Dear Open Records Coordinator for the Texas Commission on Law Enforcement (TCOLE) state agency,


This is Texas Open Records Request in which I am seeking a copy of any and all computer records, e-mail communications, reports, findings, or other documents that at any time since April 28, 2011,  were written, generated,  received, forwarded, or sent  by your online Webmaster, or by TCOLE Enforcement Specialist Darla Dixon, or by TCOLE General Counsel and current Interim Director John Beauchamp, or by TCOLE Enforcement Major and former  Austin (TX) Police Department Officer  TJ Vineyard, or by TCOLE Enforcement Captain Doug Skolaut, and that in  each such case stated that I myself was victimized by a felony  sexual assault crime or by a special victims unit crime or by some other felony crime.


Not included in the scope of this request are  e-mail communications or letters that I myself wrote and sent to your state agency in Austin.


My legal name is John Kevin McMillan. I was born in April 27, 1957, in Lincoln, Nebraska. 


I most recently resided in Austin, Texas, on a continuous basis from mid-March of 1997 through the morning of December 31, 2021.


In the late 1990s, when I resided as a tenant living alone inside  a fully locked efficiency apartment  at ViewPoint Apartments and complained to Austin Police about home-security issues for me inside my locked solo-occupancy unit near the University of Texas campus in west Austin, I received a helpful signed reply letter on official Austin Police Department letterhead stationery from Austin Police Officer TJ Vineyard, then a Community Liaison Officer for the section of Austin where I resided.


In that letter, Officer Vineyard assured me in writing that "you (John Kevin McMillan)  are not required to have a relationship with anyone" (approximate quote). It is possible, though,  that Officer Vineyard  made that particular statement to me in a telephone conversation he had with me during that time period. I kept a copy of the politely worded signed  letter to me from Officer Vineyard, but I was not able to find that letter  tonight inside my current apartment unit in Utah.


I have used the personal e-mail address of mcmillanj@att.net throughout the entire  time period applicable to this public information request.

Based on very helpful advice I received from two respective Austin Police Department officers, I relocated by commercial airplane flight  from Austin, Texas, to Salt Lake City, Utah, on December 31, 2021. 


In Salt Lake County, Utah, I resided as a rent-paying occupant or tenant inside a locked solo-occupancy unit I rented at  two respective "Extended Stay America" chain hotels--- one of them in the Sugarhouse section of  Salt Lake City, Utah and,  later, a  Sandy, Utah, location (generally instead cited online as a "Midvale", Utah, location)   of that hotel chain that is situated at 7555 South Union Park Avenue in Sandy---before I moved into a solo-occupancy rental quadraplex apartment unit with the full exact address of "6819 South 1300 East, Cottonwood Heights, Utah, 84121". I moved from that quadraplex unit into  a solo-occupancy unit (below) inside an 11-story HUD-subsidized and HUD-inspected senior citizens apartment building in Salt Lake City on June 1, 2022.

Your reply letter to me today apparently also indicates that your state agency in Austin has not had any role in the  training or re-training of  one or more current or expected future  certified peace  officers or crime lab staff members  of the Austin (TX) Police Department in any context that referred to myself, John Kevin McMillan, as having been or being the actual victim of one or more confirmed felony Home-Invasion  Somnophilia-Sexual-Assault Crimes and other Personal-Injury Crimes during my sleeping hours as I lay alone on my bed inside my locked rental apartment unit in Austin, Texas.

My legal name is John Kevin McMillan. I was born in April 27, 1957, in Lincoln, Nebraska. 


I most recently resided in Austin, Texas, on a continuous basis from mid-March of 1997 through the morning of December 31, 2021.


In the late 1990s, when I resided as a tenant living alone inside  a fully locked efficiency apartment  at ViewPoint Apartments and complained to Austin Police about home-security issues for me inside my locked solo-occupancy unit near the University of Texas campus in west Austin, I received a helpful signed reply letter on official Austin Police Department letterhead stationery from Austin Police Officer TJ Vineyard, then a Community Liaison Officer for the section of Austin where I resided.


In that letter, Officer Vineyard assured me in writing that "you (John Kevin McMillan)  are not required to have a relationship with anyone" (approximate quote). It is possible, though,  that Officer Vineyard  made that particular statement to me in a telephone conversation he had with me during that time period. I kept a copy of the politely worded signed  letter to me from Officer Vineyard, but I was not able to find that letter  tonight inside my current apartment unit in Utah.


I have used the personal e-mail address of mcmillanj@att.net throughout the entire  time period applicable to this public information request.

In Salt Lake County, Utah, I resided as a rent-paying occupant or tenant inside a locked solo-occupancy unit I rented at  two respective "Extended Stay America" chain hotels--- one of them in the Sugarhouse section of  Salt Lake City, Utah and,  later, a  Sandy, Utah, location (generally instead cited online as a "Midvale", Utah, location)   of that hotel chain that is situated at 7555 South Union Park Avenue in Sandy---before I moved into a solo-occupancy rental quadraplex apartment unit with the full exact address of "6819 South 1300 East, Cottonwood Heights, Utah, 84121". I moved from that quadraplex unit into  a solo-occupancy unit (below) inside an 11-story HUD-subsidized and HUD-inspected senior citizens apartment building in Salt Lake City on June 1, 2022.

Dear Salt Lake City Police Department Lt. Todd Mitchell,

Shortly after 3 p.m. today (Wednesday, Feb. 28) along Main Street near 400 South and near 300 South, respectively, I had two separate brief outdoor conversations with two very polite and idealistic younger gentlemen who wore Downtown Alliance uniforms.

Based on my conversations outdoors  today with those two  gentlemen---one of them a  tall black-haired Downtown Alliance male employee   named "Creed" and the other  a blond-haired white male Downtown Alliance employee----I was informed today (and the quotes below are only  approximate quotes and rough notes  from memory, since I was not taking notes on this) that:

----the Downtown Alliance "does not work with the City of Salt Lake City (municipal government)" and instead serves and is employed by  a Downtown businesses group that seeks to "improve the downtown business scene."

(I myself, downtown resident John K. McMillan,  find it very surprising that possibly  the Downtown Alliance here in Salt Lake City  does not have any official ongoing contact liaison with the Salt Lake City Police Department or Salt Lake City Mayor Erin Mendenhall, and possibly  does have any official Downtown Alliance  representative who  gives regular in-person  reports to the Salt Lake City Council at Council meetings.)

----The very dangerous and often lethal illicit drugs "Spice" (exact quote) and "Fentanyl" (exact quote) are frequently consumed by homeless persons lying or standing  on the grass directly across the street from and a matter of feet west of the outdoor platform of the Utah Transit Authority  Courthouse train station---a platform on which UTA passengers wait for incoming southbound or northbound trains. That train station is  located at 450 South Main Street  here in downtown Salt Lake City.

Often the homeless persons who consume "Spice" or "Fentanyl" outdoors across the street from the western side of the Courthouse train station experience major  harmful side effects from those dangerous illicit drugs and fall  unconscious outdoors on or near  a grassy area bordering South Main Street from the west.

-----Even if Salt Lake City Police were to arrest homeless persons at that outdoor downtown location for the alleged purchase or possession of or possible trafficking of an illicit drug, "those  homeless persons would get  out of jail very quickly and go right back to their outdoor illicit- drug activities across the street from the UTA Courthouse train station".

-----"We have tried to lobby for providing drug- addiction treatment programs for drug-addicted homeless persons from downtown who get arrested and are being held inside local jail facilities," Creed stated.  "But so far we have not been successful at achieving that goal."

-----"The other major illicit-drug crisis very close to the UTA Courthouse train station involves individuals who shoot up with heroin (exact quote) along 400 South near or at 200 (?) West, a few blocks northwest of the UTA Courthouse train stop."

----"I would estimate that  65 percent  (exact quote) of the homeless persons here in downtown Salt Lake City are illicit-drug addicts, and 35 percent of the homeless persons here in the  downtown area  are not drug addicts," Creed stated.

---"We try to focus on helping the homeless persons who ARE motivated to improve their own living conditions. Many of the homeless persons we speak with show no interest in improving their own living conditions," Creed stated.

---"It is painful for me to talk with  so many homeless persons who are suffering here in downtown Salt Lake City," Creed stated.

The Division of Water Resources has released the Great Salt Lake Basin Integrated Plan. Clyde Snow provided a Water Policy Inventory & Assessment for the project. It’s two parts – a Water Policy Narrative and an interactive Matrix of all of the laws, administrative rules, program websites, administrative forms, and related recommendations passed in the last several years. I personally find the Matrix the most helpful.

Subject: Should UT DPS Coordinate Statewide Youth Gang Prevention?

Dear Utah State Legislature House Majority Leader Mike Schultz,

Thank you again for having invited me in writing on November 27, 2023, to send you additional brainstorming  letters about concerns of mine relating to Utah.

I am concerned that at present possibly there is no adequate statewide coordination of a system for evaluating the level of effectiveness of each of the respective Gang Prevention Programs for  each of the public school districts here in Utah.

I would like to respectfully raise the question of whether you believe that the Utah State House under your fine leadership should provide additional funding to the Utah Department of Public Safety state agency for statewide  coordination of  Gang Prevention enhancement  efforts at public schools throughout all of Utah.

I mention the Utah DPS partly because many of the illicit youth gang activities are occurring away from public school  campuses. 

I am  hopeful that the Utah DPS could  be assigned legal authority by the Utah State House to routinely compile an official Utah DPS report for each and every shooting or bomb threat that occurs at a public school  in Utah.  Each such report could specifically state whether that violence on a campus or threat of violence on a public school campus was Illicit Youth Gang- Related.

The current supervisory role  by the Utah State Board of Education in Gang Prevention (below, first two online links) is  very limited and indirect in nature. 

This reminds me that I am personally not sure whether the Utah State Board of Education currently employs any  certified peace officers with expertise on juvenile criminal justice issues.

The proposed annual or semiannual  evaluation by a "Utah DPS Statewide Gang Prevention Office" of Gang Prevention programs at all public schools in Utah could be accompanied by training assistance from the Utah DPS for increasing the effectiveness of each Gang Prevention Program for any school district where the local program is determined to be unsuccessful.

I would also like to point out that the "National Gang Center" (below, third online link) of the U.S. Department of Justice might help Utah public schools obtain additional federal funding for enhancing Gang Prevention efforts at  public schools in Utah where current Gang Prevention programs are ineffective.

 Possibly the Utah DPS could be provided with additional funding by the Utah State House  to conduct statewide studies or countywide studies on behalf of  illicit-youth-gang deterrence efforts.

After visiting the Salt Lake City Main Library today and pursuing online factual  research there about cocaine, I need to correct my statement below in which I paraphrased a recent  in-person  comment to me  by a Utah Transit Authority (UTA) train operator.

I now believe that the UTA train operator who spoke with me had stated that numerous  teenage passengers on UTA Green Line trains SMOKE cocaine inside those  trains. (The UTA train operator also stated to me that the teenage cocaine smokers on UTA Green Line trains attempt to conceal their activity by using a special  large coat that they are each wearing for that purpose.)

I am making  this "smoke cocaine" correction  because  the UTA train operator whom I spoke with told me that "I can smell it (the evidence of cocaine consumption) from my cab (where the operator is stationed while on duty)."  

It is possible that the UTA train operator who spoke with me about this issue also used the word "crack", as in "crack cocaine".  I was not taking notes when I spoke with him outdoors for a matter of seconds here in Salt Lake City. 

I myself take pride in having never consumed any cocaine on any occasion in my entire life. 

I would like  to help  promote a significant reduction in cocaine consumption levels  throughout all of Utah. I strongly support very affordable (or free) and very successful   "cocaine-addiction treatment programs" for as many Utahns under age 30 as possible, possibly with help from additional Utah State Legislature  funding toward that very crucial societal goal for our entire state.

I hope this combined  correction and follow-up note  is helpful.

 I greatly appreciate the courageous in-person report I received n the last few days from a Utah Transit Authority (UTA) train operator that there is a major problem of teenage UTA Green Line passengers in the Salt Lake City area snorting crack cocaine while riding on  Green Line trains.

Does your  Salt Lake City Police Department have the option of  requesting and obtaining official permission from UTA to assign undercover SLCPD Narcotics Investigators to ride incognito in those Green Line trains that travel in Salt Lake City, including on  Green Line routes to and from  the Salt Lake City Airport?

Thank you for your prompt reply letter (below).

I was very surprised and disappointed  by your statement to me today that the Texas Rangers Division of your very influential  Texas DPS state law enforcement agency does not have any record generated or received by the Texas Rangers that refers to me in either 2011 or 2021 as having myself been the victim of a felony crime in Austin, Texas, or elsewhere in Travis County, Texas.

Calendar year 2011 and calendar year 2021 were very significant years for me as a criminal-law complainant and self-identified crime victim in Austin, Texas.

 Two DNA-traces  medical evidence  rape kits were obtained from me by two respective  forensic nurses in 2011: on April 28, 2011 (APD Case 11-1180447), and in the early morning hours of December 22, 2011, for a December 21, 2011, APD sex crimes case  (APD Case 11-3550615).

In addition, one forensic DNA swabs sexual assault medical evidence kit was obtained from me by a forensic nurse  in the early morning hours of September 2, 2021, for a sex- crimes case that first-rate  APD Sex Crimes Detective William Costello officially  activated for me on September 1, 2021. The official ID number for that sex crimes case is: APD 2021-2440624.

Each of those three respective sexual-assault- evidence rape kits were reportedly processed by a crime lab in Austin of your  Texas DPS, with the Austin Police Department Sex Crimes Unit having reportedly received each of the three respective full and complete Texas DPS Crime Lab  reports from your state agency's  processing of each those three separate  rape-evidence kits.
