Please let me know at your earliest convenience if any of you would like to receive a copy of the official APD (Austin Police Department) report I have in my possession in which Detective Rae Ann Egan of APD's Sex Crimes Unit (in Austin, Texas) refers in writing on June 3, 2015, to an official APD "Do Not Approve" list being used as a basis for automatic APD refusal at any time and under any circumstances to ever authorize any rape-evidence forensic exam for any of the self-identified-rape-victim complainants (I myself among them) on that list who might ever in the present or at any future time request a Sexual Assault Forensic Exam on their own body.

I maintain that the cited APD list allegedly violates the Constitutional and legal rights of numerous rape, myself among them, and also comprises alleged possible obstruction of justice by one or more members of the Austin Police Department and the City Government of Austin.

criminal-law complainant John Kevin McMillan, who myself in the last four and one-half-year period ever since 12:01 a.m. April 17, 2011, has myself experienced only two total multi-hour occasions involving a multi-hour sleeping experience for me as I lay alone on my own bed, in which I actually enjoyed a full and uninterrupted multi-hour period of revitalizing and restful slumber, and in which I woke up at my planned time for getting out of bed feeling refreshed and very relieved to immediately note that I had NOT been anally raped or physically abused or medically injured during my sleep on that occasion.

Those two exceptions to the rule were: the early morning hours of Saturday, September 3, 2011, and the early morning hours of Saturday, September 10, 2011. Each of those mornings were workdays for me later that morning, beginning at 11 a.m., at a corporate-owned (cafeteria) restaurant workplace of mine in Williamson County, Texas. The widely-respected for-profit corporation owning that restaurant is headquartered in Houston, Texas.

My work supervisor on duty on those two total Saturdays, Mr. Jerry Moore, was a self-identified "former crime investigator for the Harris County Sheriff's Office", he told me more than once during a workshift of mine inside that family-friendly restaurant.

Mr. Moore also told me in 2011 that he and his wife and family reside together in a Williamson County community---either Cedar Park or Round Rock, Texas, I recall Mr. Moore as having stated to me from the general manager's office of that cafeteria restaurant workplace for me.

I myself currently reside in Travis County, Texas. I have resided in Williamson County on two separate occasions, each of them for a brief multi-week period. I do not believe that I ever was myself classified as a permanent resident of Williamson County.

"I (APD Detective Rae Ann Egan) did some research and I did find out that this particular person (John Kevin McMillan of Austin, Texas) is on the 'Do Not Approve' List for SAFEs (Sexual Assault Forensic Exams)," Detective Egan wrote in that June 3, 2015, official APD supplementary report by that APD Sex Crimes Unit officer.

Detective Egan's report concludes with the highlighted phrase, "SAFE NOT APPROVED".

That report by APD Detective Egan was among 19 pages of legal documents that were mailed to me this month by the Austin Police Department in response to a (December 3, 2015-dated E-mail) public-information request from myself that APD designated as Open Records Request Number 12-23337.

"I (APD Detective Rae Ann Egan) did some research and I did find out that this particular person (John Kevin McMillan of Austin, Texas) is on the 'Do Not Approve' List for SAFEs (Sexual Assault Forensic Exams)," Detective Egan wrote in that June 3, 2015, official APD supplementary report by that APD Sex Crimes Unit officer.

Detective Egan's report concludes with the highlighted phrase, "SAFE NOT APPROVED".

That report by APD Detective Egan was among 19 pages of legal documents that were mailed to me (on the 10th of) this month by the Austin Police Department in response to a (December 3, 2015, E-mail) public-information request from myself that APD designated as Open Records Request Number 12-23337.

The following are exactly quoted portions, with some clarifications added in parentheses, of an official Austin Police Department report that was filed on June 3, 2015, by APD Detective Rae Ann Egan of APD's Sex Crimes Unit in Austin, Texas, in regard to APD Sex Crimes Case 15-1540423. It is a crime case currently classified as "suspended" for which I myself, John Kevin McMillan of Austin, as the cited victim and complainant filed a preliminary crime report with APD on the morning of June 3, 2015.

In response to a phone call inquiry from myself, a polite 311 male staff member for the City Government of Austin stated at about 9:15 p.m. on December 14, 2015, that APD Detective Rae Ann Egan is reportedly currently stationed with APD's "Homicide 1" Unit, he said. One online account available on the Internet indicates that Detective Egan apparently transferred from APD's Sex Crimes Unit to a Homicide Unit for APD in late 2015.

A copy of the following official APD police report was among 19 pages of legal documents that APD mailed to myself, John Kevin McMillan of Austin, on December 10, 2015. Those legal documents were in response to my December 3, 2015, E-mail public-information request to APD at APD's public-information coordinator's official E-mail address of management.records@austintexas.gov.

The APD-designated identification number for that public-information request from myself was: APD Open Records Request Number 12-23337.

I have repeatedly and over a multi-year period informed City of Austin officials, including officials of the Austin Police Department, that throughout any and all of my own conscious or waking hours ever since and including the day I moved to northwest Austin as an official apartment tenant at Wind River Crossing Apartments in August 2001, I myself have been completely celibate, with ZERO sexual contact or intimate physical contact between myself and any other human being (or any animal or beast, for that matter), anywhere and everywhere in the entire world where I have ever resided or been situated or traveled to or visited at any time.

I have also repeatedly over a multi-year period informed City of Austin officials, including APD representatives, that in the entire four-and-one-half-year period ever since the early morning hours of April 17, 2011, in particular, I have experienced only two total early-morning periods and morning periods in which I enjoyed a full and uninterrupted and revitalizing night's sleep as I lay alone on my own bed inside my bedroom of my bolt-locked apartment unit. On each of those two total mornings in September 2011 in which I was awakened by my alarm clock at 9 a.m., I immediately sensed with great relief that I had NOT been physically abused or injured or harmed or anally raped by any alleged intruder at any time that morning when I was asleep and unconscious. Those were the only two mornings fitting that description from the entire multi-year period that began in the early morning hours of April 17, 2011.

Those two total un-raped and un-injured early-morning periods occurred on Saturday, September 3, 2011, and Saturday, September 10, 2011, each of which were workdays for me later that day that began at 11 a.m. on each of those mornings inside a corporate-owned restaurant workplace of mine in Williamson County, Texas, within the city limits of Austin. My polite work supervisor inside my restaurant workplace on each of those two total respective mornings, Mr. Jerry Moore, was a self-identified resident of either Cedar Park or Round Rock (one of the two) in Williamson County, Texas, he said, who was also himself a self-identified married gentleman and a member of the "Roman Catholic Church" along with his wife and their family, and who was also himself a self-identified "former crime investigator for the Harris County Sheriff's Office" in Houston, Texas.

Mr. Jerry Moore politely volunteered to me in 2011 or 2012 at the start of one of my workshifts inside that same corporate-owned restaurant that "Based on my own (Mr. Moore's) prior experience as a crime investigator for the Harris County Sheriff's Office, I (Jerry Moore) knew of sex-crime and personal-injury-crime home-invasion cases in the Houston area in which the victim was kept unconscious throughout the sex crime and personal-injury crime by an intruder using (medical technology)." (approximate quote).

I have repeatedly informed City of Austin officials and Austin Police officers in recent years that numerous Austin-area residents have stated to me over a multi-year period that they do not like or are significantly offended by the new and fully independent non-Christian, non-Judaistic, non-atheistic, non-Moslem, non-Unitarian, non-MCC, non-Quaker religion I have established: the Progressive Prohibitionist Religion.

I have also repeatedly informed government officials and APD officers in recent years that many Central Texans and other Americans apparently dislike or resent or are angered by the simple fact that 99.9 percent or more of the individuals most appropriate as new members of, and who might conceivably qualify as prospective new members of, my own fully independent new religion are, in fact, heterosexual (as distinct from homosexual, gay, bisexual, lesbian, transsexual, transvestite, etc.) in sexual identity per se.

I am the founder and only approved official member of the Progressive Prohibitionist Religion, an implicitly deistic non-praying religion with strict membership-eligibility requirements.

I noticed this Sunday morning (today, December 6, 2015) when I Googled my full legal name with quotation marks around it that the very first page or list of citations from that included a frequently-visited online website that is currently asking the entire world to comment publicly on whether I myself might somehow be an alleged "serial killer."

I reported that online item to APD several months ago, and I received a reply E-mail note from an APD detective which stated that the cited item did not at that time reach the level of actual "harassment" of myself, he stated. I would like to respectfully raise the question at this time of whether the point of (possible) alleged harassment of me by that alleged group of individuals----whose online photos indicate that several of them are possibly of Asian Indian or Pakistani ancestry----has, in fact, been (allegedly) reached at this time.

If so, as I indicated to APD several months ago about that very same group, I insist on myself filing (criminal-law) harassment charges, at the very least, against all (applicable) members of the cited group.

Thank you again for your very thorough crime investigation of APD Sex Crimes Case 15-1540423, in which I am the victim and complainant. I hope this follow-up report is helpful to you in your investigation.

(EDITOR'S NOTE: The following is the exact verbatim text of a signed 2001 legal reply letter to myself, John Kevin McMillan of Austin, from the Office of General Counsel of the Texas Department of Public Safety state agency headquarters complex in north Austin.

I was employed for 12 consecutive months, from the fall of 1997 through the fall of 1998, as a full-time clerical employee of the Texas Department of Public Safety state headquarters Motor Carrier Bureau along Guadalupe Street in Austin. I was never fired from my position of employment with that state agency, and I did in fact resign from my position there in late 1998. I left the DPS a matter of weeks after Major Burroughs of the DPS Motor Carrier Bureau staff advised me during a discreet one-to-one meeting he requested of me inside his DPS office in 1998 to myself apply to work instead as a legal secretary for the Attorney General of Texas, Major Burroughs stated to me on his own initiative. Major Burroughs added during our one-to-one 1998 meeting inside his state agency office that he felt sure that I would be a better match for the Attorney General of Texas state agency as an employee than for the DPS. When I then applied for a legal secretary position at the Attorney General of Texas in downtown Austin, I was surprised and disappointed to learn that my application was rejected by that state agency. --jkm)

Here is information related to sexual harassment for your review. The Fair Housing Act (42 U.S.C. 3601-3619) protects individuals against discrimination because of sex. Courts recognize two types of sexual harassment: (1) quid pro quo sexual harassment (i.e., when a housing provider, or his or her employee, agent or contractor conditions access to or retention of housing or housing –related services or transactions on a victim’s submission to sexual conduct); and (2) hostile environment sexual harassment (i.e., when a housing provider or his or her employee, agent or contractor, or in certain circumstances another tenant, engages in sexual behavior of such severity or pervasiveness that it alters the terms or conditions of tenancy and results in an environment that is intimidating, hostile, offensive ,or otherwise significantly less desirable.

So far, the Attorney General of Texas has not expressed any concern to me in writing about the significant permanent and irreversible medical damage to my hearing capacity resulting from that continuous background noise pollution over a multi-decade period in Austin, Texas, including at each and every one of my workplaces in Austin and Cedar Park during that period, that I myself DID NOT and DO NOT generate or request or authorize or want in my own life. I lead a very quiet life in Austin , and I NEVER attend rock-music or punk-rock music concerts, for instance. In fact, I only rarely listen to music of any type during my leisuretime.

No state agency or State of Texas-owned institution, and no other government-owned or government-affiliated institution or organization of any type, has ever acknowledged to me at any time that it had any role of any type in sponsoring or permitting or authorizing or causing or inflicting or perpetrating the injurious noise pollution in Austin that has been very harmful to myself and my medical health over a multi-decade period.

However, I remain very hopeful that the Consumer Protection Division or Victim Services Division of the Office of the Attorney General of Texas state agency in Austin, Texas, will in the near future send me a reply letter providing me with helpful factual information and expressing an interest in this legal-liability matter facing the State Government of Texas, the City Government of Austin, Travis County Government, Williamson County Government, the City Government of Cedar Park, and the U.S. Government as well.

I continue to have a great need for a private attorney to file a lawsuit on my behalf relating to my being victimized ever since April 28, 2011, for instance, on a daily and year-round basis (with the only apparent exceptions having been the early-morning and morning hours of September 3, 2011, and Sept. 10, 2011) by one or more illegal intruders inside my bolt-locked apartment unit. However, so far the Austin Police Department has done nothing to stop the alleged violations of my own privacy rights occurring every day inside my bolt-locked apartment unit in which I am the only approved tenant and only approved occupant, even though I have filed several complaints with APD.

Mr. Barish, I realize that you don't handle sex-crime cases in which your client is the cited victim of injurious conduct of that type, from what you indicated in your phone message to me last year.

I am writing you today to politely ask you if you know of ANY private-attorney member of the Temple Beth Israel congregation, or any other attorney whom you would recommend, who might be willing to file a personal-injury complaint or sex-crime victim complaint on my behalf on a contingency-fee basis or pro-bono basis that relates to these alleged sex crimes victimizing myself during my sleep?

I am a very strong complainant, since I live alone (ever since late May 2011), I ALWAYS sleep alone on my bed, and I NEVER have any invited overnight guest or any invited guest inside my apartment unit between midnight and 8 a.m., for instance. This is a Texas Open Records request in which I seek to obtain from any office or department of the City Government of Austin, including your Human Resources department, a copy of one legal document for the applicable Austin Police Department APD) officer that simply states the legal name or first and last name or E-mail address of the one total Austin Police Department officer who himself or herself directly consulted or directly communicated with or directly contacted the City Attorney's Office or the City of Austin Law Department here in Austin, Texas, in a context referring in any manner to myself, John Kevin McMillan of Austin, on more total occasions during the most recent approximately four-year period from April 1, 2011, through the present, than did any of the numerous other APD officers who reportedly consulted the City Attorney's Office about me during that same approximately four-year period.

My legal name is John Kevin McMillan. I was born on April 27, 1957, at Lincoln, Nebraska. I am a lifelong single gentleman. I am gainfully employed, permanently alcohol-free (ever since 1990) and permanently marijuana-free and illicit-drug-free (ever since 1984), and dependably civil and law-abiding and vigilant. I do not have any criminal-conviction record.

I am a former full-time employee here in Austin for the Texas Department of Public Safety, the Texas Department of Criminal Justice, and the Texas Board of Pardons and Paroles, respectively.

I have resided as a rent-paying official tenant in Apartment 325 of Building 3 at Wind River Crossing Apartments, 11411 Research Boulevard in northwest Austin, ever since January 2002.
