Subject: Response to Request for Information - McMillan, J. (TCDA) [IWOV-CivilDB.FID467331]

Please note, below, that the Travis County District Attorney's Office in Austin, Texas, is currently seeking permission from the Attorney General of Texas to withhold from myself, public-information requestor John Kevin McMillan of Austin District 4, copies of recent e-mail correspondence between the local DA's Office Sex Crimes Unit and the Austin Police Department Sex Crimes Unit that each directly refer to myself by name.

The following is the exactly-quoted transcript of an attachment and an accompanying e-mail letter to me (next two documents, below) that I received today from the Travis County Attorney's Office in response to my October 5, 2019, e-mail public-information request (last item, below) to the Travis County District Attorney's Office.

Please note that I added two parenthetical clarifications of my own: the word "footnote" was added by me in two different sections of the following letter that was sent to me as an attachment..

In my Oct. 5, 2019, PIR I had sought a copy of  "any and all e-mail communications between the Travis County DA's Office Sex Crimes Unit and the Austin Police Department Sex Crimes Unit at any time since 8 a.m. January 3, 2017, that, in each and every such case, refer at least once in any manner to myself, John Kevin McMillan of Austin, Texas."

Subject: 10-5-19 PIR re: TCDA Sex Crimes Unit, APD Sex Crimes Unit, and me

To: Open Records Coordinator,

Travis County District Attorney's Office,

Open Records Division,

P.O. Box 1748,

Austin, TX 78767

October 5, 2019

Dear Open Records Coordinator,

This is a Texas Open Records request in which I seek to obtain from you a copy of any and all e-mail communications between the Travis County DA's Office Sex Crimes Unit and the Austin Police Department Sex Crimes Unit at any time since 8 a.m. January 3, 2017, that, in each and every such case, refer at least once in any manner to myself, John Kevin McMillan of Austin, Texas.

My legal name is John Kevin McMillan. My date of birth is April 27, 1957. I am a native of Lincoln, Nebraska.

I have most recently resided here in Austin, Texas, on a continuous and uninterrupted basis ever since mid-March 1997.

From October 1997 to October 1998, I worked full-time here in Austin for the Texas Department of Public Safety. My commanding officer in the Motor Carrier Bureau, Major Burroughs (sp?), advised me during a one-to-one meeting inside his office in 1998 that he had requested of me, to myself apply to work instead for the Attorney General of Texas state agency. Major Burroughs stated to me during that meeting that he believed I would be a better match for the Attorney General of Texas state agency than for the DPS. I did apply for employment with the Attorney General, but never received an employment offer from that state agency here in Austin. I was never fired from my job with the DPS. I left that position after I submitted my resignation there.

I myself do not have any criminal-conviction record.

Among the insights I hope to glean from this public-information request are:

---Has there been any dialogue between the APD Sex Crimes Unit and the Travis County DA's Office Sex Crimes Unit in regard to whether I have been and continue to be a victim of alleged continuous, daily-and-year-round sex crimes and other personal-injury-crimes allegedly being perpetrated on me during my sleeping hours on a nightly basis as I lie or lay alone, asleep and unconscious, on my own bed inside my bolt-locked rental apartment unit in Austin?

---Has there been any dialogue between the APD Sex Crimes Unit and the Travis County DA's Office in regard to which unauthorized "medical-services provider" has allegedly been illegally subjecting me against my wishes to nasal inhalants and oral inhalants and liquids during my sleeping hours as I lie alone on my own bed inside my bolt-locked apartment in Austin?

---Has there been any dialogue between the APD Sex Crimes Unit and the Travis County DA's Office in regard to whether the alleged nasal inhalants to which I have been subjected against my wishes during my sleeping hours inside my bolt-locked apartment unit have allegedly played a role in myself being held unconscious while being subjected to alleged sex crimes and alleged personal-injury crimes  during my bedtime hours inside my bolt-locked apartment unit?

---Has there been any dialogue between the APD Sex Crimes Unit and the Travis County DA's Office Sex Crimes Unit in regard to what the time-deadline-related requirements and other legal requirements are, if any, for investigating and prosecuting a rape case that has been determined to be a continuous-and-still-continuing sexual-assault case?

---Has there been any dialogue between the APD Sex Crimes Unit and the Travis County District Attorney's Unit in regard to what prompted the Federal Bureau of Investigation of the United States Government to provide me with an "intake" interview on the telephone with a female FBI staff member on Monday, September 23,  2019, in regard to APD Case 16-1340923, with that telephone interview having concluded politely at 10:30 a.m. September 23?

---Has there been any other dialogue between the APD Sex Crimes Unit and the Travis County DA's Office Sex Crimes Unit in regard to the currently-active APD Sex Crimes Case 16-1340923 in which I am the cited victim and complainant?

---Has there been any dialogue between the APD Sex Crimes Unit and the Travis County DA's Office Sex Crimes Unit in regard to whether at least one additional DNA-trace forensic rape-evidence medical exam on myself should or could be ordered by APD in the very near future?

---Has there been any dialogue between the APD Sex Crimes Unit and the Travis County DA's Office Sex Crimes Unit in regard to whether there is a need for full 180-day or 190-day retroactive DNA-trace processing on each of the two total existing DNA-trace rape-evidence kits that were obtained from me by APD on April 28, 2011, and December 22, 2011, respectively, for APD Cases 11-1180447 and 11-3550615?

---Has there been any dialogue between the APD Sex Crimes Unit and the Travis County DA's Office Sex Crimes Unit in regard to whether it would be legal and justifiable for either the City of Austin or Travis County Government or the Federal Bureau of Investigation or a State of Texas agency to provide temporary 24-hour-a-day, seven-days-per-week electronic surveillance of the entire interior of my current apartment unit --- an efficiency rental unit in which I myself am the ONLY current official tenant and the ONLY current official occupant?

---Has there been any dialogue between the APD Sex Crimes Unit and the Travis County DA's Office Sex Crimes Unit in regard to what the possible point or points of illegal entry by a law-breaking trespasser into my current bolt-locked and fully-secured rental apartment unit might be or is or are at present, and whether there is some way to use technology available to either APD or the District Attorney's Office here in Austin to clearly identify the alleged points of entry being used by alleged trespassers allegedly breaking into my own current always-bolt-locked rental unit?

---Is there any evidence that any person currently employed in the APD Sex Crimes Unit or the Travis County DA's Office Sex Crimes Unit has indicated or stated that he or she does not believe my own repeated factual statements to APD and to the DA's office over a multi-year period about my being a longtime celibate, permanently-drinking-alcohol-free, permanently illicit-drug-free, law-abiding and honest single adult gentleman who ALWAYS sleeps alone on my own bed inside my bolt-locked apartment unit in Austin?

---Is there any evidence that any person currently employed by the APD Sex Crimes Unit or the Travis County DA's Office Sex Crimes Unit has indicated or stated that he or she senses or has concluded that my own credibility as a criminal-law complainant and self-identified crime victim here in Austin has somehow been undermined or harmed?

Thank you in advance for your very diligent and helpful reply letter providing me with any and all responsive legal documents.

Sincerely and Best Wishes,

To: Open Records Coordinator,

Texas Department of Criminal Justice (TDCJ) state agency,
TDCJ Headquarters Offices,

Suite 600,
Huntsville, TX 77340

Dear Open Records Coordinator for the TDCJ,

This is a public-information request in which I seek to obtain from you a copy of any and all e-mail communications, reports, memoranda, or other written communications that were written or received or forwarded or FAXed or mailed at any time since April 1, 2011, by any staff member or attorney or administrator in your state-agency's Office of General Counsel in Huntsville, and that, in each and every such case, referred at least once in any manner to myself, John Kevin McMillan of Austin, Texas.

Excluded from the scope of this public-information requests are any and all e-mails that were directly sent by myself to your Office of General Counsel in Huntsville.

My legal name is "John Kevin McMillan". My date of birth: April 27,1957. I was born in Lincoln, Nebraska. I am a single adult white Anglo-Saxon non-Hispanic gentleman of English, Scottish, and German ancestry.

Earlier this century, one Huntsville-based attorney for your state agency, Jim Frazier, volunteered to me on the telephone during a long-distance phone call I made to his public law office from my rental-apartment unit at that time, Apt. 325 in Building 3 at Wind River Crossing Apartments in northwest Austin, that "the people of Austin have not been friendly toward you, John. I (TDCJ attorney Jim Frazier) recommend that you move to Huntsville, Texas, and purchase a home for yourself here" (approximate quote).

The same first-rate attorney for your state agency wrote and sent me the following e-mail reply letter on December 7, 2007:

Dear Mr. McMillan:

You said below, "in the hope that your State of Texas employer will take an

interest in this matter." What exactly do you want TDCJ to do?

Thanks.

Dear TDCJ Attorney Frazier at the Texas Department of Criminal Justice
state headquarters in Huntsville,

I have decided to share the following legal correspondence of mine relating

to criminal-law matters evidenced in Austin, Texas, in the hope that your

State of Texas employer will take an interest in this matter.

Incidentally, please note one typographical error in which I incorrectly

stated that Ms. Norma Hilbig established a criminal-law prosecution file on

my behalf in January of 2007. The actual date when she established that

file on my behalf was January of 2006.

Sincerely and Best Wishes from a former full-time TDCJ employee in Austin,

John Kevin McMillan of Austin, Texas.

Phone: (512) 342-2295.....

I myself do not have any criminal-conviction record, as I am sure your state agency's Office of General Counsel is very aware.

I lead a permanently drinking-alcohol-free (ever since 1990), permanently marijuana-free (ever since 1984), lifelong-illicit-drug-free in regard to any and all illicit drugs other than marijuana, lifelong-tobacco-free, lifelong-non-vaping, dependably civil and law-abiding, facially-cleanshaven (no beard, no mustache, no goatee), lifelong-tattoo-less, non-sadomasochistic and anti-S&M, clean-talking (no profanity by me in my everyday conversations with others), platonicly polite, longtime-celibate (including ever since the day I moved to north Austin in August 2001), dependably civil and law-abiding and vigilant and pro-law-enforcement lifestyle.

I strongly oppose "thought-control projects" and I take pride in being privacy-respectful. I myself DO NOT generate any anonymous communications that are inflicted on anyone else in a context that violates or impinges on their own privacy rights. I oppose verbal harassment of or by anyone.

I am a former full-time employee in Austin for the Texas Department of Public Safety state law-enforcement agency, the TDCJ, and the Texas Board of Pardons and Paroles state agency, respectively.

I have been and continue to be gainfully employed as a non-managerial staff member at one or more restaurant workplaces in the Austin area of Texas on a continuous and uninterrupted basis ever since April 27, 2002.

I am a very recent criminal-law complainant in APD Alleged Home-Invasion-Crimes and Alleged Sex Crimes Case 21-0830533----an APD crime case that was activated by APD on March 24, 2021. No DNA-swabs forensic anal-rape-evidence medical exam on me has been authorized by APD's Sex Crimes Unit or the Austin Safe Alliance so far this year. However, I remain very hopeful that the infrared motion-sensitive photographic documentation of alleged trespassers inside the bedroom of my bolt-locked current rental-apartment unit during my sleeping hours that I have been providing to the APD Sex Crimes Unit over a multi-month period this year (and in other recent years as well) will help to convince that APD unit of my urgent need for a forensic DNA-swabs anal-rape-evidence medical exam on me as soon as possible.

My primary personal e-mail address, "mcmillanj@att.net", has remained the same throughout the 10-and-one-half-year period applicable to this public-information request. My landline phone number, (512) 342-2295, has remained the same throughout the entire 10-and-one-half-year period applicable to this public-information request. My cell phone number of (512) 993-7305 has been the same ever since the summer of 2019, when I became a cell phone owner and cell phone user for the first time ever.

I have resided at the following respective home addresses during the 10-and-one-half-year period applicable to this public-information request:
---Wind River Crossing Apartments, 11411 Research Boulevard, Apt. 325, Austin, TX 78759.
---Crossland Economy Studios, Extended Stay America, 12621 Hymeadow Road, Apt. 133, Austin, TX 78729.
---Village Oaks Apartments, 10926 Jollyville Road, Bldg. 9, Apt. 902, Austin, TX 78759.
---Village Oaks Apartments, 10926 Jollyville Road, Bldg. 16, Apt. 1609, Austin, TX 78759.
---Austin Motor Inn, 11400 North IH 35 (a hotel room I rented for one week in June 2019 until I had official prior permission from the Pebble Creek Apartments management team to move into my new rental-apartment unit at the cited date and time of noon on June 21, 2019), Austin, TX 78753;

and, ever since June 21, 2019, Pebble Creek Apartments, 8805 North Plaza Drive, Building 17, Apt. 2418, Austin, TX 78753.

Ever since and including the day I moved into my current efficiency-apartment unit at Pebble Creek Apartments on June 21, 2019, I have been and continue to be the ONLY official tenant and ONLY approved occupant in my double-bolt-locked rental-apartment unit at Pebble Creek Apartments.

In the entire multi-year period ever since I moved into my current efficiency unit, with only two categories of exceptions I have never at any time ever once permitted anyone to enter or be physically present inside my current double-bolt-locked apartment on any occasion during the time period from 8 p.m. in the evening until 8 a.m. in the morning. The only exceptions to that have been on-duty Austin Police Departments officers whom I have opened the front door to at nighttime on numerous separate occasions over the multi-year period ever since June 21, 2019, and, on one total occasion during that entire approximately two-year period, on-duty Austin-Travis County Emergency Medical Services staff members who entered my unit with my permission after I opened the front door for them.

I hope to hear from you soon.

Sincerely and Best Wishes,

public-information requestor John Kevin McMillan.
