FYI to each of you on the following attachment containing a signed three-page official legal letter from earlier today (September 14, 2018) by Travis County Assistant County Attorney Ann-Marie Sheely. That legal letter refers to me by name and is addressed to officials of the Attorney General of Texas state agency in downtown Austin.

Ms. Sheely in her letter is seeking a ruling from the Attorney General of Texas in regard to whether Travis County Precinct 3 Republican County Commissioner Gerald Daugherty can withhold from me numerous legal documents referring to me in some manner that were each generated or received or sent or e-mailed or faxed by Commissioner Daugherty's office in the period ever since April 17, 2011.

The September 14, 2018-dated formal request for a ruling from the Attorney General openly acknowledges that one or more staff members of Travis County Precinct 3 Commissioner Gerald Daugherty's office during the period ever since April 17, 2011, have requested and obtained legal advice from the Travis County Attorney's Office in regard to myself, John Kevin McMillan of northwest Austin.

I am a University of Texas at Austin alumnus and longtime Austin resident. I am also a gainfully employed and dependably civil and law-abiding, single adult male resident of the very same Travis County precinct, Precinct 3, that Commissioner Daugherty primarily represents and serves and also himself resides in.

I would appreciate any reply note or written response that any of you are willing to offer me about this legal matter.

Sincerely and Best Wishes,

A respectful FYI to each of you on the following public-information request I wrote and E-mailed this Tuesday to the public-information coordinator for the Austin Police Department municipal lawenforcement agency in Austin, Texas. I would appreciate any and all written reply notes on any aspect of this public-information request that any of you are willing to offer me.

Dear Open Records Coordinator for the Austin Police Department in Austin, Texas,

This is a Texas Open Records request in which I seek to obtain from you a copy or computer printout of any and all records or reports on file with the Austin Police Department that were generated or written at any time since the early morning hours of April 28, 2011, through the present, and that each specifically refer to the refusal by your Austin Police Department municipal lawenforcement agency to authorize a forensic anal-rape-evidence medical examination on myself that I had requested at that approximate time.

The most recent such incident, as you are no doubt already aware, occurred on the morning of Monday, November 9, 2015, when APD Officer Bacon (Badge Number 4082) and APD Officer Martinez (Badge Number 2654) and an Austin-Travis County EMS employee, Mr. Collins (identification number 1662), visited my apartment unit that morning in response to a polite 911 phone call I had made at 8:33 a.m. that morning in which I had requested EMS transport of myself to a hospital exclusively for a forensic medical exam on myself at the self-identified victim of alleged analrape crimes earlier that morning inside my locked private bedroom.

APD Officer Bacon repeatedly stated to me during the officers' visit to my apartment unit on November 9, 2015, that APD was NOT willing to authorize any anal-rape forensic medical exam on myself at that time.

Based on that emphatic statement to me from APD, I then was asked by the EMS representative to sign a statement stating whether I declined to seek or sought EMS transport to a hospital.

I declined, for the one cited total reason that I was not permitted to include in my written statement (no authorization from APD for the forensic exam I sought).

Those three total APD or EMS representatives left my unit at about 9:20 a.m. yesterday upon conclusion of their visit.

My legal name is John Kevin McMillan. I am a lifelong single gentleman. My date of birth is April 27, 1957. I was born at Lincoln, Nebraska. My social security number is .....

Throughout the entire applicable time period from April 28, 2011, through July 29, 2015, I resided as an official rent-paying single adult white male tenant, always sleeping alone on my own designated bed, inside Apartment 325 at Wind River Crossing Apartments, 11411 Research Boulevard, in northwest Austin.

From late July 2015 through late September 2015, I resided as an official rent-paying tenant living alone and always sleeping alone in Apartment 133 at Crossland Economy Studios, situated in Williamson County and located at 12621 Hymeadow Road, Austin, Texas, 78729.

Ever since late September 2015, I have resided as an official rent-paying single adult white male tenant in the two-bedroom, twobathroom, Apartment 902 at Village Oaks Apartments, 10926 Jollyville Road, Austin, Texas, 78759. I always sleep alone on my own bed inside Apartment 902 at Village Oaks, and I am completely celibate throughout any and all of my own conscious or waking hours.

My relationship with my one total official apartment management-team-approved roommate in my current apartment unit, Mr. Brett Andrew Meyer his cited legal name, is, of course, strictly platonic at all times.

As I have repeatedly informed your municipal law-enforcement agency on numerous occasions over a multi-year period, I have not participated in or been subjected to any act of anal intercourse of any type on any occasion during any of my conscious or waking hours, regardless of where in the entire world I was situated or based, at any time since the late or mid 1980s.

I might add that I have been completely celibate, with zero sexual contact or intimate physical contact between myself and any other person, or any animal or beast, for that matter, throughout any and all of my own conscious or waking hours, regardless of where I was situated or based or resided, ever since and including the day when I moved back to Austin in mid-March 1997.

I have resided in Austin, Texas, on a continuous and uninterrupted basis ever since mid-March 1997.

I am submitting this public-information request to your City of Austin law-enforcement agency based on legal advice I received shortly after 9 a.m. this morning on the telephone from an incisive and first-rate attorney, Mr. David Walters, representing the Texas Legal Protection Plan or Texas Legal legal-aid service's telephone hotline service that is based in the Austin area.

I have been a fee-paying individual member of that service on a continuous and uninterrupted basis ever since May 1, 1997.

Thank you in advance for your prompt and very thorough reply letter providing me with any and all responsive legal documents.

Sincerely and Best Wishes,

John Kevin McMillan, current criminal-law complainant in APD Sex Crimes Case 15-1540423, a crime case for which I had filed an initial crime report with APD on June 3, 2015.

"A respectful FYI to each of you on the following March 10-dated public-policy letter of mine to my duly-elected state lawmaker in the Texas House, State Rep. Gina Hinojosa of Austin, Texas, in which I cited a state law in Oklahoma.

"It is my hope that the cited Oklahoma state law might possibly offer ideas for state lawmakers here in Austin on how the Texas Legislature could expand the number and scope of circumstances in Texas in which a municipal-government employee or a municipal-government official, such as a City Manager or a City Council member or department head, could be legally required by a municipal government in Texas to undergo drug testing.

"Dear State Rep. Hinojosa,

"As a law-abiding, gainfully employed, single adult male constituent of yours in northwest Austin, I appreciate your great dedication to pursuing factual research on behalf of generating proposed revisions to existing state laws and proposals for new state laws in Texas.

"During my leisuretime this weekend, I have been pursuing online research about drug testing of employees by municipal governments in the United States.

"I am pursuing this factual research because I feel very strongly that the integrity of all municipal governments in Texas, and the public-safety of all Texans, will be greatly enhanced when the percentage of all municipal employees in Texas who are drug addicts is as close to zero as possible.

"State Rep. Hinojosa, I would like to take this opportunity to ask you if you are planning to recommend any revisions to state law in Texas that significantly increase the number and scope of circumstances in which a municipal government---including the City Government of Austin in this very influential state-capital city---is either required or authorized by the Texas Legislature to conduct drug testing on one or more cited municipal employees or municipal-government officials, such as City Council Members or the Mayor or City Manager or a department head, of that municipal government in our state.

"On behalf of that type of public-policy goal for Texas, I have pursued online Google searches late this Friday night and Saturday morning inside my rental apartment unit in the District 10 section of Austin. District 10 is the local district in which the Austin City Council Member directly and officially representing any and all persons residing in that local district on City Council is Dr. Alison Alter (who, as you know, has reportedly prohibited me ever since March 9, 2017, from ever again myself directly contacting Dr. Alter or any of the City Hall staff members whom she directly supervises).

"In my online research this weekend, I have been very pleased to find an item about a pertinent state law in our neighboring state of Oklahoma.

"That item can be found at the following blogsite address:

"That blogsite address provides a link to a May 24, 2016, blog,  'Drug Testing Municipal Employees,' that was written by Suzanne Paulson of Oklahoma.

"The blog notes that Ms. Paulson is the Associate General Counsel of the Oklahoma Municipal Assurance Group (OMAG). That Edmond, Oklahoma-based organization provides insurance and risk management solutions for municipal governments throughout Oklahoma.

"The cited office phone number for Ms. Paulson at OMAG headquarters in Edmond, Oklahoma, is:
(405) 657-1400. Her E-mail address: spaulson@omag.org .

"According to Ms. Paulson's May 2016 blog, state law in Oklahoma authorizes (and I did not check to find out if that law has since been revised by the Oklahoma Legislature) drug testing of municipal-government employees or prospective new municipal-government employees in that southwestern state for any of the following reasons:

"---if the individual is applying for employment by a municipal government in Oklahoma;

"---if a municipal employee in Oklahoma is being transferred or reassigned to a different position or a different job;

"---if a municipal employee in Oklahoma was involved in a workplace accident that reportedly caused an injury or property damage;

"---if a municipal employee in Oklahoma is being required to take a routine 'fitness-for-duty' exam;

"Dear Open Records Coordinator,

"This is a Texas Open Records request in which I seek to obtain from any and all applicable offices or divisions of your State of Texas agency in Austin a photocopy or copy or computer printout of any and all lab test results and medical records and any and all crime-suspect information obtained or received or compiled by your State Government of Texas agency in regard to or relating to the Dec. 22, 2011, emergency-room-doctor-ordered forensic rape-evidence DNA-swabs exam that was very diligently and in an apparently very thorough manner conducted by a female forensic nurse on my own anus, buttocks, mouth, etc., in the early morning hours of Dec. 22, 2011, inside the emergency room of St. David's Medical Center hospital situated a few blocks from the Law School of the University of Texas at Austin.

"That factual information from you will be invaluable to me in myself pressing one or more successful criminal-law felony rape charges on my own behalf, with help from a reputable law-enforcement agency and the Travis County District Attorney's Office, inside a courtroom here in Austin.

"The early-morning December 22, 2011, forensic medical exam on myself inside St. David's Emergency Room was performed on me a matter of hours after I filed a crime report with the Austin Police Department on Dec. 21, 2011, in which I cited crime evidence to an APD officer that I had been victimized in the early morning hours of Dec. 21, 2011, by alleged anal-rape allegedly inflicted on me during my sleep as I lay alone, unconscious and probably also snoring, on my own bed inside my bolt-locked apartment unit.

"I was the only apartment management-team approved official tenant and also the only approved occupant inside my top-floor, vaulted-ceiling apartment unit at the time of the alleged rape that allegedly violated my own legal rights and human rights in Austin, Texas, USA.

"No one other than myself was authorized by or knowingly permitted by myself to be physically present anywhere inside my bolt-locked apartment unit at any time on December 21, 2011, with the sole exception of the one total Austin Police Department officer, Officer Guzman, an on-duty officer who visited my apartment unit on Dec, 21, 2011, in response to a rape-crime criminal-law complaint to APD from myself.

"Incidentally, I might note that I had taken a shower or bath minutes before I went to bed inside my bedroom of my bolt-locked apartment unit early on the morning of Dec. 21, 2011.

"When Officer Guzman while on duty visited my apartment unit later that day, he informed me in person in the living room of my apartment unit that I had the option of myself working at my scheduled restaurant workshift later that day without my taking another shower or bath (a course of action that would help preserve DNA crime evidence on my own body). Officer Guzman also told me that after my scheduled restaurant workshift that day, I could then promptly travel to St. David's Medical Center Emergency Room in central Austin and then myself on an individual basis request a rape-exam on myself inside that emergency room.

"I diligently followed Officer Guzman's advice on that, and have since been informed in writing by APD's public-information office and by the Travis County DA's Office that the Austin Police Department has been maintaining the resulting DNA-swabs rape-evidence kit at an APD substation in Austin, Texas.

"My legal name is John Kevin McMillan. I was born on April 27, 1957, at Lincoln, Nebraska. My social-security number is: ....

"I have resided in Austin, Texas, on a continuous and uninterrupted basis ever since mid-March 1997.

"Thank you in advance for your very helpful official response providing me with any and all legal documents or records responsive to this public-information request from myself.

"Sincerely and Best Wishes,

"John Kevin McMillan, a current criminal-law complainant with APD in regard to a cited illegal-trespassing incident on my lamp-lit outdoor balcony that I directly observed from inside my bolt-locked bedroom at about 1:15 a.m. one morning earlier this year----an incident about which I have filed an official crime report with APD, with APD Detective Robert Field the investigator assigned to that alleged-crime case. I appreciate the professional manner in which Detective Field has interviewed me or spoken with me on the telephone at least twice in regard to that alleged illegal-trespassing crime case in which I am the single adult white male complainant and cited crime victim.

"I am also a self-identified personal-injury-crimes victim and self-identified anal-rape-crimes victim, as I have informed numerous law-enforcement agencies in recent years here in Austin.

Who are you complaining about?

My Complaint is Against (Company or Name of Individual): US Bank, Sarah S. Maiers

Address: 204 E. Washington St.

City: Iowa City

State: IA

Zip Code: 52244

Phone: 319-356-9043

Fax: 319-356-9141

Email Address (if available): sarah.s.maiers@usbank.com

For motor vehicle complaints, list the Vehicle Identification Number (VIN): none

Product or service involved: US Bank has promised to refund me in full for late fees I incurred from the Iowa Department of Revenue that resulted from a US Bank error that forced me to re-file my Iowa Individual Income Taxes payment in 2016 AFTER the April 30, 2016, filing deadline. Despite this, Ms. Sarah Maiers of US Bank in Iowa City is so far refusing to compensate me in full for the late fees I've incurred on that. She has apparently chosen to ignore a very recent written statement I've shared with her that was written by Iowa Assistant Attorney General Laurie Heron McCown. Ms. McCown's official letter to me, a copy of which I've shared with Ms. Maiers, officially confirms that the entire $379.86 amount that the State of Iowa is currently seeking from me is all exclusively late fees. In 2016, I was forced to re-file my income taxes to the State of Iowa AFTER the April 30 filing deadline that year. This delay occurred because of a delay from US Bank in providing me with a corrected K-1 form that I needed in re-filing my Iowa income taxes in 2016. The error on the original K-! form issued to me by US Bank in 2016 was from US Bank, and definitely not from myself. On or about May 10, 2016, I mailed my signed, May 10, 2016-dated, $3,763.00 personal check to the Iowa Department of Revenue for the full tax amount due, excluding any applicable late fees. The tax preparer for Block Tax Advisors in Austin, Texas, who re-filed my Iowa income tax form for me in 2016, Shelly Lamberth Jr. of Austin, has stated to me in writing this year that when he prepared my re-filed income taxes for the State of Iowa in 2016, it was not clear online how much, if at all, the State of Iowa would charge me for mailing my income taxes after the April 30, 2016, filing deadline. The Iowa Department of Revenue apparently maintains that the letter I sent containing that check was reportedly postmarked on May 16, 2016---about two weeks, in other words, after the April 30 filing deadline.

Is the product?: Used

Date of purchase or contract: May 10, 2016

Amount of purchase or contract: 3,763.00

Actual amount paid: 3,763.00

How did you pay?: Wells Fargo personal check

Have you contacted the business or person?: Yes

Have you contacted an attorney?: Yes

What do you think should be done to resolve your complaint fairly?: I would like you to please find out why Sarah Maiers of US Bank in Iowa City is still refusing to compensate me for the $379.86 in late fees that her bank is responsible for my having incurred. I might add that I myself did not learn about any late fees that I reportedly incurred until I received a letter from the Iowa Department of Revenue about that issue on July 23, 2018. A previous letter that that state agency in Des Moines maintains that it mailed to me in 2016 was never received by me until the summer of 2018, when I requested and obtained a copy of that reported 2016 communication from the Iowa Department of Revenue. In that regard, the the upper left hand portion of a copy of that reported 2016 letter to me from that State of Iowa agency does not even specify my apartment unit number.

Summary of your complaint: US Bank owes me the entire $379.86 in late fees to me from the Iowa Department of Revenue that US Bank is blameworthy for.
