My May 3, 2014, Appeal Letter to 'Texas Medical Board' state agency in Austin

Dear Texas Medical Board state agency officials,

 

I am hopeful that your state agency in Austin will be willing to review your recent response you mailed to me by U.S. Postal Service on a politely-worded legal complaint of mine against Dr. Jessica Dapper, a female emergency room physician at St. David's North Medical Center ,that I filed with your state agency earlier this year.


I am making this polite request in view of new evidence (below) that several or more total employees or officials of four respective different City of Austin departments, including the Austin Police Department, have each consulted the City Attorney's Office here in regard to myself and in regard to one or more of my crime reports to APD and the City of Austin about my being a self-identified victim of alleged personal-injury-crimes and alleged anal-rape-crimes-during-my-sleep as I lie ALONE on my bed inside my bolt-locked private bedroom of an apartment unit where I live as a tenant ----an apartment unit in which I myself always bolt-lock  the front door before I retire to my private bedroom every night.


I would also like to take this opportunity to again thank my primary-care physician, the highly-rated internal medicine specialist Dr. Edie Shulman, for repeatedly having stated to me inside her medical clinic over over a multi-year period that Dr. Shulman has confidence in the accuracy and honesty of my numerous medical complaints to Dr. Shulman and her medical staff, including the kindly nurses or staff members Charity and Andrea and Daniela and Alma, about my being a self-identified victim of daily and year-round and multi-year personal-injury-crimes and anal-rape-crimes-during-my-sleep inside my bolt-locked private bedroom of my bolt-locked apartment unit that is situated several blocks from Dr. Shulman's medical clinic.


In fact, Dr. Shulman during her first-ever medical appointment with me in October 2012 even took the time to very diligently photocopy for her medical records on me three or more infrared-camera photographs of suspected illegal intruders inside my private bedroom of my bolt-locked apartment unit that I showed her that day---photos that had been obtained for me during my sleeping hours by an infrared camera I had purchased in 2012.


One of those infrared photographs appeared to be of a "little girl," Dr. Shulman volunteered to to me during that first-ever medical appointment with her that I had with her in October 2012. 


(For the record, I myself definitely have never invited any child to enter my bolt-locked apartment unit on any occasion since I moved into this unit in January 2002. The only child I myself ever saw in person inside this apartment unit was a male youth whom two adult representatives for a Roman Catholic Church group in Austin insisted on being present with them during a visit those two adults made to my apartment unit in 2012 or 2013 in connection with my seeking financial assistance toward payment of my apartment rent from the St. Vincent de Paul Society of the St. Albert the Great Catholic Church. 


I did politely ask those two adult Catholic Church representatives if they would please consider asking the male youth to wait outside my apartment unit during that visit, but they replied that any matter I might discuss with them would not be traumatic or unduly stressful for that male youth accompanying them, and they politely insisted that he remain inside my living room with them as I talked with that adult couple about my living conditions in my apartment and my financial problems at that time.)


I did politely reply to Dr. Shulman's "little girl" observation to me of October 2012 that I myself believe that particular infrared-camera photo obtained for me from a camera I purchased in 2012 was allegedly of a tiny male illegal intruder of Far East Asian ancestry, I pointed out to Dr. Shulman during that first-time medical appointment I had with her in October 2012.

Those four agencies are: the Austin Police Department, the Human Resources Department, the City Manager's Office, and the City Clerk's Office.


I hope that the alarming possible legal liability (below) that the City of Austin has possibly incurred on this will prove to be of interest to each of you Travis County Government officials.

Thank you again for your very diligent and thorough style as each of you review possible crime evidence on behalf of Public Integrity Unit Case 9655-13 in which I am the cited single adult male complainant.


Tonight after I returned to my apartment complex upon conclusion of my evening workshift as a waiter inside a restaurant workplace of mine in Austin, I was very surprised to find a letter addressed to myself from the City of Austin Law Department inside my mailbox for Apartment 325 at Wind River Crossing Apartments.


That three-page legal letter, as it turned out, was a carbon-copy---sent to myself as the cited "requestor" of information and the only cited carbon-copy recipient ---of an April 30, 2014, signed legal letter from Assistant City Attorney Elaine Nicholson to Texas Attorney General Gregory Abbott, in which the City of Austin Law Department is seeking exemption from the Texas Open Records Act.


The City of Austin's April 30, 2014-dated request for exemption from state law specifically cites documents being shared with the Attorney General in that particular context that refer to legal advice relating to myself, John Kevin McMillan of Austin, that the City Attorney's Office has provided to one or more employees of the Austin Police Department.


The April 30, 2014, official request for exemption from state law by Ms. Nicholson was in response to the following (below) very reasonable April 16, 2014-dated E-mail Open Records request from myself. (I had myself addressed that April 16, 2014, E-mail public-information request to Ms. Deborah Jennings, Public Information Manager for the City of Austin Law Department in Austin, Texas.)


The most noteworthy paragraph of my April 16, 2014, public information request to the City of Austin Law Department is stated as follows, and I am quoting that entire paragraph verbatim:


"Ms. Jennings, I would like to ask you today for a photocopy or computer printout of any and all letters, E-mail letters, memoranda, handwritten notes, policy decisions, or any other legal documents that were each written by or on behalf of or received by an attorney or staff member for the City Government of Austin Law Department at any time since April 1, 2011, and that, in each such case, referred to myself, John Kevin McMillan of Austin, in any manner or any way."


Assistant City Attorney Elaine Nicholson's April 30, 2014, signed letter to Texas Attorney General Abbott cites "attorney-client privilege" as a rationale for the City seeking to withhold from myself numerous legal documents that are currently on file with the City of Austin Law Department.


The next-to-last paragraph of Assistant City Attorney Nicholson's signed 

April 30, 2014, legal letter to Texas Attorney General Gregory Abbott states as follows, and I hereby quote verbatim that entire paragraph:


"The enclosed documentation consists of confidential communications between the City Attorney, the Deputy City Attorney, several Assistant City Attorneys, paralegals and law department administrative personnel with staff in the City Manager's Office, Police Department, Human Resources Department, City Clerk's Office, and Public Information Office. These communications were made for the purpose of facilitating the rendition of professional legal services and the confidentiality of these communications has been maintained. Accordingly, the City believes that this information contained in the submitted documentation is exempted from disclosure under section 552.107(1)."


The final sentence in Assistant City Attorney Nicholson's cited April 30, 2014, letter to Texas Attorney General Gregory Abbott states as follows: "If you have any questions concerning this matter, please feel free to contact me at 512-974-6463."


Investigator Carter and Prosecuting Attorney Drummond, I hope you will regard it as pertinent for PIU Case 9655-13 in which I am the complainant if I FAX to each of you later today (Friday, May 2) the entire contents of the cited three-page April 30 signed legal letter from the City of Austin Law Department to Attorney General Abbott that refers to myself by name as the requestor.


I am very hopeful that Texas Attorney General Gregory Abbott or an official of the City of Austin Law Department might be willing to politely share with either of you nobly courageous and first-rate Public Integrity Unit officials the entire contents of all the cited legal documents the City Law Department is currently seeking official permission to withhold from me --- including the legal documents that refer to myself, John Kevin McMillan of Austin, in a context also relating to the Austin Police Department.


Thank you again for your very diligent and professionally polite style on behalf of the Travis County District Attorney's Office Public Integrity Unit as you review factual evidence on behalf of my criminal-law complaint against one or more employees of the Austin Police Department.

Dear City of Austin Law Department Public Information Manager Jennings,

 

Thank you for your reply E-mail letter (below) dated April 4, 2014, in which you state that the Austin Police Department maintains that it does not have any documents responsive to my March 21, 2014 Texas Open Records request (below).

 

In response to your April 4 reply note, I would like to respectfully point out that your reply letter does not respond in any way to, or refer in any way to, the very first section of my March 21, 2014-dated Texas Open Records request. 

 

In that first portion of my March 21, 2014, public-information request, I had sought specified documents on file with the City Attorney's Office or the Public Law Department of the City of Austin.

 

Your April 4 reply letter apparently refers only to the second and third portions of my public-information request.

Dear Public Information Coordinator for the City Government of Austin

in Austin, Texas,

This is a Texas Open Records request in which I seek to obtain a

photocopy or printout of any and all E-mail letters or letters or

memoranda or rulings or advisory opinions or reports written or sent by

or received by any attorney or any other employee in the public-law

office of the City Attorney of Austin on any occasion or at any time since

or including December 21, 2011, that, in each and every such case,

directly state or refer to the possibility or certainty or likelihood that cited

conduct or cited inaction relating to or toward myself---John Kevin

McMillan of Austin---by one or more employees or officers of the Austin

Police Department of the City of Austin could possibly have been or

could possibly be either dishonest or fraudulent or libelous or

slanderous or unethical or ill-advised or injurious toward myself (John

Kevin McMillan of Austin) on the part of that APD employee or APD

officer, or could possibly or definitely have allegedly violated the law on

the part of that APD employee or APD officer.

Excluded from the scope of this first portion of this most recent publicinformation

request from myself are any and all letters or E-mail letters

written by myself, John Kevin McMillan, that were sent to or received by

the City Attorney's Office of the City of Austin, also known as the City of

Austin Law Department.

Also as part of this public-information request, I am seeking a

photocopy or printout of any and all E-mail letters or letters or

memoranda or reports or directives or executive orders written or issued

by the Austin Police Department or City of Austin at any time since

December 21, 2011, that, in each and every such case, refer to or cite

or contain a disciplinary action----possibly including the dismissal or

demotion of an employee or officer or the placement of an officer on a

leave of absence---that were imposed on one or more employees or

officers of the internal affairs unit of the Austin Police Department of the

City of Austin at any time since December 21, 2011, in a context that, IN

EACH AND EVERY APPLICABLE CASE, referred to or related in any

way to that APD internal affairs unit employee's review or evaluation of

one or more APD officers' or APD employees' conduct toward myself

(John Kevin McMillan of Austin) or their statements made to myself

(John Kevin McMillan of Austin) or those APD officers' or employees'

statements made about myself (John Kevin McMillan of Austin).

Also as part of this public-information request, I seek to obtain from the

City Government of Austin a photocopy or computer printout of any and

all disciplinary actions of any type or any demotions or any careerrelated

reassignments that at any time since December 21, 2011, were

imposed on or ordered or authorized for APD Detective David Silva,

who in the spring of 2011 was reportedly employed in the APD Sex

Crimes Unit, or for APD Officer James Turner, who in a recent year, for

instance, was himself reportedly employed as a "mental health officer"

in the APD "Crisis Intervention Team."

My legal name is John Kevin McMillan. I was born on April 27, 1957, at

Lincoln, Nebraska. My social security number is 457-96-0318.

I have most recently resided in Austin, Texas, on a continuous and

uninterrupted basis ever since mid-March 1997.

I am a lifelong non-Christian single gentleman. I am also the founder

and sole approved current member of the non-Christian and implicitly

deistic and new and fully independent Progressive Prohibitionist

Religion.

In the late 1990s and earlier this 21st Century, I gave several quality-oflife-

minded speeches on behalf of my fully independent and alcoholfree

as well as tobacco-free and anti-marijuana-minded "Honor Society"

religion that were each broadcast on local community-access television

in the Austin area.

authoritative and reliable reply letter in response to this most recent
