Subject: Re: [Records Center] Public Information Request :: R010168-083021

September 9, 2021

Dear Texas Assistant Attorney General June B. Harden,

Thank you for your September 9, 2021, reply note to me (directly below), which states: "As we have not received a request for a cost estimate, we are closing this request."

Assistant Attorney General Harden, I would appreciate receiving from you a financial-cost estimate on how much you would like me to pay your state agency in exchange for your providing me with any and all documents that you have apparently now determined to be responsive to my most recent public-information request --- a request from me that you received on August 27, 2021.

I am making this request for a cost estimate at this time because your September 9, 2021, reply note appears to possibly indicate that you may now be agreeing that you may have one or more  documents responsive to my public information request (farther below) that you received on August 27, 2021. at your correct official e-mail address for Open Records requests.

My August 27, 2021, request had sought "a  copy of any and all e-mail communications or other written communications generated or received or sent or mailed or forwarded at any time since June 21, 2019, by the OAG Deputy Attorney General for Criminal Justice or by the OAG Director of Law Enforcement, or by any staff member under either of those  OAG officials' direct supervision in their respective office areas, that referred at least once in any manner to myself, John Kevin McMillan.
"Excluded from the scope of this public-information request are any and all e-mails that were written by myself or e-mailed by myself to your state-government agency in Austin...."

Best Wishes,
John Kevin McMillan, public-information requestor.
My efficiency-apartment-unit rental-home address ever since June 21, 2019:
Pebble Creek Apartments, 8805 North Plaza Drive, Bldg. 17, Apt. 2418, Austin, TX 78753.

Subject: reply to TX Asst Atty General Harden re: your 'no docs' response to my 8-26-21-dated PIR

September 2, 2021

To: Ms. June B. Harden, Assistant Attorney General of Texas, Assistant Public Information Coordinator, Office of the Attorney General of Texas, Austin.

Dear Assistant Attorney General Harden,

Thank you for your prompt reply letter to me today (directly below) that was in response to the following (last item, below) August 26, 2021-dated and later re-sent-on-August 27 public-information request from me to your correct official e-mail address for receiving Open Records requests.
My August 26 e-mail request had sought "a  copy of any and all e-mail communications or other written communications generated or received or sent or mailed or forwarded at any time since June 21, 2019, by the OAG Deputy Attorney General for Criminal Justice or by the OAG Director of Law Enforcement, or by any staff member under either of those  OAG officials' direct supervision in their respective office areas, that referred at least once in any manner to myself, John Kevin McMillan.
"Excluded from the scope of this public-information request are any and all e-mails that were written by myself or e-mailed by myself to your state-government agency in Austin...."

Assistant Attorney General Harden, I was very surprised and disappointed by your statement to me today that your law-enforcement-minded state agency in Austin does not have any legal documents generated by any applicable staff member, investigator, or official of your agency that are responsive to the above-cited request for information.

I would like to respectfully remind you that on September 23, 2020, you wrote and sent me a reply letter (below) stating that at that time you had several or more documents not authored by me that were responsive to my information request you had received on September 11, 2020,  that sought a copy of "any and all written communications referring to me at least once in any manner, including any and all e-mail communications or reports fitting that description, that certified peace officer Captain Gregory Lucas of your state agency's Criminal Investigation Division or David Maxwell, Director of Law Enforcement for your state agency, wrote or received or sent or mailed or e-mailed at any time since 12:01 a.m. April 28, 2011. Excluded from the scope of this request are any e-mails that I myself exclusively wrote...."

Your September 23, 2020, reply letter to me (directly below, for opening text) requested in writing that I pay you in advance an estimated financial amount of "$144.00" in exchange for your providing me with responsive legal documents.

Your September 23, 2020, official reply letter to me---which specifically at the end of that letter cited yourself as the author of that legal letter----had begun with the following initial paragraphs:

"Ken Paxton
"Attorney General of Texas
"Post Office Box 12548,
"Austin, Texas 78711-2548
"(512) 463-2100   http://www.texasattorneygeneral.gov

"September 23, 2020

"John McMillan
 mcmillanj@att.net

"VIA E-MAIL ONLY RE: Public Information Request No. R005497

"Dear Mr. McMillan:

"This letter is in response to your public information request to the Office of the Attorney General (“OAG”), received by the OAG on September 11, 2020.

"The OAG maintains information responsive to your request. Much of the responsive information has been archived offsite. Other records contain confidential employee user IDs that must be redacted before the records can be released to you. 1 (footnote):
"1 (footnote) Please note, upon payment, the OAG will seek a ruling to withhold additional information from disclosure.")
Under the current OAG Cost Rules, the estimated personnel time to locate, compile, redact, and reproduce this information is $15 per hour for 8 hours ($120.00). The overhead charges are 20% of the personnel charges ($24.00). Because this information will be produced electronically, there are no postage or materials charges. The total estimated cost due for this information is $144.00. Thus, your request triggers section 552.2615 of the Government Code, as well as section 552.263 of the Government Code...."

Assistant Attorney General Harden, today I would like to point out that the scope of my current public-information request might possibly include some or several of the documents that were responsive to the request of mine you received from me on September 11, 2020. I may have enough money in my personal checking account today to pay your state agency in Austin for any and all documents you might ever identify that you determine to be responsive to my most recent PIR that you received on August 27, 2021.

Best Wishes,

John Kevin McMillan, current criminal-law complainant in APD Case 2021-2440624, a new APD Sex Crimes case that was activated by APD on September 1, 2021, and was accompanied by a forensic DNA-swabs sexual-assault-evidence medical exam on me by a female forensic nurse that concluded at 1:56 a.m. today (September 2, 2021) inside the Emergency Room of the Dell Seton Medical Center at The University of Texas, located at the intersection of Red River Street and West 15th Street in downtown Austin.
My solo-occupancy efficiency-apartment-unit rental-home address ever since June 21, 2019: Pebble Creek Apartments (a Belco Equities-managed large gated-community complex that is reportedly owned by Pebble Creek Babay, Ltd., a California Limited Partnership. for which an official agent's address is in Beverly Hills, California),  8805 North Plaza Drive, Bldg. 17, Apt. 2418, Austin, TX 78753.

Mr. McMillan:

Since June 21, 2019, you have sent 562 e-mails to the Human Trafficking inbox.  When any e-mail is received, it is forwarded to the agency's intake person so the communication can be logged in.  The forwarding communication has no information other than the contents of the original e-mail.  As you state that you do not want any e-mails that you submitted, there is no information responsive to your request.  If you do want these e-mails, please let me know as I will need to charge for the redaction of the many personal e-mail addresses in your communications.  Section 552.137 of the Government Code prohibits me from releasing personal, third-party e-mail addresses regardless of how those addresses were received.

ANOTHER IMAGINARY VICARIOUS VISIT TO NEW YORK CITY: A SEMI-FICTITIOUS EAVESDROPPER'S REPORT

---"I find it unnerving when I glance through an upper-floor window inside a skyscraper here and everyone on the ground is so tiny they remind me of an insect."

---"It is hard to avoid sounding cynical about the throngs of people here. Everyone knows one of the best-selling novels about life in New York should be entitled 'Far From the Maddening Crowd'."

--"The title of that novel will imply that if you live here too long, you turn into a deranged lunatic. You go mad to the point of complete and irretrievable derangement."

---"I don't know whether statistics will show that a higher percentage of New Yorkers go crazy and end up in a psychiatric ward than do residents of Philadelphia, for instance."

---"The human face will never be the same for me. It is the face where the COVID-19 gets spread from, so it is a lot harder to smile at faces these days. Any face could be the face of a would-be COVID Killer, as I call them."

---"If I were religious, I would be saying 'count your blessings that you tested negative for COVID' to everyone I interacted with when they tell me they didn't test positive. If they test positive, I would probably say something else, such as 'Count your blessings that you are still alive' or 'Maybe the Lord has asked you to reunite with them sooner than you had expected.'

---"Whenever I visit an art exhibit here these days and any of the subjects in the artworks have their mouth open, I want to shout at them to please SHUT YOUR MOUTH and PUT ON A MASK ASAP!"

---"I think the word 'trust' is at risk of being banished from my vocabulary. People lie to me all the time about whether they were tested recently, and whether they got vaccinated. Why should I trust anyone about anything these days?"

---"At least we've expanded our repertoire of worst-case scenarios, since children are often spreading what ends up being a fatal exposure to the COVID-19 virus. This means we'll have to use the term 'enfant fatale' to describe what's going on. I don't remember using that term before, but COVID has forced me to talk that way about children. How tragic that we're sounding cynical toward everyone these days. Children have lost their air of innocence."

---"What's especially hideous about COVID is that so many of the victims are desperately gasping for oxygen as their final statement to the entire world."

---"I think anyone who's come down with COVID finds that hugging their pet dog helps them to recover sooner. Our pet canines turn into unpaid medical assistants who nurse us back to health."

---"I never did find out whether if a person with a mild case of COVID-19 interacts with someone who has a severe case of COVID-19, is the mild case person at risk of turning into a severe case person?"

---"As a Christian, I need to find the best prayer that specifically refers to how to get over a flu as soon as possible. But I'm not sure whether there are prayers available that specifically contain the word 'flu'. This is one of the reasons why I sometimes question whether my religion is fully relevant to what I need in the here and now."

---"I find it tragic that we have all developed a hatred toward our own lips, because of this terrifying crisis. If we open our lips, we could either infect or get infected."

---"Maybe I need to attend an art exhibit that celebrates and praises human lips. This might help to restore my confidence in the beauty of human facial lips."

---"Maybe you should pay your rent several months in advance, as one way to anticipate a worst-case scenario. That way you won't get evicted if you end up in the hospital."

---"There may be a need for a doctoral thesis that's entitled, 'The Role of Medical Pandemics in Spawning Anti-Social Attitudes in American Society'."

---"I can't even tell you which university has the greatest library collection devoted to the subject of pandemics, much less who is the leading scholar with expertise on pandemics."

---"If we ever do host a Pandemic Symposium here, I hope it will all be a virtual event. I don't want anyone getting infected from attending an event aimed at helping to put a stop to pandemics."

---"One thing I hate to see during this crisis is that my oldest child seems to be a lot meaner toward my youngest child during this period."

---"I would love to attend a ballet performance in which the dancers simulate what it's like in real life to attempt to respond to the COVID-19 challenge while still maintaining a sense of forward momentum in your own life. Maybe a bold new COVID choreographer will get profiled in 'The Times' and everyone will find that feature story inspirational."

A SEMI-FICTIONAL EAVESDROPPER'S REPORT: WHAT THE NEW YORKERS ARE SAYING EITHER THIS YEAR OR NEXT YEAR

---"Whenever I say 'Are you New to New York?', it feels so redundant. I have figured out an alternative way to phrase my question. My alternative questions is: 'So how many weeks have you been living here?'"

---"I don't know whether there is a memorial anywhere on Long Island for that plane flight in 1996 that crashed nearby with 16 members of a French club at a Pennsylvania high school onboard. There should be a historic marker along the shore that everyone can study up close to remember that awful tragedy."

---"Look on the bright side. If you do succumb to COVID-19 here, there are lots of sea animals closeby who will be delighted  to devour your ashes after they're dumped into the ocean. If you're lucky, a dolphin will be the one to devour your ashes after your urn's contents are scattered here---assuming you die of COVID anytime soon. I think most of us who specify having our ashes scattered into the ocean like to think of a dolphin devouring us at that point. But there's also the alternative that some form of botanical plant life in the sea will eat your ashes. Since you're a vegetarian, I'm sure you'd like to turn into plant food after you die here from COVID. But it's better, of course, if you can survive the COVID crisis in order to dedicate the rest of your life to writing books about how grateful you are to be alive."

---"Sooner or later there will be a life theater play here featuring a long line of characters who do very abrupt vanishing acts after each declares loudly on stage that they refuse to get vaccinated. It will definitely be a  tragedy, but unfortunately, someone in the audience will be inviting a fight by clapping and cheering whenever an unvaccinated character gets killed by COVID. That member of the audience will shout loudly that their refusal to get vaccinated cost them their life, and they also infected dozens of other New Yorkers before their life story turned into an obituary."

---"I wish the obituary writers for The Times would add the factual statement for each COVID-19 victim who had refused to get vaccinated that 'it is believed that the deceased infected 200 other persons with the often-fatal  COVID-19 virus."

---"How tragic that the persons infected by the deceased can't file a lawsuit against him or her. Maybe they can sue the estate of the deceased in which they prove to a judge and jury that the deceased was maskless and standing a few feet from the plaintiff a matter of hours before the plaintiff was diagnosed as having contracted COVID-19."

---"It would make a great legal precedent here in New York if someone can win a lawsuit against a COVID-19 victim's estate. Maybe there's a need for a COVID-19 SUE THE INFECTOR'S ESTATE SOCIETY."

---"I have some great ideas for new words to add to the English language, but I can't find a dictionary publisher willing to add the words I invented on my own. Do you have any dictionary publisher friends I could invite to lunch, assuming that both of us are fully vaccinated and can prove it at the entrance to that restaurant?"

--"I don't understand why you are determined to add a new word to the English language. Are you afraid that no one will remember you in the year 2060 without a new word that jogs everyone's memory into recalling that you were here and you made a cultural contribution?"

---"And even if you do get a new word added to some dictionary here in New York, do you really think that anyone is going to actually use that word more than once per year, at most?"

--"I don't regard it as racist to find out what percentage of the schoolchildren of New York say they were bullied by a black schoolmate. It's the type of story that the liberal news media organizations tend to ignore, and that oversight borders on treason."

---"I don't know anyone in this city who doesn't have nightmares about a foreign country at the United Nations sending a spy to their home who attempts to kidnap them. I think everyone senses that at least one of the member nations of the UN would regard them as being a threat to that foreign government."

---"You need to keep in mind that if you do visit Ireland, you need to be very low-key about your alcohol-free lifestyle there. The Irish don't trust anyone who is always sober at all times."

---"Maybe you should ask for a tour of Scotland Yard headquarters if you visit England. You could explain to your British tour guide that you have repeatedly asked Scotland Yard to help you solve a crime case in the USA in which you were the victim during your sleeping hours. So it's not as if you are a complete stranger to Scotland Yard. They might  treat you to some Scottish shortbread if you visit their headquarters and offer to make a donation to some non-profit crime-prevention fund that is administered by Scotland Yard."

---"I don't even know what Palestinian Americans look like, but it's likely that New York City has as many Palestinian-Americans as any other U.S. city. Of course it makes sense to have at least one Palestinian-American friend here who opposes violent conduct in the Middle East."

---"It's odd how I don't associate Palestinian-Americans with any particular cuisine. It's not as if they have any counterpart to a bagel I could cite as a leading cultural symbol for them."

--"I agree that dehumanization of Palestinian-Americans is deplorably widespread. If we could at least celebrate their finest culinary dishes one day per year, this might help us to better acknowledge their humanity."

---"If I do agree to eat shortbread during a trip to England or Scotland, I need to insist that it's a high-fiber shortbread with as little saturated fat as possible. But how can I make that point in England or Scotland without offending them? The English and Scottish are very proud of their culinary heritage, and they might not be sympathetic if I explain that I'm under doctor's orders from my cardiologist to insist on high-fiber shortbread with as little sodium and saturated fat as possible. But there's also the chance that they might be understanding about my cardiologist's concerns."

---"The United States is so overdosed with racism talk and racism allegations that if I visit the White Cliffs at Dover and send a photo-illustrated postcard to a friend or relative of mine in the States, some black male Postal Service employee will probably photograph my postcard and post it on Facebook as an example of how white people try to flee from black people."

---"Whenever I open the door to a taxi and get in, I want to be able to immediately see the driving record of the taxi driver from the most recent five year period before I agree to let him transport me anywhere. If the driver has been in more than one accident in the most recent five-year period, I would not feel comfortable about his driving me anywhere."

---"You are always curious about who your neighbors are here, but it pays to be very low-key if you have any concerns about their background. You don't want to invite retaliation."

---"Even if only one percent of the other tenants at your apartment complex here are persons you would trust enough to invite them to visit you in your unit, that is a higher percentage than most New Yorkers would permit. Not trusting your neighbor is conventional wisdom here."

---"If New York City were put in charge of revising the Bible, the commandment about loving they neighbor would get changed to "NEVER LOVE THY NEIGHBOR UNLESS YOU HAVE GOTTEN TO KNOW THEM FOR AT LEAST 12 CONSECUTIVE MONTHS AND YOU ARE COMPLETELY SURE THAT THEY ACTUALLY PASSED A CRIMINAL BACKGROUND CHECK YOU DID ON THEM."

---"I need to do an investigation to find out the percentage of all the Anglo New Yorkers who are getting denied when they request an in-person meeting with our African-American new mayor inside his mayor's office."

---"I would be enraged if I had a meeting with our new Mayor only to hear him at the very end order a staff member of his to place notes about that two-person meeting in the 'PERSONS OF NO COLOR FILE'."

---"I'm almost afraid to find out the name of the favorite restaurant of our new Mayor. He is under very heavy political pressure to promote black-owned and black-operated restaurants, so the odds are high that the favorite restaurant he cites will have a staff more familiar with chitterlings than caviar. But is it fair for our mayor to neglect the many fine restaurants where the cuisine happens to be northern European in inspiration?"

--"You have to be very careful when you have a conversation with our new Mayor. If you tell him that the public-policy issue you've identified is very complicated, and is 'not a black or white issue', he might balk at that phrasing."

---"Things have gotten so politicized these days that even the pet dog of the mayor is probably expected to have lots of black fur on that animal in order to meet the expectations of the voters who got our new mayor elected. There is probably a 'Black Fur is Beautiful' or 'Black Fur Matters' campaign going on somewhere in New York that urges all African-Americans to only adopt as pets dogs that have at least 10 percent of their fur dark black in color."

---"I meet so many immigrants here that I have gotten tired of saying 'Good Luck on your goal of becoming a U.S. citizen'. Maybe I should say something like, 'I'm sure you know that if you develop a reputation for being law-abiding and honest and calling 911 frequently in order to help out others, your chances of getting granted citizenship here are 10 times better.'"

---"One thing I plan to ask our New mayor in person is whether he has said no to cocaine anytime recently. He may find the question offensive, but I am very determined to be one New Yorker who refuses to let the mayor's office turn into a Disciples of Marion Barry Society. We all know how disastrous the D.C. Mayor was, and no one wants to see that happen here."

---"I wish I had asked during the campaign whether Eric Adams was a close personal friend of Marion Barry, and if so, did Marion Barry ever invite Eric Adams to attend a crack cocaine party?"

---"It would be very tragic if the late Marion Barry of D.C. could somehow trigger a posthumous cocaine scandal that hurts Eric Adams's chances of getting elected in November."

---"The kind of book author I don't want to meet here is someone who never cites anyone to praise on a Dedication Page in the books they write. They are so ungrateful they don't even offer a Dedication Page explaining who the book is dedicated to, and why. I am very uncomfortable around ungrateful people."

---"I agree with you that I don't trust the published authors here who either refuse to offer a Dedication Page in the books they write or only offer what appears to be very minimal and very faint praise for someone in their Very pro-forma Dedication Page."

---"I am one book lover here who actually memorizes the contents of the Dedication Pages of the books I read. I would love to host a party honoring the authors whose Dedication Pages impressed me the most as being very sincere and very appreciative and very heartfelt. Dedication Pages uphold a tradition of sentimentality that is sorely needed in this city where cynicism and Anti-sentimental Chic plague our entire city."

--"If there were a condominium complex here where only published book authors could reside as condo owners, that complex would get immediately slapped with a lawsuit alleging that minorities were discriminated against because minorities historically are less likely to get a book published than are Anglo New Yorkers."

A PLEA FOR ANY AND ALL CRIME TIPS OR RUMORS OR SPECULATIONS THAT ANY OF MY OUT-OF-STATE COUSINS ARE WILLING TO OFFER TO THE AUSTIN POLICE DEPARTMENT SEX CRIMES UNIT

I hope all of my very honorable, law-abiding, polite, and law-enforcement-minded cousins in Iowa, California, New Jersey, Minnesota, Idaho, and Maryland will each consider sending a very helpful and informative e-mail note to Austin Police Department (APD) Sex Crimes Unit Detective William Costello.

Detective Costello, APD Badge Number 7057, is the first-rate crime investigator for the currently active APD Sex Crimes Case 2021-2440624. That new APD case was officially opened for investigation by APD on September 1, 2021. I am the cited victim and criminal-law complainant in that new APD case.
A thorough forensic DNA-traces sexual-assault-evidence medical exam on me -- a forensic medical exam approved in advance for me by APD Detective Costello in an official "Law Enforcement Request for Sexual Assault Exam" request he signed on September 1, 2021 --- was diligently performed by an Austin Safe Alliance female forensic nurse inside the Emergency Room of the Dell Seton Medical Center at The University of Texas on September 1, 2021, and extending into the early-morning hours of September 2, 2021.
The official e-mail address for Detective Costello is: "william.costello@austintexas.gov". The direct-line office phone number for APD Sex Crimes Unit Detective William Costello is: (512) 974-4247. Detective Costello's phone line will accept voice mail messages for that very polite APD officer if he is not available to take the call.
I would like to again praise Cousin Jim Dane, a kindly corn farmer and married gentleman, for volunteering to me on the telephone around the turn of the century that Cousin Jim was very aware as an Iowa resident that I myself was being victimized in Austin, Texas, by "frequent year-round criminal activities," Cousin Jim helpfully mentioned. "Stay in close contact with the Austin Police Department," Cousin Jim added very politely in that same long-distance phone conversation we had.
I will be very grateful to any of my cousins who are willing to share with APD Detective Costello any unconfirmed reports or speculations that any of them have heard or any factual information that any of my cousins are privy to, about my own current living conditions in Austin, Texas, during my sleeping hours. I live alone in a solo-occupancy efficiency rental apartment unit, I always sleep alone on my own bed, I never have any invited overnight guests, my apartment is double-bolt-locked and fully-locked, and I am a longtime celibate single adult gentleman.
I feel sure that all or nearly all of my cousins are very aware that I myself lead a permanently alcohol-free (ever since 1990), lifelong-tobacco-free, lifelong-non-vaping, lifelong-tattoo-less, non-gambling, gainfully-employed, consistently clean-talking (no profanity by me in my everyday conversations with others), platonicly polite, facially-cleanshaven (no beard, no mustache, no goatee), permanently jewelry-less, dependably civil and law-abiding and vigilant, permanently marijuana-free (ever since 1984) lifestyle in which I have never consumed any illicit drug other than marijuana on any occasion in my entire life. I also feel sure that my cousins are all very aware that I myself do not have any criminal-conviction record, and that I am very honest and factually-minded.
I am asking for help from my very honorable cousins because neither of my two brothers nor my one total sister from my and their childhood family in Westlake Hills, Texas, have ever stated to me that any of them are willing to call Austin Police or the FBI (Federal Bureau of Investigation) and offer a crime tip, whether anonymous or otherwise, that might help to solve an alleged continuous and continuing home-invasion-crimes and continuous sex-crimes and continuous personal-injury-crimes case during my sleeping hours in which I am the victim and complainant inside my bolt-locked rental housing unit in Austin.
My one total sister specifically stated to me on the telephone several years ago that "I (Julie McMillan Lechtenberger) don't want to have anything to do with you (biological brother John Kevin McMillan of Austin)." I have not directly contacted Julie on any occasion since then, and I take great pride in promptly honoring any and all rejections of myself that I ever receive.
