Dear Austin Police Chief Brian Manley in this state-capital city for Texas,

Best Wishes to you as you plan toward your expected retirement at the end of this month.

Chief Manley, I was very disappointed by the reply letter (final item, below) I received today from your Austin Police Department Open Records Team, stating that they may need "45 to 60 business days" in order to complete their response to my February 17, 2021-dated online public-information request.

I am very hopeful that as soon as possible this month you will be willing to please ask the Austin Police Department Open Records Team to assign very high priority to responding within the next five regularly-scheduled workdays to my online public-information request to APD.

I have a very tangible, very compelling reason for making this request of you for higher priority in processing of the cited Open Records request from myself. As I have repeatedly over a multi-year period informed your municipal law-enforcement agency's Sex Crimes Unit here in Austin, I am a self-identified continuous-and-continuing-felony-crimes victim on a daily and year-round and continuing basis in this state-capital city for Texas.

I allege that I as a law-abiding, gainfully-employed, single adult permanently-drinking-alcohol-free, lifelong-tobacco-free, longtime-celibate white Anglo-Saxon non-Hispanic gentleman, age 63, am being victimized by alleged anal-rape-crimes and other alleged personal-injury-crimes and alleged sleep-harassment crimes and alleged "assault by physical contact" crimes and alleged home-invasion-crimes and alleged trespassing crimes on a daily and year-round basis during my sleeping hours as I lie alone, asleep and unconscious, inside my solo-occupancy (myself, only) double-bolt-locked efficiency apartment unit in northeast Austin. 

I am the ONLY tenant and ONLY occupant inside my current unit, and I NEVER permit anyone but on-duty APD officers, or, on one total occasion that occurred several months ago, on-duty Austin EMS staff members, to enter my apartment unit at nighttime. I always sleep alone on my own bed, and I have been completely celibate throughout any and all of my own conscious or waking hours ever since and including the day I moved to the north Austin in August 2001.

I am concerned about possible legal liability and possible alleged undermining of crime investigation for the City of Austin and Austin Police Department, respectively, that might result from any additional time delay in APD providing me with any and all legal documents responsive to my public-information request relating to the cited continuous-and-continuing-crimes case in which I am the self-identified victim.

I submitted the above-cited online public-information request at 10:37 p.m. Wednesday, February 17, 2021, to the Austin Police Department at their official City Government of Austin website. 

The exact verbatim text of that request is as follows:

"I am seeking a copy of any and all records of or reports about any interviews of or findings about Lt. Gena Curtis or APD Sex Crimes Unit Sergeant Sandra Benningfield that referred at least once in any manner to myself, John Kevin McMillan of Austin, and that, in each such case, were  conducted at any time since September 1, 2015, by the APD Internal Affairs Unit or the APD Special Investigations Unit.

"My legal name is John Kevin McMillan. My date of birth is April 27, 1957. I was born at Lincoln, Nebraska.

"The APD Sex Crimes Unit under the leadership of Sgt. Benningfield and Lt. Curtis has never at any time authorized any new rape-evidence forensic medical exam on me that I repeatedly requested from APD's Sex Crimes Unit on numerous occasions over a multi-year period. 

"Also, the APD Sex Crimes Unit has never requested and obtained full 190-day maximum possible retroactive processing of either of the two 2011 forensic rape-evidence kits from me that APD has in its possession for APD Sex Crimes Case 11-1180447 (an April 28, 2011, forensic DNA-swabs rape-evidence medical exam on me) and APD Sex Crimes Case 11-3550615 (a December 22, 2011, forensic DNA-swabs rape-evidence medical exam on me).

"I have repeatedly informed the APD Sex Crimes Unit and other APD units over a multi-year period that I have been and continue to be victimized on a daily and year-round and multi-year basis by alleged anal-rape crimes and alleged oral-rape crimes as well as other personal-injury crimes and home-invasion-crimes and trespassing crimes and harassment crimes during my sleeping hours as I lie alone on my own bed, asleep and unconscious and probably snoring, inside my bolt-locked rental-housing unit in north Austin. I always sleep alone on my bed, and I have been completely celibate ever since and including the day I moved to north Austin in August 2001. 

"I have lived alone inside a double-bolt-locked efficiency apartment unit at Pebble Creek Apartments, 8805 North Plaza Drive, ever since June 21, 2019."
