Dear Open Records Coordinator Melissa in the Office of General Counsel (OGC) for the Texas Department of Criminal Justice (TDCJ) state agency in Huntsville, with your OGC office phone number of 1-936-437-6700,
It was very good to talk with you on the phone today from 4:29 p.m. to 4:40 p.m.in regard to my December 6, 2021 (official date of receipt by your state agency), public-information request focused on myself and your TDCJ Office and General Counsel exclusively in the time period ever since noon on June 21, 2019.
As I indicated in our conversation today, I was surprised that your state agency---in a December 20, 2021-dated cost estimate for me you e-mailed me today as an attachment---is asking me to pay an estimated $122.40 in exchange for any and all responsive documents.
My Dec. 6, 2021, request had sought "
a copy of any and all e-mail communications, reports, memoranda, or other written communications that were typed, word-processed, handwritten, sent, mailed, FAXed, or forwarded at any time since 12 p.m. June 21, 2019, by any staff member or attorney or administrator in your state-agency's Office of General Counsel in Huntsville, Texas, and that, in each and every such case, referred at least once in any manner to myself, John Kevin McMillan of Austin, Texas."
Thank you for your helpful suggestion in our phone conversation today that I might be able to reduce the administrative-processing fee I am charged by TDCJ if I focus my public-information request on any recent "litigation suits" (exact quote of your comment to me) that refer to me by name for which your state agency's Office of General Counsel litigation office in Austin or your TDCJ Office of General Counsel in Huntsville has a record.
In response to my question to you today about whether TDCJ has any record of any restitution payment of money having been paid to me---or currently being scheduled for payment to me, I might add at this time----on behalf of one or more persons with a felony-conviction record in Texas, you helpfully pointed out in our phone conversation today that I could obtain that information by submitting a new public-information request to the official TDCJ e-mail address of "PIA@tdcj.texas.gov".
Melissa, I also appreciated your kind statement to me on the phone this afternoon that your TDCJ Office of General Counsel does not have any record of myself having ever been an inmate in any TDCJ prison facility anywhere in Texas. TDCJ prison facilities, as you pointed out in our phone conversation this afternoon, are exclusively for inmates with a felony conviction record.
I myself do not have any felony-conviction record, you agreed in our phone conversation this afternoon.
I also appreciated your polite reply to my question to you on the phone today about whether the TDCJ has any record of myself being currently employed by the TDCJ. Your candid reply to that question from me today was: "I'm not sure whether you (John Kevin McMillan of Austin) are currently employed by the TDCJ" (a near-exact quote, with the term "not sure" an exact quote from your comment to me today on that subject).
In response to my question to you on the phone today about whether the TDCJ possibly owns any portion of the property at "Pebble Creek Apartments", 8805 North Plaza Drive, where I currently reside in Apartment 2418 of Bldg. 17, you politely replied that "I (Melissa) don't know anything about that."
Thank you again for taking the time to talk with me about how I can reduce the administrative-processing fee I incur from submitting a public-information request focused on your TDCJ Office of General Counsel and me. I appreciate your very courteous and professional style on behalf of the TDCJ.
