FYI to each of you very honorable government officials and law-enforcement officers on the most recent update from this week, final item below, in regard to my longstanding Open Records complaint against the Texas Department of Public Safety Office of General Counsel here in Austin that I filed on or about October 1, 2020, through the Attorney General of Texas Open Records Division in Austin. I myself am a former full-time employee of the Texas DPS state law-enforcement agency here in Austin. Details about this case are provided directly below:

In late November of 2020, the Texas Department of Public Safety state law-enforcement agency's Office of General Counsel in Austin was officially notified in writing (below) by the Attorney General of Texas about that DPS office's alleged failure to reply in writing to either of two specifically cited separate Open Records requests of mine in 2020.

 I had written and emailed those two public-information requests to the officially-designated Texas DPS Open Records Coordinator---a staff member in the DPS Office of General Counsel---on August 13, 2020, and February 21, 2020, respectively.

The Attorney General of Texas has specifically informed me this week (see final item, below) that it has combined my two separate Open Records complaints against the Texas DPS Office of General Counsel into one total combined complaint and has assigned that complaint an ID number of 857196.

As of this Tuesday afternoon, January 26, 2021---two months after the late November of 2020, legal letter from the Attorney General to the DPS Office of General Counsel on this issue----the DPS Office of General Counsel still had not provided me with ANY document or 
ANY final reply responsive to either of my two applicable Open Records requests from 2020.

My August 13, 2020, public-information information request to the Texas DPS officially-designated Open Records Coordinator in the DPS Office of General Counsel had stated:

"This is a Texas Open Records request in which I seek to obtain from your state-government law-enforcement agency in Austin a copy of any and all e-mail communications or reports referring to myself, John Kevin McMillan of Austin, at least once in any manner, and that were written, e-mailed, sent, mailed, received, or FAXed at any time since 12:01 a.m. April 28, 2011, by any certified peace officer or law-enforcement officer or administrator based at the Texas DPS Capitol Complex, Capitol Region Headquarters, with your Regional Director who directly supervises your Capitol Region Headquarters being one such applicable DPS administrative official.
"INCLUDED in the scope of this request are any and all e-mail communications or reports referring at least once in any manner to myself, John Kevin McMillan of Austin, that your Capitol Region Headquarters Regional Director during the applicable  nine and one-half-year time period ever on any occasion wrote or sent to, or received from, his immediate supervisor---the Deputy Director of Law Enforcement Operations for the Department of Public Safety...."

My February 21, 2020, Open Records request to the designated public-information coordinator for the Texas DPS Office of General Counsel had stated: 

"This is a Texas Open Records request in which I seek to obtain from you copies of 10 separate very recent photo images that I myself had e-mailed to your state-law enforcement agency's Texas Rangers Division during the multi-month (clarification in time frame) period from December 21, 2019 (correction on year), through the present, and that each appear to contain an image of someone other than myself apparently  having been physically present inside the bedroom of my current solo-occupancy and always-bolt-locked and fully-secured efficiency apartment unit in north Austin...."

BELOW ARE DETAILS ABOUT THE LATE NOVEMBER 2020 LEGAL REMINDER LETTER THAT THE ATTORNEY GENERAL OF TEXAS SENT TO THE TEXAS DPS OFFICE OF GENERAL COUNSEL, WITH A CARBON-COPY HAVING BEEN MAILED TO ME BY THE ATTORNEY GENERAL'S OFFICE IN AUSTIN:

On Friday, November 27, 2020, I received in my apartment-unit mailbox U.S. Postal Service mail-delivery an official carbon-copy letter directly addressed to me that had been mailed to me at my current Pebble Creek Apartments mailbox address in northeast Austin by the Attorney General of Texas in Austin.
That carbon-copy was a two-page November 23, 2020-dated official legal letter from the Attorney General of Texas (OAG) to Texas Department of Public Safety state agency Assistant General Counsel Michele Freeland that specifically referred to me by name at the very end of that legal letter.
That legal letter on official OAG stationery cited the alleged failure by the Texas DPS state law-enforcement agency headquarters in north Austin to respond "appropriately" to a public-information request I myself had submitted to the DPS several months ago:

Dear Very Honorable Government Officials and Law-Enforcement Officials,

I would like to thank Texas Assistant Attorney General Jesse Harvey for making a polite return phone call to me at 12:04 p.m. Tuesday, January 26, 2021, in response to a recent voice-mail message I had left with the Attorney General's Office Open Government Hotline here in Austin.

In that return phone call to me yesterday, Assistant Attorney General Harvey stated that my two Open Records complaints from 2020 against the Texas Department of Public Safety state agency have been combined into one legal complaint by the Attorney General's Office. 

That combined Open Records complaint from me---a legal complaint citing to the alleged failure of the Texas DPS state law-enforcement-agency to send me any reply letter in response to either of two separate Open Records requests I had written and e-mailed to the DPS on August 13, 2020, and February 21, 2020, respectively---is still classified as a currently-active complaint, Mr. Harvey stated.

The Open Records complaint identification number for that combined legal complaint of mine against the Texas DPS is "857196", Mr. Harvey said.

"It's an active complaint," Assistant Attorney General Harvey stated to me on the phone yesterday.  "They're looking at it and they'll figure out what they need to do."

I neglected to ask Mr. Harvey whether the pronoun "they" contained in the word "they're" from his comment to me referred to the officially-designated Open Records Coordinator for the Texas DPS Office of General Counsel---the DPS office in Austin that is legally responsible for officially replying to Open Records requests to the DPS---or to the Open Records Division of the Texas Attorney General's Office. 

I assumed during my phone conversation with Mr. Harvey that the "they" in his comment was referring to his Attorney General of Texas Open Records Division here in Austin. However, I have since considered the possibility Mr. Harvey may have been referring to the DPS Office of General Counsel here in Austin.

My August 13, 2020, public-information information request to the Texas DPS officially-designated Open Records Coordinator in the DPS Office of General Counsel had stated:

"This is a Texas Open Records request in which I seek to obtain from your state-government law-enforcement agency in Austin a copy of any and all e-mail communications or reports referring to myself, John Kevin McMillan of Austin, at least once in any manner, and that were written, e-mailed, sent, mailed, received, or FAXed at any time since 12:01 a.m. April 28, 2011, by any certified peace officer or law-enforcement officer or administrator based at the Texas DPS Capitol Complex, Capitol Region Headquarters, with your Regional Director who directly supervises your Capitol Region Headquarters being one such applicable DPS administrative official.
"INCLUDED in the scope of this request are any and all e-mail communications or reports referring at least once in any manner to myself, John Kevin McMillan of Austin, that your Capitol Region Headquarters Regional Director during the applicable  nine and one-half-year time period ever on any occasion wrote or sent to, or received from, his immediate supervisor---the Deputy Director of Law Enforcement Operations for the Department of Public Safety...."

My February 21, 2020, Open Records request to the designated public-information coordinator for the DPS Office of General Counsel had stated: 

"This is a Texas Open Records request in which I seek to obtain from you copies of 10 separate very recent photo images that I myself had e-mailed to your state-law enforcement agency's Texas Rangers Division during the multi-month (clarification in time frame) period from December 21, 2019 (correction on year), through the present, and that each appear to contain an image of someone other than myself apparently  having been physically present inside the bedroom of my current solo-occupancy and always-bolt-locked and fully-secured efficiency apartment unit in north Austin...."
