Dear TDHCA state agency public-information coordinator,
This is a Texas Open Records request in which I seek to obtain from your state agency in Austin a copy of any and all e-mail communications referring at least once in any manner to myself, John Kevin McMillan of Austin, Texas, that were each written or sent at any time since 9 a.m. on January 3, 2019, by Mr. Jeffrey T. Pender or any other attorney or any staff member or administrator employed in the Office of General Counsel of your State Government of Texas agency.
This public-information request was prompted by a signed legal letter to the Attorney General of Texas on official TDHCA-letterhead stationery that TDHCA Deputy General Counsel Jeffrey T. Pender wrote and signed on January 16, 2019, in response to a January 3, 2019, e-mail public-information request (see last item, below) from myself.
The legal letter from Mr. Pender requested permission from the Attorney General of Texas for the TDHCA to withhold from myself, "John McMillan" of Austin, legal documents on file with your state agency's Office of General Counsel that each directly referred to myself. The cited reason for withholding those legal documents from me that Mr. Pender stated to the Attorney General's Office was "Certain Legal Matters" (Texas Government Code 552.107).
A courtesy carbon-copy of that January 16, 2019, TDHCA legal letter to the Attorney General was sent by your state agency to my e-mail address of "mcmillanj@att.net".
The other cited recipient of a carbon-copy of that same legal letter was Ms. Kathleen Vale Castillo, Public Information Coordinator for your state agency in Austin.
Thank you in advance for your prompt and very thorough reply letter providing me with any and all responsive legal documents.
Below, as a convenience to your state agency, I am providing you with the exact verbatim texts of an exchange of e-mail letters in January 2019 relating to my January 3, 2019, public-information request to your state agency:
