Dear Mr. Bowman,

Thank you for your prompt reply message (below) to me today about this very crucial public-policy issue relating to protection of the legal rights and human rights of individuals (I among those persons) who maintain that they were or are victimized by one or more alleged home-invasion-crimes and one or more alleged sexual assaults and one or more other personal-injury-crimes during their own sleeping hours as they lay alone or lie alone, unconscious and possibly snoring, on their own bed inside their bolt-locked private residence in Texas.

Your reply letter states: "Unfortunately, the Office of the Ombudsman does not have jurisdiction over the Austin Police Department and their policies.  Please contact the Austin Police Department for further assistance."

Does your reply letter indicate that the Executive Commissioner of your state agency or the Executive Council for your State of Texas agency, or an attorney for your state agency lacks the legal authority to at least offer a respectful advisory written opinion to Austin Police Chief Joseph Chacon or Austin City Attorney Anne Morgan that refers in writing to me and my own level of credibility?

I am referring to a written advisory statement on behalf of your very influential State of Texas agency which points out in writing that state law in Texas strongly supports the right of any self-identified sexual-assault victim (regardless of whether that individual's own political or religious or personal beliefs or "nocturnal dreams" or "internal thought process" or well-documented longtime celibacy, or longtime legal status as an adult single person, is or are  "popular" here in Austin, Texas) to request and obtain a forensic DNA-swabs sexual-assault evidence medical exam on himself or herself.

I am also referring to a written statement in which your very influential state agency informs Austin Police Chief Chacon and City Attorney Morgan why your state agency strongly supports my own legal goal of each nighttime period enjoying eight or seven consecutive and uninterrupted hours of restful and uninterrupted and revitalizing sleep as I lie alone on my own bed, asleep and unconscious, inside my locked efficiency apartment unit in Austin.

I am also referring to a written advisory statement in which your Executive Commissioner or Executive Council  or an attorney for your state agency might be willing to politely mention to APD Chief Joseph Chacon and Austin City Attorney Anne Morgan whether your State of Texas agency regards me (Austin resident John Kevin McMillan, date of birth April 27, 1957; place of birth, Lincoln, Nebraska) as being a very honest and factually accurate criminal-law complainant with either a very high or high level of credibility, from what your state agency has determined.

Finally, Mr. Bowman, I need to ask you whether your  Texas Health and Human Services Commission state agency has any legal authority over, or assists in obtaining or in distributing, rent subsidies on behalf of or for any tenant or tenants or any occupant or occupants here at Pebble Creek Apartments, 8805 North Plaza Drive in northeast Austin. If so, might that relationship between your state agency and the Pebble Creek Apartments management team or landlord here possibly offer your state agency a legal basis for politely helping me to obtain a DNA-swabs forensic anal-rape-evidence medical exam on myself as soon as possible?

Subject: 7-13-21: urgent plea for help from APD Chief Chacon

Dear Austin (TX) Police Department Interim Police Chief Joseph Chacon,

Thank you again for your very kind willingness to review my multi-document written appeal to you for an APD-authorized DNA-traces rape-evidence exam on me that I have repeatedly requested from APD over a multi-month period in 2021. I have made that request as a follow-up to the APD Alleged Home Invasion Crimes and Alleged Sex Crimes case, ID number 21-0830533, that your law-enforcement agency activated for me on March 24, 2021, at my request when I was a patient in the ER of St. David's Medical Center hospital in central Austin. APD Officer Mark Bozyk, who interviewed me inside the St. David's ER that morning, provided me with the case number on my criminal-law complaint to APD that morning. 

The male Asian-American emergency room physician at St. David's on March 24, Dr. Nair,  did not examine my anus or behind or groin area, politely explaining to me inside my patient room  that he would  not want to do anything that might undermine the integrity of the expected Sexual Assault Forensic Exam (SAFE) on me later that day by a forensic nurse for Austin Safe Alliance, Dr. Nair said. I was then discharged from the hospital, over my polite objection on that, with the cited expectation from my hospital-assigned social worker, Wendy, that I would make arrangements on my own through Austin Safe Alliance for me to get a rape-evidence exam on myself at their compound in south Austin later that day. However, APD Detective William Costello of the APD Sex Crimes Unit stated to me on the telephone at 2:07 p.m. that day (March 24), when I called the APD's Sex Crimes Unit from the St. David's ER lobby and he answered the telephone for that unit, that Detective Costello and his APD Sex Crimes Unit colleagues were not willing to authorize a rape-evidence medical exam on me at that time. 

When I called Austin Safe Alliance from the St. David's ER lobby that day, I was told by Safeline Manager Rachel that they were unwilling to provide me with a rape-evidence exam. "Your needs surpass what they're able to provide at Eloise House," Rachel stated to me on the phone at about 12:30 p.m. that day in explaining to me why I could not visit their compound for an anal-rape-evidence exam on myself that day. Nor was the St. David's ER willing to re-admit me that day (March 24) in order to then have a Austin Safe Alliance forensic nurse visit the hospital and perform a rape-evidence exam on me in the ER of that hospital, according to Wendy, my hospital-assigned social worker there.

As you know, Chief, I have submitted my written appeal through the official APD chain of command. So far, none of the very honorable and highly-regarded APD peace officers I have contacted in that chain of command have sent me any reply letter or made any return phone call to me or made any visit to my apartment unit and knocked on my front door or left a note on my front door relating to my appeal. Those officers are APD Sergeant Christopher Keen, the head of the APD Sex Crimes Unit; APD Lt. Patricia Cruz; and Commander Kurtis Krause. The APD Officer who was originally assigned to my Sex Crimes case, Detective William Costello, has agreed to continue to review individual crime-evidence photos from me, but I have not yet received any verification from him that I provided that state-certified peace officer with any photographic evidence of someone other than me who was documented on camera by my infrared motion-sensitive camera in my bedroom as being physically present inside my apartment unit at nighttime.

In regard to the attached photo, Chief Chacon, you will find confirmation of my statement about multiple faces (noses and eyes are visible) of human beings in this photo if you increase the size of the attached photo to the maximum possible size.

I hope this infrared motion-sensitive-camera-generated photo documentation of alleged trespassers inside my only bedroom of my always-properly-locked efficiency apartment unit at Pebble Creek Apartments will help to convince you to please authorize a DNA-traces forensic sexual-assault-evidence medical exam on me as soon as possible. I might add that because of the allegedly continuous daily and year-round nature of the alleged home-invasion-crimes and alleged sex crimes and alleged personal-injury-crimes victimizing me as I sleep alone on my own bed inside my double-bolt-locked current apartment unit in northeast Austin, full maximum possible 190-day retroactive DNA-traces processing of any and all DNA-traceable items from that new rape-evidence kit obtained from me will be urgently needed as soon as possible.

I would like to again remind you and your APD colleagues that I myself have been completely celibate, with ZERO sexual contact and ZERO intimate physical contact between myself and any other human being, throughout any and all of my own conscious or waking hours on a continuous and uninterrupted basis ever since and including the day I moved to north Austin in August of 2001. 

I am also an always-sober (no alcohol consumption by me anytime since 1990,  no marijuana consumption anytime since 1984, no consumption of any illicit drug other than marijuana on ANY occasion in my entire life), dependably civil and law-abiding and very honest and platonicly polite,  pro-law-enforcement criminal-law complainant.  I myself do not have any criminal-conviction record, as I'm sure you are aware.

I would also like to remind you, Chief, that the alleged home-invasion-crimes perpetrators inside my double-bolt-locked apartment unit at nighttime have allegedly also been direct perpetrators of---or alleged accomplices in---alleged daily and year-round anal-rape-crimes (possibly including illegal insertion of a vibrator into my anus while I am being held unconscious by alleged perpetrators, such as through the use of nasal inhalants that might include chloroform; I myself DO NOT own or use any vibrator of any type), pain-infliction crimes, nasal-inhalant-infliction crimes (I DO NOT own or use any nasal inhalants), repeated illegal hydration of my body through my mouth or anus that forces me to  get out of bed several times per early morning period in order to urinate in my bathroom, and repeated and deliberate ruination of my sleep every hour or two, with noise pollution not generated by me playing a role my being robbed me of hundreds or thousands of hours of deep sleep, or REM sleep, in the period ever since I moved into my current apartment unit at Pebble Creek Apartments on June 21, 2019.

I have undergone three separate doctor-ordered medical surgeries on myself for potentially life-threatening medical problems I incurred in the period since I moved into my  current apartment unit at Pebble Creek Apartments on June 21, 2019. 

 I work at three separate corporate-owned restaurants owned by three separate restaurant-industry corporations, two of them headquartered in the great state of Florida and one of them headquartered in the sometimes-great state of Texas. I get very good cardiovascular exercise from my current career in restaurants. I also diligently pursue a low-in-saturated-fat, vitamin-rich and mineral-rich, high-fiber heart-healthy dietary lifestyle. I have completely abstained on a lifelong basis from any and all consumption of tobacco products or vaping products.

I have always slept alone on my own bed throughout the entire period ever since I moved back to Austin in mid-March of 1997. In fact, on no occasion in my entire life thus far have I myself ever slept on a bed anywhere in Austin, Texas, with any other human being. I attended UT-Austin for two years and am an alumnus of the University of Texas at Austin who has myself lived in Austin proper during a variety of separate time periods for about five (or possibly more) total combined years prior to my most recent return to Austin in  March of 1997.

I would like to add with polite emphasis that in the entire two-year period since I moved into my current apartment unit, with only two categories of exception I have never at any time permitted anyone but me to be physically present anywhere inside my current apartment unit on any occasion between the hours of 8 p.m. at nighttime and 8 a.m. in the morning. Those two categories of exception were on-duty APD officers and, on one total occasion since I moved into my current unit, on-duty Austin-Travis County EMS staff members responding directly to a 911 phone call I had made after I vomited repeatedly inside my current apartment unit's bathroom.

This month, I contacted the FBI Austin office and was interviewed by an intake specialist for the FBI about these apparently very complex and very baffling, allegedly continuous daily-and-year-round-and-multi-year home-invasion crimes----crimes that appear to point to alleged organized-crime perpetrators unbeknownst to me and apparently involving multiple states of origin in those crimes----victimizing me during my sleep as I lie alone on my own bed inside my double-bolt-locked efficiency apartment. I am very hopeful that the FBI will be willing to assist in 24-hour-a-day infrared-camera electronic surveillance of my entire apartment unit and the outdoor balcony of my apartment until such time as alleged possible hidden points of entry into my unit are identified and one or more perpetrators are arrested by the Austin Police Department or FBI. I hereby give my full permission for any and all electronic surveillance of my unit that you and the FBI might need on this.

 I also hereby give my full permission for APD to please send a SWAT team at any time of the day or night to my current apartment unit,  if need be, in order to arrest any and all suspected home-invasion-crimes perpetrators or trespassers or rapists---regardless of their age or asserted "relation" to me or their race or ethnicity or their nation of birth or state of birth---who are ever identified as being physically present anywhere inside my current efficiency apartment unit either during my sleeping hours or at any other time of the day.
