Dear City Government of Austin Civil Rights Officer Carol Johnson,
Do you agree that I have a civil right and Constitutionally-protected legal right to myself obtain a rape-evidence exam on myself in Austin in my capacity as a self-identified continuous-anal-rape-crimes-and-continuous-oral-rape-crimes victim in Austin, Texas, USA?
Do you also agree that since I am a self-identified continuous-and-continuing anal-rape-crimes victim during my sleeping hours, I have a legal right to obtain from a law-enforcement agency with jurisdiction full 190-day retroactive DNA-traces processing of any and all DNA-traceable items from that rape-evidence exam kit obtained from myself?
Ms. Johnson, the City Government of Austin and Austin Police Department have repeatedly on 15 or more total occasions ever since 2012 denied to authorize a rape-evidence exam on me in Austin, Texas.
As you of course know, I am very insistent on asserting my legal right to press criminal-law charges against any and all persons---regardless of their racial identity, regardless of their religious affiliation, regardless of their political affiliation, regardless of their universities or schools of affiliation, regardless of their age, regardless of the foreign country or U.S. state where they were born, regardless of whether they are U.S. citizens, regardless of their "socioeconomic status", regardless of who their employer is, regardless of whether they are current or former "relatives" of mine or "former roommates" of mine or former "classmates" of mine or current or former "personal acquaintances" of mine--who have allegedly trespassed inside my bolt-locked apartment unit during my bedtime hours at nighttime, or who have subjected me to "assault by physical contact" or "sexual assault" or personal injury crimes or illegal "medical services" (illegal nasal inhalants, for instance---I DO NOT OWN OR USE ANY NASAL INHALANTS) during my sleeping hours at nighttime.
No medical services provider or employer of mine or government-owned institution or agency or real-estatement "management' company anywhere in the world is authorized to be physically present inside my current apartment unit during my sleeping hours at nighttime, and I insist on filing criminal charges and lawsuits accordingly. I am gainfully employed (in restaurants only), I lead an illicit-drug-free, alcohol-free, and tobacco-free, longtime-celibate-by-choice, platonicly-polite lifestyle, and I am not under any "mental health" restrictions of any type. I am psychologically healthier and far more honest than the majority of all single men of Austin, as I am very sure you already know about me.
One very helpful female attorney I consulted in the last few days informed me on the telephone that I have a legal right to myself lead a celibate lifestyle in Austin---and I might add that if need be, I will file a lawsuit on behalf of my legal right to lead a celibate life during the period in which I reside in Austin.
I plan to eventually move to a city and county and state where the percentage of residents there who are tobacco smokers, persons pursuing vaping, consumers of marijuana, consumers of "medical" marijuana, illicit-drug-consumers, heavy or moderate consumers of alcohol, profane-speech-addicts, and persons with beards or mustaches or goatees or tattoos on their bodies is significantly lower than in Austin, Texas.

From: John Kevin McMillan, a longstanding criminal-law complainant with the Austin (TX) Police Department. I myself will definitely welcome and be VERY GRATEFUL for a new forensic DNA-swabs sexual-assault medical-evidence exam on me as soon as possible in 2021 that APD or any other government agency with legal authority authorizes for me in what I maintain is an alleged continuous-and-continuing, daily-and-year-round-and-multi-year, home-invasion-crimes and trespassing crimes and sex-crimes and personal-injury-crimes case.
It is an alleged felony continuous crimes case in which I am the cited longtime celibate-by-choice, single-by-choice, permanently-drinking-alcohol-free, white Anglo-Saxon male adult victim. I allege that the alleged sexual-assault crimes are occurring during my sleeping hours as I lie ALONE on my own bed, asleep and alone, inside my current double-bolt-locked solo-occupancy efficiency apartment unit in northeast Austin.
I might add that I am very hopeful that the government agency authorizing that rape-evidence exam on me will be willing to obtain full 190-day or longer (if possible) retroactive processing of any and all DNA traces obtained from that new exam on myself.
Since I have been completely celibate throughout any and all of my own conscious or waking hours ever since and including the day I moved to north Austin in August 2001, any and all DNA traces from the above-cited new rape-evidence exam on me that match to someone OTHER than myself are very convincing criminal-law evidence in a court of law in Austin that I myself was victimized by either "assault by physical contact" or "sexual assault" in which the individual matching to the DNA trace was the alleged perpetrator.

Thank you again for your very kind interest in concerns of mine about alleged possible violations of my civil rights as a criminal-law complainant and self-identified continuous-and-continuing-personal-injury-crimes victim here in Austin, Texas.
I appreciated the two reply phone calls I received from you on March 25, 2021---of them on my cell phone (phone number, 512-993-7305) and one of them featuring a voice-mail message you left at my landline home telephone number of (512) 342-2295.
After receiving your much-appreciated phone messages, I would also like to share with you (final item, below) a blind carbon-copy of the following factual report of mine I wrote and directly submitted on March 24, 2021, to the new head administrator of the Austin Police Department Sex Crimes Unit, Sgt. Christopher Keen.
One consistently polite and very professional Austin Police Department officer who was designated to me in writing in February 2020 by APD Sgt. Gena Curtis as an appropriate APD "contact" officer for myself, Officer Lelan Larroque of the APD "Crisis Intervention Team", stated to me on the telephone this year, during a local phone call I made to him at his official APD office phone number of (512) 854-3480, that it is "very rare" for the APD Sex Crimes Unit to decline to pre-authorize a forensic medical evidence sexual-assault medical exam on a self-identified rape victim who has requested a forensic DNA-swabs medical exam on herself or himself, Officer Larroque stated.
Ms. Johnson, I am very sure that APD Officer Larroque will be willing to confirm for you that he made the above-cited comment to me during a very recent phone conversation I had with him this year.
Below is the February 17, 2020, reply e-mail letter to me from APD Sgt. Curtis in which she officially cited Officer Larroque as an appropriate "contact person" for me at APD. Please note that the e-mail correspondence of mine to which she sent me a reply letter had included a February 2, 2020, e-mail letter of mine (farther below) to the Office of the Attorney General of Texas Human Trafficking and Transnational/Organized Crime (HTTOC) section in which I had stated:
"I would appreciate obtaining from you factual information about whether your HTTOC section in Austin has ever identified or investigated any case of alleged possible or suspected human trafficking anywhere in Texas in which a cited apparent victim of human trafficking was subjected to alleged sexual contact with themselves in a context in which they were either held unconscious or were otherwise unconscious throughout the entire period of, or during much of, that alleged sexual contact.
"If so, does your State of Texas agency in Austin have the legal authority to also then directly file criminal charges here in Austin in an alleged human-trafficking case of that type? Also, are there any circumstances in which you would choose to instead rely on a local law-enforcement agency and local prosecuting attorney to actually press charges in a crime case of that type?"

This is a Texas Open Records request in which I seek to obtain from you a copy of any and all written communications, including e-mail communications, that each refer at least once in any manner to myself, John Kevin McMillan of Austin, Texas, and that at any time since 9 a.m. January 5, 2015, were each written by, or received or sent or mailed or FAXed or forwarded by, any staff member or attorney or administrator in the Human Trafficking and Transnational/Organized Crime Section of the Office of the Attorney General of Texas state agency in Austin.
INCLUDED in the scope of this public-information request are any and all written communications that were authored by myself.
My legal name is "John Kevin McMillan". I was born on April 27, 1957, at Lincoln, Nebraska.
I have most recently resided in Austin, Texas, on a continuous and uninterrupted basis ever since mid-March 1997.

January 5, 2015, is the date when State Bar of Texas member attorney and political leader Ken Paxton first officially assumed office as Attorney General of Texas after winning a statewide election for that position.
The current official website for the Attorney General of Texas state agency states as follows:
"The Human Trafficking and Transnational/Organized Crime Section is tasked with assisting local law enforcement and prosecutors in prosecuting human trafficking and related crimes, aids victims of human trafficking, and develops initiatives to improve coordination between state and local law enforcement agencies. The Human Trafficking and Transnational/Organized Crime Section provides training to law enforcement, prosecution, and non-governmental entities on human trafficking through outreach activities."
The current official website for the Attorney General of Texas also states:
"His (Ken Paxton's) first major initiative as attorney general was the formation of a special unit dedicated to combating human trafficking in Texas. During its first year of existence, the Human Trafficking and Transnational Organized Crime section helped arrest the chief executive officer of Backpage.com and coordinated to facilitate the permanent shut down of Backpage.com, the largest online sex-trafficking marketplace in the United States."
This public-information request from myself was prompted in part by recent very polite e-mail correspondence of mine with your state agency's Human Trafficking section.
That correspondence included a February 2, 2020-dated e-mail letter of inquiry (below, last item) that I wrote and sent to your state agency's Human Trafficking and Transnational/Organized Crime section. As of today, I have not yet received a reply letter or phone call from any staff member or official or investigator of that particular section of your very influential state agency.

I have not received any reply letter so far from the Attorney General of Texas on a Feb. 2, 2020, e-mail letter (below) that I wrote and sent to that law-enforcement-minded State of Texas agency which refers to some of the criminal-law issues your own APD unit also investigates and has jurisdiction over.
Would either of you two very influential Austin Police Department officers with the APD Nuisance Abatement Unit please let me know in writing whether your APD unit has ever identified or investigated any case of alleged possible or suspected human trafficking anywhere in Austin, Texas, in which a cited apparent victim of human trafficking was subjected to allegedly illegal sexual contact with themselves in a context in which they were either held unconscious or were otherwise unconscious throughout the entire period of, or during much of, that allegedly illegal sexual contact?

I read online this morning in my personal computer system inside my current solo-occupancy efficiency rental-apartment unit in north Austin that in 2016, Texas Attorney General Ken Paxton reportedly established your "Human Trafficking and Transnational/Organized Crime Section" (HTTOC) in the Office of the Attorney General state agency in Austin. I also read online today that the office phone number for your section is: (512) 463-1646, and your e-mail address is "humantrafficking@oag.texas.gov".
I would appreciate obtaining from you factual information about whether your HTTOC section in Austin has ever identified or investigated any case of alleged possible or suspected human trafficking anywhere in Texas in which a cited apparent victim of human trafficking was subjected to alleged sexual contact with themselves in a context in which they were either held unconscious or were otherwise unconscious throughout the entire period of, or during much of, that alleged sexual contact.
If so, does your State of Texas agency in Austin have the legal authority to also then directly file criminal charges here in Austin in an alleged human-trafficking case of that type? Also, are there any circumstances in which you would choose to instead rely on a local law-enforcement agency and local prosecuting attorney to actually press charges in a crime case of that type?

Subject: appeal of APD Detective Costello's 3-24-21 no-rape-exam statement to me

Dear Austin Police Department current Sex Crimes Unit head administrator Sgt. Christopher Keen,
I am hereby submitting to you a formal appeal of APD Detective William Costello's statement to me on the telephone at 2:07 p.m. today (Wednesday, March 24, 2021) that the APD Sex Crimes Unit as of that time was not willing to authorize a forensic medical-evidence DNA-swabs forensic medical exam on me.
"We won't authorize it at this time," Detective Costello, APD Badge Number 7057, stated to me from his end of the phone line after I called the main phone number for the APD Sex Crimes Unit from my cell phone.
Rachel, a Safeline Manager for Safe Austin Alliance's Eloise House that conducts rape exams on self-identified rape victims, stated to me on the cell phone at 12:23 p.m. today (March 24); "You (John Kevin McMillan of Austin) cannot have a (rape) exam at Eloise House. Your needs surpass what they're able to provide at Eloise House. The hospital (St. David's in central Austin) will need to dispatch a forensic nurse, if needed (who would then perform a rape-evidence exam on you inside the ER of St. David's)."
No such option was offered to me by St. David's, with my assigned social worker, Wendy, an Anglo female staff member, stating to me that since APD had declined to authorize a rape-evidence exam on me, that effectively blocked me from obtaining a rape-evidence exam on myself inside the St. David's ER, Wendy said.
At no time did the emergency room physician who met with me in the St. David's ER, Dr. Nair, a tall male apparently Asian-Indian-American ER doctor, ever physically examine my anus or groin area or any other portion of my body. He stated instead that if he examined me, that would interfere with the expected forensic medical-evidence rape-exam on me later that day by a forensic nurse inside the Safe Austin Alliance-operated Eloise House in south Austin, Dr. Nair stated.
Austin Police Department Sex Crimes Unit Detective Costello between 8 a.m. and 9 a.m. this Wednesday morning (today) had politely spoken to me on the phone about the alleged rape case in which I am the cited victim, and had stated to me that I had the option of myself going to a hospital in order to get a rape-evidence exam on myself, he said at that time.
I am also hereby submitting to you a formal appeal of the apparent decision of one or more officers of the APD Sex Crimes Unit to repeatedly over a multi-year period decline to pursue any full maximum-possible 190-day (or longer retroactive time period, if possible) retroactive DNA-traces processing of either of the two separate rape-evidence kits from me from 2011 that that APD unit already has in its possession.
I have repeatedly informed APD Sex Crimes Unit detectives in writing that I have been and continue to be a victim of alleged continuous daily and year-round and multi-year home-invasion-crimes, trespassing crimes, anal-rape-crimes, oral-rape-crimes, personal-injury crimes, and sleep-harassment crimes that have allegedly been inflicted on me during my sleeping hours as I lie ALONE on my own bed inside my locked apartment unit.
In the period ever since May 2011, the Austin Police Department Sex Crimes Unit on more than 10 separate occasions throughout much or nearly all of that 10-year period has consistently declined to pre-authorize any new forensic medical-evidence DNA-swabs medical exam on me at any time. APD did obtain one Asian Indian-male-adult emergency-room-doctor's pre-authorized forensic medical evidence rape exam on me that was conducted by a female forensic nurse in the early morning hours of December 22, 2011, inside the St. David's Medical Center ER, for APD Sex Crimes Case 11-3550615.
I had today contacted the APD Sex Crimes Unit from the St. David's Medical Center emergency room in regard to the newly-generated APD Sex Crimes and Home-Invasion-Crimes and Personal-Injury Crimes Case Number 21-0830533. I had been transported to the St. David's ER by ambulance after I called 911 and requested a forensic rape-evidence exam on myself and APD officers to visit my current apartment unit in connection with that alleged-rape-crimes case.
Ever since June 21, 2019, I have resided alone as the only rent-paying tenant and only approved occupant inside my current solo-occupancy efficiency apartment unit at Pebble Creek Apartments, 8805 North Plaza Drive, in northeast Austin.
I am very grateful to the APD male Officer Mark Bozyk, Badge Number 8504, for having interviewed me inside room 33 of the St. David's ER beginning at roughly11:30 a.m. this Wednesday, March 24. Officer Bozyk very kindly provided me with my new APD case number of 21-0830533.
In the most recent five-year period, the APD Sex Crimes Unit has generated several new APD Sex Crimes cases in which I was the cited victim and complainant. They included: APD Case 16-1340923 and, more recently, APD Case 20-3161213.
The 2020 case was opened by APD on November 11, 2020. That occurred a matter of minutes after I handed to a helpful APD patrol officer a flashdrive of very recent infrared motion-sensitive-camera-generated crime evidence from 2020 of allegedly illegal trespassers inside my private bedroom of my current bolt-locked solo-occupancy rental-apartment unit during my sleeping hours.
I always sleep alone on my own bed, and I am a longtime celibate (including on a continuous basis ever since I moved to north Austin in August 2001), gainfully employed, always-sober, white Anglo-Saxon single adult lawfully non-Christian gentleman age 63.
