Thank you for your June 12, 2023-dated reply letter to me (farther below) in which you state that your State of Texas agency's Office of General Counsel ever since January 2, 2015, has not generated or received any documents either referring to me at least once in any context or referring to any state or local audit conducted or reviewed by your state agency which directly cited me by name in any manner or context.

Your most recent reply letter to me did not include any portion of the  text of the public-information requests of mine I wrote and e-mailed to your State of Texas agency in 2020. Nor did your June 12, 2023, reply letter provide me with any legal notes generated by staff members of your agency or received by your state agency from sources other than me that each referred to or were prompted by one or more of the politely-worded Texas Open Records requests I wrote and e-mailed to your state agency in Austin in prior years. . Among the reply letters I directly received from your state agency in response to  public-information requests of mine in 2020 were:

 I regard it as very noteworthy for the State Government of Texas and the City of Austin, respectively, that my October 2, 2020, e-mail public-information request to your State Auditor's Office state agency had contained the following factual statement immediately after the first paragraph of that information request of mine:
"One female investigator for the Texas Department of Family and Protective Services, Diana McGeehan, on November 14, 2019, made a 40-total-minute on-duty professional visit to my current Pebble Creek Apartments rental-efficiency unit in Austin in which she interviewed me for DFPS Case Number 7292-2668. During that on-duty visit to my solo-occupancy apartment unit, Investigator McGeehan stated to me that I should purchase a second infrared motion-sensitive camera and use it inside my bedroom in order to obtain additional factual evidence of alleged home-invasion-crimes perpetrators and alleged trespassing crimes perpetrators and alleged personal-injury-crimes perpetrators allegedly physically present inside my current bedroom during my sleeping hours as I lie alone on my own bed, asleep and unconscious and probably snoring, inside my always-locked efficiency apartment unit."

I would also like to respectfully mention that I am very surprised that your state agency's Office of General Counsel has apparently not identified any need for one or more audits of any state agency in Texas that might have been prompted for you by the numerous written requests to the Attorney General of Texas seeking authorized exemption from state law that a variety of state and local-government agencies and government officials have each submitted in writing over a multi-decade period in response to public-information requests of mine.

Among the state agencies and local-government agencies in Texas that requested written permission from the Attorney General of Texas to withhold from me legal documents directly referring to myself that were each responsive to a public-information request that state agency had received from me were: the Texas Commission on Environmental Quality state agency; respective Assistant Attorneys General of the Attorney General of Texas on behalf of the Open Records Division of that state agency in Austin; the Travis County Attorney's Office in separate respective ruling-request letters to the Texas Attorney General on behalf of the Travis County District Attorney's Office in Austin, on behalf of then-Travis County Judge Sarah Eckhardt, and on behalf of then-Travis County Commissioner Gerald Daugherty, respectively.

The Texas Rangers Division of the Texas Department of Public Safety state law-enforcement agency in Austin sent me a noteworthy 2013-dated reply letter (below) that I also shared a copy of with your Texas State Auditor's Office. Even though that reply letter to me from Texas Rangers Lieutenant Jesse Valdez was written two years before the scope of my  June 11, 2023, Open Records request to your state agency, I have repeatedly informed your state agency and numerous other State, County, and City officials in Austin and Texas over a multi-decade period that I was  being victimized on a daily and year-round basis inside my locked rental-apartment unit in Austin by alleged home-invasion-crimes and alleged anal-rape-crimes and other personal-injury-crimes, including flagrantly illegal and harmful infliction of nasal inhalants on me by alleged home-invaders during my sleeping hours, that were inflicted on me during my sleeping hours as I lay alone, asleep and unconscious, on my own bed. I have been completely celibate ever since one  total day in the year 1995, as I have directly informed City of Austin and State of Texas officials. Three separate respective forensic-medical evidence sexual assault exams were performed on me at my request during the 10-year time period from April 2011 to September 2021, and each of those three rape-evidence kits are reportedly being maintained at present by the City Government of Austin.

CITY OF AUSTIN LAW DEPARTMENT SENDS ITS 13TH LEGAL LETTER IN THE MOST RECENT 8-YEAR PERIOD TO TEXAS ATTORNEY GENERAL PAXTON THAT SEEKS PERMISSION TO DENY ME ACCESS TO LEGAL DOCUMENTS ON FILE WITH THE CITY THAT EACH DIRECTLY REFER TO ME


I find it fascinating to note that the City Government of Austin (TX) Law Department this month has submitted yet another legal letter to the Attorney General of Texas --- at least the 13th such legal letter (see below for details) to the Attorney General from the most recent eight-year period that directly refers to me by name --- in which the City of Austin is once again seeking permission to withhold from me cited legal documents on file with the City that directly refer to me.

Here is a summary of the multi-year history of the City Attorney's Office in Austin, Texas, responding to public-information requests from me by seeking official permission from the Attorney General of Texas to withhold from me legal documents on file with the City Attorney's Office that each directly refer by name to myself, John Kevin McMillan of Austin, Texas:

JUNE 8, 2020:
Austin Assistant City Attorney Neal Falgoust on June 8, 2020, signs and mails to Texas Attorney General Ken Paxton a written request for official permission to withhold from myself, public-information requestor John Kevin McMillan of Austin, legal documents on file with the Austin-Travis County Emergency Medical Services Department that directly refer to me by name.
The cited ID number on my public-information request that was received by the City of Austin on May 22, 2020, is: C069056.
"The City believes the information at issue is excepted from required public disclosure under section 552.101 of the Government Code.
"This letter is a request for a determination under section 552.301 of the Government Code that the information at issue is so excepted. A copy of each request and a representative sample of the information at issue are enclosed. ...
"Section 552.101 of the Government Code excepts from public disclosure 'information considered to be confidential by law, either constitutional, statutory, or by judicial decision.'...", Assistant City Attorney Falgoust stated in his signed legal letter to the Attorney General of Texas.

DECEMBER 3, 2019:
Austin Assistant City Attorney Zachary Brown on December 3, 2019, signs and mails to Texas Attorney General Ken Paxton a signed two-page request for official permission to withhold from myself, public-information requestor John Kevin McMillan of Austin, legal documents on file with the City Attorney's Office for which Mr. Brown maintains in writing that their confidentiality is protected by attorney-client privilege.

In his December 3, 2019, legal letter to Attorney General Paxton, Assistant City Attorney Brown states: "The information at issue consists of e-mail communications between attorneys in the City's Law Department and City employees in their capacity as client representatives. These communications were made in order to facilitate the rendition of legal services to the City. These communications were intended to be confidential and have remained confidential. Accordingly, the City (maintains that it) may withhold the information under section 552.107(1) of the Government Code."

The City Attorney's Office's request for a decision from the Attorney General on this was in response to a public-information request of mine to the City Attorney's Office that was received by the City of Austin law department on November 15, 2019 (PIR Number X004560).

MAY 20, 2016:
On that date, Assistant City Attorney Elaine Nicholson of the City Attorney's Office in Austin, Texas, signs and sends an official legal letter to Texas Attorney General's Office that seeks official permission from that state agency to withhold from myself, public-information requestor John Kevin McMillan of Austin, cited legal documents on file with the City Attorney's Office at that time that directly refer to myself.

The cited reason for Ms. Nicholson's request: that the cited documents are protected from disclosure because they meet the criteria for "attorney-client privilege."

The cited legal documents contain communications directly referring to myself, Austin resident John Kevin McMillan, that reportedly involve attorneys in the City Attorney's Office and City of Austin employees in their capacities as clients seeking legal advice from those attorneys.

The City's request for an Open Records ruling from the Attorney General on this was prompted by a May 9, 2016-dated e-mail public-information request from myself---a request that was received by the City on May 10, 2016.

MARCH 1, 2016:
City of Austin Law Department Assistant City Attorney Elaine Nicholson, in a signed three-page March 1, 2016-dated official legal letter to Texas Attorney General Ken Paxton, seeks written permission to withhold from myself, public-information requestor John Kevin McMillan of Austin, Texas,"confidential communications between and amongst the Law Department and Austin Police Department (that each specifically refer to John Kevin McMillan of Austin)."

The cited public-information request from myself was an E-mail letter dated Feb. 15, 2016, and officially received by the City of Austin on Feb. 16, 2016.

SEPTEMBER 8, 2015:
Assistant City Attorney Elaine Nicholson, in a signed three-page September 8, 2015-dated legal letter to Texas Attorney General Ken Paxton, requests official written permission to withhold from myself, public-information requestor John Kevin McMillan "confidential communications within the Law Department (that each specifically refer to John Kevin McMillan of Austin)."

The applicable E-mail public-information request from myself had been officially received by the City of Austin on August 24, 2015, after that written request was E-mailed to the City by myself on August 23, 2015.

JUNE 24, 2015:
City of Austin Law Department Assistant City Attorney Elaine Nicholson, in a signed June 24, 2015-dated legal letter to Texas Attorney General Ken Paxton, requests official written permission to withhold from myself, public-information requestor John Kevin McMillan of Austin, Texas, "confidential communications within the Law Department (that each specifically refer to John Kevin McMillan of Austin)."
The cited public-information request from myself was an E-mail letter received by the City of Austin on June 10, 2015.

MARCH 31, 2015:
City of Austin Law Department Assistant City Manager Elaine Nicholson, in a signed March 31, 2015-dated legal letter to Texas Attorney General Ken Paxton, requests official written permission to withhold from myself, public-information requestor John Kevin McMillan of Austin, Texas, "confidential communications between and amongst members of the Law Department (that each specifically refer to John Kevin McMillan of Austin)."

The cited public-information request from Mr. McMillan was an E-mail letter received by the City of Austin on March 17, 2015.

DECEMBER 29, 2014:

My legal name is John Kevin McMillan. I was born on April 27, 1957, in Lincoln, Nebraska. I am the founder and only approved member of the politely non-Christian and non-proselytizing "Progressive Prohibitionist Religion" that has very stringent membership-eligibility requirements and does not agree to a second member at any time in the foreseeable future.

 

I am a single adult permanently-drinking-alcohol-free (ever since 1990), permanently marijuana-free (ever since 1984), lifelong-illicit-drug-free in regard to any and all illicit drugs other than marijuana, anti-"medical-marijuana"-minded, lifelong-tobacco-free, lifelong-non-vaping, lifelong-tattoo-less, platonicly polite, permanently-jewelry-less, lifelong tongue-ring-free, lifelong-nostril-ring-free, consistently clean-talking and non-profane, dependably civil and law-abiding and very honest, white non-Hispanic gentleman of English, Scottish, and German ancestry. 

I myself do NOT have any criminal-conviction record, as I'm sure your state agency is very  aware.

 

I resided in Austin (TX) proper on a continuous and uninterrupted basis from mid-March 1997 until December 31, 2021, when I successfully relocated from Austin by airplane to the state-capital city for Utah based upon advice from two certified peace officers for the Austin Police Department and other persons.

 

I was employed by a variety of reputable employers in Austin, including the Texas Department of Public Safety state law-enforcement agency. I was employed full-time in the DPS Motor Carrier Bureau along Guadalupe Street for one year in the late 1990s. I was also employed full-time in

Austin by the Texas Department of Criminal Justice (TDCJ) state agency; the Texas Board of Pardons and Paroles state agency; the Texas Legislative Council state agency; and the LBJ School of Public Affairs at the University of Texas at Austin.

 

This public-information request was prompted in part by my having read recently that infliction of continuous and toxic medically injurious noise pollution on targeted human rights victims has frequently occurred in cases of religious or political persecution of those individuals. 

I myself am a lifelong non-Christian gentleman. I take pride in being law-abiding, conscientious, very civil, and honest. I am very opposed to the deliberate infliction of continuous noise pollution on anyone in a context that violates his own privacy rights. I also oppose the infliction of continuous anonymous obscene communications on anyone in a context that violates his own privacy rights. I also oppose infliction of thought-control projects on myself or anyone else.

In August of 2001 one Travis County Government official, David Ferris, Civil Probate Division Director for the Travis County Clerk's Office in Austin, volunteered an oral statement to me on the telephone during a polite local phone call I had made to his local government office from inside a solo-occupancy  rental apartment unit I had just moved into in northwest Austin:

"There appears to be an attempt by numerous persons to drive you (John Kevin McMillan of northwest Austin) out of the Austin area," Travis County official David Ferris stated to me on his own volition.

About seven years ago, as I walked near one Austin gentleman inside a corporate-owned restaurant workplace of mine in northwest Austin while I was on duty inside that workplace, I overheard him stating to a friend of his: "That guy is in Auschwitz (sic), but no one else is."

The new and non-Christian non-proselytizing "Honor Society" religion I founded in 1996, the above-cited Progressive Prohibitionist Religion, is anti-marijuana, anti-medical-marijuana, anti-illicit-drugs, anti-tobacco, anti-drinking-alcohol, anti-tattoos, anti-profanity-minded, and anti-facial-hair-minded.

That one total fully-independent religion of mine opposes home-invasion crimes, opposes personal-injury-crimes, opposes sexual assault crimes, opposes the sex crime of pederasty, opposes the infliction of profanity or obscene speech on anyone in a context that violates their own privacy rights, opposes anonymous communications that violate the privacy of the person being subjected to those communications, opposes fraudulent or knowingly dishonest communications, opposes thought-control projects, opposes so-called "deprogramming" projects, opposes kidnappings, opposes hostage-takings, opposes compelled speech that violates the privacy rights of the individual being subjected to that compelled speech against his wishes, and opposes deliberate infliction of continuous noise pollution on anyone in a context that harms that individual's own medical health or that is aimed at punishing him or her for having political or religious or personal beliefs---or personal prejudices, even---that are disliked or opposed by the perpetrators or sponsors of that noise pollution.

Numerous current or former Central Texas residents stated to me over a multi-year period  that they either disliked or intensely disliked or questioned the authenticity of my own fully-independent and one-total-approved-member "Progressive Prohibitionist Religion" (PPR). Around the turn of the century I gave several televised speeches on behalf of that religion of mine on local Community Access Television in Austin. One younger Central Texan man even left a violent-sounding and obscene anonymous recorded phone message on my telephone-answering machine inside my ViewPoint Apartments rental unit  near UT-Austin---a recorded phone message in which he volunteered that he himself is "Catholic". In his recorded message to me, he stated that he was reacting to one or more locally televised speeches of mine that I had given on behalf of my PPR religion.

 

 

Around the turn of the century, one former Austin-area resident, Dr. Michael Kim McMillan, declared to me in person with indignation and revulsion in his tone of voice and facial expression in a conversation I had with him outdoors near UT-Austin's campus that occurred during a brief visit of his to the Austin area from out of state: "The 'Heaven on Earth' religion you've (John Kevin McMillan of Austin) established has inflicted Hell on this entire planet!"
