Subject: Fw: Should UT House Ban Red Bull Rampage Event?

April 10, 2024

Dear Utah State House Majority Leader Mike Schultz,

The annual Red Bull Rampage Mountain Biking Event in Virgin, Utah, is a source of considerable infamy for our entire state.

That ultra-competitive event features a repeatedly  suicidal  flirtation with death by each of the competing bikers from around the world  and promulgates the message to the entire world that  Utah is Very Proud to  be the Official Host  State for Numerous  Near-Death or Possibly Fatal  Experiences for Bikers.

"Men's Health" magazine in January 2022 featured  a copyrighted story by Scarlett Wrench that bore  the title: "Welcome to the World's Most Dangerous Mountain Biking Competition".

Some key statements in that report:

----"Riders are judged on a number of criteria, including airtime and tricks, as well as more virtuoso factors such as fluidity and style. To put it bluntly, they are rewarded for taking risks: riders score points for their willingness to tread the narrow line between victory and injury."

----"...Californian rider Cam McCaul explains a 'blind take-off': ....(T)he first time the rider catches sight of the landing, it's too late to adjust speed or trajectory.

'Two miles per hour too fast and the rider will land halfway down and explode upon impact,' says  McCaul, matter of factly. '[Going] two miles per hour too slow will put the rider before the landing – and cause them to get catapulted off the bike.'”

----"In 2015, a rider named Paul Basagoitia from Nevada crashed on a step-down and shattered his vertebrae. He was evacuated by helicopter and required nine hours of surgery. The same year, Boston slopestyler Nicholi Rogatkin tumbled off a cliff in his qualifying run, enduring a 12m beating on the way down."

One copyrighted online "Outside Magazine" report about the same annual biking competition was most recently  updated on May 12,  2022, and was entitled "Inside the Most Dangerous Bike Comp on Earth". That report,  written by Peter Vigneron, began with the following statement:

"Of the dozens of crashes at last fall’s Red Bull Rampage, the one that rattled me most was Kelly McGarry’s. During practice a few days before the competition, McGarry, a 32-year-old from New Zealand, misjudged a 70-foot gap jump over a canyon and overshot his landing. At six feet four inches, McGarry is the largest guy on the Freeride Mountain Bike World Tour, and both of his wheels imploded on impact. (In the vernacular, he 'tacoed' them.) McGarry went over the handlebars and landed face first in the sandstone, eventually ragdolling to rest in a sitting position while his bike bounced down a ten-foot cliff."

State House Majority Leader Schultz, you have the legal authority to help save the lives of thousands of young men of the present and future. You can go that by asking your colleagues in the Utah House to refuse to let Utah turn into a Death Trap for young men.

Possibly the State of Utah under your kind leadership could require that each competitor at the Red Bull Rampage Mountain Biking Competition in Virgin, Utah, must be at least 21 years old, must pass a drug and alcohol test, must be certified by their physician as being  mentally and physically healthy,  and must wear specified State of Utah-required full safety gear while competing in   that event.

One biker wrote a recent safety-minded copyrighted online report (see online link below) that was most recently updated on December 7, 2023, and offered the following advice for safety gear:

"Wearing a mountain bike helmet is a no brainer (ha!), and it may even be required by law. Protective gear won’t prevent all injuries, but in most cases it can significantly reduce the severity.

"Beyond helmets, consider knee and elbow pads, chest and back protection, and even a neck brace. Manufacturers are starting to build protective features into everyday wear items like hydration packs and even jerseys. Consider adding one or more of these pieces and you just might be surprised how little they interfere with your riding comfort."

Subject: Possible Need for Update to 2016 HOV Lanes Study

https://news.byu.edu/news/byu-study-shows-fourth-utah-hov-lane-users-are-breaking-rules

"Research to increase rush hour HOV speeds finds many non-carpoolers in express lane

"Segment of I-15 with most carpool violators is between Draper and Midvale, whether it's morning or afternoon rush hour

"In morning rush hour, anywhere from 25 percent to 33 percent of HOV lane users from Lehi to Midvale are breaking rules

"Engineers suggest an increase in enforcement, education and tolls to help curb the problem

"Newly published research from BYU civil engineers finds that up to 25 percent of drivers in Utah’s high occupancy vehicle (HOV) lanes during rush hour are violating carpool requirements.

"The two segments of I-15 with the most single occupant violators in the morning won’t surprise commuters: Northbound between 14600 S. and 7200 S. (33 percent) and northbound from Lehi Main Street to 14600 S. (25 percent)."

“'The sections of I-15 with the most HOV violators are the sections where there is the most congestion,' said study lead author Grant Schultz, professor of civil engineering at BYU. “'With education and enforcement, those areas can improve.”

"....The research was done in conjunction with the Utah Department of Transportation and is aimed at finding ways to improve HOV lane speeds. The goal is to keep carpool lane speeds above 55 mph during rush-hour traffic."

Dear Utah State Legislature  House Majority Leader Mike Schultz,

Thank you again for your friendly  November 27, 2023, reply e-mail letter to me  in which you invited me to write and send you additional public policy-related concerns of mine about Utah.

I am writing you today to respectfully ask if you believe the Utah House  should authorize funding for a follow-up Utah "High Occupancy Vehicle Lanes" on highways  study  to the one about eight years ago for which the lead author was  Brigham Young University (BYU) Professor of Civil Engineering Grant Schultz.

Above is an online link to a copyrighted 2016-dated  BYU report summarizing  results from that study. The report was written by Todd Hollingshead.

One possible goal of the proposed new  follow-up study might be to identify whether there has been an increase, decrease, or no change since eight years ago  in the  percentage of drivers in Utah's High Occupancy Vehicle (HOV) lanes during rush-hour traffic  who each violate carpool requirements applicable for that highway.

The State of Utah apparently defines a carpool as a moving motor vehicle in which there is a driver and at least one  passenger inside that vehicle.

Another possible goal of the follow-up study could be to determine whether carpool- lane speeds in Utah during rush-hour traffic periods  are currently  averaging more than  55 miles per hour.

The Utah Department of Transportation reportedly supports the goal of maintaining average carpool- lane speeds on highways in Utah  at more than  55 miles per hour during rush- hour traffic.

House Majority Leader Schultz, I also am very  hopeful that your sagacious Utah House under your enlightened  leadership will please approve a Resolution praising BYU Professor of Civil Engineering Grant Schultz for his outstanding contributions toward promoting safer, more law-abiding,  and more energy-efficient use of High Occupancy Vehicle lanes in Utah during periods of rush-hour traffic on highways.

I hope to hear from you soon.

Sincerely and Best Wishes,

former Texas DPS full-time employee and current  gainfully employed, permanently alcohol-free, single adult permanent Utah resident John Kevin McMillan, 535 South 200 East, Apt. 912, Ninth Floor, Salt Lake City, UT 84111.

I am the youngest son of public-safety-minded Murray (UT) native, Murray High School alumnus, and University of Utah alumnus Dr. Calvin McMillan.

My 'Please Pave More Roads in Southern Utah' Letter Today to Utah State House Majority Leader Mike Schultz

I am very hopeful this letter of mine today to  Utah State House Majority Leader Mike Schultz will help to persuade the State of Utah to provide funding toward paving numerous dirt roads in Southern Utah.

I am very hopeful this letter of mine today to  Utah State House Majority Leader Mike Schultz will help to persuade the State of Utah to provide funding toward paving roads in Southern Utah.

A key statement from an expert on Southern Utah that is included in my letter below:

"....(E)ven flatlands can become inaccessible in Southern Utah after rains because unpaved roads turn into clay. Cars can easily become stuck and need towing, which happens regularly on the road to White Pocket. Cars can also be washed off the road entirely, like what happened in the summer of 2022 in Capitol Reef."

Subject: Fw: No Final TXOAG Reply re: My PIR Complaint vs DA

March 26, 2024

Dear Open Records Assistance Staff Members for the Attorney General of Texas state agency headquarters  offices in Austin,

I am very surprised  that your state agency has not provided me with a reply note indicating whether my current Open Records Complaint against the Travis County District Attorney's Office in Austin has been resolved or closed or re-opened.

The official ID number your state agency has issued for that legal complaint from me is:

OR-23-103287-IC

My current  Open Records Complaint to your state agency is focused on the alleged failure by the Travis County District Attorney's Office Public Information Coordinator  to send me any reply letter in response to my November 30, 2023,  public information request to that DA's Office.

My November 30, 2023,  request to the DA in Austin  had sought "a copy of any and all documents on file with each applicable division or unit of your DA's Office that were each authored by someone other than me at any time since 9 a.m. January 1, 2021, and  which each  stated that I myself was or am victimized by  a felony crime.''

I hope to hear from you soon.

Sincerely and Best Wishes,

Open Records complainant John Kevin McMillan, 535 South 200 East, Apt. 912, Ninth Floor, Salt Lake City, UT 84111.

My cell phone: (512) 993-7305.

My Date of Birth: 4-27-1957. I was born in Lincoln, Nebraska.

Subject: Fw: No Final Reply from TXOAG re: My PIR Complaint vs DAxss.gob

March 9, 2024

Dear Open Records Assistance Staff Members and  Communications Staff Members for the Office of Attorney General of Texas state agency in Austin,

I have not received any reply e-mail message from your very influential State of Texas agency in response to this message I sent (see farther below for complete text of that message) to your Public Information Division staff members on March 5, 2024:

"I still have not received from your state agency a final  response from you on my currently-active Open Records Complaint against the Public Information Coordinator for the Travis County District Attorney's Office in Austin, Texas.

"I  am seeking a follow-up note  from you on whether the Travis County District Attorney's Office has  legal  documents on file which  state that I myself was or am victimized by a felony crime at any time since 9 a.m. January 1, 2021.

"I had submitted an Open Records  Complaint to your state agency because I do not recall having received any reply to me from the Travis County DA's Office on whether they have a document on file authored by someone other than me at any time since 9 a.m. January 1, 2021, which stated that I myself was or am victimized by a felony crime.

"The official Identification Number that the Attorney General of Texas on December 283, assigned to my Open Records complaint from myself  is: ID# OR-23-103287-IC.

"My legal complaint through your state agency  alleges that the Travis County DA's Office has allegedly failed to respond in writing to my November 30, 2023, public information request to that government agency.

"My November 30, 2023,  request to the DA had sought 'a copy of any and all documents on file with each applicable division or unit of your DA's Office that were each authored by someone other than me at any time since 9 a.m. January 1, 2021, and  which each  stated that I myself was or am victimized by  a felony crime.'"

Thank you in advance for your helpful reply letter to me on this very important criminal-law issue for myself. I am a self-identified longstanding continuous Home-invasion Sexual-Assault Crimes and Personal-Injury-Crimes Victim and complainant.

Sincerely and Best Wishes,

public information requestor, Open Records Complainant, and permanently-alcohol-free (ever since 1990), lifelong-tobacco-free, lifelong-nonvaping, permanently marijuana-free (ever since 1984), facially-cleanshaven, consistently clean-talking and non-profane, lifelong-tattoo-less, permanently jewelry-less, English-Scottish-German-American in ancestry and Exclusively Monoracial and "Anglosexual" (White Non-Hispanic Only) in my own sexual orientation, non-sadomasochistic and anti-S&M, platonicly polite, longtime celibate (ever since one total day in 1995), dependably civil and law-abiding and very honest and non-stalking and public-safety-minded and vigilant and conscientious and non-pranking, psychologically healthy and disease-free and fully up-to-date on all applicable vaccinations for myself, gainfully employed single adult white non-Hispanic male former Texan resident John Kevin McMillan.

Subject: Fw: No Final Reply from TXOAG re: My PIR Complaint vs DAxss.gob

A respectful FYI to each of you on the following.

Please excuse the typographical error that occurred when I was attempting to type the final portion of an e-mail address on my cell phone for a very honorable State Government of Texas official, State Rep. Donna Howard, that would have stated "texas.gov". Those letters somehow got typed elsewhere----after the initials "DA" at the end of my subject heading.

Please note that below, I have removed those extraneous letters "xss.gob" from the subject heading. I attempted to remove those letters from the "FW:" message above, but was informed by an automated message to me on my screen that that action by myself would delete the entire e-mail.

Best Wishes,

from gainfully employed dependably vigilant and law-abiding white male adult single gentleman and longstanding criminal-law complainant John Kevin McMillan of Salt Lake City, Utah.

I am a self-identified continuous year-round personal-injury-crimes victim, longtime-celibate (ever since one total day in 1995) adult gentleman who is myself facially cleanshaven and repulsed by facial hair on men, dependably clean-talking (the "F" word is anathema to me) and repulsed by the profanity and obscene speech verbalized by others, hygienic, fully vaccinated against every applicable contagious disease for which I can obtain a vaccine for myself that is authorized by my current Primary Care Physician, permanently marijuana-free ever since 1984 and very anti-marijuana-minded, lifelong-illicit-drug-free in regard to any and all illicit drugs other than marijuana, lifelong-tattoo-less-and-repulsed-by-tattoos, and permanently jewelry-less and repulsed by tongue rings and nostril rings and ear-rings on male adult persons.

My Date of Birth: 4-27-1957. I was born in Lincoln, Nebraska. I am a lifelong American citizen. I might add politely that I as a medically healthy, intellectually strong, creatively vital, physically active white English-Scottish-German-ancestry adult gentleman DO NOT agree to ever "date" or to ever have any "sexual contact" with any person more than 12 months older than me. I might add that I myself am an exclusively MONORACIAL gentleman in my own sexual orientation --- I DO NOT agree to ever have any "sexual contact" with any person who is outside of my own White Non-Hispanic Racial Group. In my own mutual-consent personal platonic relationships I am also, of course, MONORACIAL in regard to the vast majority of those types of personal relationships for myself during my off-duty hours. I moved to Utah partly to pursue a White Anglo-Saxon-centered mutual-consent personal life during my leisuretime, with an emphasis on natural-blond-haired politely masculine facially cleanshaven hygienic law-abiding white gentlemen age 21 or over as the single adult gentlemen I get along with the best and feel calmest with and enjoy talking with the most while interacting with them in person.

Subject: No Final Reply from TXOAG re: My PIR Complaint vs DA

March 5, 2024

Dear Attorney General of Texas state  agency officials in Austin,

I still have not received from your state agency a final  response from you on my currently-active Open Records Complaint against the Public Information Coordinator for the Travis County District Attorney's Office in Austin, Texas.

I  am seeking a follow-up note  from you on whether the Travis County District Attorney's Office has  legal  documents on file which  state that I myself was or am victimized by a felony crime at any time since 9 a.m. January 1, 2021.

I had submitted an Open Records  Complaint to your state agency because I do not recall having received any reply to me from the Travis County DA's Office on whether they have a document on file authored by someone other than me at any time since 9 a.m. January 1, 2021, which stated that I myself was or am victimized by a felony crime.

The official Identification Number that the Attorney General of Texas on December 283, assigned to my Open Records complaint from myself  is: ID# OR-23-103287-IC.

My legal complaint through your state agency  alleges that the Travis County DA's Office has allegedly failed to respond in writing to my November 30, 2023, public information request to that government agency.

My November 30, 2023,  request to the DA had sought "a copy of any and all documents on file with each applicable division or unit of your DA's Office that were each authored by someone other than me at any time since 9 a.m. January 1, 2021, and  which each  stated that I myself was or am victimized by  a felony crime."

I hope to hear from you soon.

Sincerely and Best Wishes,

from Permanently Alcohol-free (ever since 1990),  Lifelong-Tobacco-free, Very Honest and Law-abiding, Single Adult Male White Anglo-Saxon Non-Hispanic Utahn Complainant and Requestor and former Austin (TX) resident John Kevin McMillan, 535 South 200 East, Apt. 912, Ninth Floor, Salt Lake City, UT 84111.

My current  cell phone number ever since August 2019: (512) 993-7305.

My current home phone number ever since 2022: (801) 355-0850.

These Seven Very Impressive State Lawmakers of Utah Have Each Written and Sent Me One or Two Reply Letters:

As a new permanent resident of Utah (ever since January 1, 2023), I continue to be very impressed by the kind willingness of several respective individual members of the Utah State Legislature to each directly  write and send me reply letters.

The state lawmakers of Utah who have each directly written to me are:

--Chairman Carl R. Albrecht of the Utah House Committee with jurisdiction over Energy issues;

---Utah House Majority Leader Mike Schultz;

---Utah State Representative Melissa Ballard of Davis County, Utah (two reply notes to me);

---Utah State Representative Brett Garner, who.politely indicated to me in writing that he has had some concerns about some of the "film-making" productions either currently occurring or that have previously occurred here in Utah.

-----Utah State Rep. Marsha Judkins (two reply notes to me);

----Utah State Rep. Angela Romero, who assured me in writing in 2022 that she supports safe housing conditions for me here in Salt Lake City.

----Utah State Rep. Paul Cutler, who very kindly asked if I might be willing to myself visit the Legislature and help advocate for his Road Rage bill before the Legislature.

I am still waiting for my first-ever reply letter from the two state lawmakers who are my official representatives in the Utah Legislature---State Rep. Joel Briscoe and State Senator Dr. Jenn Plumb.

> (Explanatory Note from Public Information Requestor and permanent Utahn resident John Kevin McMillan of Salt Lake City, Utah:  This most recent February 1, 2024, Public Information Request of mine to the Attorney General of Texas seeks documents on file with that state agency in Austin  that refer to or relate  to my current  Open Records Request complaint I have filed through that state agency against the Open Records Coordinator for the Travis County District Attorney's Office in Austin, Texas.

> The official Identification Number that the Attorney General of Texas on December 28, 2023, assigned to that Open Records complaint from myself  is: ID# OR-23-103287-IC.

> My legal complaint through the Attorney General of Texas  alleges that the Travis County DA's Office has allegedly failed to respond in writing to my November 30, 2023, public information request to that government agency.

>>

>>  "Dear Ms. Smith:

>> "On February 1, 2024, the Office of the Attorney General ('OAG') received a public information request under the Public Information Act ('PIA'), Chapter 552, Government Code, from Mr. John (Kevin) McMillan (of Salt Lake City, Utah). A copy of the request is attached as Exhibit A. In accordance with section 552.3031 of the Government Code, this brief was timely hand-delivered on February 9, 2024.

>>

>> "Except for the submitted information, the OAG  will release the responsive  information  with redactions allowed by law.  See Open Records Decision No. 684 (2009) (governmental bodies may withhold certain information, including personal e-mail addresses, without necessity of requesting (a) ruling under Gov’t Code § 552.301).

>>

>> "The OAG asserts, however, that the submitted information is excepted from required public disclosure under the PIA. Pursuant to sections 552.301(b) and 552.301(e) of the Government Code, this brief is submitted to seek a decision as to whether section 552.111  of the Government Code applies  to the submitted  information. We have copied the requestor  as a recipient of this brief pursuant to sections 552.301(d) and  552.301(e-1) of the Government Code.

>> "The information at issue is attached as Exhibit B.

>>  "I.  Information Excepted From Required Public Disclosure Under Section 552.111: Intraagency Communications Reflecting Deliberative Process of the OAG

>>

>> "Section 552.111 of the Government Code excepts from required public disclosure '[a]n interagency or intraagency memorandum or letter that would not be available by law to a party in litigation with the agency.' Gov’t Code § 552.111. Section 552.111 excepts those internal communications consisting of advice, recommendations, or opinions reflecting the policy making processes of a governmental body. See Open Records Decision No. 615 at 5 (1993); accord(sic) City of Garland v. Dallas Morning News, 969 S.W.2d 548, 556 (Tex. App.—Dallas 1998) ('Section 552.111 . . . excepts only those internal communications consisting of advice, recommendations, and opinions reflecting the policy-making processes of the governmental body at issue.'), affirmed, 22 S.W.3d 351 (Tex. 2000).

>>

>> "The purpose of section 552.111 is 'to protect advice and opinions on policy matters and to encourage frank and open discussion within an agency in connection with its decision-making processes.' Dallas Morning News, 969 S.W.2d at 556.

>>

>> "Your office has concluded that a preliminary draft of a document that is intended for public release in its final form necessarily represents the drafter's advice, opinion, and recommendation regarding the form and content of the final document, so as to be excepted from disclosure under section 552.111. See Open Records Decision No. 559 at 2 (1990) (applying statutory predecessor).

>>

>> "Section 552.111 protects factual information in the draft that also will be included in the final version of the document. See id. at  2-3. Thus, section 552.111 encompasses the entire contents, including comments, underlining, deletions, and proofreading marks, of a preliminary draft of a policymaking document. See id. at 2. However, a governmental body may only withhold a draft policymaking document if the final form of this document is intended for public release. Your office has previously ruled that draft letter rulings are excepted from public disclosure under section 552.111. See Open Records Letter Nos. 2012-00334 (2012), 2010-16830 (2010).

>>

>> "In this instance, the submitted document is a draft enforcement letter that has been released to the public in final form.(footnote)1.

>>

>> "(Footnote)1 The OAG has released the final version of the enforcement letter to the requestor.

>>

>> "The draft was made and communicated to OAG employees in furtherance of the OAG's policy of maintaining uniformity in the application, operation, and interpretation of the PIA. See Gov't Code 552.011. Because the draft reflects the deliberative process of OAG policymakers, the OAG asserts it may be withheld in its entirety under section 552.111 of the Government Code and the deliberative process privilege.

>>

>> "II. Conclusion

>> "The OAG respectfully requests a decision from the Open Records Division regarding the applicability of the argued exception as provided by the PlA.
