Mr. McMillian,
Here is information related to sexual harassment for your review. The Fair Housing Act (42 U.S.C. 3601-3619) protects individuals against discrimination because of sex. Courts recognize two types of sexual harassment: (1) quid pro quo sexual harassment (i.e., when a housing provider, or his or her employee, agent or contractor conditions access to or retention of housing or housing –related services or transactions on a victim’s submission to sexual conduct); and (2) hostile environment sexual harassment (i.e., when a housing provider or his or her employee, agent or contractor, or in certain circumstances another tenant, engages in sexual behavior of such severity or pervasiveness that it alters the terms or conditions of tenancy and results in an environment that is intimidating, hostile, offensive ,or otherwise significantly less desirable.
Additional information is available on-line under HUD’s website (HUD.gov) in the FHEO section of the site, which provides additional questions and answers on sexual harassment under the Fair Housing Act. I hope this information is helpful. Thank you.

Dear Acting Administrator Serrano of the City of Austin ,
Thank you for taking the time to discuss this matter with me on the phone this afternoon between about 4:40 p.m. and about 4:50 p.m. today.
Would you please state to me in writing the circumstances in which you and your Fair Housing Office of the City Government of Austin would in fact determine, based on a factual investigation that you had conducted, that a cited single adult tenant (myself, for instance) residing at a cited apartment complex in Austin, Texas, had himself or herself been subjected to and victimized by illegal sexual harassment that was in violation of Title 8 of the Fair Housing Act of the U.S. Government.
I look forward to receiving your helpful and informative reply note on this.

Does the City of Austin Human Rights Commission ever pursue any actions that are designed
to protect a law-abiding single adult resident of Austin who's an
approved tenant at an apartment complex from that very same individual
ever being subjected to or ever being victimized by any alleged sexual
harassment of any type by any other resident of that apartment complex
or by any employee of or representative for the apartment complex where
the cited individual resides.

Hi John,
I am sorry to let you know that I will not be able to help you at this time. While I could in the past, I am just not able to right now.
I wish you the best with your medical issues and hope you can come to a resolution soon. While I understand you cannot possibly move away from Austin at this time, I would see this as the only real solution to your problem. It seems that the longer you stay in Austin , the more you are bothered by the situation. There are other quieter cities out there that I’m sure would have employment for a nice guy like you.
Again, I wish you the very best!

Dear Heather,
Thank you again for your Nebraska-style kindness and friendliness toward myself in recent years.
As a native of Nebraska myself, I am very hopeful that you will be interested in the following (below) legal correspondence of mine with the Attorney General of Nebraska, Mr. Jon Bruning---including a much-appreciated E-mail reply letter from Mr. Bruning (see below).
I am striving to work seven days per week in order to improve my finances here in Austin , and I will be beginning a new job with a nice work environment next week. I hope to have the opportunity to invite you to lunch again sometime soon, and to hear more from you about why you are glad you relocated to Texas from your native state. Your success story in Austin is very inspirational!
Incidentally, Heather, because of my doctor-ordered medical exam in March my finances are very, very tight this week, a week when my monthly rent is due. Please let me know if there is any possibility I could borrow $50 from you, with the understanding I would then pay you back in cash as soon as I possibly can.
Best Wishes,

April 1, 2011
Dear Nebraska Attorney General Bruning in Lincoln, Nebraska,
As a proud native of your widely-admired capital city of Lincoln , I want to thank you for taking the time to write me an encouraging reply letter (below).
Your reply E-mail letter was apparently in response to E-mail correspondence from me I recently shared with you relating to medically injurious and unwanted noise pollution to which I have been subjected in Austin , Texas , on a continuous and year-round basis.
So far, the Attorney General of Texas has not expressed any concern to me in writing about the significant permanent and irreversible medical damage to my hearing capacity resulting from that continuous background noise pollution over a multi-decade period in Austin, Texas, including at each and every one of my workplaces in Austin and Cedar Park during that period, that I myself DID NOT and DO NOT generate or request or authorize or want in my own life. I lead a very quiet life in Austin , and I NEVER attend rock-music or punk-rock music concerts, for instance. In fact, I only rarely listen to music of any type during my leisuretime.
No state agency or State of Texas-owned institution, and no other government-owned or government-affiliated institution or organization of any type, has ever acknowledged to me at any time that it had any role of any type in sponsoring or permitting or authorizing or causing or inflicting or perpetrating the injurious noise pollution in Austin that has been very harmful to myself and my medical health over a multi-decade period.
However, I remain very hopeful that the Consumer Protection Division or Victim Services Division of the Office of the Attorney General of Texas state agency in Austin, Texas, will in the near future send me a reply letter providing me with helpful factual information and expressing an interest in this legal-liability matter facing the State Government of Texas, the City Government of Austin, Travis County Government, Williamson County Government, the City Government of Cedar Park, and the U.S. Government as well.
Sincerely and Best Wishes,

Thank you again, Mr. Barish, for your polite return phone message last year in response to my cited search for a private attorney member of the State Bar of Texas who will help me.
I continue to have a great need for a private attorney to file a lawsuit on my behalf relating to my being victimized ever since April 28, 2011, for instance, on a daily and year-round basis (with the only apparent exceptions having been the early-morning and morning hours of September 3, 2011, and Sept. 10, 2011) by one or more illegal intruders inside my bolt-locked apartment unit. I have repeatedly alleged to the Austin Police Department that that illegal intruder (intruders?) has allegedly subjected me during my nocturnal slumber to alleged sexual abuse and alleged physical abuse and alleged medically injurious conduct harmful to myself.
I continue to find a wide variety of thick black hair follicles, many of them curly, on a bed of mine virtually every morning (my own hair color is brown, and my hair follicles are not thick in texture), and I've shared many of those black hair follicles with the Austin Police Department. However, so far the Austin Police Department has done nothing to stop the alleged violations of my own privacy rights occurring every day inside my bolt-locked apartment unit in which I am the only approved tenant and only approved occupant, even though I have filed several complaints with APD.
Mr. Barish, I realize that you don't handle sex-crime cases in which your client is the cited victim of injurious conduct of that type, from what you indicated in your phone message to me last year.
I am writing you today to politely ask you if you know of ANY private-attorney member of the Temple Beth Israel congregation, or any other attorney whom you would recommend, who might be willing to file a personal-injury complaint or sex-crime victim complaint on my behalf on a contingency-fee basis or pro-bono basis that relates to these alleged sex crimes victimizing myself during my sleep?
I am a very strong complainant, since I live alone (ever since late May 2011), I ALWAYS sleep alone on my bed, and I NEVER have any invited overnight guest or any invited guest inside my apartment unit between midnight and 8 a.m., for instance. Also, I lead a compeltely illicit-drug-free (no marijuana, either), permanently alcohol-free, fully-ambulatory, gainfully-employed lifestyle as a single adult lifelong-non-Christian gentleman. Also, I am psychologically healthy and consistently civil and clean-talking and law-abiding (I have no criminal-conviction record, in fact), and I do not seek to harm anyone or myself.
Thank you in advance, Mr. Barish, for any suggestions you might be willing to offer me.
Sincerely and Best Wishes,

Dear City of Austin Public Information Coordinator,
This is a Texas Open Records request in which I seek to obtain from any office or department of the
City Government of Austin, including your Human Resources department, a copy of one legal document for the applicable Austin Police
Department APD) officer that simply states the legal name or first and last name
or E-mail address of the one total Austin Police Department officer
who himself or herself directly consulted or directly communicated
with or directly contacted the City Attorney's Office or the City of
Austin Law Department here in Austin, Texas, in a context referring in
any manner to myself, John Kevin McMillan of Austin, on more total
occasions during the most recent approximately four-year period from
April 1, 2011, through the present, than did any of the numerous other
APD officers who reportedly consulted the City Attorney's Office about
me during that same approximately four-year period.
My legal
name is John Kevin McMillan. I was born on April 27, 1957, at Lincoln,
Nebraska. I am a lifelong single gentleman. I am gainfully employed,
permanently alcohol-free (ever since
1990) and permanently marijuana-free and illicit-drug-free (ever since
1984), and dependably civil and law-abiding and vigilant. I do not
have any criminal-conviction record.
I am a former full-time employee here in Austin for the Texas Department of
Public Safety, the Texas Department of Criminal Justice, and the Texas
Board of Pardons and Paroles, respectively.
I have resided as a rent-paying official tenant in Apartment 325 of Building
3 at Wind River Crossing Apartments, 11411 Research Boulevard in
northwest Austin, ever since January 2002.
Thank you in advance for your prompt and authoritative reply letter in response
to this public-information request from myself.
Sincerely and Best Wishes,
John Kevin McMillan.

I do not believe so. I would suggest that you might be interested in looking up all the bills that were introduced to see if any of the bills introduced might be addressing the areas of interest to you: http://www.capitol.state.tx.us/.

Dear Ms. Gerson,
Thank you for your reply note of (earlier) today.
Does your reply letter of May 12 also imply that you yourself are not aware of ANY bill or resolution authored or sponsored by Senator Watson this session that was designed to address ANY of the concerns or complaints from myself that I have shared with your legislative office in Austin?
Best Wishes,
John Kevin McMillan, a law-abiding constituent of Senator Watson.

Subject: 6-16-14 question for aide to Sen. Watson re: alleged-continuous-sex-crimes case
Dear Ms. Defrates,
Does Senator Kirk Watson support full privacy rights for me and my legal and human right to sleep alone, without anyone else inside my private bedroom at that time, and to also myself sleep UN-molested as well as UN-harmed and UN-injured and UN-raped, inside my bolt-locked private bedroom of my rental apartment unit throughout the entirety of any and all time periods when I am sleeping or napping?
I might add that the ONLY exception to that legal right for myself I am seeking and agree to authorize would be if the Texas Department of Public Safety, a reliable and trusted former employer of mine, or the Travis County Sheriff's Office or the Dallas County District Attorney's Office or the Dallas County Sheriff's Office or some other reputable government agency or government official, such as the FBI or the U.S. Department of Homeland Security or U,S. President Obama, or the very distinguished State of Texas Senator Kirk Watson himself, or possibly the Austin Police Department or the Travis County DA's Office, were to be willing to provide me with top-secret and externally controlled electronic surveillance of my entire bedroom per se and my entire bathroom per se on a temporary multi-day or multi-week basis.
I am a low-income single adult white gentleman, and I cannot financially afford ADT surveillance of my private bedroom or bathroom at present.
I ALWAYS sleep alone, and I have ALWAYS been completely celibate throughout the entirety of all of my conscious or waking hours, with no sexual contact or intimate physical contact of any type with any person or any creature, for that matter, at any time ever since and including the date when I moved into Apartment 325 in January 2002 at this Westdale-managed apartment complex in northwest Austin.
Any and all DNA-swab evidence ever since January 2002, for instance, that was obtained from my own anus or buttocks or genitals or mouth or other part of my body, and that can be traced to a human or animal DNA source OTHER than myself, is therefore very clear and convicing criminal-law evidence and legal proof in a court of law in Austin that I was, in fact, raped by that alleged criminal person or creature.
I feel hopeful that either Westdale headquarters officials in Dallas or my professionally polite general manager, Ms. Coker, would agree to government-provided top-secret electronic surveillance of my bedroom and bathroom on a temporary multi-day or multi-week basis during this time period.
The legal address for Westdale's corporate headquarters in Dallas, Texas, is: 3100 Monticello Avenue, Suite 600, Dallas, Texas, 75205, with their headquarters office phone number being: (214) 515-7000.
The highly-regarded general manager of my apartment complex is Ann Coker, and her office phone number is: (512) 346-1902.
Ms. Defrates, thank you for your very kind interest in this alleged-personal-injury-crimes, including during my sleep, and alleged-anal-rape-crimes-during-my-sleep crime case in which I am the self-identified victim on a daily and year-round and still-to-this-very-morning-continuing basis inside my bolt-locked apartment unit at Wind River Crossing.
I hope to hear your reply note on this in the very near future.
Sincerely and Best Wishes,
John Kevin McMillan, a law-abiding and gainfully employed, longtime-celibate-by-choice, always-sober (I have NEVER consumed any alcoholic beverage at any time, anywhere in the entire world, on any occasion since the late summer of 1990), lifelong-tobacco-free and anti-tobacco-minded, white non-Hispanic non-Jewish single adult male constituent of Senator Watson. I am also a lifelong non-Christian gentleman who, unlike many of the non-Christian men of Travis County, Texas, does not myself have any criminal-conviction record.
