To: Sondra Williams, Contact Supervisor for Cap Metro bus service in Austin, Texas.

June 22, 2021

Dear Ms. Williams,

Thank you for your follow-up reply letter (below) that you sent me today. Your letter cites a "global silicone shortage" as one of the reasons for Cap Metro's multi-month delay in replacing an out-of-order and badly shattered electronic departures-times board at a Cap Metro bus stop along the western side of North Lamar Boulevard, about one block north of West Rundberg Lane in north Austin. The most recent date of service cited on that sign board, as the attached photo I sent you clearly stated, is April 22, 2021---two months ago.

Please let me know as soon as your electronic departures-listings board is replaced and states the correct date and currently applicable expected departure times for bus passengers.

I feel sure that many thousands of Cap Metro bus passengers who live in my current section of Austin will be very grateful when that repair work is completed.

Best Wishes,

John Kevin McMillan, a year-round passenger on Cap Metro buses here in Austin.

Mr. McMillan,

You are so very welcome. I have spoken with our IT Team, and this is what I was told:

“Due to the global silicone shortage and delays in the supply chain caused by COVID-19, the vendor who manufactures and repairs our signs has been experiencing significant delays in acquiring some components for the signs. We have had several signs damaged by vandalism throughout the system and are working to replace them as soon as we are able to.

We are expecting spare signs and parts to replace all the damaged signs within the next 30 days.”

While we understand those signs assist our customers with providing schedules for the routes servicing this location, we are doing our best to get this location and locations fixed as soon as we can. If there are anymore updates, I will notify you via this email chain.

Have a safe and wonderful day and thank you for riding Capital Metro.

Dear Austin-based Cap Metro Mass Transit Service Contact Center Supervisor Sondra Williams,

Thank you for your prompt reply note (below) to me about this very alarming longstanding problem at the cited heavily-trafficked bus stop along North Lamar Boulevard in northeast Austin. The cited bus stop is located a matter of yards from the property of a McDonald's-chain fast-food restaurant situated north of the bus stop and along that same street.  A portion of the parking lot for an H.E.B.-chain supermarket is located a matter of feet west of the cited bus stop.

Please send me a follow-up note as soon as possible after the problem has been corrected.

I hope to hear from you soon.

 With Friendly Best Wishes,

Subject: 6-17-21 PIR re: Austin (TX) City Attorney's Office and me

June 17, 2021

Dear City of Austin (TX) Public Information Office Open Records Coordinator,

This is a Texas Open Records Act request in which I seek to obtain from the City Government of Austin a copy of any and all written communications, including e-mail communications or memoranda or reports or letters or press releases, that were generated or received or sent or mailed or forwarded or FAXed at any time since 12:01 a.m. November 15, 2019, on behalf of or by any attorney or administrator or other staff member employed in or by the City of Austin Law Department (also known as the City Attorney's Office) here in Austin, and that, in each and every such case, referred at least once in any manner to myself, John Kevin McMillan of Austin, Texas.

EXCLUDED FROM THE SCOPE OF THIS PUBLIC-INFORMATION REQUEST ARE ANY AND ALL DOCUMENTS THAT WERE EXCLUSIVELY OR SOLELY WRITTEN BY MYSELF,  JOHN KEVIN McMILLAN OF AUSTIN.

My legal name is John Kevin McMillan. I was born on April 27, 1957, at Lincoln, Nebraska. I have most recently resided in Austin proper on a continuous and uninterrupted basis ever since mid-March 1997.

I am a gainfully employed single adult white male Austin resident of English, Scottish, and German ancestry. I am a lifelong American citizen. I am also a certified direct descendant of the Rev. William Brewster, the great Puritan religious leader who served as head chaplain on the Mayflower and, later, as a leading religious adviser to British Plymouth Colony Governor William Bradford in a geographical area now situated in the U.S. state or Commonwealth of Massachusetts.

I myself do not have any criminal-conviction record. I lead a permanently drinking-alcohol-free (ever since the late summer of 1990, and never previously addicted), longtime-celibate-by-choice (including ever since I moved to north Austin in August 2001), single-by-choice, lifelong-tobacco-free and anti-tobacco-minded, lifelong-vaping-free, permanently marijuana-free (ever since the late fall of 1984, and never previously addicted), lifelong-illicit-drug-free in regard to any and all illicit drugs other than marijuana, lifelong-tattoo-less and anti-tattoo-minded, permanently facially-cleanshaven (no beard, no mustache, no goatee, etc.) and anti-facial-hair-minded, civil and law-abiding and honest and law-enforcement-minded, clean-talking (no profanity by me in my everyday conversations with other persons), non-gambling, lawfully non-Christian and implicitly-deistic (non-atheistic), religiously independent (I'm the only approved current member of my non-proselytizing "Progressive Prohibitionist Religion", an Honor Society new religion with very stringent membership-eligibility requirements) lifestyle here in Austin.

I have resided alone as the rent-paying sole official tenant and the only approved occupant in Apartment 2418 of Building 17 at Pebble Creek Apartments, 8805 North Plaza Drive in northeast Austin and in the Austin City Council District 4 section of Austin, on a continuous and uninterrupted basis ever since June 21, 2019. I always sleep alone on my own bed.

Ever since my move-in date of June 21, 2019, I have NEVER at any time ever once permitted anyone but on-duty APD officers or, on one total occasion ever since I moved into my current unit, on-duty Austin-Travis County EMS staff members, to enter or be physically present anywhere inside my current always-bolt-locked apartment unit anytime between the hours of 8 p.m. at nighttime and 7:59 a.m. in the morning.

No staff member or representative for the City Government of Austin Public Health Department has ever been physically present anywhere inside my current always-bolt-locked efficiency apartment unit on any occasion since or including the day I moved into my current rental-housing unit on June 21, 2019.

I have maintained the same primary e-mail address throughout the entire multi-year period applicable to this public-information request. That e-mail address is: mcmillanj@att.net .

My landline home phone number has remained the same throughout the entire time period applicable to this public-information request. That phone number for me is: (512) 342-2295.

My cell phone number, which I have had ever since I obtained my first-ever cell phone (AT&T being my cell-phone service provider) in August of 2019, is: (512) 993-7305.

Thank you in advance for your very diligent and authoritative and thorough reply letter providing me with any and all responsive legal documents.

Sincerely and Best Wishes,

John Kevin McMillan, public-information requestor.

Subject: PIR: APD Forensic Science staff who ID'd photos of persons OTHER than me in my current bedroom

From: John Kevin McMillan, very recent criminal-law complainant in Austin (TX) Police Department  (APD) Alleged Home-Invasion-Crimes and Alleged Sex-Crimes Case Number 21-0830533, a crime case generated by APD on March 24, 2021, in which APD Sex Crimes Unit Detective William Costello is the assigned crime investigator. Detective Costello helpfully stated to me on the telephone on May 24, 2021, that if I can provide him with at least one total photo from the early morning hours of March 24, 2021, or anytime after that date which contains an image of anyone other than me inside my current bedroom, Detective Costello will promptly agree to officially authorize a forensic sexual-assault-evidence medical exam on me. I have repeatedly and politely emphasized to Detective Costello that the crime case in which I am a self-identified home-invasion-crimes and anal-rape-crimes and personal-injury crimes victim during my sleeping hours as I lie alone, asleep unconscious and possibly snoring, on my own bed inside my bolt-locked current solo-occupancy apartment unit, is an allegedly CONTINUOUS AND CONTINUING DAILY AND YEAR-ROUND AND MULTI-YEAR felony crimes case.
My solo-occupancy efficiency rental-apartment unit address ever since June 21, 2019:
Pebble Creek Apartments (a large gated-community apartment complex owned by "Pebble Creek Babay, Ltd., dba Pebble Creek Apartments" according to the management-team-approved new six-month lease agreement for my current apartment unit that begins officially on July 1, 2021; and managed by Belco Equities Inc., a for-profit corporation headquartered at 505 East Huntland Drive, Suite 530, Austin, TX, 78752, their headquarters office phone number (512) 454-6200, with Ms. Joslyn Domel the very honorable President of Belco Equities and Mr. Cecil Domel the highly-esteemed area manager for Belco Equities),
8805 North Plaza Drive, Building 17 (northeastern corner of Pebble Creek Apts. complex), Apt. 2418 (a second-floor, eastward-facing unit), Austin, TX 78753. My home phone: (512) 342-2295. My cell phone: (512) 993-7305. My Blog: http://www.johnkevinmcmillan.blogspot.com

A respectful FYI to each of you law-enforcement officers and civic leaders on the following online public-information request of mine tonight to the Austin (TX) Police Department, along with APD's e-mail confirmation note to me (last item, below) on my online public-information request that I had submitted to APD tonight at the official City Government of Austin website for submitting requests for information to APD:

"I hereby request a copy of any document on file with APD's Forensic Science Division, 812 Springdale Road in Austin, that cites the name of each APD employee or APD officer or APD administrator in that division who specifically determined at any time since June 21, 2019---including anytime this month ----that one or more of the infrared motion-sensitive photographs in APD's possession that were generated for me at my own financial expense during my bedtime hours from inside the bedroom of my current solo-occupancy rental apartment unit, Apt. 2418 at Pebble Creek Apartments, 8805 North Plaza Drive in northeast Austin, APPEARED TO BE OF SOMEONE OTHER THAN MYSELF.

"I have lived alone and have always slept alone in my current always-bolt-locked second-floor efficiency rental apartment unit in Building 17, situated near the northeastern corner of the Pebble Creek Apartments gated-community complex, ever since the early afternoon of June 21, 2019. I am a longtime celibate-by-choice (including ever since the day I moved to north Austin in August 2001), gainfully-employed, permanently drinking-alcohol-free, facially-cleanshaven, permanently-marijuana-free, lifelong-tobacco-free, lifelong-vaping-free, dependably civil and law-abiding and law-enforcement-minded single adult white Anglo-Saxon gentleman.

"Below, please find the exact verbatim text of a January 31, 2020, reply letter to me from your APD Open Records Unit that referred to your having nine photos obtained from inside my current apartment unit that appear to be of someone other than me.

Subject: 6-15-21 appeal to Lt. Cruz on my unanswered prior appeal to Sergeant Keen

To: Lt. Patricia Cruz, Direct Supervisor of Sergeant Christopher Keen of the Austin Police Department Sex Crimes Unit in this state-capital city for Texas, with your own office phone number reportedly being (512) 974-9205, according to a polite Austin 311 staff member, Liz, whom I spoke with on the phone at 12:37 p.m. today.

Tuesday, June 15, 2021

Dear Highly-Esteemed Austin Police Department Lt. Patricia Cruz,

As of 12:30 p.m. today, have not heard back from Sgt. Keen on the two questions I respectively posed (below) to that high-ranking APD officer. Those two questions:   "Sergeant Keen, are you now willing to authorize a forensic sexual-assault evidence medical exam on me? If so, are you also willing to authorize full 190-day retroactive DNA-traces processing of any and all DNA-traceable items in that new resulting rape-evidence kit from 2021?"

I live alone, and I am a permanently-alcohol-free (ever since 1990), longtime celibate Anglo-Saxon non-Hispanic gentleman who always sleeps alone on my own bed. I have NEVER permitted anyone but on-duty APD officers, or, on one total occasion from the most recent two-year period, on-duty Austin-Travis County EMS staff members, to actually enter or be physically present inside my current unit at nighttime. I have always lived alone in my current efficiency-unit apartment at Pebble Creek Apartments, 8805 North Plaza Drive in Austin, ever since June 21, 2019.

Lt. Cruz, I am not sure how many total days of waiting are expected of me before I am permitted to appeal through the chain of command to yourself on this issue.

For that reason, I am courtesy-carbon-copying this letter of appeal to Sgt. Keen and to Detective Costello, who is the most recent APD Sex Crimes Unit detective assigned to investigate a crime report from me --- a report that APD received from me on March 24, 2021, when I was a patient requesting a rape-evidence medical exam on myself inside the St. David's ER near UT-Austin. The APD Case number on that case is 21-0830533.

No visual inspection of my anus or behind or groin area was performed by the apparently Asian-Indian-American male ER doctor, Dr. Nair, who met with me in my assigned patient room at St. David's ER on the morning of March 24, 2021.

Austin Safe Alliance, a very influential Austin-based non-profit organization that staffs forensic sexual-assault-medical-exam nurses and holds quasi-governmental authority over forensic rape-evidence medical exams in Austin, declined to send a forensic nurse to the hospital and stated to me on my cell phone on March 24 that I could not obtain a forensic DNA-swabs medical evidence exam on myself if I were to visit the Austin Safe Alliance compound in south Austin that day.

"You (criminal-law complainant and self-identified rape-victim John Kevin McMillan of Austin) cannot have an exam at Eloise House (where forensic rape-evidence exams are routinely performed for Austin Safe Alliance). Your needs surpass what they're able to provide at the Eloise House," Safeline Manager Rachel stated to me at 12:23 p.m. March 24, 2021, during a cell phone call I made to her from the St. David's ER waiting room in central Austin. I jotted down legal notes on that very disappointing statement to me from Rachel. I am a former full-time newspaper reporter, and I had a very good accuracy record in my reporting.

Lt. Cruz, I am also appealing through you the May 24, 2021, stated decision by APD Detective Costello (with his immediate supervisor APD Sgt. Christopher Keen having apparently also been informed about that decision by Detective Costello), to decline to accept a brand-new flashdrive from me I have in my possession that contains hundreds of very recent infrared motion-sensitive crime evidence photo images from the spring of 2021 of illegal trespassers inside my current always-double-bolt-locked solo-occupancy apartment unit at nighttime, including during the early morning hours after midnight. Detective Costello stated to me in that May 24 phone conversation I had with him that he would prefer instead that I e-mail him one photo at a time of an alleged trespasser inside my current apartment unit.

In that regard, I would like to call your attention to the fact that APD Detective Costello volunteered to me on the telephone at 9:19 a.m. May 25, 2021, that Detective Costello recommended that I move away from Texas, since the home-invasion crimes problem I've been complained about to APD has only occurred when I resided in Texas, Detective Costello stated.  It seems to me that Detective Costello's statement may have possibly conveyed an implicit acknowledgement from himself that I am, in fact, currently being victimized by alleged home-invasion-crimes inside my current solo-occupancy efficiency apartment unit in Austin. I am the ONLY tenant and ONLY occupant on my current official lease agreement for Apartment 2418 at Pebble Creek Apartments, 8805 North Plaza Drive, in northeast Austin (Austin District 4). My current lease expires at 11:59 p.m. Wednesday, June 30, 2021.

A polite management team member for Pebble Creek Apartments, Miranda Vasquez, stated to me during a meeting I had with her in the management team office at about 5 p.m. June 7, 2021, when I signed my new lease agreement for my unit, that if I can provide their management team with a written statement from a representative for Austin Police that APD has determined that I am unsafe in my current apartment unit, that could be a helpful legal document on my behalf, Miranda Vasquez stated. A statement of that type from APD could potentially serve as a basis for their management team releasing me without penalty from my most recently approved official lease agreement, a six-month lease-agreement that becomes effective 60 seconds before 12:01 a.m. on July 1, 2021.

I would like to also respectfully point out that I have obtained numerous infrared motion-sensitive crime-evidence photos  from inside my current apartment unit --- photos I have shared with APD --- that appear to show movement to three or more walls of my bedroom and, in some cases, mysterious protrusions from a wall of my bedroom and mysterious arms reaching through a wall of my bedroom in the middle of my sleeping hours at nighttime.

The issue of certifying each and every possible point of entry into my current efficiency unit is one that the polite Pebble Creek management team stated to me in writing several months ago that it is willing to review. I have documentation on that if you would like me to send that to you. I was initially informed by the management team at Pebble Creek in 2019 that there are only three possible points of entry into my current apartment unit. More recently, the total number of possible points of entry confirmed by the management team has been raised to four, based on information provided to me for the first time on October 1, 2020, by security expert Andrew Tijerina.  However, the same Mr. Tijerina did volunteer to me during his inspection of my unit that he observed very surprising dramatic chips to the paint at the point of intersection between the ceiling and the western wall to my bedroom. That statement appeared to indicate that Mr. Tijerina was willing to consider the possibility of one or more additional points of entry into my current bedroom emanating from the walls of my bedroom.

Lt. Cruz, thank you in advance for your prompt reply letter to me on this written appeal to yourself.

Sincerely and Best Wishes,
John Kevin McMillan, very recent criminal-law complainant in APD Alleged-Home-Invasion-Crimes and Alleged Sex Crimes case 21-0830533.

He also stated to me that a hard-to-identify "ceiling door" inside the walk-in closet that abuts my bedroom leads directly into or from that attic, Mr. Tijerina stated. Mr. Tijerina also stated to me that unspecified "neighbors" of mine could possibly or allegedly enter my unit  through that attic, Mr. Tijerina helpfully volunteered. Subject: 6-10-21 urgent follow-up question to APD Sergeant Keen

June 10, 2021

Dear Austin Police Department Sergeant Sergeant Christopher Keen,

I have provided you and Detective William Costello with numerous statements and supporting crime-photo evidence about my being victimized on a daily and continuing basis by alleged invasion-crimes, alleged continuous sex-crimes, and alleged personal-injury-crimes during my sleeping hours as I lie alone on my own bed, asleep and unconscious and possibly snoring, inside my current double-bolt-locked solo-occupancy efficiency apartment unit in Austin.

Sergeant Keen, are you now willing to authorize a forensic sexual-assault evidence medical exam on me? If so, are you also willing to authorize full 190-day retroactive DNA-traces processing of any and all DNA-traceable items in that new resulting rape-evidence kit from 2021?

In that regard, I would like to politely remind you that two of the APD officers, including the APD Crisis Intervention Team Officer Lelan Larroque, have each stated to me this spring on the telephone that they recommend that I move away from Texas. One of those officers, Detective Costello of your APD Sex Crimes Unit, volunteered to me on the telephone that it seemed to Detective Costello that my own problem of being victimized by alleged home-invasion-crimes inside my apartment units has only occurred in Texas, he stated. For that reason, he said, it might be logical and appropriate for me to move to another U.S. state.

Thank you in advance for your helpful reply letter to me on this.

Sincerely and Best Wishes,

criminal-law complainant and self-identified continuous personal-injury-crimes victim John Kevin McMillan.
My solo-occupancy efficiency-apartment-unit rental-home address ever since June 21, 2019:

That female Census Bureau staff member added in response to a question from me that she had legal authority to require me to provide her with information about the person or persons residing in Apartment 2419, she stated), 8805 North Plaza Drive, Building 17 (northeastern corner of complex), Apartment 2418 (a second-floor unit that shares the same second-floor balcony area of Building 17 with only one other unit, Apartment 2419), Austin, TX 78753.
