Subject: Fw: 12-22-20 PIR to City re: any evidence from City of my own housing conditions cited as 'unsafe'

December 23, 2020

Dear Highly-Esteemed Law-Enforcement Officers,

After sending out an e-mail letter (directly below) with this background material (farther below) yesterday, I have tentatively decided against directly pursuing a public-information request relating to this.

The type of  public-information request that I was tentatively planning to submit to a City of Austin office or department would have sought a copy of any documents on file with the City that refer to or comprise statements from City of Austin employees or City of Austin officials at any time since April 28, 2011, that they regard my own housing conditions or sleeping conditions in Austin as possibly or apparently or definitely being "unsafe" for me.

For now, I have decided instead to directly share with each of you several of the documents in my own possession inside my current apartment unit that refer to or respond in writing to my citedly "unsafe" housing conditions in Austin.
I made that tentative decision because, as each of you may already be aware, I am the current criminal-law complainant and cited victim in the Austin Police Department Alleged-Continuous-and-Continuing-Home-Invasion-Crimes-and-Alleged-Trespassing-Crimes-and-Alleged-Sex-Crimes-and-Alleged-Personal-Injury-Crimes Case with APD ID Number 20-3161213. That APD case was generated by APD on November 11, 2020.

I have repeatedly emphasized to APD officers ever since early 2012 that I welcome any forensic medical-evidence sexual-assault-evidence exam on myself at any time (including any time of the day or night) and on any calendar day of the year that APD or the City of Austin is willing to authorize for me either at present or in the near future.

I am a gainfully employed longtime-celibate white Anglo-Saxon senior-citizen gentleman, age 63. I am always sober and never high, never previously addicted, and platonicly polite. I am also a lifelong abstainer from tobacco products or vaping and a lifelong abstainer from tattoos; I do not have any criminal-conviction record; and I always sleep alone on my own bed inside my bolt-locked apartment unit. I also live alone in my current unit.
ANY DNA trace to someone other than myself that is obtained from a law-enforcement-agency-authorized forensic exam on my own anus or buttocks or genitals or groin area is virtual proof in a court of law that I was in fact sexually assaulted or raped or molested or physically abused by that person during my sleeping hours or during a period in which I was held unconscious by an alleged home-invasion-crimes perpetrator.

Thank you in advance to each of you for your kind interest in the above-cited current criminal-law complaint of mine with APD.

Sincerely and Best Wishes,
John Kevin McMillan.

The following are legal notes I plan to draw from as factual evidence of my own in a public-information request I plan to submit to the City Government of Austin (TX) later today. Thank you, President-Elect Biden and District Attorney-Elect Jose Garza, for your very kind support for my personal safety and well-being as a single adult male private citizen in Austin, Texas, and Travis County, Texas.

Subject: 11-1-20 safe-housing-related question for Austin Apartment Association

Dear Distinguished Representatives for the Austin Apartment Association in this state-capital city for Texas,

Does your professional realtors organization support the legal right of a gainfully-employed diligently-rent-paying official tenant and only approved occupant on a currently-active signed lease agreement for an apartment unit in Austin to himself keep anyone and everyone away from any portion of the interior of his bolt-locked apartment unit during his bedtime hours at nighttime?

Thank you in advance for your very helpful reply note to me on this, which I feel sure will be very reassuring to me.

Sincerely and Best Wishes,
John Kevin McMillan, a law-abiding, honest, vigilant, and gainfully-employed single-by-choice, longtime-celibate-by-choice (including on a continuous and uninterrupted basis ever since I moved to the northern section of Austin in August 2001), permanently-drinking-alcohol-free (ever since 1990 and never previously addicted), permanently marijuana-free (ever since 1984 and never-previously-addicted), lifelong-illicit-drug-free in regard to any and all illicit drugs other than marijuana, lifelong-tobacco-free and anti-tobacco-minded, facially-cleanshaven (no beard, no mustache, no goatee), lifelong-tattoo-less, platonicly polite, consistently clean-talking (no profanity by me in my everyday conversations with others), lifelong-non-Christian gentleman and religiously-independent apartment tenant residing in the second-floor, eastward-facing Apartment 2418 of Building 17 at the northeastern corner of the Belco Equities-affiliated, gated-community Pebble Creek Apartments complex, 8805 North Plaza Drive, in northeast Austin. I might add that I have resided alone in the same always-properly-locked rental-efficiency unit at Pebble Creek Apartments ever since the early afternoon of June 21, 2019; and my current one-year lease agreement with Pebble Creek Apartments expires at 11:59 p.m. June 30, 2021.
I might add that the media services provider for my current unit's Internet, cable television, and landline home phone service is a media services provider headquartered in San Marcos, Texas---Grande Communications---that has an exclusive contractual relationship with the management team at Pebble Creek Apartments. That media-services contract with the polite management team at Pebble Creek Apartments required me ever since June 2019 to choose Grande Communications for my home telephone service, my Internet service, and my cable television service inside my always-bolt-locked current apartment unit. No staff member for Grande Communications has ever been observed by me anywhere inside my current apartment unit on any occasion since June of 2019 or possibly July 2019---and strictly in connection with on-duty technicians installing my new media services through three or more separate on-duty visits to my unit inside my current unit....

Good morning-

I am sorry to hear about your situation. As Mr. Gerber was saying,  the Austin Tenant's Council and Rio Grande Legal Aid are excellent resources available free of charge, so I would recommend contacting them for representation.

Our agency does not offer immediate or emergency housing; however, we do have several waiting lists that are currently open and you can apply by going to www.hacaapply.org.  I have also attached a list of community resources for you, and the Tenant's Council resource listing for additional housing options in the area.

I hope this helps.  Best of luck to you.

Dear Austin Police Department Representatives in Austin, Texas,

A polite assistant manager for Wind River Crossing Apartments, Ms.  Samantha Redmon, told me in person inside her office area earlier this year that their Westdale management company is now requiring that I myself must obtain a written statement from a reputable law-enforcement agency with jurisdiction---an official letter from APD, for instance, stating that I myself am believed to be unsafe inside my current apartment unit- at Wind River Crossing---before I myself could ever be released at some hypothetical future date from my current rental apartment lease with Wind River Crossing, this without my being subjected to any penalty fee or any cited status as a tenant who had allegedly "broken" his lease with Wiind River Crossing.

Are any of you APD officials or Travis County Sheriff's Office representatives or Texas DPS officials or representatives for the Attorney General of Texas state agency,. willing to state in writing at this time that you believe that I myself am currently unsafe inside my current rental apartment unit at Wind River Crossing Apartments?

Thank you in advance for your helpful reply note on this.

personal-injury crimes , including during my sleep, and of alleged anal-rape-crimes-inflicted on me solely during my

Subject: RE: FIVE City of Austin departments consulting an attorney re: me
Hi John.  Say, if I were to very respectfully ask that you remove me from this list, would you be willing to do that?  Two reasons: 1) … and this is no lie, my wife just got offered a job in Geneva Switzerland with an organization called the International Labor Organization that is affiliated with the UN. Yep, I’m moving to Geneva Switzerland.  I will be back next spring for a couple months with my son who will be returning to his current high school, Eagan, but then after he graduates, I’m headed back over there.  Yep, I’m really excited.  I’m going to transition back into consulting and I am trying to line up a gig as something called an “Honorary (yep, I’d be fricking HONORARY) Consul”. How great is that?  But in the immediate term, I plan on visiting as much of Europe with my son and wife as possible!! Et je parle francais, aussi! So the thing is john, this email address is getting shut down, and I’d really appreciate not having to explain some of this to someone.

2) Seriously, John, if this was happening to me, I would just get the hell out of there.  You might recall when we spoke on the phone a few months back, that was my - perhaps unsolicited advice – but my advice all the same.  There must be better options somewhere, right?

So thanks.  I think back fondly at my time at COACT, and the truth is, you were one of the first friends I made in this town.  But it’s time for me to open up this next big chapter of my life, so I am asking you to take me off this list please, okay, John?

Thanks.  Sincerely,

Matt

John,
Of course we do not wish you any harm and wish for nothing but your health and safety. Moving may be the only resolution at this point. You are welcome to give your notice at any time, without penalty. We will not however, approach any of your neighbors regarding construction noise. What they do inside their dwelling is their business. It certainly does not have anything to do with your situation. Have you determined yet whether your federal agency does have legal authority or legal jurisdiction to investigate the housing-related civil rights complaints (below) from myself that I've filed with you?

Thank you in advance for your prompt reply note on this.

I have looked through the photos you sent me but I can't identify if that's you or someone else. I also have no experience with infrared cameras but I hope you find someone that can help you get more familiar with it, if i knew anyone with experience in that area I would help. I'm sorry for what your going through and I really wish I could be of more help.

Dear Officer Turner,

Alma, an assistant in the medical clinic of my new primary-care physician, Dr. Edie Shulman, helpfully and politely advised me in person today that I will need to myself sign a formal affidavit provided to me by the Austin Police Department, if I wish to formally and officially authorize Dr. Shulman and her staff to share any and all medical records and any other records about me with your municipal law-enforcement agency in Austin.

As a law-abiding and civil and honest and gainfully-employed single adult male criminal-law complainant, I definitely wish to formally authorize your law-enforcement agency to obtain any and all records that you might ever wish to obtain that relate to myself in any way.

I wish to offer that authorization to APD because I am very sure that the resulting information about medical injuriousness to myself during my sleep in the period ever since mid-April 2011, in particular, will be invaluable to the Austin Police Department.

That factual information will help your law-enforcement agency to formally press criminal-law charges against an alleged criminal person who has allegedly illegally entered my bolt-locked apartment unit and allegedly illegally subjected me to alleged medical injury and alleged personal injury of myself and alleged molestation of my own body, and alleged frequent disruption and frequent interruption of my sleep, during periods in which I am sleeping alone on my bed.  During those periods in which I am sleeping on my bed, I am also unconscious, probably snoring as well, and lying alone, as always, on my orthopedic bed inside my bolt-locked apartment unit at Wind River Crossing....

Sincerely and Best Wishes,
longtime criminal-law complianant (ever since April 28, 2011, for instance) and cited personal-injury cirme victim and former recent Texas Restaurant Association indivdiual dues-paying member John Kevin McMillan.

John – the conservative legislature and judiciary has made cases of this nature almost impossible to prosecute – you would have to know who the perpetrator is to even begin – I don’t know an atty who handles these matter any more – you might try travis county lawyer referral service on the outside chance they could make a recommendation – sorry for all your troubles --louis

Good afternoon, John,

The statements you made in your e-mail were mostly correct, except that I did not say that we have done everything to make your apartment as “secure and safe” as possible. We can never ensure anyone’s safety as it is against policy to do so. What I stated was that we have done everything that Texas apartment laws require in your lease contract as far as the number of locks on your door and the locks installed on your sliding patio door.

I will mention your request about Josh to Ann, our manager. Until then, if you have any other questions, please let me know. Thank you, and I hope you have a great day, John!

Respectfully,

Dear John,

I am again impressed at how expensive and unsafe your apartment might be…and how little I can do to help your problem, except suggest that perhaps you investigate possible other causes of the pain, especially anal cancer.  If I remember correctly Farrah Fawcett died of anal cancer. It is not a pleasant disease and of course very painful. What amazes me is that you seem to be such a sound sleeper, yet always wake up  with pain.

There must be cheaper and safer apartments in Austin???

Even I can see that you have substantial problems….and not only at the end of every month…way beyond my meager capacity to help you…though now there is substantial uncertainty in my mind exactly what they are..and how to solve them…I am amazed at how much money rich people make off of poor people who cannot balance their budgets and wind up paying exorbitant late fees…translating into humongous interest rates….I guess eventually poor people learn to budget…

I wish you “Good Luck”…

Mike

PS. Do not worry about me…
