Maybe he is also the owner of a Chinese-Italian restaurant in that same city. If so, I would love to find out how he combines China and Italy in the dishes he offers. Sweet and Sour Chicken Pizza is probably one of his menu items, but that's just a guess from someone who has never been to Chino myself."

Your July 25, 2018, e-mail reply letter appears to indicate that NONE of the following (below) applicable legal documents I myself have received from City of Austin officials and then later provided to you as a courtesy to each of you City officials in connection with my July 14, 2018, Open Records request to the City, are on file anywhere with the City Government of Austin.

I would like to remind you that the scope of my July 14, 2018, Open Records request to the City of Austin and the Austin Police Department was very clearly and specifically limited to: 

 "any e-mail communications or letters generated or written or sent or forwarded or FAXed or mailed at any time since 12:01 a.m. April 17, 2011, by any assistant police chief or any police chief or interim police chief of the Austin Police Department (APD), or by anyone employed in the Office of the Police Monitor for the City Government of Austin, or by any anyone employed in the office of the City of Austin Assistant City Manager in charge of supervising APD operations, and that, in each such case, referred at least once in any manner or context to myself, John Kevin McMillan of northwest Austin."

I would also like to respectfully remind you that each of the following legal documents I received within the applicable multi-year time period via e-mail or e-mail attachment (the full text of the cease and desist order from Police Monitor Margo Frasier that I received) appear to be responsive to the above-cited public-information request from myself. 


Please note that the following legal documents (below) are listed in chronological order, from earliest date to most recent date.

May I politely ask you at this time whether any City of Austin official or APD official or APD officer unbeknownst to me has ever at any time since April 17, 2011, allegedly ordered or allegedly perpetrated the destruction or deletion from your City of Austin Internet files or computer files or APD Internet files or computer files of any of the following applicable legal documents that were each generated by applicable City of Austin officials during the most recent seven-year period?

If so, I will gladly provide full legal documentation to the City of Austin and to APD, respectively, for each and every one of the legal documents I received via e-mail from each of the cited City Government of Austin officials.

Each of those legal documents, I might add, are currently on file in my own internet records through my first-rate AT&T internet service that I have relied on as my internet provider throughout the entire seven-year period applicable to my July 14, 2018, public-information request to the City.

Those legal documents include one legal document that originated in a context in which an APD officer and work supervisor, APD Sergeant Michael King, presented himself in writing as being my own City of Austin-designated "contact" person with the Office of the Police Monitor, and in that context clearly indicated in writing that he himself directly represented the Police Monitor at the time when Sergeant King reportedly wrote and sent me the cited (below) May 12, 2014, e-mail letter.

You made that comment to me after I responded to a question from you by stating that I myself have experienced what I regard as allegedly unsafe housing conditions in northwest Austin on a continuous daily and year-round basis for several consecutive years, including at present, regardless of the apartment complex where I have resided as a rent-paying tenant at any time during that multi-year period.

I also mentioned to you in our July 16 phone conversation that I have been awakened abruptly inside my bolt-locked apartment unit several times per early-morning period in the middle of my nocturnal dreams.

As I also stated in response to a question from you, my being awakened abruptly several times per early-morning period has been repeatedly and consistently accompanied by an unpleasant nasal-inhalant sensation in my nostrils, often an unpleasant oral-inhalant or oral ingestion sensation in my mouth, and an unpleasant and very mysterious vibrating sensation in my anus, as well as an urgent need for me to go to the bathroom. I myself do not own any vibrator of any type.

I might add at this time that I also consistently experience a wobbliness in my legs and a tingling sensation or numb sensation in my legs when I get out of bed in the middle of my sleeping hours in order to use the bathroom after experiencing a sudden need to urinate just after I was awakened abruptly without anyone else visible to me anywhere inside my bolt-locked apartment unit.

I also want to thank you, Ms. Salas, for directly referring me to the Austin Police Department Sex Crimes Unit during our July 16 conversation.


You made it reassuringly clear to me that your direct referral for me that day to that APD unit directly authorized me to myself provide that APD unit with updated factual information about the alleged continuous personal-injury-crimes and alleged continuous anal-rape crimes to which I have been subjected against my wishes on a daily and year-round basis inside my bolt-locked apartment unit in Austin.

They are alleged felony crimes to which I am being subjected on a year-round basis during periods when I am lying alone (and I ALWAYS sleep alone), asleep and unconscious and probably also snoring, on my own bed inside my bolt-locked apartment unit. I am currently the ONLY current tenant and only current resident inside this third-floor, top-floor rental apartment located on the southeastern side of Building 16 at Village Oaks Apartments in northwest Austin.

With your kind help in connecting me from your end of the phone line with a 311 phone service dispatcher for the City of Austin, I was then referred by that helpful female dispatcher, Cynthia, to the voice-mail message-taking system at the APD Sex Crimes Unit for my primary 2017 contact person at that APD unit, Sergeant Martina St Louis.

I have not heard back yet from Sergeant St Louis or any of the detectives for that APD unit.


I remain hopeful, though, that APD as soon as possible will be willing to install---with my full advance authorization on that---a secret surveillance camera focused on my bed area inside the partitioned section of the living room where I sleep every night. I want that surveillance camera to provide instantaneous photo documentation to APD's Sex Crimes Unit about any alleged illegal intruder or personal-injury crimes perpetrator situated on or near my bed during my sleeping hours.

That photo documentation will then be invaluable crime evidence for Travis County District Attorney Margaret Moore in pursuing long-awaited criminal prosecutions on my behalf in a court of law here in Austin.

I might add that I welcome any and all forensic DNA tests or non-psychiatric exams on any portion of my own body that APD might ever want to authorize or request or sponsor at any time.

I am very definitely a first-rate and very solid criminal-law complainant. I welcome the opportunity to provide very solid testimony as a complainant and cited crime victim when I make my long-awaited visit to court of law in Austin, Texas, in order to myself testify against one or more cited defendants unbeknownst to me.

Finally, do you have any additional suggestions that you are willing to offer me during this period in which I still have not heard back from the APD Sex Crimes Unit?

Two Austin Police Department officers knocked on the front door of my apartment unit yesterday morning and indicated to me in person that one or more members of the Austin City Council had reportedly been offended by infra-red spy-camera photos those City Council members apparently viewed that had been taken on my own behalf inside my bolt-locked and apparently-secured, top-floor, vaulted-ceiling, private one-bedroom apartment unit in northwest Austin.

I am referring to the 20 total infra-red-camera spy-camera photos that were recently E-mailed by myself to several Austin City Council members as cited attachments to a courtesy-carbon-copy I sent to yourself and several of your City Council colleagues of a letter of complaint I'd written and E-mailed to the Office of the Police Monitor for the City of Austin.

That letter of complaint from myself related to my very emphatic belief that the Austin Police Department has failed to adequately investigate the several criminal-law complaints I've filed with APD ever since April 28, 2011.

Those crime-reports from myself referred to alleged flagrantly-illegal physical abuse of myself and alleged personal injury to myself by one or more illegal intruders inside my bolt-locked apartment unit ---- alleged physical abuse and alleged personal injury of myself and alleged flagrant violations of my own privacy rights that allegedly occurred on a daily and year-round basis during my nocturnal slumber, with myself always having slept alone on my Swedish bed at the time of those cited alleged criminal-law incidents.

The two Austin Police Officers who visited my apartment unit yesterday each stood on the outdoor balcony in front of my apartment unit (Apartment 325 at Wind River Crossing) on Thursday morning (May 24), with one of the two officers, APD Officer James Turner (APD Employee Number 5980), repeatedly and with very apparent anger toward me in his voice and demeanor demanding from the outdoor balcony that I "cease and desist" (exact quote of that APD officer's words) from myself ever again sending any more spy-camera infrared-photography photos of any type on my own behalf to any current member of the Austin City Council.

The APD officer who stood with Officer Turner on the outdoor balcony of my apartment unit yesterday morning was APD Officer Donnie Williamson (APD Employee Number 1619).

The infra-red photographs to which that APD officer referred were taken on my behalf by an infra-red spy camera (also known as a "hunter's camera") that I purchased earlier this year at an Academy store in northwest Austin.

Council Member Riley, did you or one of your staff members ever at any time ask the Austin Police Department to send one or more APD officers to visit my apartment unit yesterday and then state to me that I am myself forbidden from ever again at any time sending to ANY current member of the Austin City Council ANY of the spy-camera photos that have been taken on my behalf inside my bolt-locked and apparently secured apartment unit by an infra-red photography camera owned by myself?

Thank you for your reply note (below) in regard to conduct exhibited toward me by APD Officer Adam Best during a January 20, 2014, visit he made to my apartment unit on behalf of APD in which he spoke with me inside my private bedroom.

In regard to the quote you directly attribute to Officer Best --- "I am not forbidding you (John Kevin McMillan) from calling (APD about your being a self-identified victim of alleged anal rape during your sleep inside your bolt-locked private bedroom of your bolt-locked apartment unit)", with parenthetical clarifications added by myself at this time in this context --- are you completely sure that that is an exact quote of a comment that Officer Best actually made to me during that police officer's visit to my rental apartment unit?

I am posing this one follow-up question to you partly because I do not recall any such words having been verbalized to me by Officer Best during his January 20, 2014, official visit to my apartment unit on behalf of APD.

Sergeant White, your presumably diligent review of the cited audio-video recording of Officer Best's January 20, 2014, on-duty visit to my rental apartment unit should have also provided you with factual evidence that Officer Best repeatedly and emphatically and with anger or indignation in his tone of voice emphasized to me inside my private bedroom that my repeatedly calling 311 or 911 over a multi-year period to report alleged anal-rapes of myself during my sleep inside my bolt-locked private bedroom of my bolt-locked apartment unit had comprised a major and very annoying and enraging nuisance to the Austin Police Department and the City of Austin, Officer Best emphatically stated to me during his visit to my apartment on January 20, 2014, inside my private bedroom.

I might point out with emphasis that I myself always bolt-lock and chain lock and lock the front door of my apartment unit, Apartment 325, every night before I retire to my private bedroom where I always sleep alone on my bed.

I am the only person who is supposed to be inside my bolt-locked private bedroom during periods when I am sleeeping.

My strictly-platonic-at-my-insistence-and-his-repeatedly-stated-agreement-on-that older male roommate ever since April 27, 2013, Mr. "John Douglas Martin," chose to place his own bed in the living room on April 27, 2013, and he has kept his own bed in that particular room of our apartment unit ever since then.

Mr. Martin always sleeps alone with his tiny-headed cat in the living room during the periods when I myself am sleeping alone in my bolt-locked bedroom, Mr. Martin has repeatedly stated to me over a multi-month period, with himself also assuring me repeatedly over a multi-month period hat he himself NEVER enters my private bedroom during periods when I myself am sleeping, and that he never knowingly permits anyone else to somehow 'enter' my bolt-locked and fully-secured private bedroom during my sleeping hours, he has also repeatedly stated to me inside this apartment unit.

I maintain that APD Officer Best's agitated and hostile demeanor toward me and his coments to me during his January 20, 2014, two-person conversation with me inside my private bedroom conveyed a very apparent warning of reprisals against me by APD or the City of Austin if I myself ever attempted to call APD at any time subsequent to January 20, 2014, to make any 311 or 911 phone call about my being a victim of alleged anal-rape during my sleep that particular night --- or about my being a victim of alleged rape in any other context, Officer Best apparently indicated.

One private attorney in Houston whom I frequently consulted in 2011 and 2012 and early 2013 on the telephone reminded me during a consultation I had with him in December 2012 or January 2013, at the latest, that any and all official intimidation or "offiicial repression", I believe the actual term was that he used, by a law-enforcement officer toward me could be an alleged possible violation of the law by that law-enforcement officer.

I have reviewed the report and the audio/video recording of the incident under case number 14-0200747. Officer Best clearly states that “I am not forbidding you from calling.” Officer Best suggested to you that “you need to stop calling for this event,” however, “if you have locked your door and it is broken in the morning, or there is some amount of evidence that furthers something then yes you need to call us, or if you want to speak with a mental health officer then yes we will come out and talk with you.”

I find no evidence that Officer Best has prohibited you from calling 911.

Dear APD Sergeant White,

I would like to thank a distinguished colleague of yours, Administrative Specialist Claudio A. Martinez of APD's Central Records Division, for having kindly typed and mailed to me a signed April 28, 2014-dated reply letter on official City of Austin stationery that cited yourself as the immediate supervisor of APD Officer Adam Best.

I received that reply letter from Mr. Martinez in my Postal Service delivery this Wednesday, April 30, at my designated apartment complex unit mailbox.

That reply letter from Mr. Martinez was in response to an online Texas Open Records request I had submitted to the Austin Police Department that was officially received by APD on March 31, 2014, according to Mr. Martinez's reply letter to me. The official identification number on my March 31 Open Records request was ORR# 3-07574, according to Mr. Martinez's signed reply letter to myself.

Sergeant White, I would appreciate it if you would please review the official report written by APD Officer Adam Best in regard to APD crime report
14-0200747 that I myself initiated through a home-security-check-request 311 phone call I made to your law-enforcement agency on Monday, January 20, 2014.

I am assuming that APD Officer Adam Best in his report about his on-duty visit to my rental-apartment unit on January 20, 2014, stated in writing that he asked me during his visit to "stop calling us (APD)" (exact quote) with any additional crime report to APD about myself (John Kevin McMillan) being victimized by ANY alleged anal-rape crimes during my sleep as I lie alone on my bed inside my bolt-locked private bedroom in my rental apartment unit at Wind River Crossing Apartments in Austin, this according to what Officer Best emphatically warned me in person on January 20 as he spoke to me inside my private bedroom.
Sergeant White, do you yourself believe that Officer Adam Best has the legal authority to speak on behalf of your entire municipal police department in that particular context?

If not, does this also imply that you yourself are now inviting me in the present and future to myself feel free to call 311 or 911 at any time to report the most recent factual daily evidence observed by myself that I was in fact victimized by alleged anal-rape crimes during my sleep as I lay alone on my bed inside my bolt-locked private bedroom of my apartment?

Also, do you believe that any and all police officers under your supervision should generally refrain from stating to a gainfully-employed, civil and law-abiding and polite, always-sober and teetotaling, and tactfully-honest single adult private citizen such as myself that the latter individual is "prohibited" by that police officer from ever again calling 311 or 911 to report the most recent evidence about that same private citizen---myself, for instance--being victimized by a cited category of crime such as alleged anal-rape during that private citizen's sleep.

John Kevin McMillan, a self-identified victim of alleged continuous-and-still-to-this-day-continuing alleged anal-rape-crimes during my sleep on a frequent and daily and year-round basis as I lie alone and sleep alone on a bed I own inside my bolt-locked private bedroom of my rental apartment unit at Wind River Crossing.

I might add that my only current apartment management-team-approved roommate, a heavyset older man named "John Douglas Martin" who is currently unemployed, always sleeps alone with his tiny-headed cat in the living room of this apartment unit.

My relationship with that older man is, of course, strictly platonic and with ZERO physical contact, as I have repeatedly emphasized to him, including when I interviewed him as a prospective roommate for me in March 2013 inside a nearby Schlotzky's chain restaurant.

Mr. Martin moved into my top-floor, vaulted-ceiling, one-bedroom and four-total-room rental apartment unit on April 27, 2013, after his application to room with me passed a reportedly thorough criminal-background check and overall background check, including a credit-history check, by the polite management team here at Wind River Crossing.

Mr. Martin has stated to me many times that he fully honors my own privacy rights and never attempts to enter my bolt-locked bedroom during periods in which I am sleeping on my bed inside my bolt-locked bedroom.

I myself always make sure that the front door of the apartment unit is locked, bolt-locked, and chain-locked before I retire to my bedroom at nighttime.

I also triple-check every night just before I go to bed to make sure that all seven of the currently-functional locks and currently-functional bolt-locks to my private bedroom are secured properly.

One of the new bedroom locks that I had installed by a friendly adult male restaurant-coworker of mine at Denny's Lakeline, Eduardo Arreguin, inside my bedroom on January 5, 2014---a lock to my very large accordion closet of my bedroom, my primary closet in my bedroom----has not been functioning properly for me ever since late March 2014.

I mentioned in my standard diary entry for Monday, March 24, 2014, that I discovered at about 12:50 a.m. that Monday, March 24, that I was not able to secure the lock to my accordion closet anymore.

That is the only lock in my bedroom that I have not been able to properly secure at any time in the entire period ever since and including March 24, 2014. I myself do not fully understand what might have caused the current difficulty I am experiencing when I attempt to secure that lock to my accordion closet in bedroom, and my attempt fails.

APD Officer James Turner, the APD officer who reportedly had been assigned as the "detective" on that cited crime case according to a City of Austin employee I spoke with on the telephone, informed me on the telephone on Monday, June 10, 2013, that he (Officer Turner) had authorized the prompt destruction of any and all of the crime evidence from myself that APD Officer Dean Tran on May 28, 2013, had himself obtained from inside my and my new roommate's rental-apartment unit (Apt. 325 at Wind River Crossing) in connection with my APD Crime Report 131441002.

The crime evidence from myself which APD Officer Tran in a politely professional manner obtained for APD in response to a polite request from myself inside my apartment unit on May 28, 2013, included:

---two plastic jugs of milk, at least one of which had an unpleasant aftertaste to it when I drank milk from that jug in early May 2013, even though I had not noticed any such unpleasant aftertaste when I first opened that jug of milk to drink some milk from that jug;

---one bag of soggy bread I had eaten that had a very unpleasant and very surprising aftertaste to it, even though I had not noticed any such aftertaste when I ate that bread for the first time; the medical report issued to me that stated I had tested positive for arsenic in my urine;

----the early May of 2013 sales receipt from H.E.B. Braker Lane supermarket in northwest Austin for the cited one loaf of whole-wheat H.E.B.-brand bread that I had purchased in that retail store owned and operated by H.E.B. Supermarkets of San Antonio, Texas.

---one bedspread, one fitted bed sheet, and one regualr bed sheet that had each been lying on my orthopedic Swedish bed in my private and locked bedroom for many consecutive months in 2012 and 2013, and that each contained numerous identifiable stains on them that I emphasized to Officer Tran could provide APD with possible criminal-law DNA evidence of a suspected illegal intruder in Apartment 325 at Wind River Crossing. That illegal intruder, I pointed out to Officer Tran inside my apartment unit on May 28, might also be the criminal person who allegedly put arsenic in one or more of my foods or beverages inside my apartment unit at Wind River Crossing.

The cited stains on those bed linens had accumulated over a multi-month period in 2012 and 2013, something that my first-rate primary care physician's office in northwest Austin had very helpfully authorized me to permit during that one particular time period, with the understanding that I would myself be taking showers in my bathroom on a nightly basis just before I went to bed at nighttime inside my private bedroom during that same multi-month time period..

---a May 2013 reliable and authoritative medical report on myself which stated that I had myself tested positive for arsenic in my urine earlier that month----this despite the fact that I myself do not know what arsenic looks like, I have never purchased or possessed any quantity of arsenic in my entire life, I myself definitely would NEVER knowingly consume any quantity of arsenic at any time, and I myself have a very strong will to live and to myself enjoy the best possible medical health and creative medical vitality in the present and throughout the remaining several or more decades of my own life.

Finally, I would appreciate your please providing me with the official case number you have assigned to your office's planned investigation of my legal complaint against APD Officer Turner in regard to this alleged crime case involving suspected foul play by one or more persons unbeknownst to myself that allegedly victimized myself, John Kevin McMillan of Austin, Texas.
