TENATIVE LIST OF PUBLIC OFFICIALS AND GOVERNMENT AGENCIES THAT AS OF AUGUST 21, 2020, HAVE NOT YET SENT ME A FINAL REPLY TO A PUBLIC-INFORMATION REQUEST I SUBMITTED TO THEM IN THE MOST RECENT 12-MONTH PERIOD:

"This is a Texas Open Records request in which I seek to obtain from you a copy of any and all written communications, including any and all e-mail communications, that refer at least once in any manner to myself, John Kevin McMillan of Austin, Texas, and that in the period ever since 12:01 a.m. April 28, 2011, were written, produced, generated, received, sent, mailed, or FAXed by any staff member, officer, or administrator for your Human Resources and Staff Services Division who routinely or frequently pursues job duties relating to safety issues or security issues in regard to your state agency complex in Austin or to TCEQ staff members employed at or visitors to your headquarters offices.

"This Open Records request is prompted in part by my sensing that one or more employees or officials of your state agency possibly may have concluded that they regarded me as being a possible alleged 'security risk' for your state agency.

"I mention this partly because earlier this century I received a very surprising rejection e-mail letter, if I remember correctly, from an attorney for your state agency's Office of General Counsel. It seems to me that the staff attorney was Kevin McCalla, and that he requested in writing that I refrain from ever again directly contacting Mr. McCalla himself. I attempted today to locate that reply letter to me from Mr. McCalla, but have not been able to do so. It is possible that the rejection letter to me was written and sent to me by another attorney for your state agency in Austin.

"According to legal documents your state agency provided me earlier this century in response to a public-information request, in November of 2001 a female Human Resources staff member of your state agency made a tentative job offer to me on the telephone for a full-time clerical job at your headquarters complex in Austin----but later retracted that job offer. That withdrawal of the job offer occurred a matter of hours after your HR Department obtained a follow-up oral statement from one of your full-time employees, Randy Hamilton, himself a former classmate of mine at Eanes Elementary School of Eanes ISD in Westlake Hills, in which Mr. Hamilton stated to your HR department staff member that if I myself were working in the same building as himself, Mr. Hamilton would feel 'very uncomfortable'  about any such scenario for himself. 

"At that time, your state agency bore the official name of 'Texas Natural Resource Conservation Commission'. 

"According to legal documents provided to me by your state agency in response to the above cited public-information request, Mr. Hamilton also stated to your HR department that I myself was "paranoid". He elaborated on that oral evaluation of me by stating to an HR department staff member who interviewed Mr. Hamilton that 
I myself had directly consulted private attorney John F. Campbell of Austin in regard to concerns of mine about alleged violations of my own privacy rights in Austin...."

"This is a five-part, narrowly-focused Texas Open Records request in which I seek to obtain from you:

"(a) any and all written or typed or word-processed or printed communications generated by Ms. Terrie Reyes-Kitch or any other applicable AISD staff member or official at any time since 8:15 p.m. July 29, 2020, that refer in any way to a "block" (ITEM "A" DOCUMENT, BELOW) having been imposed by your public school district on 
e-mails of mine to the Board of Trustees of the Austin Independent School District, or that refer to what prompted your public school district to impose a "block" on e-mails of mine to the AISD Board of Trustees.

"(b) any and all follow-up e-mail communications (ITEM "B" DOCUMENTS, BELOW) generated on any date after July 19, 2020, 
in which Ms. Terrie Reyes-Kitch or some other staff member for your school district's Board of Trustees directly referred in writing in any context or in any manner to myself, AISD Stephen F. Austin High School alumnus John Kevin McMillan of Austin, Texas.
The cited e-mail communications on any date after July 19, 2020, might have possibly included any follow-up e-mail communications from Ms. Reyes-Kitch to a school district administrator or member of the AISD Board of Trustees, such as the President of the AISD Board of Trustees, that referred at least once in writing in any manner to myself, John Kevin McMillan of Austin.

"(c) any and all e-mail communications generated by Ms. Terrie Reyes-Kitch or any AISD Police Officer or any other applicable school district official on any date after July 19, 2020, that specifically referred in any way to a reply e-mail letter I myself wrote and e-mailed to your school district Board of Trustees at 10:18 p.m. July 20, 2020 (ITEM "C" DOCUMENT, BELOW), that was specifically addressed to and sent to Ms. Terrie Reyes-Kitch, Executive Assistant to the AISD Board of Trustees.

"(d) any and all written or typed or word-processed or printed communications, including handwritten notes, generated or produced or written or sent or forwarded or mailed or FAXed by your AISD Police Department that directly refer to what prompted Officer John Yoder of the AISD Police Department to make a phone call to me on June 21, 2020, at my home phone number of (512) 342-2295 and himself leave the following exactly quoted recorded voice mail message for me in that one total phone call that Officer Yoder has ever made to me on any occasion:

"'Yes, Mr. McMillan, this is Officer Yoder with the Austin ISD Police Department. Just wanted to, uh, try to make contact with you. We've had some e-mails that you've sent forwarded to us. Sounds like you may be trying to request some information. Just want to see if we could help you out. So give us a call back when you can. Our dispatch number is going to be (512) 414-1703. Thank you."

"(e) any and all written communications on file with the Austin Independent School District Police Department that refer at least once to any AISD student, any AISD teacher, any AISD staff member, any AISD administrator, or any AISD Police Department officer ever on any occasion on any date since or including June 21, 2019, ever at any time having been physically present anywhere inside my current always-double-bolt-locked and always-fully-locked solo-occupancy rental-apartment unit at Pebble Creek Apartments, 8805 North Plaza Drive, in northeast Austin...."
