Mr. McMillian,

Here is information related to sexual harassment for your review. The Fair Housing Act (42 U.S.C. 3601-3619) protects individuals against discrimination because of sex. Courts recognize two types of sexual harassment: (1) quid pro quo sexual harassment (i.e., when a housing provider, or his or her employee, agent or contractor conditions access to or retention of housing or housing –related services or transactions on a victim’s submission to sexual conduct); and (2) hostile environment sexual harassment (i.e., when a housing provider or his or her employee, agent or contractor, or in certain circumstances another tenant, engages in sexual behavior of such severity or pervasiveness that it alters the terms or conditions of tenancy and results in an environment that is intimidating, hostile, offensive ,or otherwise significantly less desirable.

Thank you for taking the time to discuss this matter with me on the phone this afternoon between about 4:40 p.m. and about 4:50 p.m. today.


Would you please state to me in writing the circumstances in which you and your Fair Housing Office of the City Government of Austin would in fact determine, based on a factual investigation that you had conducted, that a cited single adult tenant (myself, for instance) residing at a cited apartment complex in Austin, Texas, had himself or herself been subjected to and victimized by illegal sexual harassment that was in violation of Title 8 of the Fair Housing Act of the U.S. Government.

I look forward to receiving your helpful and informative reply note on this.

Does the City of Austin Human Rights Commission ever pursue any actions that are designed to protect a law-abiding single adult resident of Austin who's an approved tenant at an apartment complex from that very same individual ever being subjected to or ever being victimized by any alleged sexual harassment of any type by any other resident of that apartment complex or by any employee of or representative for the apartment complex where the cited individual resides.
