Dear Lt. Gruetzner,
I have been helpfully advised on the telephone by Sergeant Mike Henderson of the Travis County District Attorney's Office Criminal Investigations Division to myself follow the proper chain of command in appealing the longstanding multi-year defacto "policy" by the Austin Police Department Sex Crimes Unit to decline to officially authorize ANY forensic sexual-assault medical evidence DNA-traces exam on myself on any occasion or at any time subsequent to the year 2011.

I am hereby requesting a reply letter from you on the following letter of mine (below) to Sgt. Benningfield that she chose not to send me any reply letter to.

The repeated "reason" cited to me through the years by the APD Sex Crimes Unit under Sgt. Benningfield is that I as the self-identified rape victim failed to myself demonstrate to APD that my rental apartment unit's front door had been busted or my front-door lock had been tampered with or that my apartment window had been shattered, and I also failed to offer any factual evidence that I had been subjected to any type of physical "trauma" by anyone during my sleeping hours as I lay alone on my own bed inside my bolt-locked unit, according to APD officers.

Most recently, Nicole, a staff member of Sgt. Benningfield in the APD Sex Crimes Unit who spoke with me on the telephone at about 2 p.m. that day, stated to me that Nicole during my phone conversation with herself yesterday had spoken briefly with Sgt. Benningfield and was told by that APD Sex Crimes Unit head administrator that her APD unit "isn't going to handle your case (APD Sex Crimes Case 16-1340923).It (your future submissions of factual crime evidence to APD) is going to be through the CIT (Crisis Intervention Team mental-health officers) unit. If they have any have any crime evidence to offer (our Sex Crimes Unit), they'll contact us." (near-exact quote).

Yesterday was the very first occasion in which I received an official direct statement from an actual staff member of your APD Sex Crimes Unit that their unit will not accept any additional photo-evidence flashdrives from me about illegal trespassers and illegal sex-crimes perpetrators and alleged illegal personal-injury-crimes perpetrators inside my bedroom of my bolt-locked current apartment unit during my sleeping hours.

I had called the APD Sex Crimes Unit yesterday in the hope that an actual detective would directly speak with me on the phone and would directly authorize me to provide an APD patrol officer with thousands of additional new infrared motion-sensitive-camera photo images that were obtained for me in January 2020 during my sleeping hours inside my current solo-occupancy rental unit. 

At least two of those photo images I've examined most recenmtly, and which I have provided to the Texas Rangers by e-mail, definitely show a portion of the body of a second person inside my bedroom. I do everything I can to keep everyone away from any portion of the interior of my bolt-locked apartment unit during my sleeping hours; and I am a longtime-celibate-by-choice Anglo white male single adult gentleman.

A respectful FYI to each of you on the following civilly-worded letter I wrote and e-mailed today to Sergeant Sandra Benningfield of the Austin Police Department Sex Crimes Unit in Austin, Texas.

Please note that numerous infrared motion-sensitive photo images obtained from inside my current bedroom during my sleeping hours--and I ALWAYS sleep alone on my own bed---have indicated apparent or possible protrusions from one or more walls of my bedroom or apparent movements somehow involving the walls of my bedroom of my bolt-locked and fully-secured solo-occupancy efficiency rental apartment unit here in Austin. 

No point of entry into my apartment has ever been cited to me by the polite apartment-management team here, other than my one total front door, my one total window abutting my kitchen, and my two-part sliding glass door abutting my living room---only three total possible points of entry into my unit, as Assistant Manager Miranda Vasquez politely confirmed for me between 5 p.m. and 5:30 p.m. today inside or near her management team office for this large and gated apartment complex where I currently reside as an official rent-paying tenant and the only approved occupant inside my current unit here at Pebble Creek Apartments in north Austin.

I keep all three of the three total management-team-cited points of entry into my rental-housing unit either double-bolt-locked (my front door) or locked and bar-locked (the sliding glass door) or locked (in the case of the kitchen window) at all times. Also, I do NOT let anyone into my unit at nighttime other than on-duty Austin Police Department officers.

I would welcome a reply note from any of you on any aspect of this.

Dear Sergeant Sandra Benningfield,

I was helpfully advised by Sergeant Mike Henderson of the Travis County District Attorney's Office Criminal Investigations Division, during a Tuesday afternoon December 10, 2019, multi-minute phone conversation I had with him that concluded at 3:45 p.m. that day, to myself follow the proper chain of command in appealing the longstanding decision by the Austin Police Department Sex Crimes Unit on numerous occasions throughout the most recent approximately nine-year period to repeatedly and consistently decline to officially authorize for me in advance ANY forensic DNA-traces rape-evidence on myself.

As you know, the most recent occasion in which your APD Unit promptly and that same day authorized a forensic DNA-traces rape-evidence on myself in advance that I as the self-identified rape victim had requested that day was April 28, 2011, for APD Sex Crimes Case 11-1180447. No 180-day retroactive processing of that rape kit was apparently ever requested or obtained by your APD unit. 

Nor did your APD unit ever apparently authorize full 180-day retroactive processing of the rape-kit obtained from me for APD Case 11-3550615 in the early morning hours of December 22, 2011, based on a male Asian-Indian-American emergency-room physician's advance authorization (but without any official APD authorization having been provided to me at the time of that exam, from what I was told) on the night of December 21, 2011, inside St. David's Central Medical Center near the UT-Austin Law School campus.

"You (criminal-law complainant John Kevin McMillan of Austin) can ask that (a new DNA-swabs rape-evidence exam on yourself), yes Sir," Travis County DA's Office Sergeant Mike Henderson politely stated to me on the telephone during our December 10, 2019, phone conversation in regard to which I jotted down legal notes.

Sergeant Benningfield, I maintain that I have been and continue to be a victim of alleged daily-and-year-round-and-multi-year alleged sex crimes, including anal-rape crimes, and alleged personal-injury-crimes to which I have been subjected against my wishes during my sleeping hours, as I lie alone, asleep and unconscious and probably snoring, on my own bed inside my bolt-locked apartment unit. 

I am awakened an average of about five times per early-morning period with an unpleasant vibrating sensation in my anus (I DO NOT own any vibrator of any type), irritability from having had my deep sleep ruined once again because of alleged harassment of me inside my bolt-locked unit, an unpleasant nasal-inhalant sensation in my nostrils (I DO NOT own or use ANY nasal-inhalants), often with a sharp pain in my legs and wobbliness in my legs, and an urgent need to urinate in my bathroom.

In the period ever since February 2016, I have been advised by first-rate doctors to undergo, and have in fact undergone, five separate major medical surgeries on myself for life-threatening medical conditions none of my relatives have ever had, and that I allege were each needed primarily or partly because of alleged personal-injury-crimes allegedly being perpetrated on me during my sleeping hours as I lay ALONE on my own bed inside my bolt-locked apartment unit in Austin, Texas.

I would like to respectfully remind you that since this is an alleged daily-and-year-round-and-continuing felony-crimes case, great urgency is needed by APD to help put a stop to the alleged home-invasion crimes immediately and also to officially authorize a rape-evidence exam on me as soon as possible.

One of your APD unit's detectives, Detective Michael Endres, office phone number (512) 974-8142, stated to me on the telephone on January 24, 2020, after answering the main phone number for your APD Unit office area at 1:06 p.m. that day: "We have to wait for the ADA (sic) to review it (APD Case Number 16-1340923) before it can be released (sic)." 

Detective Endres also stated to me that another APD unit, the APD digital forensics unit, is currently reviewing the crime-evidence flashdrives I have provided to your Sex Crimes Unit in 2019, and the APD digital forensics unit could need "one year" (exact quote), Detective Endres said, to complete the latter digital forensics unit's review of all of the crime-evidence flashdrives I've provided to APD.

In that regard, Sgt. Benningfield, I would like to politely emphasize to you that your very influential APD unit has accepted a total of eight separate flashdrives from me over a multi-month period ever since the summer of 2019 specifically for APD Sex Crimes Case 16-1340923. That crime case dates back to 2016, when I resided in Apartment 902 at Village Oaks Apartments, 10926 Jollyville Road, in northwest Austin, and I surveillanced my own bedroom during that time period using ADT-security system video surveillance that involved a significant expenditure of money from myself.

Each of those eight flashdrives I submitted to you in 2019 contained hundreds or thousands of photo images of crime evidence from me of an alleged stalker, alleged home-invasion-crimes-perpetrator, alleged trespasser, alleged-fraudulent-and-unauthorized-medical-services provider, and alleged sex-crimes and personal-injury-crimes perpetrator who allegedly victimized me during my sleeping hours inside my bolt-locked and fully-secured current solo-occupancy (myself only) efficiency apartment unit at Pebble Creek Apartments, 8805 North Plaza Drive, Apt. 2418 (a second-floor, eastward-facing unit in Building 17), in north Austin. 

I am a very strong criminal-law complainant for numerous reasons, including my long-term celibacy throughout any and all of my own conscious or waking hours, and including the fact that no one but me is authorized to be anywhere inside my current rental-apartment unit during my bedtime hours.

I have been living alone inside a solo-occupancy rental-apartment unit in north Austin ever since June 21, 2019. I have NEVER allowed anyone other than on-duty APD officers to enter my current always bolt-locked and locked and fully-secured rental-apartment unit at nighttime.

I might add that I have NEVER at any time permitted ANY of my current neighbors or any of my friends or former friends or current or former coworkers or any of my former roommates or any of my relatives to enter my current apartment unit on any occasion----regardless of the time of day or night----at any time since I moved into my current efficiency unit on June 21, 2019.

As I have repeatedly informed you, I myself have been completely celibate, with ZERO sexual contact or intimate physical contact between myself and any other human being--or any "beast", for that matter---at any time or on any occasion during any of my own conscious or waking hours ever since and including the day when I moved to the northern section of Austin (as an official tenant with a new roommate already there, Mr. Christian Meza, in Apartment 1638 (Building 16, top floor, a southward-facing unit), at Wind River Crossing Apartments), in August 2001.

I very emphatically and politely insist on asserting my legal right to myself lawfully and in a civil manner press charges against anyone --- regardless of the individual --- who is ever determined at any time to have committed any alleged home-invasion-related crime or alleged trespassing-related crime or alleged assault-by-physical-contact-related crime or alleged sexual-assault crime or alleged personal-injury crime victimizing myself during my sleeping hours inside my current bolt-locked unit.

Sergeant Benningfield, please respond in writing to this hopefully polite follow-up request from myself as soon as is convenient for you. If I don't hear back from you in the near future, I will have no choice but to myself submit a written appeal on this to your immediate supervisor, APD Lt. Brian Gruetzner.
