Subject: Re: 10-29-20 request for proper procedure info on how I can obtain a rape-evidence exam on myself
Dear Austin 311 Staff Member Eboni,
Thank you for your helpful statement to me that I can obtain a forensic medical-evidence rape exam on myself by visiting a local hospital and reporting that I was sexually assaulted.
On Tuesday (October 27) of this week, I did exactly that and was very surprised that the emergency room physician at St. David's Medical Center near the UT-Austin Law School campus, Dr. Casey S. West, M.D., stated to me during a very brief meeting with me that he would not authorize a forensic medical-evidence exam on me.
Dr. West and a male nurse accompanying him, Don, also stated to me that "we don't do rape-evidence exams here" (approximate quote).
Dr. West did not examine my anus or genital area, despite my having changed into the proper medical gown for a forensic medical exam of that type in the first-floor room of St. David's, Room 24, where a female staff member had escorted me for the medical exam I had requested.
What option does a self-identified rape victim have under a circumstance in which the emergency room physician declines to authorize a forensic medical-evidence exam and also apparently also chose not to contact the Austin Police Department Sex Crimes Unit and directly consult them about whether they are willing to authorize a medical exam of that type on myself?
I mention this latter point because Dr. West made no reference to the Austin Police Department at any time during my exam, despite the fact that I informed him that earlier that day I had e-mailed to my APD District Representative, APD Officer Ruben Espinoza, two infrared motion-sensitive crime-evidence photos of suspected illegal intruders caught on camera inside my bedroom during my sleeping hours that Tuesday morning.
The male nurse accompanying Dr. West, Don, provided me with seven pages of green discharge papers from St. David's Medical Center at 5:45 p.m. Tuesday, October 27.
I then politely approached the nurses' station and asked to speak with a supervisor for Dr. West, and I also asked to speak with a patient-advocate representative. No such meeting with a supervisor or patient-advocate resulted from either request of mine. One male staff member at the nurses' station, "Kej" his self-identified name, stated to me that since I had been handed my discharge paperwork, "you (John Kevin McMillan of northeast Austin) are good to go." I then politely walked out of the hospital.
Do you have any suggestions on how I can be more successful next time at actually obtaining a rape-evidence exam on myself inside a local hospital here in Austin?
Best Wishes,
longstanding criminal-law complainant John Kevin McMillan in APD Sex Crimes Case 16-1340923 and other crime cases.

Subject: Re: 10-29-20 request for proper procedure info on how I can obtain a rape-evidence exam on myself

Dear Austin 311 Staff Member Niah,
Thank you for the referral (below) you offered me today to The Safe Alliance's Eloise House in south Austin for a forensic sexual-assault-evidence DNA-swabs medical exam on myself in the very near future.
As you may be aware, I am a self-identified victim of alleged continuous-and-continuing-daily-and-year-round sexual assault crimes and other alleged personal-injury-crimes allegedly being inflicted on me on a daily and year-round basis by alleged home-invasion-crimes perpetrators unbeknownst to me during my sleeping hours at nighttime as I lie alone on my own bed, asleep and unconscious and probably also snoring, inside my always-bolt-locked current solo-occupancy apartment unit in northeast Austin.
The link to a webpage for The Safe Alliance that you kindly shared with me today contains the following factual statement from that non-profit organization based in Austin: "SAFE’s Eloise House clinic provides 24/7 free sexual assault forensic exams and medical care." The other link you offered me was to the Attorney General of Texas state-agency website.
I did not see any reference in either link you provided me today to any option in which I as a complainant and crime victim can obtain a forensic rape-evidence medical exam on myself by a certified forensic nurse inside a hospital in Austin.
Niah, do you have any reason to believe that it is no longer possible for me (or any other self-identified rape victims in Austin, for that matter) to obtain a forensic rape-evidence exam on myself (or on themselves, in the case of those respective individuals) inside a local hospital such as the highly-rated and high-integrity Seton Medical Center in central Austin?
If the local-hospital-visit forensic-medical-exam option has in fact been discontinued by the City Government of Austin, do you know which vote of the Austin City Council---or which public-policy action by a City of Austin official, such as Austin Mayor Steve Adler, Austin City Manager Spencer Cronk, Austin Assistant City Manager for Public Safety Rey Arellano, Austin Police Chief Brian Manley, or APD Sex Crimes Unit head administrator Sergeant Sandra Benningfield----has possibly terminated the option for self-identified rape victims in Austin of their obtaining a forensic rape-evidence exam on themselves inside a hospital in Austin?
Thank you in advance, Niah, for your very helpful reply letter to me on these two follow-up questions.
Sincerely and Best Wishes,
John Kevin McMillan, longstanding criminal-law complainant with the Austin Police Department in APD Sex Crimes Case 16-1340923 and other alleged-sex-crimes-and-personal-injury-crimes cases here in this state-capital city for Texas.
