Thank you for asking, Eric. That appears to be what happened. I was awakened at or before 8 .m. this morning, even though my alarm clock had been set for 9 a.m. I had gone to bed at about 2 a.m., so I should have slept soundly until 9 a.m., as I normally would before April of last year.
This morning, I noticed the same sensation in my body, including pain in my legs and some pain in my anus tthat I did NOT experience ...(before) April of last year whenever I would wake up.
Norma Hilbig, then a paralegal in the Travis County DA's Office, did helpfully volunteer to me several months ago on the phone that because I live in a vaulted ceiling, top-floor apartment, this makes my apartment vulnerable to intruders entering my apartment from above. That is one "point of entry" theory of mine, particularly since I do find bizarre bits of twigs and other odd items I myself did not put there that are situated directly under one corner of my ceiling in my bathroom. There is a huge gap between the ceiling directly above my apartment unit and the roof. Unfortunately, I don't have the sophisticated technology I need to photograph an alleged possible intruder hiding above my apartment in the area between the ceiling and the roof.
Unfortunately, Norma Hilbig has retired, and her successor does not even return phone messages from me. At least, so far she hasn't.
Thank you again for your strong stated support for my legal and human right to sleep alone on my Swedish bed (I'm a longtime celibate-by-choice gentleman, I don't mind mentioning) without ANYONE having any physical contact with me or torturing me in any way during my sleep or attempting to wrec havoc on and mess up my REM sleep or deep sleep.
Before April of last year, I NEVER had any difficulty sleeping for the entire eight straight hours on my bed, if I did in fact set my time clock for eight hours of sleep or if I decided to sleep in without setting my alarm clock.
Eric, it's good to sense that someone as smart as you are is willing to help me solve this bizarre crime mystery inside my bolt-locked apartment unit.
I might add that this is NOT the first crime mystery case in which the illegal point of entry has been difficult for a law-enforcement agency to identify.

A very distinguished attorney member of the State Bar of Texas has helpfully advised me today to contact your office in Austin and share with you several of the infrared-photography spy-camera photos I've obtained from inside my bolt-locked one-bedroom, top-floor, vaulted-ceiling apartment unit ever since I purchased my first-ever infrared spy camera in February 2012 here in Austin.
Attached, please find numerous examples of spy-camera photos taken on my behalf inside my bolt-locked apartment unit at Wind River Crossing Apartments in the time period since, and including, February 2012. Please note that I had considerable difficulty with trying to set the times and dates for my infrared "Wildview"-brand spy-camera (and I have since purchased a second spy-camera of the same type that I'm also using, and for which I also have a receipt from a nearby Academy store in northwest Austin), so the cited dates and times on nearly all of these photos will not be accurate.
I am sharing this criminal-law evidence with you primarily because the Austin Police Department has stated to me in writing in a recent prior week, according to legal documents from official APD reports about criminal-law complaints I've filed, that ALL of the dozens of spy-camera photos and accompanying videocards that I have provided to APD officers in 2012 are photos of myself (John Kevin McMillan) only, and no one else, according to APD.
District Attorney Lehmberg, I feel very confident that the attached criminal-law evidence from myself contains several spy-camera photos that are definitely NOT of myself, and I wish to press charges accordingly.
Some of the attached photos may be of myself attempting to set up my spy camera or adjusting the location of my spy camera or grabbing my spy camera in order to examine the most recent photos it obtained for me. However, you will notice a variety of facial sizes and facial features, and a variety of body sizes and body shapes, that underscore the accuracy of my emphatic contention that several of these photos are NOT of myself.
I never have any invited late-night guest or any invited late-night visitor inside my apartment unit after midnight. The photos are ALL or nearly all photos that were taken on my behalf between the hours of midnight and 9 a.m. in the morning, depending on the day when each of the attached spy-camera photos were taken from inside my bolt-locked apartment unit.
I would also like to point out that nearly every day ever since 2011, I have been collecting numerous hair follicles and other tiny odd items (including dark black specks and mysterious yellowish specks) from my Swedish bed that I find there shortly after I wake up in the morning. That Swedish bed is a bed on which I have always slept alone ever since I purchased that bed in 2007, and on which NO ONE has ever at any time been authorized to be on that bed of mine.
Each morning or day when I collect that criminal-law evidence from my Swedish bed, I place those hair follicles and other items in a separate sealed envelope for each applicable date. Many of those hair follicles I've collected using tweezers are thick black or thick very dark hair follicles, sometimes with a reddish tint to those hair follicles. My own hair color is brown and gray, and has no reddish tint at all, and my hair follicles are thin in texture, rather than thick. Also, many of the hair follicles I collect nearly every day from my Swedish bed are curly and appear to definitely be pubic hairs----this despite the fact that I always sleep with my underwear on.
I have been completely celibate throughout all of my waking or conscious hours in Austin, Texas, ever since December 1979. Also, I lead a completely illicit-drug-free (ever since 1984, in the absence of any prior addiction),completely tobacco-free (lifelong) and completely alcohol-free (ever since 1990, in the absence of any prior addiction), consistently civil, tattoo-less, facially-cleanshaven (no mustache or beard or goatee, etc.), clean-talking (virtually no profanity ever verbalized to others by me), and law-abiding lifestyle.I have no criminal-conviction record, and no pending charges against me, either.
I feel that I am a very strong complainant on my own behalf. I welcome the opportunity to tesitfy in a court of law as soon as possible here in Austin about the hundreds of hours of sleep, including REM sleep, that I have lost ever since April 2011 because of one or more alleged illegal intruders who allegedly entered my apartment unit illegally and somehow woke me up in the middle of my sleep without their being directly visible to me. I have often been awakened with pain in my anus, often so severe that it took me a half-hour just to recover from the pain in order to fall back to sleep on my bed in the middle of my sleep. I have also experienced pain in my anus when I get up in the morning, along with pain in my legs, pain in my hips, and pain in my abdomen on numerous occasions in recent months when I get out of bed. I have reported to the Austin police and showed police officers evidence of mysterious cuts and bruises to my legs and arms that I maintain I myself definitely DID NOT incur at any of my three restaurant workplaces (Outback Arboretum, situated virtually "across the street" from my apartment complex where I reside; ...(one corporate-owned restaurant in Williamson County); and Denny's Lakeline), and that I did not recall having incurred on my own, either. I have a very strong will to live, and to enjoy a full and fully vital medical lifespan for myself; and I do not seek to harm myself or anyone else, I wish to emphasize.
I have lived alone inside my apartment unit ever since late May 2011. In late May 2011, I conveyed a permanent and irrevocable and law-abiding and civilly-stated rejection of my most recent previous roommate, a self-described "citizen of Indonesia" who stated that his name was "Sandjaja Utama." He reportedly was employed by Pearson educational testing services in northwest or north Austin during the period (from mid-April until late May 2011) in which he resided with me, and his cited "employment information" was provided to me in a letter I received from an HR officer for Pearson educational testing service.
I do not have any relationship of any type with Pearson, and neither Pearson nor any of its current or former employees are authorized to violate my own privacy rights in any way. I have not spoken with Sandjaja Utama or met with him in person or received any E-mail letters or phone calls from him or made any phone call to him, for that matter, on ANY occasion since he moved out of Apartment 325 at Wind River Crossing in late May 2011.
District Attorney Lehmberg, I would appreciate learning from you how you plan to proceed with this criminal-law case in which I am the sole victim. I emphatically allege that the continuous crimes involving physical injury and medical injury to myself by illegal intruders during periods in which I am sleeping and snoring on my Swedish bed inside my bolt-locked apartment unit do, in fact, comprise a felony crime by any and all of those illegal intruders.
I hope to hear from you soon about this major criminal-law case that poses a major legal liability for the City Government of Austin as well as for Travis County Government.
Finally, I would also like to take this opportunity to remind you that the Austin Police Department has refused to do any lab testing on the extensive DNA medical swabs that were taken at my request from several parts of my body during the early morning hours of December 22, 2011, by a female forensic nurse inside the emergency room of St. David's Medical Center near the University of Texas at Austin. Those DNA swabs were taken from my body a matter of hours after I complained to APD on December 21, 2011, that I had been physically assaulted during my nocturnal slumber, with myself asleep and probably snoring at the time, inside my bolt-locked apartment unit at Wind River Crossing.
It seems to me that the Austin Police Department may be allegedly or possibly guilty of obstruction of justice, because of APD's refusal to fully investigate this ongoing crime case in which I am the victim.

On Dec. 21, 2011, I worked as a waitstaff member at only one of my restaurant workplaces---and I worked there in the late afternoon and evening. Would you please explain to me in writing why you have yourself apparently permitted the Austin Police Department (APD) to itself refuse to do ANY lab testing on the extensive DNA medical swabs that were obtained from several parts of my body in the early morning hours of Dec. 22, 2011, by a female forensic nurse inside St. David's Medical Center Emergency Room near UT-Austin?
Also, would you please explain to me in writing why you have chosen not to insist that the Austin Police Department pursue full lab testing on hair follicle samples and other criminal-law evidence from my bed that I provided to APD Officer Guzman on Dec. 21, 2011?
I would like to politely remind you, Mr. McDonald, that the above-cited DNA swabs were performed on own body at my politely-stated request in connection with my having filed a criminal-law complaint with APD on Dec. 21, 2011 (APD Crime Report Number 11-3550615). In that crime report with APD, I alleged that one or more persons had illegally entered my bolt-locked top-floor, vaulted-ceiling one-bedroom apartment unit, where I live alone and always sleep alone, and had themselves allegedly subjected me to personal injury and inappropriate physical contact with myself and physical abuse of myself during my sleep.
APD Officer Guzman (Employee ID number 4611) did politely visit my apartment on Dec. 21, 2011, in response to my criminal-law report with APD earlier that day. Officer Guzman during his daytime visit to my apartment unit that day did accept a sealed envelope from me containing numerous hair follicles, several of them definitely NOT being from my own body, and numerous other odd items I had found on my bed that morning and I had collected using tweezers.
During his visit to my apartment unit on Dec. 21, 2011, APD Officer Guzman did helpfully advise me that I had the option of myself going alone to St. David's Medical Center Emergency Room later that day, or that evening, and then myself requesting a SANE (SAFE?) exam on myself by a forensic nurse. With permission from Officer Guzman, I made that trip to the St. David's emergency room only after I had completed my workshifts on Dec. 21, 2011, at two different respective restaurant workplaces of mine. (I had taken a bath early in the morning of Dec. 21, 2011, before I went to bed early that morning.)
During my visit to St. David's Medical Center on the night of Dec. 21, 2011, I did emphasize to the Emergency Room admissions staff that I wanted them to please contact the Austin Police Department and obtain prior authorization before a forensic nurse then performed a SANE or SAFE exam on me during that visit. I was led to believe that official authorization from APD was, in fact, obtained by St. David's medical staff before I underwent my first-ever truly extensive and comprehensive DNA medical swabbing from my own body in that hospital.

On March 22, 2014, a male representative for the U.S. Department of Homeland Security informed me on the telephone that my most recent previous roommate---a self-identified "Indonesian" citizen who had stated his name as "Sandjaja Utama", and who had stated to me that he himself is an official member of the Roman Catholic Church in the Austin area---is now being officially investigated by Homeland Security as a possible alleged crime suspect.
The Homeland Security official who spoke with me on the phone made that disclosure to me in the context of his volunteering to me in that same conversation that a reliable source OTHER than myself had contacted Homeland Security with a tenative crime tip about Mr. Utama.
As you may be aware, I did myself politely complain in a recent prior year to the Austin Diocese of the Roman Catholic Church about myself being victimized by alleged daily and year-round personal-injury crimes and alleged daily and year-round anal-rape-crimes during my sleep as I lie ALONE on my bed (I ALWAYS sleep alone, and I am a longtime celibate-by-choice, always-sober, dependably civil and law-abiding, gainfully-employed, single adult white gentleman of northern European ancestry) inside my bolt-locked apartment unit at the Westdale-managed Wind River Crrossing Apartments in Austin.
The communications director for the Austin Diocese, Mr. Christian Gonzalez (sp?), sent me a reply letter asking me to never again contact Mr. Gonzalez directly. I of course fully honored his request on that.
I am writing you today to politely ask you whether the Texas Catholic Conference ever has the legal authority to pursue an investigation of your own into alleged possible sex crimes allegedly being possibly inflicted on a law-abiding NON-Catholic gentleman such as myself by a cited "current member" of the Roman Catholic Church.

In your reply note (below), you point out that the APD in Austin, Texas, is not a current "client" (exact quote) of your very influential and widely-admired nationwide accreditation organization.
Mr. Beatty, are you also suggesting that neither APD nor any of its employees or officers or officials currently have any relationship of any type with your prestigious nationwide accreditation organization for law-enforcement agencies?
Also, do you happen to know of any nationwide professional organization or nationwide accreditation organization or monitoring organization in which APD is, in fact, an official member at present?

This is a Texas Open Records request in which I seek to obtain from your municipal law-enforcement agency in Austin, Texas, a photocopy of any and all preliminary or, if applicable, final
DNA medical test results that the Austin Police Department (APD) has received or obtained in connection with APD Criminal-Law Complaint 11-1180447 and the accompanying APD Criminal-Law report number 11-1471240------criminal-law reports that I myself filed with APD on April 28, 2011, and on May 27, 2011, respectively.
As part of those DNA test results, I am seeking to obtain from your law-enforcement agency the cited legal name and cited address of each and every person on whom DNA medical testing was conducted by or for APD in connection with this criminal-law case.
Also as part of this Texas Open Records request, I am seeking from you a photocopy of one to two pages of a legal document in APD's current files that cite and describe the nature of the alleged criminal offense in this case-----a criminal-law case that APD has told me has been classified as an alleged "forcible sodomy" case.
Also in connection with this Open Records request, I am seeking the name and cited residential address of each and every person who has been arrested and formally charged with a crime in connection with or in response to this criminal-law legal complaint from myself.
Detective David Silva of the APD Sex Crimes Division has helpfully confirmed for me on the telephone that APD has requested or ordered or conducted DNA medical testing on myself as well as on at least one other cited legal-status-adult individual in connection with this criminal-law case in which I am myself the cited complainant, according to Detective Silva. Detective Silva's APD office phone number is: (512) 974-5526.
Detective Silva has also helpfully informed me on the telephone that he has personally interviewed in person at least one legal-status-adult individual other than myself in connection with this criminal-law case.
The same Detective Silva helpfully assured me in person in May of this year that the Austin Police Department and City of Austin fully support and fully uphold and fully protect my own asserted legal right and my own asserted human right to myself enjoy full and year-round freedom from any and all sexual molestation of myself and any and all sexual penetration of myself, and any and all physical contact with myself, in any scenario that might ever allegedly or hypothetically occur at any time during my sleep during periods when I am sleeping alone on my own bed inside my fully locked and bolt-locked and fully secured apartment residence in Austin, Texas.
In June of this year, Detective Silva informed me on the telephone that the Attorney General of Texas state agency has established a policy prohibiting the Austin Police Department from conducting or sponsoring any additional follow-up DNA medical testing on me in connection with criminal-law complaint that I originally filed with APD on April 28, 2011. Detective Silva offered me that factual response on the telephone in explaining why his law-enforcement agency is not willing to order any additional DNA testing on my anus or anal cavity at this time.
I am a single adult gentleman, and I have never been married to anyone at any time. I have specifically permanently rejected numerous individuals of my past from my own personal life and life, and many of the individuals whom I've specifically and permanently rejected from my own life were or are homosexual, gay, effeminate male adult, bisexual, lesbian, transvestite, or transsexual in self-described or conveyed sexual or gender identity per se. The persons whom I have permanently and irrevocably rejected include a "Dan Hitt" or "Daniel Hitt" who reportedly resides or has resided in Palo Alto, California, and I have informed the Attorney General of Texas about my own permanent rejection of Dan Hitt and associates.
During the entire period since January 1, 2000, for instance, I have never once agreed to have sex with anyone or have any romantic or sexual physical contact of any type with anyone, or sleep or physically lie with anyone on the same bed, on any occasion.
The last occasion in which I ever had any mutual-consent sexual contact or any mutual-consent sex with any other legal-status-adult person anywhere in Austin, Texas----or anywhere in Central Texas, for that matter--- occurred in December of 1979.
I have resided inside Austin, Texas, on a continuous and uninterrupted basis ever since mid-March of 1997, most recently.
In the period since mid-March 1997, I have repeatedly and in a civil manner expressed major concerns of my own about alleged violations of my own privacy rights, in phone calls I have made and letters I have written and sent or E-mailed to private attorney members of the State Bar of Texas, officials of the State Bar of Texas, the Attorney General of Texas state agency, the Governor of Texas, the Austin Police Department, the City Attorney of Austin, the Travis County Attorney, the Travis County District Attorney, the Travis County Judge, the Federal Bureau of Investigation, the U.S. Department of Justice, and numerous duly elected officials who represent me and serve me in government at the local, state, and federal levels.
One Travis County Government official, Travis County Civil Probate Division Director David Ferris, did volunteer to me on the telephone in late 2001, in a surprising disclosure he made with no apparent context to his remarks during a local phone call I had made to him from a two-bedroom apartment unit in northwest Austin (a nice apartment unit that I was living in and sharing with a roommate during that period), that "There appear to be lots of people in the Austin area who are trying to drive you (John Kevin McMillan) out of town" (approximate quote).
In the period since late 2001, Mr. Ferris has never provided me with any subsequent factual criminal-law or civil-law evidence on behalf of his unsolicited telephone observation to me indicating alleged possible harassment of myself or alleged possible violations of my own privacy rights in Austin, Texas, during that time period.
One medical physician, Dr. David Tobey, a nationally renowned ear, nose, and throat specialist, has statistically documented ever since 2005, when he first began examining me and evaluating my hearing capacity inside his medical clinic in northwest Austin, significant permanent and irreversible noise-pollution-inflicted damage to my own hearing capacity and medical health that I have sustained over a multi-year period in Austin, Texas-----all in a context in which Dr. Tobey has emphasized that I myself did not request or generate or authorize or cause the cited continuous and year-round noise pollution in Austin, Texas, Dr. Tobey has repeatedly assured me.

Dear Officer Turner,
After returning home from my workshift at ...(a corporate-owned restaurant) this Friday night, I have continued to search in my computer system for the computer photo file of a suspected possible minor as well as illegal intruder on my orthopedic bed inside my bolt-locked apartment --- a photo that you had recently indicated to me that you wanted me to send you by E-mail.
I have not yet located that particular photo in my computer system, a photo that my new primary care physician, Dr. Edie Shulman, photocopied for her records on me after I showed her a hard copy of that photo inside her medical clinic during a medical appointment I had with Dr. Shulman in July 2012.
Incidentally, I did orally authorize Dr. Shulman during my medical appointment with her this Friday, August 17, to feel free to herself share any and all of her records on me or about me with the Austin Police Department.
During my search this Friday night and early this Saturday morning for the cited infrared photo, I have found several additional infrared motion-sensitive hunter's camera photos of possible alleged intruders that were each obtained for me in 2012 inside my bedroom or elsewhere inside my bolt-locked apartment unit at Wind River Crossing.
I wish to again emphasize that since I had difficulty with the time-and-date setting function with my new Wildview infrared camera that I purchased this year, the cited dates and times for several or more of these photos may be inaccurate.
Thank you again, Officer Turner, for your patience and understanding as I share with you these additional photos as well. My hope is that you and your colleagues at APD will in the near future agree that several or more of these infrared photos from 2012 will definitely strike you as being photos of an illegal intruder inside my bolt-locked apartment.
I have lived alone inside my apartment unit ever since May 31, 2011, and I NEVER have any invited overnight guest or any invited guest inside my bolt-locked apartment unit between the hours of midnight and 8 a.m.
I hope to hear from you soon in regard to whether the Austin Police Department appears to be nearing a decision on whether you have identified one or more infrared hunter's camera photos taken from inside my bolt-locked apartment unit in 2012 that appear to be of someone OTHER than myself, and who is also himself or herself an illegal intruder.

I was very fortunate to be able to meet with Dr. Shulman today, since I called her medical clinic this morning to schedule a follow-up appointment with her. In scheduling my appointment for today, I did mention to Dr. Shulman's nurse, Charity, that the alleged molestation of myself by one or more illegal intruders inside my bolt-locked apartment unit has continued, including this morning. I woke up at about 8:30 a.m. this morning on my orthopedic bed in my bedroom, and I quickly sensed that I had been molested during my sleep once again. I had gone to bed at about 1:30 a.m. this morning (Friday).
In the meantime, as I continue to search for the infrared spy-camera photo computer file image I'd promised you of the illegal intruder on my orthopedic bed whom Dr. Shulman told me last month resembled a little girl, I would like to share with you a few more spy-camera Wildview photos taken this year during my bedtime hours from inside the bedroom of my bolt-locked apartment at Wind River Crossing.
Again, I need to emphasize that I had difficulty with the date-and-time-setting mechanism for my camera, so those may not be accurate. All of these photos were taken on my behalf in the period since or including early February 2012, since early Feb. 2012 was when I purchased my first-ever infrared spy camera (a Wildview hunter's camera, as the photos indicate). I bought that at an Academy store near my apartment complex.
Officer Turner, I would like to thank you for your willingness to review these infrared spy-camera photos taken during my bedtime hours, with some of these photos possibly being from time periods after I had been abruptly awakened on my bed and I'd briefly gotten out of bed and walked into the restroom or the kitchen area or the living room area of my apartment unit.
I am very hopeful, Officer Turner, that one or more of these infrared motion-sensitive Wildivew photos taken on my behalf this year from inside my bedroom or in the living room of my apartment, in at least one case, will help to persuade you and your colleagues at APD to re-open your investigation of this alleged felony ongoing personal-injury and ongoing sex-crimes case in which I allege that I have been the victim during my sleep on a daily and frequent (more than once per night or morning or day during my sleep or napping time) and year-round basis, with the apparent exceptions of Sept. 3, 2011, and Sept. 10, 2011, inside my bolt-locked one-bedroom apartment unit, with myself always sleeping alone on my orthopedic bed and there being no one else authorized to be inside my apartment unit at the time.

The city of Quincy recently passed a noise ordinance, and I worked with the sponsoring ward councilor for several months on the draft ordinance, prior to its submission. So I understand the concerns you raise in your question.
I will tell you that it is generally the case that the impacts of noise on residents of a community are very difficult for local government to address. I know nothing about the particulars of Travis County , but I can tell you that in my experience, I can conceive of no conceivable scenario where a local government would “knowingly permit or authorize noise pollution.”
What constitutes bothersome noise is very subjective. You may find something bothersome that others do not. That is one problem. Another problem is catching the party making the noise in the act – so that something can be done about it.
I believe that what you are encountering is a common problem across the country. How we manage noise issues is something that communities continually struggle with. I would hope for you that, notwithstanding how difficult the problems in your community might be, you have confidence that your government is doing – and will do – what it can to help. And, I hope you can feel comfortable that your local government is not part of the problem.

Please confirm for me in writing as soon as possible that you have medical records for me from the late 1990s.
I am referring to records obtained for me in the context of my hearing capacity having been evaluated in person and a huge quantity of wax having been removed from each of my ears by ear, nose, and throat medical specialist Dr. Mueller (sp?). Dr. Mueller's medical clinic was situated at the Medical Arts Square near the UT-Austin Law School.
Thank you in advance for your very kind assistance on this, as I will need a photocopy of those medical records on behalf of the multi-million dollar lawsuit I will be filing against the individual or group of individuals or media company or other media entity that allegedly has inflicted injurious and slanderous noise pollution on me over a multi-decade period in Texas.
That unwanted noise pollution, as you are no doubt very aware, has inflicted severe permanent damage on my hearing capacity and medical health here in Austin----medical damage to myself for which I have never been financially compensated by any individual or media company or other business, or by any "educational" services provider or religious group or political group, or by any government-owned institution, for that matter, at any time.
I have resided in Austin proper on a continuous basis ever since mid-March of 1997. I have resided in Texas on a continuous basis ever since January of 1988.
In that regard, an Austin-based private attorney member of the State Bar of Texas has helpfully informed me this year that if I can identify the source of that noise pollution, I can file criminal-law as well as civil-law legal charges against himself or herself, or their corporation or business or non-profit group or other entity, at the earliest opportunity here in Austin.
I am very grateful to that attorney member of the State Bar of Texas for clarifying the point for me that I have that option of myself filing criminal-law charges as well as a lawsuit in a court of law against that individual or group of individuals allegedly guilty of inflicting continuous year-round noise pollution on me against my wishes in Austin-----noise pollution that pervasively and injuriously violated and violates my privacy rights in Austin, Texas, I might add.
Finally, I would like to ask your Travis County Medical Society if you happen to know the name of the individual or group of individuals or media entity or media company that has inflicted continuous year-round unwanted noise pollution on myself in violation of my privacy rights in Austin? That information will be invaluable to me in the resulting lawsuit and criminal charges that I will be filing here in Austin.

I would appreciate any reply letter from any of you officials about this very important human-rights issue relating to permanent and significant hearing loss inflicted on me by year-round, continuous noise pollution occurring against my wishes and without my consent over a multi-decade period, including at present, in Austin, Texas.
Just this morning, for instance, I suffered a ringing sound in my left ear when I awoke from my sleep inside my very nice apartment unit in northwest Austin.
Please note the cited medical findings (see below) from Dr. David Tobey, a nationally renowned ear, nose, and throat medical specialist in Austin, about the noise pollution-inflicted damage to my medical health in Austin, Texas, that he has statistically documented in the period since 2005. I should mention that 2005 was the very first year in which Dr. Tobey examined me inside his ENT medical clinic in northwest Austin.
Prior to that, a Dr. Mueller (ENT medical specialist based at Medical Arts Square near the UT-Austin Law School) statistically documented my hearing capacity in the late 1990s and removed massive quantities of wax from each of my ears during that medical appointment I had scheduled in advance with himself. Dr. Mueller has since retired, from what I understand.
Dr. Tobey has helpfully emphasized to me inside his medical clinic in northwest Austin that I myself am definitely NOT the source of the injurious noise pollution, nor did I cause it or request it or generate it, Dr. Tobey has helpfully pointed out.
I have provided written authorization to Dr. Tobey to discuss his medical findings about me with any person or organization or government official or attorney who might ever contact Dr. Tobey at any time.

Thank you for authorizing me today on the telephone to myself E-mail to you at State Rep. Donna Howard's legislative office in Austin the following (see below) exact verbatim text of a signed legal letter of mine to the FBI federal law-enforcement agency that I mailed to the FBI office in West Virginia by certified-delivery UPS mail on July 28, 2009.
I have since received official confirmation from the UPS that the FBI did receive this legal letter from myself, which also contained a photocopy of a certified statement from Dr. David Tobey, a first-rate ear, nose, and throat medical specialist in Austin. That certified statement from Dr. Tobey noted that I myself have sustained a medical disability in Austin, Texas, involving significant permanent damage to my hearing capacity.
Dr. Tobey stated to me on April 21, 2009, during my most recent medical examination by himself inside his medical clinic, that permanent damage to my hearing capacity caused by noise pollution in Austin, Texas, that I myself did not authorize or generate or cause---including, Dr. Tobey has repeatedly emphasized to me in person inside his medical clinic, noise pollution to which I have been subjected at my various respective workplaces during working hours for me in Austin---has been of the magnitude and severity that a police officer would sustain over the course of a multi-year career involving frequent exposure to the sounds of loud noises such as gunfire, Dr. Tobey stated to me on April 21, 2009, during that medical appointment of mine that day.
Dr. Tobey also stated to me during that visit of mine to his medical clinic on April 21, 2009, that he still has not determined the alleged source of that noise pollution determined to be injurious to myself, John Kevin McMillan of Austin, Texas.
My letter to the FBI (see below) also contained very recent fingerprint samples from myself obtained for me at my personal request by the Texas Department of Public Safety during a follow-up visit I made relating to my seeking to submit samples on my own to the FBI after I was told by Ms. Jo Lynn Brown, an official of a non-profit temp agency in Austin, Peak Performers, that matches individuals listed with that service to temp jobs with state agencies in Austin, that the Concealed Handgun and Licensing section of the DPS is not willing to employ me on a temporary basis due to cited "FBI" information relating to myself and some alleged incident in another U.S. state, Jo Lynn Brown of Peak Performers temp agency told me on July 28, 2009.

State Rep. Howard and Scott, I am very concerned about the possibility that the Texas Department of Public Safety state agency, a former employer of mine in Austin that never previously cited to me any "legal barrier" to my working for the DPS state agency in any context---and a state agency that has in fact granted me several job interviews this year for permanent positions of employment at the DPS, including in the Concealed Handguns and Licensing section-----has possibly subjected me to an allegedly illegal employment-related barrier or prohibition that discriminates against me or violates my legal rights in some manner.
I should emphasize to you that all communications to me about a cited prohibition from the DPS in regard to my working for a cited office of the DPS as a temp employee, came from Jo Lynn Brown of Peak Performers employment agency. It is possible that Jo Lynn Brown would have additional information at this time that she might be willing to share with you.
Peak Performers employment services matches job applicants listed with that service to temporary jobs, including some temp-to-perm jobs, with State of Texas agencies in Austin.
Thank you for any assistance or information about this very surprising "legal matter," that you are willing or able to offer me.
Incidentally, I should mention to you that I have also provided my congressman, U.S. Rep. Michael McCaul, with full and signed official privacy-related authorization to directly contact the FBI for me about this cited "criminal-law" matter.

My legal name is John Kevin McMillan.
During a brief period of 1986, I did have my name changed to Kevin John McMillan through a court appearance I made in the South Shore of Massachusetts for that one purpose. Later that year, I had that name change nullified through a follow-up court appearance of mine for that sole purpose.
I was born in Lincoln , Nebraska , on April 27, 1957. My social security number is .... I have been a single person throughout my entire life thus far: I have never been married to anyone.
The U.S. states where I have resided or lived for at least three consecutive weeks are: Nebraska , Texas , possibly Iowa during my youth, California , Georgia (during my high school years, only), Missouri , Florida , Minnesota , Massachusetts , and New York .
I am making this request today because I was told today for the first time ever by an official of a non-profit employment service in Austin, “Peak Performers,” that she has been told by an official of the Texas Department of Public Safety state agency in Austin, Texas, that there is an apparent criminal-conviction record or criminal-law matter in some other U.S. state that relates to myself, John Kevin McMillan, she told me today on the telephone and, later, during a visit of mine to “Peak Performers” employment agency.
That employment service official in Austin , Texas , made that very surprising statement to me in connection with a criminal background check that had been conducted relating to a planned “Peak Performers” temp-job placement for me with the Texas Department of Public Safety’s Concealed Handgun and Licensing Bureau in Austin.
I have since been informed by an official of the Texas Department of Public Safety in Austin that the “Peak Performers” employment service official apparently spoke with the Texas DPS Concealed Handgun and Licensing Bureau in Austin , Texas , in connection with criminal-history background checks on that planned temp-job placement for myself. The main phone number for the Texas DPS state agency in Austin , Texas , is: (512) 424-2000.
I did make a follow-up phone call to the “Peak Performers” employment service official who had informed me today that there is something on my own criminal-history record, she said. She did state to me in person at about 12:50 p.m. today inside her employment agency office that I am currently prohibited from working as a “Peak Performers” temp agency staff member for the Texas DPS, she told me at one point during a brief two-person meeting with that employment agency official. That “Peak Performers” official also told me in person today, after calling the DPS for me again from her employment agency office at 314 Highland Mall Boulevard, Suite 115, Austin, Texas, at about 12:40 p.m. today, this while I waited in the lobby of her employment service office, that she was told on the phone today by the DPS that an FBI check on me that had been routinely pursued early this month by the DPS in Austin had identified an apparent criminal-law violation by myself in a U.S. state other than Texas, the “Peak Performers” representative told me today. Please let me know if you would like more information about the circumstances in which I was provided with that very unexpected employment-related statement today by a Peak Performers representative. I would welcome the opportunity to elaborate about those circumstances.
I should also mention, by the way, that I have already provided Peak Peformers with a signed “medical disability” statement (enclosed) from a highly-esteemed ear, nose, and throat specialist, Dr. David Tobey of Austin , indicating that I myself have sustained significant permanent damage to my own hearing capacity over a multi-year period of residence in Austin , Texas . Dr. Tobey has informed me this year that he believes I did not authorize or generate or cause the noise pollution in Austin that he has determined (this over a multi-year period of his examining me inside his medical clinic) to have inflicted permanent damage on my own hearing capacity and medical health in Austin.
I myself have never owned any weapon in my entire life, and according to several Texas DPS-generated criminal-background reports on me that have been conducted at my request or an employer’s request in recent years, including this year, I have no criminal-conviction record.

I submitted a previous request from Austin , Texas , to the FBI for a complete criminal-history background check on myself about 10 years (?) years ago, and I was informed by your federal agency at that time that you had no record of any convictions against myself.
In your response to this informational request from myself, I would also appreciate your informing me of whether you have any record of ANY pending criminal-law charges or any previous or currently applicable criminal convictions against me of any type.
