Subject: 5-16-20 need stronger state penal code re: criminal conduct by HIV-positive persons May 16, 2020 Dear Rep. Cole, As a law-abiding constituent of yours residing in your legislative district, I need to find out from you whether you are willing to author a new bill in the Texas Legislature that will revise the state penal code of Texas in regard to conduct by persons who have tested positive for the HIV-virus and are aware that they tested positive. Specifically, I am very hopeful you will be willing to ask the Texas House to specifically cite as illegal very specific violations of the state penal code by HIV-positive persons in cited contexts, and to provide accompanying very specific criminal-law penalties. I am referring to proposed violations of the state penal code specifically by self-identified HIV-positive persons in Texas who failed to disclose their HIV-positive status to a sex partner or intravenously-administered illicit-drug partner, or to the appropriate blood-bank staff member, if applicable, shortly before or during sex, acts of prostitution, or needle exchanges, or in the context of the HIV-positive person donating organs, blood, or semen. At present, as you must be very painfully aware, the state penal code of Texas does not include any HIV-specific laws that specifically and in clear and unambiguous language cite the specific criminal-law penalties for violating those laws. Cole, thank you for taking the time to review this public-policy-change request from me that should make it easier for prosecuting attorneys throughout our entire state, including Central Texas District Attorneys Margaret Moore and Shawn Dick, to successfully press criminal charges in a court of law against any and all HIV-positive persons in Texas who failed to directly disclose their HIV-positive status in any of the above-cited unconscionable contexts. One hoped-for long-term benefit to our entire state from a strengthening of our state penal code in these specific ways should be a significant increase in the percentage of all of the HIV-positive persons who choose to maintain a permanently celibate lifestyle in which they do not put any HIV-negative person at risk of being infected by their own often-fatal HIV virus. Upholding the human rights and legal rights of nobly law-abiding and conscientious members of the HIV-negative community throughout our entire state will truly be a great human rights victory for all Texans.
