Subject: Fw: 12-19-15 Open Records re: APD ban on authorizing any SAFE exams for cited rape-victim complainants

Please let me know at your earliest convenience if any of you would like to receive a copy of the official APD (Austin Police Department) report I have in my possession in which Detective Rae Ann Egan of APD's Sex Crimes Unit (in Austin, Texas) refers in writing on June 3, 2015, to an official APD "Do Not Approve" list being used as a basis for automatic APD refusal at any time and under any circumstances to ever authorize any rape-evidence forensic exam for any of the self-identified-rape-victim complainants (I myself among them) on that list who might ever in the present or at any future time request a Sexual Assault Forensic Exam on their own body.

I maintain that the cited APD list allegedly violates the Constitutional and legal rights of numerous rape, myself among them, and also comprises alleged possible obstruction of justice by one or more members of the Austin Police Department and the City Government of Austin.

criminal-law complainant John Kevin McMillan, who myself in the last four and one-half-year period ever since 12:01 a.m. April 17, 2011, has myself experienced only two total multi-hour occasions involving a multi-hour sleeping experience for me as I lay alone on my own bed, in which I actually enjoyed a full and uninterrupted multi-hour period of revitalizing and restful slumber, and in which I woke up at my planned time for getting out of bed feeling refreshed and very relieved to immediately note that I had NOT been anally raped or physically abused or medically injured during my sleep on that occasion.

Those two exceptions to the rule were: the early morning hours of Saturday, September 3, 2011, and the early morning hours of Saturday, September 10, 2011. Each of those mornings were workdays for me later that morning, beginning at 11 a.m., at a corporate-owned (cafeteria) restaurant workplace of mine in Williamson County, Texas. The widely-respected for-profit corporation owning that restaurant is headquartered in Houston, Texas.

My work supervisor on duty on those two total Saturdays, Mr. Jerry Moore, was a self-identified "former crime investigator for the Harris County Sheriff's Office", he told me more than once during a workshift of mine inside that family-friendly restaurant.

Mr. Moore also told me in 2011 that he and his wife and family reside together in a Williamson County community---either Cedar Park or Round Rock, Texas, I recall Mr. Moore as having stated to me from the general manager's office of that cafeteria restaurant workplace for me.

I myself currently reside in Travis County, Texas. I have resided in Williamson County on two separate occasions, each of them for a brief multi-week period. I do not believe that I ever was myself classified as a permanent resident of Williamson County.

This is a Texas Open Records request in which I seek to obtain from you a copy of any and all lists of names at any time since 12:01 a.m. April 28, 2011, that were generated or developed or produced---along with a copy of any revisions or additions to those lists or any accompanying explanatory notes that state why the cited individual's name was included on or possibly removed from or not added to the cited list---by any applicable office or division or officer or official of the Austin Police Department, and that, in each and every such case, refers by name to each of the individuals for whom APD has or had an established official policy of refusing to authorize any Sexual Assault Forensic Exam (SAFE) on that individual.

This public-information request was prompted by an official APD report filed on June 3, 2015, by Austin Police Department Sex Crimes Detective Ms. Rae Ann Egan.

In that full-page report, Detective Egan explained in writing why APD on that day chose not to authorize any Sexual Assault Forensic Exam on myself, criminal-law complainant and self-identified continuous-anal-rape-crimes-and personal-injury-crimes victim John Kevin McMillan of Austin, Texas, even though had repeatedly requested that SAFE exam on myself on the morning of June 3, 2015.

"I (APD Detective Rae Ann Egan) did some research and I did find out that this particular person (John Kevin McMillan of Austin, Texas) is on the 'Do Not Approve' List for SAFEs (Sexual Assault Forensic Exams)," Detective Egan wrote in that June 3, 2015, official APD supplementary report by that APD Sex Crimes Unit officer.

Detective Egan's report concludes with the highlighted phrase, "SAFE NOT APPROVED".

That report by APD Detective Egan was among 19 pages of legal documents that were mailed to me this month by the Austin Police Department in response to a (December 3, 2015-dated E-mail) public-information request from myself that APD designated as Open Records Request Number 12-23337.
