In our approximately five-minute or 10-minute phone conversation this morning, you very helpfully informed me for the first time ever that you have contacted the Travis County District Attorney's Office and the Texas Restaurant Association about the cited crime case in which I am definitely a victim inside my bolt-locked apartment unit at Wind River Crossing Apartments.

You also stated to me that you have chosen NOT to share the contents of my E-mail (below) to you about the cited crime case with either Mike or Amada or any of your other assistant managers or shift leaders--- or any other member of your staff, you indicated.

You also emphasized to me that none of your staff members at your particular location reside anywhere close to your Schlotzsky's restaurant, and for that cited reason none of them would have ever at any time heard any rumors or information about (, you indicated, or had any direct alleged possible involvement of their own of any type in) the cited felony-crimes case in which I am myself a continuing victim, you emphasized to me today.

I did mention to you today about my hope that possibly some of your customers unbeknownst to me might have possibly made oral statements inside your restaurant about the cited crime case---comments that that were either directly heard or overheard by you or a member of your staff, I stated.

Also in our phone conversation today, you asked me to please refrain from ever again myself discussing the cited crime case inside your restaurant with any of your managers or staff members. You emphasized to me that that type of unpleasant and stressful topic, you indicated, should not be discussed any further inside your location's restaurant environment.

For the record, the only members of your staff whom I can currently recall having myself inside your restaurant discussed the crime case with are your management team members Mike and Amanda, and yourself.

I replied to your first-time request of me on the phone today by politely assuring you that I will of course refrain from ever myself while inside your restaurant ever again discussing the cited felony-crimes case in which I am definitely a victim with any member of your staff at any time in the present or future. The only possible exception to that, I politely added, is if a member of your staff directly directly poses a question to me about the crime case in which I am a continuing victim. You did not cite any objection to my offering an honest answer if a question of that type is ever directly posed to me by any member of your management team.

You also advised me in our phone conversation today that you believe I may have to lawfully and in a civil manner...(terminate my co-tenant roommate involvement with) my current roommate, a male adult older person whom I had met for the first time ever in March 2013 when I interviewed him on two separate occasions inside your Schlotzsky's location. I agreed to meet with that individual inside your store (a location I had cited to him because your store is very close to where I live) only after he had responded in writing to a wholesome roommate-wanted ad of mine on Craigslist. In my roommate-wanted ad, I had emphasized in writing that I was seeking an honorable and law-abiding strictly-platonic-relationship (zero-physical-contact) roommate for myself.

During the two separate interviews I had with that heavyset older man inside your location, I might add at this time, that prospective new roommate for myself repeatedly stated to me that he would definitely contact the Austin Police Department on my own behalf if he himself ever observed any evidence of any alleged illegal intruder inside this particular apartment unit at Wind River Crossing.

Also in our phone conversation this morning, you very kindly offered to yourself contact the Austin Police Department on my behalf about the cited crime case in which I am a victim.

I politely replied to your statement that the current investigation by the Travis County District Attorney's Office Public Integrity Unit is (apparently or possibly) focused on possible alleged violation of the law by one or more members of the Austin Police Department in connection with their response to one or more of my dozens of crime complaints I have filed with APD ever since April 28, 2011, about my being a cited victim of personal-injury crimes inside my bolt-locked apartment unit. I politely emphasized to you in our phone conversation that the Austin police so far have not been willing to investigate this crime case in the last few years.

I also mentioned to you in our phone conversation today that partly because I have been a restaurant-industry employee in Austin on a continuous basis ever since April 27, 2002 (my birthday), and partly because I have been a regular customer inside your restaurant providing you with helpful and honest and accurate reports relating to the trash can in your restroom overflowing with trash and other factual reports, etc., over a multi-year period, I have been hopeful that you might be particularly interested in supporting my legal right and human right to myself sleep alone on my bed inside my bolt-locked private bedroom without anyone ever having any physical contact with me of any type during my sleep. I am a lifelong single gentleman, and I am also a longtime celibate-by-choice single adult gentleman who myself always sleeps alone on a bed that I own.

David, thank you again for your kind interest in seeing that my privacy rights are fully protected here in Austin. Please let me know if any portion of this follow-up letter strikes you as being anything but accurate and honest on my part.

I appreciate having received your recent E-mail note to me relating to the continuous-and-still-continuing felony-crimes case in which I am definitely the victim during my sleep on a daily and year-round and continuing basis inside a bolt-locked apartment unit that I rent at the Westdale-managed Wind River Crossing Apartments in Austin.

A recent E-mail note (below) to me that you kindly wrote and sent to me cited the identification number of 9655-13 in regard to the criminal-law case your Public Integrity Unit has been investigating.

I am referring to the criminal-law case for which one current total legal issue was directly cited to me on the telephone on Feb. 20, 2014, by Travis County Prosecuting Attorney Rob Drummond during an approximately 35-minute phone conversation I had with him from my home phone inside my apartment. It was a phone conversation, I might add, in which you also participated from time to time from a third phone line in the DA's Office in Austin.

As I anxiously await your Public Integrity Unit's follow-up letter to me about this case that you have kindly indicated to me I will eventually receive in the mail at my home mailing address at Wind River Crossing Apartments, I have one additional hopefully-polite follow-up question for you.

I need to mention that I am a former full-time newspaper reporter in Texas, and I had a very good accuracy record in my reporting for a variety of general-circulation newspapers in this state. Even today, I feel hopeful that I have a very good reputation among many of the news media professionals in Texas and elsewhere.

For that and other reasons, would you mind if I were to share the case number for this cited Public Integrity Unit case and a summary of what this case might potentially entail with a variety of news media organizations and individuals and government agencies that or who have expressed concern to me about my being a victim of crime in Austin?

In re-reading that letter of mine early this Friday morning, I find one glaring factual error:

(He) has also assured me that he will let me know immediately if he ever learns about any possible or suspected intruder or trespasser inside our bolt-locked rental apartment unit...

Officer Turner, I am asking you this question because I hereby allege that ... (additional information withheld).

This is a follow-up note to you after your unannounced 9:35 a.m. visit to my apartment unit on Tuesday, January 19, 2016 (correction here on the date cited in the original version of this letter) in which I invited you into the apartment in the hope you might collect crime evidence for APD during your visit about my being a victim of alleged continuous crimes. You were accompanied during your visit by a male officer, who stated that he is "Officer Burnett" (sp??) of APD's CIT Unit.

During your approximately 30-minute joint visit into my apartment unit, you stated to me, in response to a question from myself, that you have had previous CIT subjects who were actual victims of crime, and for whom you chose to turn over crime evidence on that to actual crime investigators for APD promptly after you concluded that those respective CIT subjects of yours were actual victims of crime in Austin.

Officer Turner, I appreciate your assuring me that if you yourself ever conclude at any time that I may be a victim of any alleged criminal activity of any type in Austin, you will promptly turn over that crime evidence to a certified crime investigator at APD.

Also during your January 19 visit to my apartment unit:

---You orally warned me that if I write to or call any APD officer or any APD official other than yourself or Sgt. Michael King, APD might charge me with alleged harassment of that APD officer or official.

---You stated to me that it IS acceptable to you for me to contact City of Austin employees or any other government officials who are not directly employed by the Austin Police Department, since you have not received any recent complaints about receiving unwanted E-mails or unwanted phone calls from me by any (official or employee of any) other City of Austin (department), you stated.

Also during your January 19, 2016, visit, Officer Turner, you stated to me that your and your Austin Police Department colleagues fully acknowledge and support my legal right to myself permanently exclude rejectee "Dr. Daniel Hitt" from my own life. The subject of Dr. Dan Hitt, whom I lawfully and permanently rejected in 1976, (and) about whom I have heard numerous (unwanted) anonymous rumors in Austin over a multi-decade period, arose at a moment during your visit inside my bedroom when I happened to spot in one of my boxes on the floor containing legal letters of mine, a signed October 26, 1999, "memo" written communication of mine to a state agency employer of mine at that time, the Texas Board of Pardons and Paroles.

That signed letter of mine politely informed that State Government of Texas agency in writing that I will file a lawsuit against any and all individuals allegedly subjecting me against my wishes to rumors violating my own privacy rights about rejectee Dan Hitt allegedly seeking to have an alleged current or future involvement in my own life.

Any involvement in my own life by rejectee Dr. Daniel Hitt is completely unacceptable to me, as I politely emphasized to (yourself,) Officer Turner(,) as (you) spoke with me (on January 19, 2016) inside my private bedroom.

The original version of that letter had been signed by Ms. Allen and mailed to me by herself in early 2012 at my Wind River Crossing Apartments mailing address.

Also included in the FAX I sent you this Monday was a copy of the July 18, 2014, postmark on the official envelope, along with the entire front contents of that envelope, that Melinda Griffith, a Patient Relations staff member at St. David's, addressed to me while mailing to me this month the unsigned computer-printout copy of that signed Jan. 23, 2012, letter to me from Ms. Allen.

That one-page unsigned copy of the 2012 letter to me from Ms. Allen was the ONLY item contained in the follow-up letter to me that Ms. Griffith mailed to me this month. She did not include any cover letter of her own inside that envelope.

Also included in the FAX I sent you this Monday was a handwritten July 21, 2014-dated FAX cover letter from myself that was addressed to both of you.

In that FAX cover letter, I politely emphasized in writing that Ms. Allen in her January 23, 2012, letter to me stated to me that the doctor-ordered DNA-swabs kit obtained from my body at my request during my late-night Dec. 21, 2011, visit to St. David's ER that extended into the early-morning hours of Dec. 22, 2011, I might myself add for clarification, WAS, IN FACT, PROMPTLY TRANSPORTED TO THE TEXAS DEPARTMENT OF PUBLIC SAFETY STATE AGENCY HEADQUARTERS IN AUSTIN FOR PLANNED LAB TESTING THERE.

Investigator Carter or Prosecuting Attorney Drummond, please let me know as soon as possible if you would like me to politely ask the Office of General Counsel for the Texas DPS to please share with each of you the entire contents of my public-information-request legal correspondence I pursued with that state agency in Austin in 2012 that specifically focused on handling of and any possible processing of the doctor-ordered Dec. 22, 2011, DNA-swabs forensic kit obtained from my own body that the DPS acknowledged having received from St. David's Medical Center in late December 2011.

(Note: At about 12:00 a.m. Thursday morning, April 3, 2014, crime victim John Kevin McMillan of northwest Austin officially filed a crime report with the Austin Police Department, APD Crime Report Number 140922183, about an incident that reportedly occurred at about 10:30 p.m. Wednesday, April 2, 2014.

That "No Calls, No E-mails" policy toward me by Chief Art Acevedo has prompted me to wonder I am the only current resident of Austin for whom a ban on direct communications from me of either type has been imposed by our city's police chief. I seek to learn through this public-information request which other Austin residents are also currently each being banned from ever directly contacting Chief Acevedo in any context or at any time during his tenure in office as Chief of Police for the City Government of Austin.

As you know, I myself do not have any criminal-conviction record. I am a dependably civil and law-abiding, gainfully-employed, always-sober (no drinking alcohol consumption, no illicit-drug consumption), single adult white non-Hispanic, lifelong-non-Christian gentleman in Austin.

Austin Police Department reportedly assigned that complaint from myself as Case # 090551846.

Included among the topics discussed during that February 24 meeting inside my private residence was a cited criminal-law file relating to myself, John Kevin McMillan, and cited evidence of others' possible or alleged criminal intent or harmful intent toward me. That criminal-law file relating to myself as a cited victim was formally established by the Travis County District Attorney's Office Strategic Prosecution Division in January of 2006. I mentioned all of this information to the three APD police officers during that meeting they had with me inside my residence on February 24. The contact person in regard to that cited "John McMillan File" at the DA's Office in Austin, Texas, is Ms. Norma Hilbig of the Strategic Prosecution Division, as I also mentioned to the three Austin police officers who met with me inside my residence during that February 24, 2009, visit by those representatives for the Austin Police Department.

I have resided at 11411 Research Boulevard, Apt. 325, Austin, Texas, 78759, ever since early 2002. ---Is there any evidence indicating that Austin Police Chief Acevedo exhibits any possible antipathy toward me that relates in any way to my own religious or political or philosophical or moral or personal beliefs?

---Is there any evidence indicating that Austin Police Chief Acevedo is aware that two other government agencies in Austin (the Travis County District Attorney's Office Strategic Prosecution Division and the Texas Workforce Commission state agency, respectively) in recent years have each classified reported conduct by others citedly victimizing myself in Austin, Texas, as being or as having been an apparent "criminal-law" matter, in the stated view of that government agency.

---What prompted APD representative Stephanie Hernandez, an individual whom I had never met before or spoken with before on any prior occasion that I can recall in my entire life, to herself on April 28, 2009, leave an unsolicited phone message on my personal voice mail for my home phone line in northwest Austin?

---What prompted APD representative Stephanie Hernandez to advise me on the telephone between 3:40 p.m. and 3:50 p.m. April 28, 2009, that I myself should report to a "Human Resources" officer for my private-sector employer any and all anonymous-communications verbalized death threats to which I myself am ever subjected against my wishes at my workplace in Austin, she stated to me in that phone conversation, according to legal notes I jotted down during that conversation.

---What might explain the emphatic recent request of me on the telephone in late April 2009 by Stephanie Hernandez, herself reportedly an executive assistant to Austin Police Chief Acevedo, that I myself should never again send Austin Police Chief Acevedo a carbon-copy of any future Open Records request of mine to any government-owned institution or public agency, regardless of whether that public-information request from myself referred to a cited "criminal-law" matter, Ms. Hernandez also indicated to myself.

---Why is it that Austin Police Chief Acevedo is the only police chief in the entire world who at any time during my entire life thus far, has himself prohibited me from sending that police chief any more E-mail correspondence of any type?

---Is Austin Police Chief Art Acevedo aware that the Austin-based Director of the Texas Department of Public Safety, Colonel Thomas Davis, and the Federal Bureau of Investigation federal agency in Washington, D.C., and the police department for The University of Texas at Austin, each continue to accept E-mail letters of complaint from myself relating to possible criminal-law conduct occurring or evidenced in Austin, Texas.

---Is Austin Police Chief Acevedo or any other official of the Austin Police Department aware that I myself have been victimized by injurious noise pollution in Austin, Texas, that I did not generate and that I myself never requested or authorized at any time.

---Is Austin Police Chief Acevedo aware that I have repeatedly complained to the Austin Police Department in recent years about noise pollution injurious to myself in Austin, Texas?

--Why did Stephanie Hernandez on behalf of the Austin Police Department state to me during our phone conversation between 3:40 p.m. and 3:50 p.m. April 28, 2009, that I myself cannot file any criminal-law complaint with APD relating to citedly "illegal" noise pollution victimizing myself, John Kevin McMillan, in Austin, Texas, unless I can myself first identify to the Austin Police Department a suspected source of that illegal noise pollution, she also stated to me in that phone conversation.

----Is there any legal evidence indicating that any official of the Austin Police Department fails to fully acknowledge that I am permanently alcohol-free (ever since 1990, in fact) and never-previously-addicted, I am lifelong-tobacco-free, I am permanently illicit-drug-free (ever since 1984, in fact) and never-previously-addicted, that I myself am permanently tattoo-less on a lifelong basis, that I myself am emphatically non-sadomasochistic (I don't beat or whip, for instance, and I don't permit any other person to beat or whip myself), that I myself never wear any jewelry of any type (other than my watch), that I myself am recently-certified-HIV-negative, that I myself am fully ambulatory, that I myself am facially cleanshaven (no facial hair), that I myself am masculine and platonically polite and gentlemanly in my personal and professional style?

---Does the Austin Police Department fail to fully acknowledge that I myself am a morally and aesthetically straight single adult gentleman, and that my greater emotional and aesthetic and overall personal identification with, and own personal and moral and emotional and intellectual and cultural affinity for, and my own greater personal receptiveness as a human being toward, a higher percentage of all masculine and cleancut heterosexual adult men (as distinct from other cited subpopulations of adult male persons), is a law-abiding affinity and accompanying law-abiding conduct on my own part that is legally protected and Constitutionally protected by the U.S. Bill of Rights.
