E-mail letter containing any actual words at any time in the year 2008, with your one total E-mail transmission to me in 2008 having contained no text of any type and having been completely blank in the body of that "reply" message from yourself.

---Is there any evidence that the expected future District Attorney of Travis County, the individual expected to replace Ronald Earle in that position, has herself attempted to persuade you yourself, Ms. Hilbig, to not have any further communications with myself in any context?

---Is there any evidence of negligence or malice or possible harmful intent toward myself on the part of any current or former employee or official of the Travis County District Attorney's Office or any other law-enforcement agency or any other government-owned institution?

---Has the DA's Office in Austin ever at any time identified myself, John Kevin McMillan, as a cited victim of fraudulent communications, unwanted communications I have repeatedly objected to, any obscene communications I did not specifically authorize, any form of involuntary defacto public nudity in any context that I myself did not want for myself or authorize for myself, mail fraud, medical fraud, identity theft in any context, alleged possible attempted homicide by others in a context victimizing myself, alleged extortionism or alleged bribery or alleged blackmail in any context, any illegal form of hostage-taking or entrapment or attempted brainwashing of myself, theft of my own property or financial wealth by any other person or group of persons, verbal harassment of myself involving profane communications or involving interstate commerce that was illegal, any illegal censorship of myself involving a violation of the state penal code on the part of any such censorious persons, allegedly illegal stalking of myself by one or more of the persons whom I have already rejected or who have already rejected myself (John K. McMillan) from their own life; or any other harmful or injurious or criminal conduct toward myself at any time.

---Has the DA's Office in Austin expressed any concern about the noteworthy warning to myself on the telephone in the late 1990s by a cousin of mine and married man in Iowa, Mr. Jim Dane of the Iowa City area (a warning that I have in fact in the last few years again informed your Travis County DA's Office and the Austin Police Department about), that Cousin Jim Dane was privy to information leading him to believe that numerous persons in the Austin area of Texas were allegedly exhibiting alleged harmful or criminal intent victimizing myself, John K. McMillan of Austin, according to Cousin Jim Dane.

---Why has the DA's Office in Austin expressed no interest to me in the possible criminal-law implications from the very surprising oral disclosure made to me over the telephone in 2001 by Mr. David Ferris, Probate Division Director for the Travis County Clerk's Office in Austin, that "there appear to be many people in the Austin area who are trying to drive you (John K. McMillan) out of the Austin area."

---Is the DA's Office aware that one legal scholar at The University of Texas at Austin Law School, Dr. Gibson (the biological father of 1976 Stephen F. Austin High alumnus Michael Gibson of Austin) did politely volunteer to me in 1988, during a local phone call I made to his law office from a pay telephone along Guadalupe Street, that "business law" (*exact wording) was the field of law most applicable to my own baffling "life" circumstances during that period, Dr. Gibson stated to me in that brief phone conversation we had. At no time did Dr. Gibson ---or anyone else whom I have consulted, for that matter---ever state to me any applicable legal contract I might have somehow ever signed with any business entity or businessperson that would have somehow authorized any impingements upon my own privacy rights in any context applicable to the year 1988, for instance.

---Is the DA's Office in Austin aware that my legal and Constitutional right to myself EXCLUDE from my own life each of the persons whom I have already rejected from my own life, is fully protected by the American legal system, and that compelled relationships are, in fact, illegal and can comprise a form of slavery that's a very sinister and injurious felony crime.

---Has the DA's Office in Austin expressed any concern about the pervasively injurious effects on my own medical health and my own financial earnings capacity deriving from noise pollution and verbal harassment of myself I do not want that has been occurring on a year-round, multi-year basis in Austin, Texas.

----Is the DA's Office in Austin aware that the World Health Organization, affiliated with the United Nations, has reportedly determined that noise pollution can cause heart disease in a person being repeatedly subjected to that noise pollution on a year-round basis, according to a representative for the American Heart Association whom I recently consulted about that very important legal matter.

---Has any official of the DA's Office in Austin attempted to contact Dr. David Tobey, an ear, nose, and throat specialist based in northwest Austin, who has repeatedly stated to me based on examinations of my hearing capacity inside his medical clinic over a multi-year period that Dr. Tobey believes that my own hearing capacity has been significantly harmed by noise pollution in Austin, with Dr. Tobey several months ago also citing possible noise pollution and possible air pollution at one or more of my places of employment during that approximate time period as having been apparently injurious to myself, he volunteered to myself inside his medical clinic.

---Has the DA's Office in Austin expressed any concern about numerous medical problems, including several life-threatening medical problems, that I have myself sustained in the period since January 1, 2006, with two separate hospital surgeries on myself at Seton Northwest Hospital having occurred during that period.

---Is the DA's Office in Austin aware that I myself have myself led a completely and permanently illicit-drug-free, tobacco-free, alcohol-free, tattoo-less, facially cleanshaven, clean-talking, platonically polite, morally and aesthetically straight, law-abiding and civil, honest, hygienic, HIV-negative, fully ambulatory, physically fit, gainfully employed lifestyle featuring year-round exercise and a conscientiously healthful dietary lifestyle by myself throughout the entire multi-year period since January 1, 2006.

---Are any criminal-law prosecutions that relate to myself, John Kevin McMillan, in any way, being contemplated or pursued at this time by any official of the Travis County DA's Office?

----Why has the Travis County District Attorney's Office in Austin, Texas, chosen not to share with any official of the Austin Police Department the Travis County District Attorney's concerns about possible or alleged criminal intent by others allegedly victimizing myself, John Kevin McMillan of Austin, in a cited context.

---Has the Travis County District Attorney's Office in Austin compiled any legal evidence that the Austin Police Department has ever at any time failed to enforce the law against any person or entity or business or institution that or who allegedly has violated the law in a manner violative of my own legal rights in any way.

---Is the DA's Office in Austin aware that three different respective private attorney members of the State Bar of Texas whom I have myself consulted in the last few years have each stated to me that I am apparently or possibly being victimized by illegal communications from others, including noise pollution, that's evidenced in the Austin area.

---Is the DA's Office in Austin aware that Mr. John Broders, Story Assignments Editor for "Texas Monthly" magazine, in 2000 or 2001 did emphatically state to me over the telephone during a local phone call I made to his magazine office in downtown Austin from my State Board of Pardons and Paroles state agency workplace, "No, no, that's (the surprising rumors I'd myself heard in Austin during that period, and which I cited to Mr. Broders in that one phone call to his magazine office, about a cited Judaistic religious congregation in Austin having allegedly been verbally harassing me during that period, according to those very surprising rumors I'd heard from others, with myself indicating to Mr. Broders that I of course questioned the reliability of those repeated verbalized rumors I'd heard in Austin) not it. There appears to be an unethical (exact wording) media company (exact wording) harassing (sic) you (John Kevin McMillan) in Austin these days."

---Has the DA's Office in Austin received any evidence that a media company headquartered in another U.S. state and another U.S. city, such as in Atlanta, Georgia, has allegedly violated my own privacy rights in any context involving an alleged violation of the law on the part of that media company.

---Has Travis County District Attorney Ronald Earle received any letters or phone calls or E-mail correspondence from "Austin American-Statesman" daily newspaper publisher Michael Laosa (a self-described personal friend of DA Earle from what Mr. Laosa volunteered to me over the telephone in a recent prior year) that referred to myself, John Kevin McMillan, in any manner or context.

---Why has the Travis County District Attorney's Office expressed no apparent concern about the criminal-law implications from the very surprising in-person disclosure to myself in 1998 inside the "Austin Chronicle" newspaper office by Mr. Dan Hardick, an official of that newspaper in Austin, that "there may be a gay (exact wording) professor (exact wording) wrecking havoc on your (John K. McMillan's) own quest for a social life and romantic life in the Austin area." None of my own male friends or male acquaintances during that period of my life was, in fact, a "gay professor," I wish to emphasize; and I myself have not been affiliated in any way with any gay group or gay media company or gay professor at any time during the period since January 1, 2006, in particular.

---Is the DA's Office in Austin aware that no media company anywhere in the world has ever been authorized by myself, John Kevin McMillan, to subject me to anonymous communications or verbal harassment or stalking of myself or electronic surveillance or televising of myself or videotaping of myself or slander or libel or public disparagement of myself at any time, and that during the two- and one-half year period since January of 2006 for which this Texas Open Records request is applicable, I myself have never at any time been employed by ANY media company or media entity anywhere in the world.

---Is the DA's Office in Austin aware that one veteran attorney member of the State Bar in Austin advised me in person inside his law office in the last year or two to myself file a lawsuit against the City Government of Austin relating to cited noise pollution injurious to myself, that male attorney advised me at least once.

----Why is it that no restitution payments of money to myself have been made thus far, if in fact any other person has ever at any time been ever convicted of violating my own legal rights while subjecting me to a felony crime in the process.

---Is there any evidence of complicity in crime in a manner injurious to my own personal safety or legal rights or human rights on the part of any of the various former or current acquaintances or relatives or professional associates or coworkers or schoolmates or roommates or housemates of myself, John Kevin McMillan.

----Does the DA's Office in Austin acknowledge that defiance of my own lawfully and legally heterophiliacal and accompanying pro-masculine-male, pro-cleanshaven-male lifestyle by various persons or business entities or civic groups evidenced in Austin, Texas, has possibly involved illegal verbalized communications to myself by others that I do not want.

----Is the DA's Office in Austin aware that repeated slandering of myself or repeatedly libeling of myself or repeated public disparagement of myself in Austin, Texas, might possibly be an indication of harmful or criminal or injurious intent victimizing myself on the part of one or more other persons?

----Is the DA's Office in Austin aware that two relatives of mine who reside in Austin, Texas, on their own volition did each volunteer to me in the 1990s over the telephone that they themselves believed that I myself, John Kevin McMillan, was being "persecuted" (exact wording) in Texas during that period, or, in the case of the other cited relative's comment to me in 1996, that many people believe that I myself, John Kevin McMillan, was being "persecuted" in Texas in the year 1996, for instance.

----Has the Travis County District Attorney's Office ever at any time pursued any legal action against, or advised any legal action by any government-owned institution against, any media company or media entity or individual allegedly violating on my own privacy rights and subjecting me to fraudulent or dishonest communications in any context.

Thank you in advance, Open Records Coordinator Hilbig, for what I feel very hopeful will be a thorough and very diligent reply letter to myself in response to this Open Records request from myself.

Sincerely and Best Wishes,

John Kevin McMillan,
