ATTORNEY GENERAL OF TEXAS ON APRIL 28, 2017, INVITES ME TO FILE A COMPLAINT VS AUSTIN CITY ATTORNEY RE: RAPE CASE

FRIDAY, APRIL 28, 2017, LEAVES RECORDED VOICE-MAIL PHONE MESSAGE (BELOW) TO MYSELF, OPEN RECORDS REQUESTOR AND AUSTIN DISTRICT 10 RESIDENT JOHN KEVIN McMILLAN, INVITING ME TO SUBMIT A LEGAL COMPLAINT AGAINST THE AUSTIN CITY ATTORNEY'S OFFICE FOR ITS ALLEGED FAILURE TO SEND MYSELF, THE REQUESTOR, A CARBON-COPY OF THE CITY'S APRIL 2017 REPORTED REPLY LETTER TO THE ATTORNEY GENERAL OF TEXAS ON THE JANUARY 2017 OPEN RECORDS COMPLAINT (OAG COMPLAINT NUMBER 652094) AGAINST THE AUSTIN POLICE DEPARTMENT (APD) BY MYSELF---WITH THAT FIRST COMPLAINT FROM ME HAVING ALLEGED THAT APD FAILED TO PROVIDE ME WITH ACTUAL COPIES OF LEGAL DOCUMENTS REFERRING TO THE DATE OF SHIPMENT AND OUT-OF-STATE DNA LAB PROCESSING SITE FOR THE DEC. 22, 2011, DOCTOR-ORDERED FORENSIC DNA-SWABS RAPE-KIT FOR APD CASE 11-355016, AN ALLEGED CRIME CASE IN WHICH I MYSELF AM THE CITED LONGTIME-CELIBATE-BY-CHOICE, SINGLE-BY-CHOICE, GAINFULLY EMPLOYED, DEPENDABLY CIVIL AND LAW-ABIDING AND HONEST, PERMANENTLY ALCOHOL-FREE, WHITE ADULT MALE VICTIM AND COMPLAINANT:

"Hello, Mr. McMillan, this is Joseph Benhke at the Open Records Division at the Attorney General's Office, returning your phone call.

"Uh, in relation to the correspondence uh, the, uh, governmental body sent us and did not copy you in, in the informal complaint process, there are less rules, and stuff associated procedurally. 

"Um, and so they are, they are not required to---often they do, but they are not required to send uh, what correspondence they send to us, to the requestor as well, to the complainant as well.

"Um, so, uh, it it's not, I mean if you did make a complaint, uh, it would, it's not a violation or anything that we could do anything about.

"Um, and so, uh, so there's, I mean, so I mean you're welcome to file a complaint. But it probably wouldn't go, uh, anywhere, because it's not a violation----because they are not required to send it to the complainant as well.

"If there's anything else I can, uh, answer for you, give me a call back. My number: 512-936-1391.

"Again, that's 512-936-1391. Thanks."
