Subject: Are Alcohol Bevs In Soft Drink Cans/Bottles Deceptive Trade Practices?

Dear Cody,

Thank you again for recently providing me on the telephone with your official e-mail address as a very influential  staff member for Congresswoman Celeste Maloy of Utah.

I am very hopeful that Congresswoman Maloy----a first-rate and incisive  attorney----will identify as in flagrant and dangerous violation of federal law the current widespread practice by various alcohol-producing companies in the USA  of their manufacturing and  distributing to  retail stores numerous  alcoholic beverages that are bottled or canned and labeled to resemble alcohol-free "soft drinks" or alcohol-free "seltzers".

I will be very grateful to Congresswoman Maloy if she is willing to request a Congressional Hearing on whether the current "marketing" of canned or bottled alcoholic beverages as "Soft Drinks" or "Seltzers" violates the "Deceptive Trade Practices Act" federal law that is  enforced by the "Federal Trade Commission" agency of the U.S. Government.

I am a public-safety-minded and vigilant permanently alcohol-free (ever since 1990) single adult white English-Scottish-German-American  male American- citizen registered voter constituent of Congresswoman Maloy who myself  resides in Salt Lake City, Utah. 

As a daily outdoor   pedestrian who also  travels around Salt Lake County and into Davis County and the city of Bountiful  by riding Utah Transit Authority trains or buses,  I frequently discover outdoors along public sidewalks, and on  the outdoor platforms of  UTA train stops, commercially produced cans of alcohol or bottles of alcohol that initially appear to be "innocuous  soft drinks" or "only seltzers".

When I check the fine print on the  can or bottle ---fine print that is often located on the back of the container or lower on the can or bottle ----   I discover the shocking information that that manufactured product actually contains alcohol.

Many youths in Utah and youths nationwide will be drawn to these types of products that are advertised as being  "Soft Drinks With a Mild Kick". Those same youths will be in dire risk of being severely medically harmed by those products.

Alcohol is poison to the children and teenagers of Utah, and  I feel sure that Congresswoman Maloy will strongly agree with this copyrighted online  report at "kidshealth.org":

Please note the following 2022-dated and copyrighted "Salt Lake Tribune" news story that referred to the threat to the medical health of minors in Utah that so-called "hard seltzers" had  inflicted on our state.

The following copyrighted online report reveals a typically flippant and irresponsible alcohol-industry  outlook toward distribution of certain types of alcoholic products in cans that appear to be "endorsed" or "co-sponsored" by the "Coca-Cola Company" (registered trademark brand name) of Atlanta, Georgia. 

That flippancy by the alcohol industry  is, in fact, insidiously injurious. Tragically, these types of products will be misidentified  by many children and teenagers  in Utah as "safe beverages, since they bear the trademarked  brand name 'Coca Cola', a favorite soft drink of mine".

Thank you again, Cody,  for kindly sharing public policy-related concerns of mine with Congresswoman Maloy. 

I am very concerned that "Soft Drink-Style"  packaging of Alcoholic Beverages being sold  in Utah will have tragic consequences for thousands of Utahn minors each year---including an increased risk of their either walking outdoors on public property while intoxicated or driving while intoxicated here in the Beehive State.

I hope this very tentative brainstorming letter to yourself and Congresswoman Maloy is helpful to your  first-rate Congressional Team in Washington, D.C.

former Texas DPS full-time employee and a permanent Utah resident (ever since January 1, 2023) with a multi-century Mormon heritage from sagacious and courageous  Mormon ancestors of mine in Utah, including my hard-working Murray butcher shop owner grandfather, Parley Neal McMillan, and his devoted LDS member wife, Mrs. Alice Mae Pugh (maiden name) McMillan of Murray.

I might add that I greatly  appreciated the in-person comment to me in a small town of Utah in the 1970s  by my Murray-born Father, Dr. Calvin McMillan of Westlake Hills, Texas,  that he himself was alarmed by the sale of a beverage product named "Near Beer"  (registered trademark  brand name) inside that retail convenience store in Utah that our Texan family had visited during a vacation road trip.
