A respectful FYI to each of you on these additional public policy-related and public safety-focused concerns of mine that I hope will help to promote dialogue and ideas for possible new state laws or possible  new state policies here in Utah.

 from former Texas DPS full-time staff member and permanent Utahn resident (ever since January 1, 2023) John Kevin McMillan of Salt Lake City.

I am very happy to be living in the same  state where my paternal grandparents, Mr. and Mrs. Parley and Alice Mae Pugh (her maiden surname) McMillan, lived together as civic-minded residents raising a family in Murray, Utah.  Parley McMillan owned a butcher shop in Murray, and he and his wife were devoted members of The Church of Jesus Christ of Latter-day Saints.

Their youngest son ----my father, Murray native Dr. Calvin McMillan, who was employed for many years as a Botany Professor at The University of Texas at Austin  ---- commented to me in the 1980s or 1990s that in his own entire life he (Father) had never once sustained any traffic  accident at any time when  Calvin McMillan was behind the wheel of a motor vehicle.

Dear Utah State Legislature House of Representatives Majority Leader Mike Schultz,

I greatly appreciate your kind stated recent written  request to me that I also share with you in writing any concerns of mine that might be helpful to you and your Utah House colleagues as you give full consideration to possible new proposed state laws and state policies for our great  State of Utah.

Some additional concerns of mine are:

---Some or many of the respective persons that were each holding or claiming to hold  "power of attorney" legal authority over a permanent resident  of Utah might possibly have subjected that  Utahn resident--- and possibly a government official in Utah---to deliberately fraudulent or knowingly hostile communications, or may have abused or injured or endangered the personal safety of the cited Utahn resident through "power of attorney" actions they pursued that were ostensibly on behalf of that individual but were instead harmful to that Utahn resident.

---I also sense that some or many current residents of Utah were never at any time provided by a person  claiming to hold "power of attorney" over themselves with the opportunity to obtain for their own legal records file  and  review a notarized  copy of  the currently applicable power-of-attorney authorization form they had approved in writing  that gave power of attorney authority to a cited individual.

----I am not sure whether state law in Utah currently  requires that any person claiming to hold legal authority over a permanent resident of Utah must keep that notarized and approved legal-authorization document on file at all times with an officially designated office of the County Government in the county of residence of  the individual holding that legal authority,  and also in the county of residence of the individual who reportedly had "given" power-of- attorney authority to the former individual.

It might be help law enforcement agencies in Utah and protective services investigators in Utah if they each had immediate and automatic year-round  online access to any and all such "power of attorney"online  records that are ever on file anywhere in Utah.

-----The incidence of  Road Rage-related personal- injury crimes on or along highways and other roadways here in Utah  may continue to occur with alarming frequency  unless the Utah Legislature takes action.

Among the possible actions the Utah House might pursue are:

(1) Require that all high school students at public high schools in Utah and all public-college students in Utah must each attend an all-school or all-campus assembly featuring an educational  movie about "Road Rage in Utah"---a movie  that offers 15 or more tips on how to avoid being victimized by Road Rage violence and how to avoid victimizing others with Road Rage violence here in Utah. 

Presentation of each such educational film before students and faculty  of that public school or public institution of higher education in Utah could be followed by a question- and-answer session in which an "Expert on Road Rage Prevention in Utah"  answers questions from students and faculty members.

(1a) The Utah Legislature could authorize the Utah DPS and Utah Department of Transportation to develop guidelines for official issuance of "Utah  Road Rage Prevention Specialist" certifications here in Utah.

(2) The Utah Legislature House of Representatives could authorize funding for State-mandated establishment of a fully-illustrated and easy-to- understand English-language and Spanish-language "Utah Road Rage Prevention" official website. 

The proposed website could offer 10 or 15 online tips on how a Utahn motorist or Utahn  pedestrian or Utahn  bicyclist  can  help prevent Road Rage-related violence  from ever  occurring.

A variety of online  photos and videoclips at that official  website could illustrate HOW a motorist in Utah SHOULD NOT  react or conduct himself when he is involved in a Road Rage incident. 

Other  online photos and videoclips at that website could offer tips  on HOW TO RESPOND in a civil and law-abiding and polite manner during a possible verbal  conflict, such as after a collision  with another motorist or a pedestrian or bicyclist or scooter rider, etc.

(3) The  Utah Legislature could require certification by   all driver-education instructors in Utah on how they can successfully teach their students to never themselves ever commit a Road Rage-related act of violence or verbalize a death threat or threat of violence against  another motorist here in Utah. 

Each driver-education instructor in Utah could be required to ask each of his or her students to take and pass a written Road Rage Prevention multiple-choice test before each such  student is permitted to ever take a driver certification test by  the State of Utah that enables him or her to get approved for a State of Utah-issued driver's license.

(4) Require that any and all persons involved in a Road Rage-related incident in Utah must undergo medical tests on their blood or urine or breath that identify whether any of the persons involved in that Road Rage incident were under the influence of marijuana, so-called "medical" marijuana, cocaine or another illicit drug, or alcohol at the time of the incident. Road Rage crime suspects could be subjected to automatic Felony Crime allegations if any of those tests indicate that the cited motorist was driving "under the influence" of alcohol or a psychoactive drug or illicit drug.

(5) Revise the state penal code of Utah, if need be, to specifically include the term "Road Rage", such as "Road Rage Assault" or "Road Rage Vehicular Homicide" or "Road Rage Death Threat",  in any and all formal criminal charges for which a law-enforcement officer in Utah arrests an applicable suspect along a roadway in Utah.

(6) Sponsor a study to determine whether  the incidence of Road Rage Crimes in Utah may be heavily concentrated at certain highway intersections or along specific stretches of public highways in Utah.

The Utah House of Representatives under your very fine leadership could approve funding for a study by the Utah Department of Transportation and the Utah DPS to identify where the "Road Rage Hubs" of Utah currently are located.

(7) I am concerned about the possibility that inadequate shoulders or the absence of shoulders along some highways in Utah, potholes on roadways, hazardously narrow lanes, overly abrupt "merge lanes" conditions on roadways in Utah, and slippery or icy conditions on roads in our state  may increase the risk of angry conflicts erupting between motorists here in Utah. 

Possibly the State of Utah could offer financial incentives for motorists to purchase brand-new snowy-weather and icy-weather tires that are less likely than conventional tires to hydroplane in Utah.  The better the traction of motorists' tires on roadways here in Utah, the lower the risk of collisions  occurring that might trigger Road Rage here in our state.

Another possibility might be that the Utah House could approve increased funding for the Utah Department of Transportation toward the  purchase of additional snowplows and employment of additional emergency weather conditions staff members who help quickly remove snow and ice from highways and other heavily traveled roadways here  in Utah.

The Utah House could approve funding for a new study by the Utah Department of Transportation state agency and  the Utah Department of Public Safety state agency, including the Utah Highway Patrol, that attempts to determine the percentage of Road Rage incidents in Utah in which highway or bridge  design or construction  flaws or a damaged road or bridge or  inadequate placement of traffic safety  signs along highways in Utah might have caused or partly caused conflicts between motorists along or on a highway or other roadway in Utah.
