Thank you for your very prompt December 7, 2021, reply letter to me in response to my revised public-information request earlier today to your state agency.

 

The text of my December 7 public-information request that you sent me today as an accompaniment to your reply letter was incomplete. As I  mentioned in a follow-up e-mail letter I sent at 11 a.m. today to your state agency at your official public-information requests address, I have added the following exact verbatim text (below) to the next-to-last paragraph of my Open Records request that I had originally sent you at 1:16 a.m. today.

 

As a convenience to yourself, please note, final item below, that I have also inserted this multi-paragraph additional text just before the final paragraph in my revised and expanded public-information request letter to your state agency in Austin. Please disregard the previous and incomplete version of my public-information request that I had originally sent to you at 1:16 a.m. today. Thank you for your kind patience and understanding about this revision I have made to my public-information request to your state agency.

 

The additional text I added at 11 a.m. today to my public-information request to your state agency is:

 

I have repeatedly over a multi-decade period informed the Austin Police Department (APD) and the APD Sex Crimes Unit here in Austin, Texas, that I have been victimized by and am being victimized by alleged CONTINUOUS AND CONTINUING, DAILY AND YEAR-ROUND home-invasion crimes, sex-crimes, and personal-injury-crimes allegedly inflicted on me during my sleeping hours as I lay alone or lie alone on my own bed, asleep and unconscious, inside my bolt-locked rental-housing unit in Austin. 

 

I always sleep alone on my own bed, I never have any overnight guest of my own, and I have been completely celibate anywhere and everywhere in Austin---and anyplace else where I have traveled to or been situated---ever since and including the day I moved to north Austin in August 2001. I might add that I have been completely sober at all times throughout the entire period ever since I moved to north Austin in August 2001. In fact, the last-ever occasion in which I ever consumed any quantity of drinking alcohol anywhere in the entire world occurred in the late summer of 1990, here in Austin. I drank that alcohol inside a bar, the Texas Showdown Saloon, at 2610 Guadalupe Street, across the street from the UT-Austin campus. I might add that in my entire life I have never at any time ever once consumed any illicit drug other than marijuana, and the most recent occasion in which I consumed any quantity of marijuana occurred in the late fall of 1984, in the Worcester area of Massachusetts. 

 

Despite my repeated statements to APD over a multi-decade period about the allegedly CONTINUOUS DAILY AND YEAR-ROUND nature of the alleged home-invasion-crimes and alleged sex crimes and personal-injury-crimes victimizing me in each of my respective rental-housing units in Austin where I resided as a rent-paying official tenant or rent-paying approved occupant, the Austin (TX) Police Department has never at any time ever once agreed to classify any of the home-invasion-crimes and sex-crimes cases that I have reported to  APD as a CONTINUOUS CRIMES case.

 

Of the three total forensic DNA-evidence sexual-assault-evidence medical-exam kits that APD currently has in its possession, APD's Sex Crimes Unit has so far chosen not to retroactively process any of those rape-evidence kits for the full maximum possible 190-day time period. I remain very hopeful that APD will be willing to reconsider its "no full 190-day-retroactive forensic DNA-traces processing" policy toward myself and the three separate rape-evidence kits that were obtained from me in Austin.

 

Those rape-evidence kits were obtained from me at my request for APD Sex Crimes Cases 11-1180447 (an April 28, 2011, forensic Sexual Assault-evidence medical exam on me in the St. David's Hospital ER in central Austin), 11-3550615 (a Dec. 22, 2011, early-morning forensic Sexual-Assault-evidence medical exam on me in the St. David's Hospital ER in central Austin), and 2021-2440624 (a Sept. 2, 2021, early-morning forensic Sexual-Assault-evidence medical exam on me in the Dell Seton Hospital ER in central Austin). Of those three respective forensic exams on me that I had specifically requested, two ---- the Sept. 2, 2021, forensic exam on me and the April 28, 2011, forensic anal-rape-evidence medical exam on me --- were pre-authorized for me by APD's Sex Crimes Unit.

 

I need to also add with polite emphasis that I have repeatedly informed the APD Sex Crimes Unit over a multi-year period that I myself DO NOT agree to ever have any sexual contact of any type with any non-Anglo person---and I do insist on my legal right to file criminal charges, when applicable, against any non-Anglo person (or any other person, for that matter) who allegedly subjected me to assault by physical contact during my sleeping hours or sexual assault or personal-injury-crimes or home-invasion-crimes during my sleeping hours inside my bedroom or partitioned bed area of any of my respective bolt-locked or locked rental-apartment units or bolt-locked hotel rooms where I have resided in Austin.

 

I have also repeatedly and specifically emphasized to the Austin Police Department Sex Crimes Unit this year, for instance, that I DO NOT agree to ever have any sexual contact of any type with any person more than two years older than me---and I do press charges accordingly, when applicable.

This is a Texas Open Records request in which I seek to obtain from you a copy of any and all e-mail communications, reports, memoranda, directives, other written communications referring at least once in any manner either to myself, John Kevin McMillan of Austin, or to the level of safety of my own rental-housing conditions here in Austin, that at any time since June 1, 2018, were each written, generated, produced, received, sent, mailed, forwarded, or FAXed by any staff member or official of your state agency---including your President, your Executive Vice President, your Governor-of-Texas-appointed Board of Directors or any individual member of your board, your Senior Manager for External Relations, or any attorney employed by your state agency.

 

According to your current official website, your current President of your state agency is David Long; the current Executive Vice President of your state agency is Janie Taylor; and the current Senior Manager for External Relations at your state agency is Michael Wilt.

 

Your state agency's official website currently contains the following statement: "TSAHC was created in 1994 as a self-sustaining nonprofit housing organization. At TSAHC we believe that every Texan deserves the opportunity to live in safe, decent and affordable housing. Our programs target the housing needs of low-income families and other underserved populations in Texas who do not have acceptable housing options through conventional financial channels. All TSAHC programs are offered statewide, with special attention given to rural areas and other select target areas."

 

My legal name is John Kevin McMillan. I was born on April 27, 1957, at Lincoln, Nebraska. I am a lifelong single gentleman.

 

I am a gainfully employed, permanently-alcohol-free, lifelong-tobacco-free, lifelong-non-vaping, dependably civil and law-abiding and non-stalking and public-safety-minded, anti-marijuana-minded, lifelong-tattoo-less, facially-cleanshaven, clean-talking (no profanity verbalized by me in my everyday conversations with others), longtime celibate-by-choice, very recently-certified-HIV-negative, platonicly polite, permanently-jewelry-less, white Anglo-Saxon gentleman of English, Scottish, and German ancestry. I myself do not have any criminal-conviction record. 

 

I am the founder and only current member of a new and politely non-Christian as well as non-proselytizing factually-focused religion, the Honor Society "Progressive Prohibitionist Religion" (PPR), that has very stringent membership-eligibility requirements. 

I will not agree to even consider permitting any other person to officially apply to be a member of or to be a member of my fully-independent PPR religion, until a full 12-consecutive-month time period has passed in my own life in which I agree that I myself enjoy full privacy rights, consistently safe housing conditions, consistently safe living conditions, and fully honest and reliable news and information services throughout that entire 12-month period.

 

In the period ever since June 1, 2018, I have submitted numerous crime reports and criminal-law complaints with the Austin Police Department about alleged home-invasion crimes victimizing me during my sleeping hours and alleged unsafe housing conditions for myself during my sleeping hours---including alleged verbal harassment of me, alleged-sleep-harassment crimes, alleged sexual-assaults and other personal-injury-crimes victimizing me, and alleged noise pollution inflicted on me against my wishes inside bolt-locked rental-housing units in Austin where I resided as a rent-paying official tenant or rent-paying approved occupant. 

 

During the time period ever since June 1, 2018, I have undergone four or more separate doctor-ordered medical surgeries on myself in local hospitals in Austin relating to cardiovascular problems and circulatory problems and digestion-related problems I sustained in recent years in Austin. One first-rate medical physician whom I have consulted in Austin in recent years, Dr. Carson Higgs of Austin Regional Clinic at Quarry Lake, stated to me during a medical appointment I had with him that sleep deprivation I experienced inside my rental-housing unit in Austin might have played a role in my developing medical problems for which medical surgeries were then needed for me here in Austin, Texas.

 

One first-rate medical physician with the Austin Regional Regional Clinic Far West Specialists clinics location in Austin, Dr. Amy Mason, herself a Super Doctor-designated dermatologist, stated to me in person during a medical appointment I had with her this year that Dr. Mason agrees with me that I will benefit from significantly safer housing conditions and living conditions if I move from Austin, Texas, to Salt Lake City, Utah.

 

Two different officers of the Austin Police Department (APD), APD Detective William Costello of the APD Sex Crimes Unit and APD Officer Lelan Larroque of the APD Crisis Intervention Team, respectively, have also each stated to me in 2021 in separate telephone conversations I had with each of them that they each believe that I will enjoy safer living conditions and safer housing conditions for myself if I move from Austin, Texas, to Salt Lake City, Utah.

 

"It should get a lot quieter for you (John Kevin McMillan of Austin) after you move to Salt Lake City, Utah", one honorable Central Texan not employed by the Austin Police Department stated to me late this year.

 

One male adult work supervisor of mine at a workplace of mine in northwest Austin stated to me in the last few weeks that he believes it makes good sense for me to move from Austin, Texas, to Salt Lake City, Utah, and that I should benefit from significantly safer housing conditions for myself in that state-capital city for Utah, that assistant manager indicated to me.

 

One former classmate of mine from Stephen F. Austin High School, James Willett, in a recent prior year very helpfully volunteered to me inside the Catfish Parlor restaurant in northwest Austin that James recommends that I move to Salt Lake City, Utah, from Austin, Texas. James stated that he believes that I will find significantly more affordable housing for myself in Salt Lake City, and that my overall living expenses in Salt Lake City will be significantly lower for myself than they have been for me in Austin, Texas.

 

I was Salutatorian of the Class of 1975 for Stephen F. Austin High School of Austin Independent School District here in Austin, Texas. I am a graduate of The University of Texas at Austin and The University of Minnesota Graduate School of Journalism and Mass Communications (in Minneapolis), respectively.

 

 I have most recently resided in Austin, Texas, on a continuous and uninterrupted basis ever since mid-March 1997.

I have repeatedly over a multi-decade period informed the Austin Police Department (APD) and the APD Sex Crimes Unit here in Austin, Texas, that I have been victimized by and am being victimized by alleged CONTINUOUS AND CONTINUING, DAILY AND YEAR-ROUND home-invasion crimes, sex-crimes, and personal-injury-crimes allegedly inflicted on me during my sleeping hours as I lay alone or lie alone on my own bed, asleep and unconscious, inside my bolt-locked rental-housing unit in Austin. 

 

I always sleep alone on my own bed, I never have any overnight guest of my own, and I have been completely celibate anywhere and everywhere in Austin---and anyplace else where I have traveled to or been situated---ever since and including the day I moved to north Austin in August 2001. I might add that I have been completely sober at all times throughout the entire period ever since I moved to north Austin in August 2001. In fact, the last-ever occasion in which I ever consumed any quantity of drinking alcohol anywhere in the entire world occurred in the late summer of 1990, here in Austin. I drank that alcohol inside a bar, the Texas Showdown Saloon, at 2610 Guadalupe Street, across the street from the UT-Austin campus. I might add that in my entire life I have never at any time ever once consumed any illicit drug other than marijuana, and the most recent occasion in which I consumed any quantity of marijuana occurred in the late fall of 1984, in the Worcester area of Massachusetts. 

 

Despite my repeated statements to APD over a multi-decade period about the allegedly CONTINUOUS DAILY AND YEAR-ROUND nature of the alleged home-invasion-crimes and alleged sex crimes and personal-injury-crimes victimizing me in each of my respective rental-housing units in Austin where I resided as a rent-paying official tenant or rent-paying approved occupant, the Austin (TX) Police Department has never at any time ever once agreed to classify any of the home-invasion-crimes and sex-crimes cases that I have reported to  APD as a CONTINUOUS CRIMES case.

 

Of the three total forensic DNA-evidence sexual-assault-evidence medical-exam kits that APD currently has in its possession, APD's Sex Crimes Unit has so far chosen not to retroactively process any of those rape-evidence kits for the full maximum possible 190-day time period. I remain very hopeful that APD will be willing to reconsider its "no full 190-day-retroactive forensic DNA-traces processing" policy toward myself and the three separate rape-evidence kits that were obtained from me in Austin.

 

Those rape-evidence kits were obtained from me at my request for APD Sex Crimes Cases 11-1180447 (an April 28, 2011, forensic Sexual Assault-evidence medical exam on me in the St. David's Hospital ER in central Austin), 11-3550615 (a Dec. 22, 2011, early-morning forensic Sexual-Assault-evidence medical exam on me in the St. David's Hospital ER in central Austin), and 2021-2440624 (a Sept. 2, 2021, early-morning forensic Sexual-Assault-evidence medical exam on me in the Dell Seton Hospital ER in central Austin). Of those three respective forensic exams on me that I had specifically requested, two ---- the Sept. 2, 2021, forensic exam on me and the April 28, 2011, forensic anal-rape-evidence medical exam on me --- were pre-authorized for me by APD's Sex Crimes Unit.

 

I need to also add with polite emphasis that I have repeatedly informed the APD Sex Crimes Unit over a multi-year period that I myself DO NOT agree to ever have any sexual contact of any type with any non-Anglo person---and I do insist on my legal right to file criminal charges, when applicable, against any non-Anglo person (or any other person, for that matter) who allegedly subjected me to assault by physical contact during my sleeping hours or sexual assault or personal-injury-crimes or home-invasion-crimes during my sleeping hours inside my bedroom or partitioned bed area of any of my respective bolt-locked or locked rental-apartment units or bolt-locked hotel rooms where I have resided in Austin.

 

I have also repeatedly and specifically emphasized to the Austin Police Department Sex Crimes Unit this year, for instance, that I DO NOT agree to ever have any sexual contact of any type with any person more than two years older than me---and I do press charges accordingly, when applicable.
