Dear Attorney General Paxton, 

The City of Austin (the “City”) received the above-referenced public information request. The City was closed on November 28 and 29, 2019. The City has made a good-faith effort to relate the request to information in its custody. 

The City believes the information at issue is excepted from required public disclosure under section 552.107 of the Government Code. This letter is a request for a determination under section 552.301 of the Government Code that the information at issue is so excepted. A copy of the request and a representative sample of the information are enclosed. 

By copy of this letter the City is notifying the requestor that it has asked for a decision from the Office of the Attorney General. 

Section 552.107(1) of the Government Code protects information within the attorney-client privilege. When asserting the attorney-client privilege, a governmental body has the burden of providing the necessary facts to demonstrate the elements of the privilege in order to withhold the information at issue. Open Records Decision No. 676 at 6-7 (2002). 
First, a governmental body must demonstrate the information constitutes or documents a communication. Id. at 7. 
Second, the communication must have been made “to facilitate the rendition of professional legal services” to the client governmental body. TEX. R. EVID. 503(b)(1). 
The privilege does not apply when an attorney or representative is involved in some capacity other than providing or facilitating professional legal services to the client governmental body. In re Tex. Farmers Ins. Exch., 990 S.W.2d 337, 340 (Tex. App.—Texarkana 1999, orig. proceeding) (attorney-client privilege does not apply if attorney acting in a capacity other than that of attorney). Governmental attorneys often act in capacities other than professional legal counsel, such as administrators, investigators, or managers. Thus, the mere fact a communication involves an attorney for the government does not demonstrate this element. 
Third, the privilege applies only to communications between or among clients, client representatives, lawyers, and lawyer representatives. TEX. R. EVID. 503(b)(l). Thus, a governmental body must inform your office of the identities and capacities of the individuals to whom each communication at issue has been made. 
Lastly, the attorney-client privilege applies only to a confidential communication, id. 503(b)(1), meaning it was “not intended to be disclosed to third persons other than those: (A) to whom disclosure is made to further the rendition of professional legal services to the client; or (B) reasonably necessary to transmit the communication.” Id. 503(a)(5). 
Whether a communication meets this definition depends on the intent of the parties involved at the time the information was communicated. Osborne v. Johnson, 954 S.W.2d 180, 184 (Tex. App.—Waco 1997, orig. proceeding). 
Moreover, because the client may elect to waive the privilege at any time, a governmental body must explain that the confidentiality of a communication has been maintained. Section 552.107(1) generally excepts an entire communication that is demonstrated to be protected by the attorney-client privilege unless otherwise waived by the governmental body. See Huie v. DeShazo, 922 S.W.2d 920, 923 (Tex. 1996) (privilege extends to entire communication, including facts contained therein).

The information at issue consists of e-mail communications between attorneys in the City’s Law Department and City employees in their capacity as client representatives. These communications were made in order to facilitate the rendition of legal services to the City. These communications were intended to be confidential and have remained confidential. Accordingly, the City may withhold the information under section 552.107(1) of the Government Code.

This is a Texas Open Records request in which I seek to obtain from you a copy of any and all e-mail communications or any other written communications that at any time in calendar year 2019 were authored or generated or received or sent or mailed or forwarded or FAXed by any staff member or official of the Office of Police Oversight (OPO) of the City of Austin, and that, in each such case, specifically referred in any manner either to myself, John Kevin McMillan of Austin, or to OPO Complaint Number 2019-1056.

I myself wrote and submitted the above-cited OPO complaint on September 25, 2019, at the official OPO website.

This public-information request was prompted in part in part by the factual information that no OPO staff member employed as a "Complaint Specialist" has ever actually interviewed me or spoken with me on the telephone at any time. I have called the Office of Police Oversight on several occasions in recent weeks, and I have been repeatedly informed on the phone that either a complaint specialist or a cited supervisory staff member in that office will call me back and speak with me. However, I have not yet received any such reply phone call or reply phone message from an actual complaint specialist or an actual supervisor for the OPO. So far, I have not been granted any phone conversation or in-person meeting with any supervisor or any complaint specialist in that new government office for the City Government of Austin. I did leave one voice mail message at 2:36 p.m. November 5, 2019, for Ms. Mia Demers, a cited female work supervisor for OPO, upon referral at that time from a female program specialist who had herself politely answered the telephone for OPO at 2:25 p.m. November 5. That female program specialist stated to me that her own first name is "Mallory", but that she was not willing to state her own last name, Mallory said.

The most recent written reply I have received so far from the Office of Police Monitor was the following e-mail to me:

The civilly-worded legal complaint to OPO from myself that I submitted online on September 25, 2019, was focused on Sergeant Sandra Benningfield of the Austin Police Department Sex Crimes Unit. Sergeant Benningfield is the reported chief administrator of the APD Sex Crimes Unit, and is reportedly one of three total sergeants currently employed in that APD unit in Austin, Texas. The other two sergeants in that APD Unit are reportedly Sergeant Richard Jennings and Sergeant Jason Laduque.

The Office of Police Oversight reports directly to the Austin City Manager, according to what I was told this week by a very helpful 311 telephone reference service staff member for the City of Austin.

Two of the primary phone numbers for the City of Austin Office of Police Oversight are: (512) 974-9090 and (512) 972-2676. The OPO FAX number is 512-974-6306. The street address for the OPO is: 1520 Rutherford Lane, Austin, TX 78754.
