Subject: 1-5-2021 question re: appeal procedure and civil rights of criminal-law complainant

January 5, 2021

Dear Austin Police Department Region 2 District Representative and APD Officer Ruben Espinoza (office phone number (512) 974-4289),

Best Wishes to you and your Austin Region 2 colleagues in the New Year.

I have a polite question I would like to pose to you, District Representative Espinoza.

Do you know what the written appeal procedure is for a criminal-law complainant (myself, in this case) who has been informed by the Austin Police Department that APD has apparently closed his most recent APD criminal-law complaint (APD ID number 20-3161213) that was generated by APD on November 11, 2020, and that APD has instead referred that entire issue or subject to the APD "Crisis Intervention Unit" or APD mental-health unit?

As you are no doubt aware, Austin Region 2 District Representative Espinoza, I myself am not under any mental-health restrictions, and I myself do not have any criminal-conviction record. I lead a lifelong-tobacco-free, lifelong-vaping-free, permanently-drinking-alcohol-free (ever since 1990), and permanently marijuana-free (ever since 1984) lifestyle. In my entire life, I myself have never at any time consumed any illicit drug other than marijuana.

As I'm sure you are also very aware, my own right to myself successfully press criminal charges against any and all alleged home-invasion-crimes perpetrators and alleged trespassers and alleged personal-injury-crimes-and-sex-crimes perpetrators allegedly victimizing me during my sleeping hours as I lie alone on my own bed inside my current always-bolt-locked and fully-secured solo-occupancy efficiency-rental-apartment unit, is fully protected by the American legal system and the legal system of the State of Texas.

Thank you in advance for your helpful reply note to me on this.

Sincerely and Best Wishes,
John Kevin McMillan, very recent criminal-law complainant with APD.
My date of birth: April 27, 1957.
My city of birth: Lincoln, Nebraska.
My always-bolt-locked solo-occupancy efficiency apartment-unit rental-home address ever since June 21, 2019:
Pebble Creek Apartments, 8805 North Plaza Drive, Bldg. 17, Apt. 2418, Austin, TX 78753.

Dear Austin Police Department Open Records Unit Officials in Austin, Texas,

Thank you for your December 31, 2020, reply to my online public-information request (below) at your official City of Austin website that your municipal law-enforcement agency received on December 19, 2020.

In response to your statement to me that "We are unable to complete your request as received since you did not provide the name of an officer and as such, we have no responsive information", I would like to revise one total paragraph of that public-information request of mine.

That one total revision I am hereby making will be to this paragraph:
“I am seeking a copy of any and all e-mail communications or other written communications that have occurred at any time since 12:01 a.m. June 21, 2019, between the government office of Austin Mayor Steve Adler or the government office of Austin District 4 Representative Greg Casar and APD Chief Brian Manley or APD Assistant Chief/Chief of Staff Troy Gay in a context that referred at least once in any manner to myself, John Kevin McMillan of the District 4 section of Austin."

Please disregard the original version of the above paragraph (farther below) that you received on December 19, 2020.

I would like to keep the rest of the text exactly the same as before in the online public-information request of mine to APD that you have assigned the identification number of: R050569-121920.

Please let me know at your earliest convenience if you would prefer that I submit a separate new public-information request on this, or whether this one total revision to my existing public-information request is acceptable to you.

Sincerely and Best Wishes,
John Kevin McMillan, public-information requestor.

My legal name is John Kevin McMillan. I was born on April 27, 1957, at Lincoln, Nebraska.

Ever since June 21, 2019, I have resided alone on a continuous and uninterrupted basis inside an always-bolt-locked solo-occupancy efficiency unit at Pebble Creek Apartments in northeast Austin.

<chris.riley@austintexas.gov>

<chris.riley@austintexas.gov><mcmillanj@att.net>

Dear Williamson County District Attorney Shawn Dick,

This is a Texas Open Records request in which I seek to obtain from you a copy of any and all telephone records and e-mail communications or other written communications that were authored, generated, produced, received, forwarded, sent, or mailed by yourself or any other official or staff member in your Williamson County District Attorney's Office at any time since 9 a.m. January 1, 2017, and that each directly refer at least once in any manner to myself, John Kevin McMillan of Austin, Texas.

Excluded from the scope of this public-information request are any and all e-mail letters that were directly sent to your office by myself.

I was reminded to submit this public-information request after noting in the last several days that your immediate predecessor, then-Williamson County District Attorney Jana Duty, personally wrote and directly sent to me the following initial reply to a polite March 18, 2015, public-information request  follow-up note I had e-mailed to Ms. Duty at her official Williamson County DA's Office e-mail address:

I am so sorry Mr. McMillan. I have been preparing for a Capital Murder trial that starts on Monday, March 30th and I've been so focused that I let your request get past me. I'm in San Antonio today visiting my best friend who's dying from ovarian cancer. As soon as I get into the office tomorrow I will send you what I have. As far as I know, I only have the e-mails from you. I have never responded to them and I have never forwarded them to anyone. I will get right on it when I get back to the office. I'm sorry  for the oversight. Jana

This public-information request was also prompted in part by surprising news I received during your first year in your current influential elective position that a Jewish religious group in the very same city where your DA's office is situated --- Georgetown, Texas --- had rejected me in writing.

The text of the April 28, 2017, rejection letter I received from Ellen Silverman, Co-President of the Havurah Shalom unaffiliated Jewish religious congregation at 1530 Sun City Boulevard, Georgetown, TX, 78633 (office phone number 512-591-7000), along with the e-mail letter Ms. Silverman had apparently received from me about six minutes before she sent her rejection note to me, are as follows:

Subject: Fw: City Attorney's 'assertions' re: 12-22-11 rape kit prompt questions from OAG

A respectful FYI to each of you on the following, which contains (last item, below), the verbatim exact recorded transcript of an April 26, 2017, voice mail message left on my AT&T private home phone line by Assistant Attorney General of Texas Joseph Behnke of the Austin area.

The recorded message from Mr. Behnke is in regard to the alleged failure by the City Attorney of Austin to respond adequately and in a timely manner to an official legal letter from Mr. Behnke on my behalf, which requested copies of actual documents from the City that directly refer to the reported APD Sex Crimes Unit's shipment of, and the current processing site for, the Dec. 22, 2011, doctor-ordered forensic rape-evidence kit for APD Sex Crimes Case 11-3550615 (with myself the cited victim as well as the longtime celibate and permanently alcohol-free and gainfully employed and law-abiding single adult white male complainant) that is reportedly being stored or processed at a private DNA lab in Salt Lake City, Utah.

Please do not hesitate to call me or write to me if you have any questions about this very alarming legal-liability issue currently facing the City Government of Austin in this capital city of Texas.

 Sincerely and Best Wishes,

Williamson County District Attorney Dick, I would also like to offer you the following factual information about myself that might be helpful to you as you attempt to locate legal documents on file at your DA's Office that are responsive to this January 4, 2021, public-information request from myself:

My legal name is John Kevin McMillan. I was born at Lincoln, Nebraska, on April 27, 1957.

I myself do not have any criminal-conviction record, as I'm sure that you may already know.

My primary personal e-mail address of "mcmillanj@att.net" and my primary personal phone number of "512-342-2295" have remained the same for many years. Ever since August 2019, I have also owned and used a personal cell phone I purchased through AT&T that has the cell phone number assigned to me by AT&T of (512) 993-7305.

I am a former Salutatorian of Stephen F. Austin High School of Austin Independent School District in Austin, Texas. I am an alumnus of The University of Texas at Austin and The University of Minnesota Graduate School of Journalism and Mass Communications in Minneapolis, respectively.

In the period ever since January 1, 2015, I have resided at the following locations, listed chronologically from oldest address for me to most recent address:
---Wind River Crossing Apartments, 11411 Research Boulevard, Apt. 325, Austin, TX 78759;
---Crossland Economy Studios, 12621 Hymeadow Road, Apt. 133, Austin, TX 78729;
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 902, Austin, TX 78759;
---Village Oaks Apartments, 10926 Jollyville Road, Apt. 1609, Austin, TX 78759;
---Austin Motor Inn, 11400 North Interstate Highway 35, a first-floor room, Austin, TX 78753; and
---Pebble Creek Apartments, 8805 North Plaza Drive, Apt. 2418, Bldg. 17, Austin, TX 78753.

I am the founder and only approved current member of a new and non-Christian non-proselytizing "Honor Society" religion, the anti-marijuana, anti-medical-marijuana, anti-illicit-drugs, anti-tobacco, anti-drinking-alcohol, anti-tattoos, anti-profanity-minded, anti-facial-hair-minded  "Progressive Prohibitionist Religion", that has very stringent membership-eligibility requirements.

That one total religion of mine opposes home-invasion crimes, opposes personal-injury-crimes, opposes sexual assault crimes, opposes the sex crime of pederasty, opposes the infliction of profanity or obscene speech on anyone in a context that violates their own privacy rights, opposes verbalization of anonymous death threats or other death threats to anyone, opposes verbal harassment of anyone, opposes continuous anonymous communications that violate the privacy of the person being subjected to those communications, opposes fraudulent or knowingly dishonest communications, opposes thought-control projects, opposes so-called "deprogramming" projects, opposes kidnappings, opposes hostage-takings, opposes the crime of stalking, opposes the crime of spying on anyone against that person's wishes, opposes attempted censorship of non-anonymous communications that are in compliance with the law and that advocate civil and law-abiding conduct or that support law-enforcement, opposes compelled speech that violates the privacy rights of the individual being subjected to that compelled speech against his wishes, and opposes deliberate infliction of continuous noise pollution on anyone in a context that harms that individual's own medical health or hearing capacity or that is aimed at punishing him or her for having political or religious or personal beliefs---or personal prejudices, even---that are disliked or opposed by the perpetrators or sponsors of that noise pollution.

Numerous current or former Central Texas residents have stated to me over a multi-year period that they either dislike or intensely dislike or question the authenticity of my own fully-independent "Progressive Prohibitionist Religion" (PPR). Around the turn of the century I gave several televised speeches on behalf of that religion of mine on local Community Access Television in Austin. One younger Central Texan man left a violent-sounding and obscene anonymous recorded phone message on my telephone-answering machine inside my apartment near UT-Austin---a recorded phone message in which he volunteered that he himself is "Catholic", and that he was very critical of my PPR religion,  that self-identified Catholic man stated.  In his recorded message to me, that self-identified Catholic man stated that he was reacting to one or more locally televised speeches of mine that I had given on behalf of my PPR religion.

Around the turn of the century, one former Austin-area resident and self-identified older brother  of mine from my childhood family in Westlake Hills, Texas, Dr. Michael Kim McMillan, declared to me in person with indignation and revulsion in his tone of voice and facial expression in a conversation I had with him outdoors near UT-Austin's main campus that occurred during a brief visit of his to the Austin area from out of state: "The 'Heaven on Earth' religion you've (John Kevin McMillan of Austin) established has inflicted Hell on this entire planet!"

Subject: 1-2-2021 urgent question for new District Attorney Jose Garza

January 2, 2021

Dear Travis County District Attorney Jose Garza,

Congratulations again on your very influential new career as Travis County District Attorney that officially began on January 1, 2021.

District Attorney Garza, do you have the legal authority as District Attorney to request that the Austin Police Department Sex Crimes Unit or some other APD unit officially authorize a new anal-rape DNA-traces forensic sexual-assault medical exam on myself as soon as possible?

I hope very much that your answer to that question is "yes".

As you may be aware, District Attorney Garza, ever since 2012 I have repeatedly but unsuccessfully asked the APD Sex Crimes Unit and other APD units, local hospital emergency room physicians, and the Austin SAFE Alliance for a full forensic medical-evidence sexual assault exam on myself.
Each of my 10 or more requests of mine over a multi-year period ever since early 2012 for a forensic rape-exam on myself have been denied by either APD, hospital emergency-room physicians, or the Austin SAFE Alliance on each of those 10 or more separate occasions.

The only two rape-evidence kits for me that APD currently has in APD's possession are both from calendar year 2011. Those two rape kits were obtained that year for APD Sex Crimes Case 11-1180447 and APD Sex Crimes Case 11-3550615.

One follow-up question for you, District Attorney Garza:
If you plan to ask APD to authorize a new rape-evidence exam on me as soon as possible in January 2021, do you also have the legal authority as District Attorney to personally request full possible 190-day retroactive DNA-traces processing for APD of any and all DNA swabs and other DNA-traceable items in that new rape-evidence kit to be obtained from my own body by a forensic nurse with my full prior hereby-stated permission on that?

As I'm sure you are already aware, I am the self-identified longtime-celibate-by-choice, single-by-choice, English-Scottish-German-American white non-Hispanic senior-citizen and American citizen male adult crime victim during my sleeping hours inside my bolt-locked current solo-occupancy efficiency-apartment unit in northeast Austin. I allege that I am the victim in a very alarming alleged continuous-and-continuing, daily and year-round and multi-year personal-injury-crimes, anal-rape-crimes, home-invasion-crimes, and trespassing crimes case.
One additional point of entry into my always-bolt-locked unit that was not previously mentioned to me by the polite management team at my current complex was identified to me for the first time ever on October 1, 2020, by an home-security expert with an A-plus-rated Better Business Bureau-accredited company in the Austin area.
That first-rate home-security expert, Andrew Tijerina of Fortress Lock, Safe, & Security, volunteered to me during his on-duty October 1 inspection of my unit at my request that "neighbors" (exact quote) of mine could conceivably enter my own apartment unit --- through a small unlockable door situated on the ceiling of my large walk-in closet next to my bedroom --- from a massive attic that extends above the ceiling of numerous apartment units across the entire length of Building 17 (the building I live in at present) here at Pebble Creek Apartments.

I am very insistent on asserting my legal right to press criminal-law charges in that alleged continuous-felony crimes case, with help from your courageous and very honorable style as the very first-rate new District Attorney for Travis County, Texas.

I hope to hear from you soon, District Attorney Garza.
Thank you in advance for your very kind interest in supporting safe housing conditions for me during my sleeping hours inside my current always-bolt-locked solo-occupancy apartment unit.

With Friendly Best Wishes,

John Kevin McMillan, recent criminal-law complainant with APD in 2020 in a new crime case, APD Case 20-3161213, for which I handed a male APD officer, Officer Brozynski, on November 11, 2020, a flashdrive of very recent infrared motion-sensitive photo images obtained for me inside my bedroom during my sleeping hours.
My current solo-occupancy efficiency-apartment-unit rental-home address ever since June 21, 2019:
Pebble Creek Apartments (a large and gated-community complex affiliated with Belco Equities, which maintains a headquarters office in north Austin for that for-profit business), 8805 North Plaza Drive, Bldg. 17 (northeastern corner of this large complex), Apartment 2418 (a second-floor, eastward-facing unit), Austin, TX 78753.
Home phone: (512) 342-2295.
Cell phone: (512) 993-7305.

FYI on the following "we have no responsive information" e-mail reply I received on December 31, 2020, from the Austin (TX) Police Department (APD) Open Records Unit in response to the following (next paragraph) online public-information request of mine to APD at the official City of Austin website that was officially received by APD on December 19, 2020:

“I am seeking a copy of any and all e-mail communications or other written communications that have occurred at any time since 12:01 a.m. June 21, 2019, between the government office of Austin Mayor Steve Adler or the government office of Austin District 4 Representative Greg Casar and a certified peace officer of the Austin Police Department in a context that referred at least once in any manner to myself, John Kevin McMillan of the District 4 section of Austin."

The official December 31, 2020, reply I received from the APD Open Records Unit on this stated:
"We are unable to complete your request as received since you did not provide the name of an officer and as such, we have no responsive information."

Any written response or suggestions on this from any of you would be greatly appreciated. I myself am not sure which APD officials or staff members are the most likely APD employees to have communications with Mayor Adler or Council Member Casar specifically in regard to me and my criminal-law complaints with APD.

Sincerely and Best Wishes,
John Kevin McMillan, longstanding criminal-law complainant and self-identified victim of alleged continuous-and-continuing-daily-and-year-round-home-invasion-crimes-and-trespassing-crimes-and-personal-injury-crimes-and-sex-crimes here in Austin.

January 1, 2021.
A respectful FYI to each of you on the following official response to a recent online public-information request to the Austin (TX) Police Department (APD) that I received on December 31, 2020, from APD's Open Records Unit here in this state-capital city for Texas:
"A thorough search of records of the Austin Police Department provided no responsive information."
I would welcome any reply from any of you on this, particularly if you happen to know of any person, group of persons, government agency, religious group or anti-religious group or atheist group, political group, "educational services provider", for-profit corporation, or other entity that you believe or suspect may have flagrantly or significantly violated my own privacy rights in Austin, Texas.
With Friendly Best Wishes,
John Kevin McMillan.

Re: Open Record Request of December 25, 2020, Reference # R050812-122520

Dear Mr. John Kevin McMillan,

The Austin Police Department (APD) received a Public Information request from you on December 25, 2020, to request copies of records pertaining to the following:

“I hereby request a copy of any and all e-mail letters or other written communications between the Austin Police Department and any public institution or private institution or individual or group of individuals or business enterprise or non-profit organization or media company, that refer at least once in any way to either the content of my own nocturnal dreams during my sleeping hours, or the content of my internal thought-process during my waking hours.

My legal name is John Kevin McMillan. I was born at Lincoln, Nebraska, on April 27, 1957. I am a gainfully employed permanently-drinking-alcohol-free (ever since 1990), dependably civil and law-abiding and honest, single adult white male American citizen of English, Scottish, and German ancestry. I am also a certified direct descendant of the Rev. William Brewster, who served as head chaplain on the Mayflower and, later, as a leading religious adviser to British Plymouth Colony Governor William Bradford in colonial territory that was governed during that time period by The United Kingdom. I myself am a lifelong non-Christian, and I'm the founder and only approved current member of the "Progressive Prohibitionist Religion" with very stringent membership-eligibility requirements.

This public-information request is prompted in part by a surprising disclosure that a male Boston-area private attorney volunteered to me on the telephone from his law firm office earlier this century. During a long-distance phone call I made that day to the cited attorney, he volunteered to me that "You (John Kevin McMillan of Austin, Texas) may have been victimized by an illegal federally sponsored thought-control project during a period of the 1980s when you lived in the South Shore area near Boston" (approximate quote).

One American History Professor at the University of Texas at Austin, Professor Lewis Gould, in 1988 or 1987 made a very surprising unsolicited statement to me on the telephone during a local phone call I made to his home in which he did not verbalize any specific rejection of myself at that time. "Keep your thoughts away from me" (exact quote), Professor Gould stated to me with emphasis in that 1988 or 1987 phone conversation----a matter of a year or two after I had visited Professor Gould at his and his wife's west Austin home in 1986 upon specific prior invitation from Professor Gould for that visit.

This public-information request is also prompted by surprising statements to me about my nocturnal dreams that personal acquaintances of mine or relatives have volunteered to me. "You (John Kevin McMillan) have nice dreams about girls" (exact quote), Sarah Goodfriend, a female former schoolmate of mine at Stephen F. Austin High School of Austin Independent School District, volunteered to me in 1990 or 1991, during a time period when I resided in Sweetwater, Texas.

"In your dreams, you are a woman" (exact quote), my biological mother, Phyllis Dolores (Gardner) McMillan, volunteered to me in 1988 in an unsolicited statement to me on the telephone during a long-distance phone call I made to her and Father's home in Westlake Hills, Texas, from my duplex apartment unit in El Campo, Texas.

I hope to hear from you soon in response to this public-information request.

Sincerely and Best Wishes,
John Kevin McMillan.
