Texas Department of Public Safety,
Office of General Counsel,

Austin, TX 78752

Dear Texas DPS Open Records Coordinator,

This is a Texas Open Records request in which I seek to obtain from you a copy of any and all e-mail letters or other written communications referring at least once in any manner to myself, John Kevin McMillan of Austin, that were written or received or forwarded or mailed or sent at any time since April 1, 2011, by a staff member or attorney or administrator in your State of Texas law-enforcement agency's Office of General Counsel here in Austin.

Excluded from this request are any and all e-mails that I myself had specifically and directly sent to your state agency's Office of General Counsel.

My legal name is John Kevin McMillan. I was born on April 27, 1957, in Lincoln, Nebraska. I am former salutatorian of Stephen F. Austin High School of Austin ISD here in this state-capital city for Texas. I am the founder and only current approved member of a new and non-Christian, factually-minded and implicitly-deistic, permanently drinking-alcohol-free religion, the Progressive Prohibitionist Religion. I am a lifelong single gentleman, and I am Anglo-Saxon in ancestry. I have been and continue to be a resident of Austin on a continuous and uninterrupted basis ever since mid-March 1997. I lead a permanently drinking-alcohol-free (ever since the late summer of 1990), lifelong-tobacco-free and anti-tobacco-minded, lifelong-non-vaping, permanently marijuana-free (ever since the late fall of 1984), lifelong-illicit-drug-free in regard to any and all illicit drugs other than marijuana, lifelong-tattoo-less and anti-tattoos-minded, facially-cleanshaven (no beard, no mustache, no goatee) and anti-facial-hair-minded, clean-talking (no profanity verbalized by me in my everyday conversations with others), dependably civil and law-abiding and honest and conscientious and vigilant, pro-law-enforcement, public-safety-minded, healthful-living-minded lifestyle.

Ever since June 21, 2019, I have resided alone as the rent-paying only official tenant and the only apartment-management-team-approved occupant in an always-bolt-locked efficiency apartment unit at a very large gated-community apartment complex in northeast Austin, Pebble Creek Apartments, 8805 North Plaza Drive.   I am a longtime celibate (including on a continuous and uninterrupted basis ever since the day I moved to north Austin in August 2001), single adult Anglo non-Hispanic gentleman, and I always sleep alone on my bed. I might add with polite emphasis that I have never once permitted anyone but on-duty Austin Police Department officers or, on one total occasion, on-duty EMS staff members after I called 911 to complain about having vomited repeatedly inside my unit, to enter or be physically present anywhere inside my current apartment unit anytime between the hours of 8 p.m. in the evening and 8 a.m. in the morning.

As an official tenant at Pebble Creek Apartments, I  have frequently observed Austin Independent School District school buses being driven by Austin ISD employees into, out of, or through the gated-community parking lot area of my current apartment complex.

The apartment complex where I currently reside is located 5.1 miles in driving distance from the Texas Department of Public Safety state law-enforcement agency headquarters compound along North Lamar Boulevard. Even though I am a former full-time Texas DPS employee here in Austin, only one total crime investigator for the Texas Rangers Division of the DPS, Lt. Jesse Valdez, has ever directly contacted (below) me anytime since April 1, 2011, in regard to my repeated crime reports to APD about my being victimized by alleged continuous and continuing daily and year-round  home-invasion crimes and alleged continuous and continuing daily and year-round anal-rape-crimes and other personal-injury-crimes allegedly inflicted on me during my sleeping hours as I lay alone on my own bed, asleep and unconscious and possibly snoring, inside my bolt-locked apartment unit in north Austin.

Dear Lt. Valdez,

I would appreciate a clarification about your E-mail reply note to me.

Is the Texas Rangers Division of the DPS giving consideration to pursuing an investigation of any type in regard to this ongoing-felony-crimes case in which I am definitely the victim, and for which I am currently  obtaining additional infrared photographs during my bedtime hours from inside my bolt-locked apartment unit?

I raise this question after being awakened abruptly on my bed at 8:30 a.m. this morning, with an immediate sense of pain in my anus from an alleged illegal intruder. I did not see any illegal intruder, but my hunter's camera photographs from the early morning hours of today do contain at least one image that appears to be of someone OTHER than myself. With your kind prior permission, I will gladly E-mail to you two total infrared photos of possible illegal intruders from the last few days that have been taken from inside my bolt-locked apartment unit during my bedtime hours.

I am a single adult gentleman, I live alone, I'm a longtime celibate-by-choice gentleman (I've been celibate throughout all of my conscious or waking hours ever since December 1979, in the Austin area, and the most recent occasion in which I myself ever at any time participated in anal intercourse anywhere in the world was in 1987 or 1986, which occurred on one total occasion for that entire calendar year). I would also like to emphasize to your law-enforcement agency that NONE of my own current mutual-consent friends in my own personal life is or are homosexual, "gay," bisexual, transsexual, transvestite, or lesbian in sexual identity or gender identity per se. As a morally and aesthetically straight and law-abiding human being, I definitely feel much more comfortable with a higher percentage of law-abiding, non-smoking, non-alcoholic heterosexual men and a higher percentage of law-abiding, non-smoking, non-alcoholic heterosexual women in my own personal life, and overall life, than of the other cited subpopulations.

I never have any invited overnight guest inside my bolt-locked apartment at Wind River Crossing, nor have I ever had any invited guest inside my bolt-locked apartment unit after midnight.

It is very apparent to me that there has been yet another criminal intruder inside my bolt-locked apartment unit this morning as well, and I would welcome any and all DNA testing on my bedsheets (which do have several stains on them that appear to have been caused by an illegal intruder) and on my own body (my anus, my buttocks, my ears, my nostrils, my chest, my genitals, etc.) that the Texas Rangers or the Texas Department of Public Safety, a former employer of mine, might be willing to sponsor or request or obtain at this time.

Sincerely and Best Wishes,

John Kevin McMillan, a single adult gentleman who myself is the founder of a new and NON-proselytizing one-member fully-independent religion, the non-Christian and modern Progressive Prohibitionist Religion, a drinking-alcohol-free "Honor Society" religion with very strict membership-eligibility requirements in which I am the ONLY approved member as of January 23, 2013.

My non-Christian, non-Catholic, non-Unitarian, non-Judaistic, non-Moslem, non-Shinto-Buddhist, non-atheist, implicitly-deistic and factually-minded religion emphatically opposes anonymous communications, opposes thought-control projects, opposes brainwashing attempts, opposes noise pollution injurious to anyone's hearing capacity, opposes fraudulent or dishonest communications, opposes legalization of marijuana, opposes consumption of marijuana in any context, opposes any and all illicit-drug activities, opposes tattoos on human bodies, opposes any and all "arranged marriages," opposes slavery, opposes sadomasochistic practices such as the physical beating and whipping or physical torture of anyone, opposes the failure of many to report criminal-law evidence of alleged felony crimes to a law-enforcement agency, and opposes personal-injury crimes as well as rape crimes.

My home address: 11411 Research Boulevard, Apt. 325, Austin, Texas, 78759.

Home phone: (512) 342-2295.

Mr. John McMillan,

We have received your email dated 01-01-2013 regarding your alleged allegations / complaints and your request to investigate Austin Police Department.  Furthermore, I also have received an additional thirty (30) emails from you regarding the same.  We are not investigating Austin PD.  Please continue to refer to Austin Police Department complaint process.

My primary personal e-mail address, "mcmillanj@att.net",  has remained the same throughout the entire 10-year period applicable to this public-information request. My landline phone number, (512) 342-2295, has remained the same throughout the entire 10-year period applicable to this public-information request.  My cell phone number of (512) 993-7305 has been the same ever since the summer of 2019, when I became a cell phone owner and cell phone user for the first time ever.

I have resided at the following respective home addresses during the 10-year period applicable to this public-information request:
---Wind River Crossing Apartments, 11411 Research Boulevard, Apt. 325, Austin, TX 78759.
---Crossland Economy Studios, Extended Stay America, 12621 Hymeadow Road, Apt. 133, Austin, TX 78729.
---Village Oaks Apartments, 10926 Jollyville Road, Bldg. 9, Apt. 902, Austin, TX 78759.
---Village Oaks Apartments, 10926 Jollyville Road, Bldg. 16, Apt. 1609, Austin, TX 78759.
---Austin Motor Inn, 11400 North IH 35 (a hotel room I rented for one week in June 2019 until I had official prior permission from the Pebble Creek Apartments management team to move into my new rental-apartment unit at the cited date and time of noon on June 21, 2019), Austin, TX 78753;
and, ever since June 21, 2019, Pebble Creek Apartments, 8805 North Plaza Drive, Building 17, Apt. 2418, Austin, TX 78753.

Many of the infrared motion-sensitive crime-evidence photos that have been taken for me during my sleeping hours inside my current double-bolt-locked efficiency rental-apartment unit's bedroom have appeared to show male persons (and possibly female persons, in some cases) who were significantly younger in age than myself or, in many cases, male persons who appeared to be older in age than myself. I have directly shared that alleged possible crime evidence with the Austin Police Department Sex Crimes Unit and other APD units. I am very opposed to the sex crime of pederasty. I am also very opposed to the outrageous crime of alleged human trafficking of a person during that person's sleeping hours as that individual lies alone, asleep and unconscious, on his or her own bed inside his locked private residence.

Officer John Yoder of the Austin Independent School District Police Department in Austin, Texas, contacted me on his own initiative on June 21, 2020, at my home phone number of (512) 342-2295. AISD Police Officer Yoder left the following exact verbatim voice-mail message with me that I have kept recorded in my home telephone's voice-mail system in my apartment unit for future reference:

"'Yes, Mr. McMillan, this is Officer Yoder with the Austin ISD Police Department. Just wanted to, uh, try to make contact with you. We've had some e-mails that you've sent forwarded to us. Sounds like you may be trying to request some information. Just want to see if we could help you out. So give us a call back when you can. Our dispatch number is going to be (512) 414-1703. Thank you."

One highly-regarded Ear, Nose, and Throat medical specialist whom I have consulted in Austin, Dr. David Tobey, stated to me in a recent prior year during a medical appointment I had with him that he believes that alleged home-invasion-crimes perpetrators inside my locked apartment unit at that time in northwest Austin had illegally subjected me to chloroform in my nostrils that held me unconscious during my sleeping hours as I lay alone on my own bed inside my locked apartment unit, Dr. Tobey helpfully volunteered.

The same Dr. Tobey earlier this century stated to me inside his medical clinic, then situated along Angus road in northwest Austin, that he believed that permanent damage to my own hearing capacity from continuous noise pollution in Austin that I myself had not generated and I myself was not blameworthy for, he said, was comparable in magnitude to what an Austin Police Department officer sustains over the entire course of that APD officer's career, Dr. Tobey stated.

I have been employed exclusively in the restaurant industry in Austin and nearby cities that included Round Rock and Cedar Park and possibly Pflugerville, on a continuous and uninterrupted basis throughout the entire 10-year period applicable to this public-information request.

In the 10-year period of this public-information request, I myself have undergone 10 separate doctor-ordered medical surgeries on myself in several respective hospitals of Austin (including St. David's North Austin Medical Center, Seton Central Medical Center in central Austin, and Heart Hospital of Austin) for potentially life-threatening medical problems I had sustained. One medical physician whom I consulted, Dr. Carson Higgs, a first-rate family-practice physician at Austin Regional Clinic Quarry Lake location, stated to me during a medical exam I had with him that sleep deprivation could have played a role in my having sustained damage to my circulatory system for which medical surgery was ordered by doctors. Ever since mid-April 2011, I have been awakened several times per night, in the middle of my nocturnal dreams, with anal pain or an unpleasant vibrating sensation  in my anus even though I don't own or use any vibrator of any type, an unpleasant nasal-inhalant sensation in my nostrils even though I do not own or use nasal inhalants, often with a ringing sensation in my eardrums, an urgent need to urinate in my apartment's bathroom, pain in my legs or hips, and wobbliness in my legs as I walked to the bathroom. Because of mysterious pain in my body I had sustained while unconscious during my sleeping hours, I often had difficulty falling back asleep after I walked back to my bed.

My Wind River Crossing Apartments management-team-approved roommate in northwest Austin from mid-April 2011 through the end of May 2011, Sandjaja Utama, a self-identified citizen of Indonesia and self-identified "member of the Catholic Church", stated to me several times while rooming with me and during interviews I had with him prior to my agreeing to let him apply with the management team for the legal right to room with me, that his "auntie" was a medical physician named "Dr. Sheila Shung" who resides with her husband in Round Rock, Texas, Mr. Utama stated. Mr. Utama stated to me that he himself was interviewed by Austin Police Department Sex Crimes Detective David Silva on the telephone during Mr. Utama's period of residence with me. That telephone interview took place after I filed a crime report with APD on April 28, 2011, for which APD's Sex Crimes Unit officially authorized a forensic DNA-swabs forensic sexual-assault-evidence medical exam on me for APD Case 11-1180447---a rape-evidence exam on me that occurred on April 28, 2011, inside the St. David's Medical Center ER in central Austin. There was never any APD arrest of any suspect in that APD alleged Sex Crimes case in which I was the single adult Anglo male complainant sleeping alone (as always) on my own bed.
